exercise any undue influence intended to benefit <strong>the</strong><br />

lawyer in preference to that of a client. A lawyer must<br />

not accept instructi<strong>on</strong>s or c<strong>on</strong>tinue to act <strong>for</strong> a client,<br />

when <strong>the</strong> lawyer becomes aware that <strong>the</strong> client’s<br />

interest in <strong>the</strong> proceedings would be in c<strong>on</strong>flict with<br />

<strong>the</strong> lawyer’s own interest.<br />

3.3 <str<strong>on</strong>g>Internati<strong>on</strong>al</str<strong>on</strong>g> implicati<strong>on</strong>s<br />

The differences in nati<strong>on</strong>al rules <strong>on</strong> c<strong>on</strong>flicts of<br />

interest will have to be taken into account in any<br />

case of cross-border practice. Every lawyer is called<br />

up<strong>on</strong> to observe <strong>the</strong> relevant rules <strong>on</strong> c<strong>on</strong>flicts of<br />

interest when engaging in <strong>the</strong> practice of law outside<br />

<strong>the</strong> jurisdicti<strong>on</strong> in which <strong>the</strong> lawyer is admitted to<br />

practice. Every internati<strong>on</strong>al law firm will have to<br />

examine whe<strong>the</strong>r its entire organisati<strong>on</strong> complies<br />

with such rules in every jurisdicti<strong>on</strong> in which it<br />

is established and engaged in <strong>the</strong> provisi<strong>on</strong> of<br />

legal services. A universally accepted framework<br />

<strong>for</strong> determining proper c<strong>on</strong>duct in <strong>the</strong> event of<br />

c<strong>on</strong>flicting or incompatible rules has yet to be<br />

developed, although certain jurisdicti<strong>on</strong>s have<br />

adopted c<strong>on</strong>flict of law principles to determine which<br />

rules of professi<strong>on</strong>al c<strong>on</strong>duct apply in cross-border<br />

practice.<br />
