• Steal from the person with circumstances of aggravation, pursuant to section 95(1) of the<br />
Crimes Act 1900;<br />
• Enter dwelling house with intent to commit a serious indictable offence, pursuant to section<br />
111(2) of the Crimes Act 1900.<br />
Accordingly in relation to these allegations the <strong>Commission</strong> is not of the opinion that consideration<br />
should be given to any further prosecution under section 97(2)(a) of the PIC Act.<br />
Masri is also not a member of the NSWPF so the issue of him engaging in any police misconduct<br />
does not arise. In the circumstances the <strong>Commission</strong> expresses no opinion as to whether Masri<br />
engaged in any other misconduct (section 16(1)(a) of the PIC Act).<br />
Baroudi<br />
Baroudi was the subject of the following substantial allegation:<br />
(i) He was a party to the proposal to intercept a truck carrying a container load of tobacco<br />
products and the theft and subsequent sale of those products, albeit that this interception<br />
did not eventuate.<br />
As discussed in the body of this Report, the <strong>Commission</strong> is not satisfied that LP1’s evidence as to<br />
the object of the alleged proposal should be totally accepted, in light of the fact that the plan did<br />
not eventuate and that each of the other alleged participants denied the allegation made by LP1,<br />
however unsatisfactory their alternative explanations may have been.<br />
Pursuant to section 97(2) of the Act the <strong>Commission</strong> is not of the opinion that consideration should<br />
be given to the prosecution of Baroudi for a specified criminal offence.<br />
Baroudi is also not a member of the NSWPF so the issue of engaging in any police misconduct<br />
does not arise. In the circumstances the <strong>Commission</strong> is not of the opinion that Baroudi engaged in<br />
any other misconduct (section 16(1)(a) of the Act).<br />
In undertaking the <strong>Operation</strong> <strong>Lantana</strong> investigation the <strong>Commission</strong> acknowledges the cooperation<br />
and assistance provided by the NSWPF, and in particular, officers from the Professional Standards<br />
Command and the Liverpool Local Area Command.<br />
