Subject: Items c<strong>on</strong>cerning Toys R’ Us and Babies R’ Us<br />
the existing enclosures locked at night, this is not a requirement <strong>of</strong> the PID<br />
Agreement.<br />
2. Trucks/trailers l<strong>on</strong>ger than 50 feet are not allowed.<br />
<strong>City</strong> Resp<strong>on</strong>se: Development approvals <str<strong>on</strong>g>for</str<strong>on</strong>g> Ridgedale Festival included the<br />
following c<strong>on</strong>diti<strong>on</strong> related to the size <strong>of</strong> trucks/trailers:<br />
“…The service drive is to be posted to not allow tractor/trailers l<strong>on</strong>ger than 50<br />
feet and direct all l<strong>on</strong>ger vehicle to fr<strong>on</strong>t delivery <strong>on</strong>ly… Covenants shall also be<br />
placed <strong>on</strong> the property and in lease agreements to preclude tenants or owners<br />
from utilizing tractor/trailers l<strong>on</strong>ger than 50 feet.”<br />
<strong>City</strong> Acti<strong>on</strong>: The current proposal addresses this issue.<br />
3. The gate to rear <strong>of</strong> the building is always left open and should be locked.<br />
<strong>City</strong> Resp<strong>on</strong>se: The c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> approval state, “…If evidence that<br />
delivery/service hours are not observed more than three times in a calendar year,<br />
the <strong>City</strong> retains the right to require a lockable barrier to be used at the above<br />
noted hours [7:00 a.m. to 10:00 p.m. M<strong>on</strong>day through Saturday].<br />
<strong>City</strong> Acti<strong>on</strong>: <str<strong>on</strong>g>Staff</str<strong>on</strong>g> is unaware <strong>of</strong> other commercial centers, including those<br />
adjacent to residential areas, which have gated delivery/loading dock area.<br />
The property owner recently installed a locking system <str<strong>on</strong>g>for</str<strong>on</strong>g> the gate but it<br />
does not appear to be operable. <str<strong>on</strong>g>Staff</str<strong>on</strong>g> will c<strong>on</strong>tinue to work with property<br />
management to ensure it functi<strong>on</strong>s properly or another soluti<strong>on</strong> is<br />
implemented.<br />
4. The p<strong>on</strong>ding area behind the building should remain dry.<br />
<strong>City</strong> Resp<strong>on</strong>se: The p<strong>on</strong>ding area is a wetland. It also serves as a stormwater<br />
management facility <str<strong>on</strong>g>for</str<strong>on</strong>g> the area. <str<strong>on</strong>g>Staff</str<strong>on</strong>g> visited the site earlier this spring and<br />
inspected the storm water storage area prior to the neighborhood <str<strong>on</strong>g>meeting</str<strong>on</strong>g> <str<strong>on</strong>g>for</str<strong>on</strong>g> this<br />
project. The c<strong>on</strong>diti<strong>on</strong> <strong>of</strong> the outlet to Lake Ashley was inspected and no<br />
evidence <strong>of</strong> clogging or malfuncti<strong>on</strong> was found.<br />
<strong>City</strong> Acti<strong>on</strong>: No acti<strong>on</strong> needed<br />
5. No parking signs al<strong>on</strong>g Horn Drive previously installed were removed after<br />
the street rec<strong>on</strong>structi<strong>on</strong> project.<br />
<strong>City</strong> Resp<strong>on</strong>se: Public works will be installing additi<strong>on</strong>al no parking signs al<strong>on</strong>g<br />
Horn Drive and Wayzata Blvd.<br />
