A golden opportunity<br />

The Department of C<strong>on</strong>servati<strong>on</strong> (DOC) is a<br />

significant provider of tourism and outdoor recreati<strong>on</strong><br />

opportunities in New Zea<strong>land</strong>.<br />

By working proactively together, the <str<strong>on</strong>g>business</str<strong>on</strong>g> sector<br />

and DOC can deliver envir<strong>on</strong>mental, social and<br />

ec<strong>on</strong>omic benefits to New Zea<strong>land</strong>ers and help make<br />

New Zea<strong>land</strong> the greatest living space <strong>on</strong> Earth.<br />

We want to enable <str<strong>on</strong>g>business</str<strong>on</strong>g> opportunities that are<br />

c<strong>on</strong>sistent with c<strong>on</strong>servati<strong>on</strong>, with a particular focus<br />

<strong>on</strong> increasing the number of people enjoying <strong>public</strong><br />

c<strong>on</strong>servati<strong>on</strong> areas.<br />

At a local level, DOC has been working <strong>on</strong> <strong>Great</strong> Barrier<br />

Is<strong>land</strong> to improve visitor facilities including major track<br />

upgrades and the building of the <str<strong>on</strong>g>new</str<strong>on</strong>g> Mt Heale Hut.<br />

This work has created the <str<strong>on</strong>g>new</str<strong>on</strong>g>ly named Aotea Track,<br />

which will enable visitors to enjoy a multi-day tramping<br />

experience using the two huts en route. In<str<strong>on</strong>g>for</str<strong>on</strong>g>mati<strong>on</strong> panels<br />

are also planned to tell the stories of the is<strong>land</strong>’s rich history and special<br />

wildlife. These increased opportunities <str<strong>on</strong>g>for</str<strong>on</strong>g> visitors will help to further<br />

entice people to take the short trip from Auck<strong>land</strong> <str<strong>on</strong>g>for</str<strong>on</strong>g> an adventurous<br />

active holiday or a relaxing unwind to escape city life.<br />

Private enterprise and the local community have an important role<br />

to play in realising the full potential of <strong>public</strong> c<strong>on</strong>servati<strong>on</strong> <strong>land</strong>. The<br />

development of <str<strong>on</strong>g>business</str<strong>on</strong>g> initiatives such as ecotourism ventures, guided<br />

walks and organised events is essential to creating a marketable product<br />

and generating local ec<strong>on</strong>omic benefit.<br />

This in<str<strong>on</strong>g>for</str<strong>on</strong>g>mati<strong>on</strong> sheet aims to answer some questi<strong>on</strong>s and provide<br />

some pointers <str<strong>on</strong>g>for</str<strong>on</strong>g> entrepreneurs c<strong>on</strong>sidering the set-up of a <str<strong>on</strong>g>business</str<strong>on</strong>g><br />

using <strong>public</strong> c<strong>on</strong>servati<strong>on</strong> <strong>land</strong> <strong>on</strong> <strong>Great</strong> Barrier Is<strong>land</strong>.<br />

Some ideas <str<strong>on</strong>g>for</str<strong>on</strong>g> tourism based <str<strong>on</strong>g>business</str<strong>on</strong>g>es:<br />

l Guiding e.g. hiking, biking, kayaking, climbing, fishing<br />

l Themed guiding e.g. plants and animals, mining and logging<br />

history, Maori history, photography, or a mixture of everything!<br />

l Pick-ups and drop-offs at track ends<br />

l Sporting events e.g. bike races, multisport events<br />

l Mountain bike hire<br />

l Luxury guided walks – provide transport of packs and gourmet<br />

food<br />

l Accommodati<strong>on</strong> and meals <str<strong>on</strong>g>for</str<strong>on</strong>g> visitors<br />

C<strong>on</strong>cessi<strong>on</strong>s<br />

If you choose to run a commercial activity<br />

<strong>on</strong> <strong>public</strong> <strong>land</strong> managed by DOC, you need<br />

to apply <str<strong>on</strong>g>for</str<strong>on</strong>g> a c<strong>on</strong>cessi<strong>on</strong>. This is an official<br />

authorisati<strong>on</strong> to operate <strong>on</strong> <strong>land</strong> managed<br />

by DOC. It may be in the <str<strong>on</strong>g>for</str<strong>on</strong>g>m of a lease,<br />

licence, permit or easement.<br />

A c<strong>on</strong>cessi<strong>on</strong> gives you:<br />

l A legal right to carry out your proposed<br />

activity <strong>on</strong> <strong>land</strong> managed by DOC<br />

l A <str<strong>on</strong>g>for</str<strong>on</strong>g>mal relati<strong>on</strong>ship between yourself<br />

and DOC so that both parties are aware<br />

of their obligati<strong>on</strong>s<br />

l Security of tenure <str<strong>on</strong>g>for</str<strong>on</strong>g> the term of your<br />

c<strong>on</strong>cessi<strong>on</strong> provided that you comply<br />

with the c<strong>on</strong>diti<strong>on</strong>s of your c<strong>on</strong>cessi<strong>on</strong>


Frequently asked questi<strong>on</strong>s about<br />

c<strong>on</strong>cessi<strong>on</strong>s<br />

What will it cost?<br />

Applicati<strong>on</strong> processing fees<br />

Processing fees vary with the level of impact of a<br />

c<strong>on</strong>cessi<strong>on</strong>. The streamlined C<strong>on</strong><str<strong>on</strong>g>for</str<strong>on</strong>g>ming C<strong>on</strong>cessi<strong>on</strong>s<br />

process is <str<strong>on</strong>g>for</str<strong>on</strong>g> low impact activities which are deemed to<br />

be ‘c<strong>on</strong><str<strong>on</strong>g>for</str<strong>on</strong>g>ming’ (e.g. guided walking). Applicati<strong>on</strong> fees <str<strong>on</strong>g>for</str<strong>on</strong>g><br />

C<strong>on</strong><str<strong>on</strong>g>for</str<strong>on</strong>g>ming C<strong>on</strong>cessi<strong>on</strong>s can be as low as $285 + GST and<br />

take <strong>on</strong>ly five working days to process. The majority of<br />

tracks <strong>on</strong> <strong>Great</strong> Barrier Is<strong>land</strong> are ‘c<strong>on</strong><str<strong>on</strong>g>for</str<strong>on</strong>g>ming’.<br />

Processing fees <str<strong>on</strong>g>for</str<strong>on</strong>g> activities with a potentially higher<br />

impact vary from $1330 + GST <str<strong>on</strong>g>for</str<strong>on</strong>g> a n<strong>on</strong>-notified<br />

c<strong>on</strong>cessi<strong>on</strong>, to a higher individually assessed fee <str<strong>on</strong>g>for</str<strong>on</strong>g><br />

notified c<strong>on</strong>cessi<strong>on</strong> applicati<strong>on</strong>s.<br />

On-going fees<br />

Additi<strong>on</strong>al fees that may be charged throughout the<br />

term of your c<strong>on</strong>cessi<strong>on</strong> are an annual management fee,<br />

m<strong>on</strong>itoring fees to cover the cost of m<strong>on</strong>itoring the effects<br />

of your activity and activity fees which are based <strong>on</strong> the<br />

actual number of clients you have<br />

Health and Safety<br />

Safe operati<strong>on</strong>s are a vital part of today’s <str<strong>on</strong>g>business</str<strong>on</strong>g><br />

envir<strong>on</strong>ment. Having good safety management systems<br />

<str<strong>on</strong>g>for</str<strong>on</strong>g> your <str<strong>on</strong>g>business</str<strong>on</strong>g> is not just a DOC or legal requirement,<br />

they are also good <str<strong>on</strong>g>for</str<strong>on</strong>g> your <str<strong>on</strong>g>business</str<strong>on</strong>g> and help you to set<br />

and support safe operati<strong>on</strong>s as your <str<strong>on</strong>g>business</str<strong>on</strong>g> grows.<br />

All c<strong>on</strong>cessi<strong>on</strong>aires must either provide evidence of<br />

Qualmark or Outdoorsmark certificati<strong>on</strong> or provide<br />

evidence of an independently audited safety plan, if they<br />

offer recreati<strong>on</strong> or tourism activities. From 1 October 2011,<br />

<str<strong>on</strong>g>for</str<strong>on</strong>g> adventure tourism operators, this will be superceded<br />

by a <str<strong>on</strong>g>new</str<strong>on</strong>g> compulsory registrati<strong>on</strong> system managed by the<br />

Department of Labour.<br />

Associated costs<br />

DOC c<strong>on</strong>cessi<strong>on</strong>aires are also required to have <strong>public</strong><br />

liability, with <str<strong>on</strong>g>for</str<strong>on</strong>g>est and rural fire extensi<strong>on</strong>, and third party<br />

vehicle insurance (if applicable). Any insurance company<br />

or broker can advise you <strong>on</strong> <strong>public</strong> liability insurance.<br />

Why are c<strong>on</strong>cessi<strong>on</strong>s necessary?<br />

The c<strong>on</strong>cessi<strong>on</strong> system helps DOC to ensure that the<br />

various c<strong>on</strong>cessi<strong>on</strong> activities are compatible with the<br />

primary aim of protecting the <strong>land</strong> and other resources.<br />

It also helps to make sure that services and facilities<br />

provided <str<strong>on</strong>g>for</str<strong>on</strong>g> visitors are appropriate, of a suitable standard,<br />

and that commercial activities do not c<strong>on</strong>flict with visitor<br />

enjoyment.<br />

What sort of activities need a c<strong>on</strong>cessi<strong>on</strong>?<br />

Any commercial activity <strong>on</strong> <strong>public</strong> c<strong>on</strong>servati<strong>on</strong> <strong>land</strong><br />

needs a c<strong>on</strong>cessi<strong>on</strong>. Some examples of comm<strong>on</strong><br />

c<strong>on</strong>cessi<strong>on</strong>s include:<br />

l Guiding<br />

l Accommodati<strong>on</strong> facilities<br />

l Land transport services<br />

l Commercial educati<strong>on</strong> or instructi<strong>on</strong> activities<br />

l Grazing and other sorts of <strong>land</strong> use<br />

How do I apply <str<strong>on</strong>g>for</str<strong>on</strong>g> a c<strong>on</strong>cessi<strong>on</strong>?<br />

Sometimes c<strong>on</strong>cessi<strong>on</strong> opportunities are <strong>public</strong>ly offered<br />

(tendered) by DOC. But most c<strong>on</strong>cessi<strong>on</strong>s are initiated<br />

by an individual or company approaching DOC seeking<br />

permissi<strong>on</strong> to run a particular activity.<br />

As part of the process, c<strong>on</strong>sultati<strong>on</strong> with local iwi may be<br />

required. DOC staff can tell you whether you need to talk<br />

to iwi yourself and if so, who to c<strong>on</strong>tact.<br />

Employing other people<br />

If you are employing staff you will need to register with<br />

In<strong>land</strong> Revenue and make PAYE payments <strong>on</strong> behalf<br />

of your employees. You should also register with In<strong>land</strong><br />

Revenue <str<strong>on</strong>g>for</str<strong>on</strong>g> GST if you expect your turnover will be<br />

greater than $60,000 <str<strong>on</strong>g>for</str<strong>on</strong>g> the next 12 m<strong>on</strong>ths. In<strong>land</strong><br />

Other requirements<br />

Depending <strong>on</strong> your activity, you <str<strong>on</strong>g>business</str<strong>on</strong>g> may require<br />

c<strong>on</strong>sent from the Auck<strong>land</strong> Council. As a first step, you<br />

should speak with a Council officer and they can advise<br />

you of the requirements.<br />

You must comply with legislati<strong>on</strong> and understand<br />

your resp<strong>on</strong>sibilities under the Health and Safety in<br />

Employment Act 1992.
