ELECTRICIANS BOARD<br />

<strong>June</strong> <strong>24</strong>, <strong>2008</strong><br />

The regularly scheduled meeting of the Electricians’ Board was held at the Division of Fire Safety Office, 110 Smokey<br />

Bear Boulevard, Concord, <strong>NH</strong> on the above date, beginning at 9:30am. Unless otherwise indicated, the members present<br />

and participating were Henry Szumiesz (Chairman); Thomas Malley, Gerald McCarthy and Dennis Hager (public<br />

member) and Robert Farley, Deputy Fire Marshal. Also present were Mark Hilbert, Chief Electrical Inspector and Dean<br />

Sotirakopoulos, Kenneth Vallery and Alfio Torrisi,; Electrical Inspectors and Pamela Olin, Administrative Assistant. A<br />

motion to approve the minutes of the May 27, <strong>2008</strong> meeting was made by Thomas Malley seconded by Dennis Hager and<br />

passed. New Electrical Inspector Alfio Torrisi was welcomed.<br />

Raymond Staples completed the schooling required of him. A motion was made by Thomas Malley to accept the<br />

schooling and send a thank you to Mr. Staples. The motion was seconded by Dennis Hager and passed. The Education<br />

Committee did not meet. The Apprenticeship Curriculum Committee did not meet. Their next meeting will be July 23 rd at<br />

1:00 pm. A question came up as to whether the schools, Dept of Education were still sending out completion letters for the<br />

apprentices each year. The next State Advisory Committee on Fire Protection and Certification meeting will be August 1,<br />

<strong>2008</strong>. Gerald McCarthy resigned as the representative the State Advisory Committee on Fire Protection and Certification,<br />

a new representative will be nominated. Thomas Malley reported on the <strong>June</strong> meeting of the Building Code Review<br />

Board. The new Chairman is Donald Bliss. The Building Code Review Board voted on the Exhibits the Electricians Board<br />

reviewed and made recommendations on at their April 29 th meeting. The votes were: Exhibit 43 regarding NFPA 70<br />

Section 210.12(B) was 9 to 3 not to adopt, Exhibit 44 regarding NFPA 70 Section 680.26(7)(C) was 12 to 0 not to adopt,<br />

Exhibit 45 regarding NFPA 70 Section 406.11 was 10 to 2 not to adopt. Exhibit 46 regarding NFPA 70 Section 406.08<br />

was 12 to 0 not to adopt and Exhibit 47 regarding NFPA 70 Section 210.5(C) was 12 to 0 to adopt. Thomas Malley<br />

resigned from his position on the Building Code Review Board effective September 1, <strong>2008</strong>.<br />

A motion to approve the <strong>2008</strong> Code Provider Application for EC&M (John Dedad) pending the receipt of additional<br />

information was made Henry Szumiesz and seconded by Gerald McCarthy and passed. A motion to approve the <strong>2008</strong><br />

Code Provider Application for IBEW Local 7 (Mark Kuenzel) pending the receipt of additional information was made<br />

Thomas Malley and seconded by Henry Szumiesz and passed.<br />

As an application for corporation license was received from Live Wire LLC the hearing was reopened to discuss the<br />

decision. A motion was made by Thomas Malley to require a two year limitation where Live Wire LLC would be required<br />

to report on a monthly basis for <strong>24</strong> months all employees with electrical licenses and apprentice ID cards and all electrical<br />

jobs. The motion was seconded by Gerald McCarthy and passed.<br />

The committee planning the reciprocal meeting with Maine, Massachusetts and Vermont will meet in July. Bills SB360,<br />

SB 440 and SB453 were all signed by the Governor.<br />

Inspector Hilbert reported that the exams were being updated to the <strong>2008</strong> NEC for the July exams. The meeting with the<br />

multi state group will be in Alaska, August 4-5. New Hampshire will be hosting this meeting in 2009. Inspector Hilbert<br />

reviewed all the proposed rule changes with the Board. A motion was made by Henry Szumiesz to have Inspector Hilbert<br />

take the older changes when he meets with the attorney working on our rule changes while the newer changes regarding<br />

criminal questions to be put in the new applications will be discussed further. Inspector Hilbert brought to the Board a<br />

situation which Inspector Vallery has been dealing with: John Arrison with an unregistered apprentice making electrical


installations – with prior instances of the same issue in previous years. A motion was made by Thomas Malley that Mr.<br />

Arrison be brought in for a hearing with the Board in July for having an unregistered apprentice making electrical<br />

installations. The motion was seconded by Gerald McCarthy and passed. Inspector Hilbert brought to the Board a second<br />

situation which Inspector Vallery has been dealing with: George Smith with unlicensed employees, claiming to be<br />

licensed, making electrical installations. A motion was made by Henry Szumiesz that Mr. Smith be brought in for a<br />

hearing with the Board in July for having unlicensed employees making electrical installations. The motion was seconded<br />

by Dennis Hager and passed.<br />

Inspector Sotirakopoulos reported that there is an exam form that has standard method of load calculations that some of<br />

the teachers have for students who asked if it could be used for the exam. Since this would only be available to the<br />

students taking those courses and the information can be found in the books allowed, a motion was made by Henry<br />

Szumiesz that this NOT be allowed at the exam. The motion was seconded by Gerald McCarthy.<br />

Inspector Vallery reported that the fairs are being proactive regarding the <strong>2008</strong> NEC changes, currently he has worked<br />

with the North Haverhill, Lancaster and Sandwich Fairs meeting with the AHJs.<br />

Inspector Torrisi reported that he is getting all set up and that he is due to be in Hudson making inspections with Inspector<br />

Joe Bourque on Thursday.<br />

Motion to commence non public session (minutes kept separately)<br />

On the motion of Thomas Malley seconded by Gerald McCarthy the board voted to conduct a non public session for the<br />

purpose of discussing confidential board business, namely a matter which if discussed in public would likely affect<br />

adversely the reputation of a person, other than a member of the body or agency itself and records pertaining confidential<br />

information noting that such a non public session is authorized by RSA 91-A:3,II(c) and RSA 91-A:5,IV. Each member<br />

recorded his or her vote on the motion, which passed by the unanimous vote of all members present.<br />

Upon the motion of Thomas Malley and second of Gerald McCarthy, the Board voted to withhold the minutes of the non<br />

public session from public disclosure pursuant to RSA 91-A:3,III on the grounds that public disclosure would be likely to<br />

affect adversely the reputation of a person other than a board member. Each member recorded his or her vote on the<br />

motion which passed by the unanimous vote of all members present.<br />

On motion of Gerald McCarthy seconded by Thomas Malley, the Board voted to go back into public session.<br />

With no further business to address the Board meeting adjourned at 12:25 p.m. The next meeting of the Board will be<br />

July 29, <strong>2008</strong> at 9:30 a.m., at the Richard M. Flynn Fire Academy, Route 106, Concord, <strong>NH</strong>.<br />
