In addition to the requirement to include in a report to Parliament a statement of the <strong>Commission</strong>’s<br />
opinions regarding those against whom substantial allegations have been made, the <strong>Commission</strong><br />
has discretion to recommend that consideration be given to other disciplinary action. This includes<br />
“non-reviewable action” within the meaning of section 173 of the <strong>Police</strong> Act 1990. Non-reviewable<br />
action is disciplinary action available against police officers for less serious breaches of discipline.<br />
There is no avenue of appeal to the Industrial Relations <strong>Commission</strong> against the imposition of a<br />
form of non-reviewable action. The available forms of non-reviewable action are:<br />
• coaching;<br />
• mentoring;<br />
• training and development;<br />
• increased professional, administrative or educational supervision;<br />
• counselling;<br />
• reprimand;<br />
• warning;<br />
• retraining;<br />
• personal development;<br />
• performance enhancement agreements;<br />
• non-disciplinary transfer;<br />
• change of shift (but only if the change results in no financial loss and is imposed for<br />
a limited period and is subject to review);<br />
• restricted duties; and<br />
• recording of adverse findings.<br />
OThER TYPES Of RECOMMENDATIONS AND OPINIONS<br />
If the <strong>Commission</strong> considers it appropriate in the circumstances, a report to Parliament may also<br />
include recommendations for the taking of other action. Such recommendations may, for example,<br />
relate to the need for law reform or for changes to policies and procedures affecting the way in<br />
which police or other persons carry out their respective duties and responsibilities.<br />
