Accordingly in relation to these allegations the <strong>Commission</strong> is not of the opinion that<br />

consideration should be given to any further prosecution under section 97(2)(a) of the<br />

PIC Act.<br />

4.50 Masri is also not a member of the NSWPF so the issue of him engaging in any police<br />

misconduct does not arise. The <strong>Commission</strong> expresses no opinion as to whether Masri<br />

engaged in any other misconduct (section 16(1)(a) of the PIC Act).<br />

4.51 For the same reasons it is also unnecessary to consider any possible action against Masri<br />

under section 97(2)(c) or (d) of the PIC Act.<br />

MONTAZE BAROUDI<br />

4.52 In the opinion of the <strong>Commission</strong> Baroudi is an affected person because he is the subject<br />

of the following substantial allegation:<br />

(i) He was a party to a proposal to intercept a truck carrying a container load of<br />

tobacco products and the unlawful seizure and subsequent sale of those tobacco<br />

products (though this interception and theft did not ultimately take place).<br />

4.53 As discussed previously in this Report, with regard to this allegation (referred to as the<br />

‘Baroudi truck incident’) the <strong>Commission</strong> is not satisfied that LP1’s evidence as to the<br />

object of this proposal should be totally accepted, in light of the fact that the plan did not<br />

eventuate and that each of the other alleged participants denied the allegation made by<br />

LP1 in his evidence, however unsatisfactory their alternative explanations may have been.<br />

4.54 Pursuant to section 97(2) of the Act the <strong>Commission</strong> is not of the opinion that<br />

consideration should be given to the prosecution of Baroudi for a specified criminal<br />

offence.<br />

4.55 Baroudi is also not a member of the NSWPF so the issue of engaging in any police<br />

misconduct does not arise. The <strong>Commission</strong> is not of the opinion that Baroudi engaged<br />

in any other misconduct (section 16(1)(a) of the Act).<br />

4.56 As Baroudi is not a member of the NSWPF it is also unnecessary to consider any possible<br />

action under section 97(2)(c) or (d) of the PIC Act.<br />
