(14) Nothing in this section shall be construed as binding<br />
a purchaser to complete his purchase in any case where, on a<br />
contract made independently <strong>of</strong> this section, <strong>and</strong> containing<br />
stipulations similar to the provisions <strong>of</strong> this section, or any <strong>of</strong> them,<br />
specific performance <strong>of</strong> the contract would not be enforced against<br />
him by the Court.<br />
7. (1) A vendor or purchaser <strong>of</strong> any interest in l<strong>and</strong>, or their<br />
representatives respectively, may apply in a summary way to the<br />
Court, in respect <strong>of</strong> any requisitions or objections, or any claim for<br />
compensation, or any other question arising out <strong>of</strong> or connected<br />
with the contract (not being a question affecting the existence or<br />
validity <strong>of</strong> the contract), <strong>and</strong> the Court may make such order upon<br />
the application as to the Court may appear just, <strong>and</strong> may order<br />
how <strong>and</strong> by whom all or any <strong>of</strong> the costs <strong>of</strong> <strong>and</strong> incident to the<br />
application are to be borne <strong>and</strong> paid.<br />
(2) Where the Court refuses to grant specific performance<br />
<strong>of</strong> a contract, or in any action for the return <strong>of</strong> a deposit, the Court<br />
may, if it thinks fit, order the repayment <strong>of</strong> any deposit.<br />
(3) This section applies to a contract for the sale or<br />
exchange <strong>of</strong> any interest in l<strong>and</strong>.<br />
8. (1) Where l<strong>and</strong> subject to any encumbrance, whether<br />
immediately realisable or payable or not, is sold or exchanged by<br />
the Court, or out <strong>of</strong> Court, the Court may, if it thinks fit, on the<br />
application <strong>of</strong> any party to the sale or exchange, direct or allow<br />
payment into Court <strong>of</strong> such sum as is hereinafter mentioned, that<br />
is to say—<br />
(a) in the case <strong>of</strong> an annual sum charged on the l<strong>and</strong>,<br />
or <strong>of</strong> a capital sum charged on a determinable<br />
interest in the l<strong>and</strong>, the sum to be paid into Court<br />
shall be <strong>of</strong> such amount as, when invested in<br />
Government securities, the Court considers will<br />
be sufficient, by means <strong>of</strong> the dividends there<strong>of</strong>,<br />
to keep down or otherwise provide for that<br />
charge; <strong>and</strong><br />
