“l<strong>and</strong>” includes l<strong>and</strong> <strong>of</strong> any tenure, houses <strong>and</strong> other buildings,<br />

mines <strong>and</strong> minerals, <strong>and</strong> other corporeal hereditaments; also<br />

a rent <strong>and</strong> other incorporeal hereditaments, <strong>and</strong> an easement,<br />

right, privilege, or benefit in, over, or derived from l<strong>and</strong>, <strong>and</strong><br />

also an undivided share in l<strong>and</strong>; <strong>and</strong> in this definition “mines<br />

<strong>and</strong> minerals” include any strata or seam <strong>of</strong> minerals or<br />

substances in or under any l<strong>and</strong>, <strong>and</strong> powers <strong>of</strong> working <strong>and</strong><br />

winning the same; <strong>and</strong> “hereditaments” mean real property<br />

which under an intestacy devolve on the next <strong>of</strong> kin;<br />

“lessor” includes an under-lessor <strong>and</strong> a person deriving title under<br />

a lessor or under-lessor; “ lessee” includes an under-lessee<br />

<strong>and</strong> a person deriving title under a lessee or under-lessee;<br />

<strong>and</strong> “ lease” includes an under-lease or other tenancy;<br />

“mining lease” means a lease for mining purposes; that is, the<br />

searching for, winning, working, getting, making<br />

merchantable, carrying away, or disposing <strong>of</strong> mines <strong>and</strong><br />

minerals, or purposes connected therewith, <strong>and</strong> includes a<br />

grant or licence for mining purposes;<br />

“mortgage” includes any charge on any property for securing<br />

money or money’s worth; <strong>and</strong> “mortgage money” means<br />

money, or money’s worth, secured by a mortgage; <strong>and</strong><br />

“mortgagor” includes any person from time to time deriving<br />

title under the original mortgagor, or entitled to redeem a<br />

mortgage, according to his estate, interest, or right in the<br />

mortgaged property; <strong>and</strong> “mortgagee” includes any person<br />

from time to time deriving title under the original mortgagee;<br />

<strong>and</strong> “mortgagee in possession” means a mortgagee who, in<br />

right <strong>of</strong> the mortgage, has entered into <strong>and</strong> is in possession<br />

<strong>of</strong> the mortgaged property;<br />

“personal representative” means the executor or administrator for<br />

the time being <strong>of</strong> a deceased person <strong>and</strong> includes the<br />

Administrator General;<br />

“possession” includes receipt <strong>of</strong> rents <strong>and</strong> pr<strong>of</strong>its or the right to<br />

receive the same, if any;<br />

“property” includes anything in action, <strong>and</strong> any interest in real<br />

or personal property;<br />
