Requirement checklist
To ensure your application to register the transfer is not unduly delayed, please ensure the following requirements are satisfied:
Payment of fees
Written approval of each person, other than the licence holder, who has an interest in the licence noted in the Register of
Authorities
The current Commercial Fishing Boat licence hereby temporarily transferred must be given to the temporary transferee.
Logbook returns are up to date (see notes)
Transfer of associated quota units by completion of a Register Temporary Transfer of Quota – Form FDU1469 (if applicable)
Provision of a copy of the current company extract (see notes) for each company involved in the above transfer. You may
provide a copy with your application, or a copy can be arranged on your behalf by contacting this office (fees apply).
The information in this checklist is to assist you in complying with the requirements of the Fisheries Act 1994 that relate to the
licence/s to be transferred. It should not be relied on for specific advice. It is not a precise statement of law and deals with matters
that are subject to change. Complete copies of the Fisheries Act 1994, regulations and management plans can be accessed via

Notes:
The transfer must be executed in the same manner as provided for under the Land Title Act 1994 Section 161 (1), (2), and (3A), for
example:
• For individuals, signatures must be witnessed by a notary public, justice of the peace, a commissioner for declarations or for
taking affidavits, a lawyer, a barrister, a solicitor, legal practitioner, conveyancer, or another approved person.
• For a corporation, the form is signed in accordance with the Corporations Act 2001, s127 by: either two directors, or a director and
a company secretary, or (for a proprietary company) the sole director who is the sole secretary.
Be aware
that during the period of the temporary transfer, both the transferor and transferee are taken to be the holder for certain
compliance and administrative purposes.
Logbook returns
Intending temporary transferees (lessees’) should ensure that all logbook returns are up to date before the transaction in finalised.
A check on this can be made by telephoning (07) 3227 7427. Please note that the logbooks in relation to the boat and licence as
noted on the front of this form may be passed from the transferor to the transferee once all requirements regarding the logbook
returns have
been met. Alternatively, a new logbook will be forwarded to the transferee if the following box is ticked:
Spanner Crab Quota Books
If the boat licence has a Spanner Crab Fishery symbol marked on it, the Transferor must hand over the Spanner Crab Quota Book
in its entirety to the Transferee.
Company
extract
A company extract is a specific document issued by the Australian Securities and Investment Commission which identifies the
directors and
secretaries of the company. Please note that a certificate of incorporation is not a company extract.
Stamp Duty
Queensland Stamp Duty may be payable on the transfer of a fishing authority. Further details may be obtained from the Office of
State Revenue on telephone (07) 3227 8733 (Brisbane area) or 1300 301 342 (outside Brisbane area). The Commissioner of
Stamp Duties may take action against either the vendor or purchaser when recovering unpaid duty.
