Introducti<strong>on</strong><br />

1 The lawyer’s role, whe<strong>the</strong>r retained by an<br />

individual, a corporati<strong>on</strong> or <strong>the</strong> state, is as <strong>the</strong><br />

client’s trusted adviser and representative,<br />

as a professi<strong>on</strong>al respected by third parties,<br />

and as an indispensable participant in <strong>the</strong> fair<br />

administrati<strong>on</strong> of justice. By embodying all<br />

<strong>the</strong>se elements, <strong>the</strong> lawyer, who faithfully serves<br />

a client’s interests and protects <strong>the</strong> client’s rights,<br />

also fulfils <strong>the</strong> functi<strong>on</strong>s of <strong>the</strong> lawyer in society<br />

– which are to <strong>for</strong>estall and prevent c<strong>on</strong>flicts, to<br />

ensure that c<strong>on</strong>flicts are resolved in accordance<br />

with recognised principles of civil, public or<br />

criminal law and with due account of rights and<br />

interests, to negotiate and draft agreements and<br />

o<strong>the</strong>r transacti<strong>on</strong>al necessities, to fur<strong>the</strong>r <strong>the</strong><br />

development of <strong>the</strong> law, and to defend liberty,<br />

justice and <strong>the</strong> rule of law<br />

2 The <str<strong>on</strong>g>Internati<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Principles</str<strong>on</strong>g> c<strong>on</strong>sist of ten<br />

principles comm<strong>on</strong> to <strong>the</strong> legal professi<strong>on</strong><br />

worldwide. Respect <strong>for</strong> <strong>the</strong>se principles is <strong>the</strong><br />

basis of <strong>the</strong> right to a legal defence, which is <strong>the</strong><br />

cornerst<strong>on</strong>e of all o<strong>the</strong>r fundamental rights in a<br />

democracy.<br />

3 The <str<strong>on</strong>g>Internati<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Principles</str<strong>on</strong>g> express <strong>the</strong> comm<strong>on</strong><br />

ground which underlies all <strong>the</strong> nati<strong>on</strong>al and<br />

internati<strong>on</strong>al rules which govern <strong>the</strong> c<strong>on</strong>duct of<br />

lawyers, principally in relati<strong>on</strong> to <strong>the</strong>ir clients.<br />

The General <str<strong>on</strong>g>Principles</str<strong>on</strong>g> do not cover in detail o<strong>the</strong>r<br />

areas of lawyer c<strong>on</strong>duct, <strong>for</strong> instance regarding<br />

<strong>the</strong> courts, o<strong>the</strong>r lawyers or <strong>the</strong> lawyer’s own bar.<br />

4 The <str<strong>on</strong>g>Internati<strong>on</strong>al</str<strong>on</strong>g> <str<strong>on</strong>g>Principles</str<strong>on</strong>g> take into<br />

c<strong>on</strong>siderati<strong>on</strong>:<br />

• nati<strong>on</strong>al professi<strong>on</strong>al rules from states<br />

throughout <strong>the</strong> world;<br />
