Boudreaux, the smoothest-talking Cajun in the Louisiana<br />

National Guard, got called up to active duty. Boudreaux’s first<br />

assignment was in a military induction center. Because he was a<br />

good talker, they assigned him the duty of advising new recruits<br />

about Gov’t benefits, especially the GI insurance to which they<br />

were entitled. The officer in charge soon noticed that Boudreaux<br />

was getting a 99% sign-up rate for the more expensive<br />

supplemental form of GI insurance. This was remarkable,<br />

because it cost these low-income recruits $30.00 per month for the<br />

higher coverage, compared to what the Gov’t was already<br />

providing at no charge. The officer decided he’d sit in the back of<br />

the room at the next briefing & observe Boudreaux’s sales pitch.<br />

Boudreaux stood up before the latest group of inductees & said,<br />

“If you has da normal GI insurans an’ you goes to Iraq an’ gets<br />

youself killed, da governmen’ pays you beneficiary $20,000. If<br />

you takes out da supplemental insurans, which cost you only t’irty<br />

dollars a mons, den da governmen’ gots ta pay you beneficiary<br />

$200,000! “Now,” Boudreaux concluded, “which bunch you<br />

tink dey gonna send ta Iraq first?

Automotive Safety Devices Coming Soon to Motorcycles: Within<br />

the next 2 years, motorcycles could be sporting collision detection<br />

& other safety features more typically found installed in cars. The<br />

new safety systems being tested for motorcycles include speed<br />

limit warnings, information about neighboring vehicles &<br />

changing lanes, & information of the tightness of road bends &<br />

the speed in which to turn. According to a report from the BBC,<br />

tests are being completed to bring the latest technologies found on<br />

cars to two-wheels, & the rise in motorcyclist fatalities has<br />

prompted researchers to adapt the first bike-based safety systems<br />

by late 2012. MIRA (the Motor Industry Research Association)<br />

acts as a testing & innovation center for carmakers & has been<br />

carrying out tests on the “Saferider” systems on road bikes &<br />

simulators. An ITS (Intelligent Transportation Systems)<br />

consultant at MIRA, Jonathan Moore, said of the project:<br />

“Saferider takes the driver safety systems that are becoming<br />

standard on cars & tries to adapt them to the unique needs of<br />

motorcyclists.” Moore said making safety systems on<br />

motorcycles useful was “challenging” because of all the<br />

distractions to which riders were subjected. With traffic noise &<br />

motorcycle helmets insulating riders from the traditional audible<br />

alarms found on car collision systems, researchers have looked for<br />

ways to alert bikers of pending danger with tactile warning<br />

systems such as vibrating seats & special gloves. New hi-tech<br />

systems could also protect riders from themselves, as one system<br />

being tested warns that a rider is going too fast to negotiate a turn.<br />

MIRA has developed “smart” software that acts as a “co-pilot”<br />

which, with the help of a digital map, knows what speed a<br />

motorcyclist should be travelling to make it around an<br />

approaching curve in the road.<br />

South Carolina Bill Would Allow Charitable Raffles: With many<br />

states around the nation cracking down on everything from poker<br />

runs to raffles, lawmakers in South Carolina moving to ensure that<br />

local churches, schools & nonprofits do not unknowingly break<br />

the law when they hold charitable raffles. Legislation, already<br />

approved by a Senate committee 18-4, would change the state<br />

Constitution to allow the groups to hold a limited number of<br />

raffles & casino nights annually -- as long as 90% of the money<br />

raised goes to benefit charitable causes. “It’s a good start,” said<br />

Austin Coates of ABATE South Carolina, a motorcyclist rights<br />

nonprofit that holds hundreds of raffles annually for Special<br />

Olympics, breast cancer prevention, burn victims & others. “But<br />

there’ll be a fight ahead before it becomes law.” The bill next<br />

heads to the full Senate for consideration. Should it survive there,<br />

it would go to the House. Ultimately, however, voters would<br />

have to approve any change in the state Constitution.<br />

Motorcycle Checkpoints in Georgia During Bike Week: The<br />

state of Georgia has received a $70,000 federal grant to launch<br />

motorcycle-only checkpoints in early March, just as Daytona Bike<br />

Week is getting underway. For most travelers, their route will take<br />

them through Georgia & likely into awaiting roadblocks to check<br />

for such things as proper license & current registration, insurance,


DOT-approved helmets, EPA-approved mufflers, working horn &<br />

lights, etc, etc. “We were informed by unnamed sources that the<br />

Check Points would start in early March to coincide with the<br />

Daytona Bike Week event,” said Dan Forrest, State Director of<br />

ABATE of Georgia. “Most points of entry to Florida will be<br />

involved, so anyone traveling through Georgia to Daytona might<br />

want to rethink their route.” The US Defenders have issued a Call<br />

To Action regarding the proliferation of these motorcycle-only<br />

roadblocks being funded by NHTSA grants, & are urging the<br />

motorcycle community to voice their opposition to these so-called<br />

“Safety Checks” by contacting NHTSA, the U.S. DOT & most<br />

importantly by asking your own federal legislators to support H.R.<br />

1498 by Rep. Jim Sensenbrenner (R-WI) to retain a ban on<br />

NHTSA’s ability to lobby State Legislators using our federal<br />

dollars through the “Motorcycle Law Enforcement<br />

Demonstration” grant program (DTNH22-10-R-00386). “These<br />

roadblocks or checkpoints for motorcycles Only are being<br />

conducted illegally & are discriminatory to say the least,” says<br />

Escondido Paul, National Lt. Commander of the US Defenders.<br />

“This is one more piece of evidence of the constant profiling<br />

attempts targeting our community at large.”<br />

Washington State Bill Would Prohibit Motorcycle Profiling:<br />

The Confederation of Clubs, US Defenders & ABATE of<br />

Washington are seeking support for legislation that would<br />

condemn & prevent the widespread law enforcement practice of<br />

motorcycle profiling. The Washington Courts have confirmed that<br />

the Washington State Patrol is guilty of unlawful profiling &<br />

discrimination against motorcyclists. In 2002 the Court granted a<br />

permanent injunction against the State Patrol’s use of a training<br />

pamphlet titled Biker 101 (Wulfekuhle v. Washington State<br />

Patrol). However, on November 23, 2009 the WSP, under oath,<br />

explicitly admitted that they profile members of motorcycle clubs<br />

& continue to use Biker 101 as a training manual. This gross<br />

violation of a Washington State Superior Court injunction proves<br />

that the pattern of motorcycle profiling continues & that the WSP<br />

brazenly violates the liberties of motorcyclists even in the face of<br />

judicial reprimand. To curb such injustices, Rep. Steve Kirby<br />

(D-Tacoma) introduced HB 1333 on January 19 to require law<br />

enforcement agencies to adopt a written policy that condemns &<br />

prevents motorcycle profiling, review existing procedures, &<br />

institute training to address the issue of motorcycle profiling,<br />

which means using the fact that a person rides a motorcycle or<br />

wears motorcycle-related clothes as a factor in deciding to stop &<br />

question, arrest, or search a person or a vehicle without legal<br />

basis. (Companion: SB 5242).<br />

ABATE of Florida, Inc. stands with NCOM & A.B.A.T.E. of<br />

Georgia in this highly discriminatory action. James “Doc”<br />

Reichenbach, II, the President of ABATE of Florida, Inc. & the<br />

Chairman of the Board, NCOM, stated upon hearing of these<br />

planned checkpoints; “We are totally against this taxpayer-funded<br />

profiling of motorcyclists on both the state & federal levels. The<br />

fact that they have decided to implement this potentially<br />

unconstitutional action against motorcyclists at the same time they<br />

travel through Georgia en route to the well-publicized Daytona<br />

Bike Week, simply shows that the Govt’s true motives are not<br />

safety, but the collection of money from a profiled segment of<br />

citizens.” We ask that all contact their elected Representatives &<br />

Senators in Washington, D.C. & let them know that you are<br />

against this discriminatory action against motorcyclists.<br />

ABATE of Minnesota Bikerday 2011 was on Feb 3, 2011 – By<br />

Mack Backlund; State Coordinator - I have read in chapter<br />

minutes & heard from some people that “The numbers were down<br />

for Bikerday.” But in fact we had our most successful Bikerday<br />

ever. It is best not to rely on visual estimates, as our attendees<br />

were scattered throughout the Capitol & State Office Building all<br />

day long from the minute they arrived until they departed. I heard<br />

Edgar Burke say to his fellow hometown bikers “Come on, let’s<br />

go - We gotta be upstairs in 5 minutes” shortly after arriving. We<br />

are always looking to increase attendance, but I can assure you<br />

that Bikerday 2011 made a tremendous impact on all of our<br />

elected officials. I have heard it from many powerful people at the<br />

Capitol & also in committee discussion. This is true grass roots<br />

lobbying in action. Many groups & organizations that visit the<br />

Capitol only wish they could be so successful. Many thanks to all<br />

Nationwide Call to Action for KMA members & US<br />

Defenders – Feb 11, 2011 – Kentucky / USA – By Jay Huber;<br />

State President KMA/KBA - Here is an update on the National<br />

Call to Action regarding the extension of the Patriot Act<br />

provisions. A vote happened earlier this week & the extension<br />

failed but it was not killed. This issue will rear its ugly head again<br />

several times before all is said & done. I urge you to light up the<br />

switchboards in Washington D.C. You can call the main<br />

switchboard at 202-225-3121 & they can direct you to your<br />

Congressman & Senators Mitch McConnell & Rand Paul’s<br />

offices. The message once again remains simple. “Please Oppose<br />

Any extension of the Patriot Act.” Below is the letter from Paul<br />

of Texas & the National Office of the US Defenders.<br />

Dear Honorable Your U.S. Senator, There’s more evidence than<br />

ever that Patriot Act abuse is a real & Present danger. Here in<br />

Texas there have been numerous reports of Law Enforcement<br />

stopping bikers, photographing their tattoos & patches & putting<br />

the information in the Fusion data base even if they are not<br />

suspected of a crime. The 3 expiring provisions of the Patriot<br />

Act give the Gov’t sweeping authority to spy on individuals inside<br />

the United States, & in some cases, without any suspicion of<br />

wrongdoing. Section 215 . Section 206 . Section 6001 of the<br />

Intelligence Reform & Terrorism Prevention Act of 2004 are due<br />

to expire Feb. 28th, 2011. I feel all 3 should be allowed to expire<br />

if they are not amended to include privacy protections to protect<br />

personal information from Gov’t overreach. I am against HR67<br />

which allows another extension on the provisions until 2012; this<br />

matter needs to be dealt with now. I also respectfully request that<br />

you promote Patriot Act reform. It’s past time for our Gov’t to<br />

stop violating the rights of everyday people who have nothing to<br />

do with terrorism. Please tell congressional leaders to include<br />

substantive National Security Letter reforms in any bill extending<br />

Patriot Act powers. I look forward to your response on this<br />

Plan Would Relax Motorcycle Helmet Law – Feb 14, 2011 –<br />

Salem, Oregon – By Dan Corcoran; http://KEZI.com - Twenty<br />

Oregon lawmakers want to relax the state’s helmet requirement<br />

for motorcyclists & their passengers. If legislators get their way,<br />

wearing a helmet would be optional for people older than 21.<br />

Only those who are under 21 years old would be required by law<br />

to wear a helmet. Albany Republican Representative Andy Olson<br />

is sponsoring House Bill 3141. One of Representative Olson’s<br />

reasons for pushing the bill is that he believes that the change in<br />

law would actually help riders hear better & see more out on the<br />

roads. Some bikers see both pros & cons with what this bill<br />

could do. “Some people don’t like the idea of wearing a helmet,<br />

so I know that it’s going to be popular with a certain segment of<br />

the populous that rides motorcycles & scooters. I myself ride<br />

with a full-face helmet,” said Bill Cole, owner of WheelWorks.<br />

Many highway safety studies show that helmets reduce crashrelated<br />

head injuries, which are the leading cause of deaths among<br />

riders who don’t wear helmets. The measure could go to the<br />

House Transportation Panel & come up for a hearing in the next<br />

week. Oregon is one of 20 states that require helmets for anyone<br />

on a motorcycle regardless of age. Four states have no motorcycle<br />

helmet requirement. Many other states require helmets for<br />

younger people, like the plan being proposed in Oregon.<br />

Critics knock no-knock police raids – Feb 13, 2011 – USA – By<br />

Ron Barnett & Paul Alongi; www.USAToday.com - Dressed in<br />

black & carrying assault rifles, members of a local multijurisdiction<br />

police unit burst into a dark home in Ogden, Utah, one<br />

night in Sept shouting, “Police! Search warrant!” A video of the<br />

incident made by the Weber-Morgan counties Narcotics Strike<br />

Force & the federal Drug Enforcement Agency shows a man<br />

suddenly appearing in a hallway holding a shiny object that an<br />

officer thought was a sword, but was really a golf club, according<br />

to Weber County Attorney Dee Smith. In the instant he appeared,<br />

the video shows, 3 shots rang out & the man, Todd Blair, 45, fell<br />

to the floor, dead. The Ogden incident was among a growing<br />

number of no-knock police raids last year, a tactic that has grown<br />

in use from 2,000 to 3,000 raids a year in the mid-1980s, to<br />

70,000 to 80,000 annually, says Peter Kraska, a professor of<br />

criminal justice at Eastern Kentucky University who tracks the<br />

issue. That increase has raised questions about the tactic,<br />

including whether the surprise element poses an unnecessary<br />

threat to people whose residences are invaded. Judges can issue<br />

no-knock warrants when they believe the element of surprise<br />

could help officers avoid danger or keep people from destroying<br />

evidence, Kraska says. Critics say the no-knock tactic gives<br />

residents — some innocent — seconds to decide if they face a<br />

police raid or a home invasion.<br />

members of the Bandidos, a motorcycle gang, & the town’s<br />

nightspots - the Symes Hotel, Fergie’s Pub & the Montana Bar -<br />

have live music scheduled for Saturday night as well. There’s no<br />

number to call for further information, because there’s not anyone<br />

really in charge of anything. It’s just stuff taking place in Hot<br />

Springs this weekend.<br />

Corona officer says she faced retaliation over expose – Feb 20,<br />

police lieutenant said in a claim against the city that she was<br />

denied a promotion, among other retaliatory measures, because<br />

she threatened to tell another law enforcement agency that her<br />

department was allowing an officer to associate with a gang<br />

member while off duty. Kelly Anderson is seeking $750,000 in<br />

damages from the city. She said in the claim that she was also<br />

removed from command of a special-enforcement team, was<br />

punitively transferred ahead of schedule, denied special<br />

assignments & improperly reprimanded. The officer she<br />

complained about was Lt. Brent Coleman, who was on paid<br />

administrative leave for 10 months in 2009-10 during what was<br />

believed to be an investigation into his association with a member<br />

of the Vagos. Coleman eventually left his job under unspecified<br />

circumstances after he rejected the city’s offer of $25,000 to<br />

resign. Anderson is on medical leave, Corona Sgt. Frank Barron<br />

said. The law office representing Anderson, Stone Busailah of<br />

Pasadena, would not say whether her leave is related to her claim.<br />

Anderson could not be reached for comment. Claims are filed as<br />

a first step. Lawsuits usually follow if the claim is rejected.<br />

Man gets probation in vicious 2008 Franklin bar beating – Feb<br />

- A Greenfield man convicted in a vicious Franklin tavern beating<br />

on July 4, 2008, after which the victim died from painkillers & a<br />

sleeping pill was sentenced Monday to probation. Justin<br />

Leszczynski & Daniel Hintz were charged in 2009 with beating a<br />

41-year-old Franklin man at the Irish Cottage, 11433 W. Ryan<br />

Road. Donald L. Sieben, 41, died 3 days later. While police first<br />

considered it a possible murder case, a medical examiner<br />

determined his cause of death was drugs he took for pain & to<br />

sleep after being released from the hospital where he had been<br />

treated for several injuries suffered in the beating. Many people<br />

who saw the attack refused to cooperate or deliberately misled<br />

investigators, police said. Several said they feared retaliation<br />

because the suspects were believed to be part of the Black Pistons,<br />

an affiliate of the Outlaws MC. Police finally brought aggravated<br />

battery charges after they seized boots from the defendants that<br />

matched marks on the victim. Leszczynski, 26, pleaded guilty in<br />

Nov to an amended charge of substantial battery as party to a<br />

crime. On Monday, Milwaukee County Circuit Judge David<br />

Hansher sentenced him to 18 months in prison followed by 2<br />

years of extended supervision, but suspended the sentence in<br />

favor of 3 years of probation. As a condition of the probation,<br />

Leszczynski must serve 5 months at the County Correctional<br />

Facility-South, with work-release privileges. Hansher also<br />

ordered he have no contact with Hintz & not return to the Irish<br />

Cottage. Hintz, 34, of St. Francis, pleaded guilty to the same<br />

amended charge in May, & was sentenced in July to 18 months in<br />

prison & 2 years of extended supervision. He had originally been<br />

charged with aggravated battery & 2 counts of threatening to<br />

injure a witness.<br />

Bikies suspected of prison recruitment drive – Feb 21, 2011 –<br />

officials have banned 3 ‘‘senior members’’ of the notorious Rebel<br />

MC from visiting a Northland prison following allegations they<br />

were trying to recruit members behind bars. Chris Lightbown,<br />

manager of the Northland Regional Corrections facility at<br />

Ngawha Springs, confirmed the ban as fears grow about the<br />

Australian bikie gang’s plans to make a stronghold on this side of<br />

the Tasman. ‘‘The visitor bans were put in place after<br />

information gathered via prisoner telephone monitoring revealed<br />

the gang members were intending to recruit new members from<br />

the prison population,’’ Lightbown said. ‘‘We know gangs take<br />

any opportunity to enhance their portfolio & ability to grow. ‘‘In<br />

prisons they’ve got a captive audience. They target vulnerable<br />

individuals who can be convinced that aligning themselves with<br />

gangs will make their time in prison easier. ‘‘We’re are also<br />

aware they are recruiting out in the community.’’ It is estimated<br />

that close to 30% of the total prison population are associated with<br />

gangs. The Rebel MC are Australia’s largest motorbike gang &<br />

have been linked to methamphetamine distribution, extortion &<br />

serious violence. Lightbown said the Corrections Depart was<br />

‘‘happy’’ to support the multi-agency approach being coordinated<br />

by police which is targeting the Rebels. ‘‘We are<br />

happy to support this by putting a stop to the gang recruiting<br />

prisoners,’’ Lightbown said. ‘‘At the same time the ban means<br />

we are also avoiding the potential danger of having prisoners<br />

affiliate themselves with a gang which can lead to tensions within<br />

the prison environment. ‘‘Anything going on in our prisons that<br />

has an impact on the safety & good order of the prison<br />

environment is something we identify, focus on & stop. ‘‘The<br />

visitor ban is another example of us taking action to ensure the<br />

safety of the public, our staff & the prisoners is maintained.’’<br />

Corrections regulations allow prisons to refuse entry to visitors if<br />

they effect the security, discipline & good order of the prison or<br />

affect the chances of successful rehabilitation. ‘‘We have a clear<br />

vetting process & we have rules that prohibit any form of gang<br />

participation & recruitment,’’ Lightbown said<br />

Bikie to appeal parking fine court ruling – Feb 21, 2011 –<br />

bikie who lost a court challenge over a parking fine issued after a<br />

Sydney protest against controversial anti-association laws says he<br />

will appeal the decision. Greg Hirst, from the Brotherhood<br />

Christian MC, said he also plans to complain to the Police<br />

Integrity Commission over the evidence of an officer during<br />

Monday’s hearing at Sydney’s Downing Centre Local Court. The<br />

original $84 fine was issued after the peaceful protest at NSW<br />

Parliament House in June last year. Members of The Finks, Lone<br />

Wolf, God’s Squad, Black Uhlans & Hells Angels motorcycle<br />

clubs also received tickets. Hirst claimed police gave permission<br />

for the bikies to leave their motorcycles in a no-parking area on<br />

Macquarie St because they were “exercising a democratic right”.<br />

But the officer in charge of the scene, Detective Inspector David<br />

Maguire, denied the allegation in court. Outside court, Hirst said<br />

there was a “clear dispute between Detective Inspector Maguire &<br />

myself as to what discussions transpired at parliament house”. “I<br />

believe there needs to be an investigation as to whether his<br />

evidence was influenced by superiors from within Strike Force<br />

Raptor or from somewhere else within the NSW police Dept,” he<br />

told reporters. He said he had been involved in many political<br />

protests over the past 30 years & police usually either allow<br />

participants to park illegally or suggest they move on. Hirst’s<br />

lawyer Robert Wensley told the court Inspector Maguire “went to<br />

Parliament House that morning anxious to avoid trouble, hoping<br />

to achieve a peaceful outcome”. He said Inspector Maguire had<br />

“made a conscious decision not to give a direction for the people<br />

to move the bikes” because he feared confrontation. However,<br />

Magistrate Alex Mijovich on Monday found Hirst had<br />

“consciously parked there knowing it was a no-parking zone” &<br />

the offence was proven. “There is no exclusion of a person’s<br />

liability because it keeps the peace,” he said. “There is no law<br />

that absolves a person because a police officer doesn’t ask a<br />

person to move.” He ordered Hirst to pay $200 plus $79 court<br />

costs. The cases of a further 23 bikies who are also challenging<br />

their fines are due to be heard on March 1 at the same court. But<br />

Finks sergeant-at-arms `Ferret’ told AAP they were undecided<br />

about whether to proceed following the outcome of Hirst’s case.<br />

He said the United Motorcycle Council would discuss it at a<br />

meeting on Monday night.<br />

Bikie jailed over axe attack – Feb 21, 2011 – Australia – By<br />

Bandidos motorcycle gang is behind bars today after pleading<br />

guilty to terrorizing staff & patrons at a Gold Coast pub with an<br />

axe. John Fahey, 35, of Mermaid Waters, was jailed for 9<br />

months to be released after serving 3 months of the sentence. He<br />

was also banned from attending the Mermaid Tavern or Jupiters<br />

Casino for a year following his release from prison. Fahey<br />

pleaded guilty in the Southport Magistrates Court to going armed<br />

to cause fear, wilful damage & being drunk & disorderly on a<br />

licensed premises. The court was told that on Nov 14, 2010,<br />

Fahey punched a patron at Jupiters Casino after he was<br />

accidentally bumped into. That same day he was evicted from the<br />

Mermaid Tavern but returned 30 minutes later with an axe &<br />

attacked the door.<br />

held services this past weekend for a longtime member, & CBS 5<br />

News was invited to attend the service to see how the group is<br />

trying to change its image. “Because we’ve been in the press so<br />

much lately & it’s all been pretty much negative, we thought we’d<br />

invite you guys out here to see a different side,” Lee Cole,<br />

Phoenix chapter president for the Hells Angels said. For the first<br />

time in club history, news cameras were allowed unrestricted<br />

access to services for Raymond “Boomer” Baker, 70, who died 3<br />

weeks after a motorcycle accident outside Las Vegas. “Boomer<br />

was an Oakland member for 30-something-odd years before he<br />

transferred out to Phoenix,” Cole said. Within the parking lot of<br />

more than 500 were Hells Angels from east to west & several<br />

more from around the globe. But there were also dozens of Rough<br />

Riders, Vultures & Hooligans. “I don’t have family in town,”<br />

said “Solid” with the Deer Valley Hooligans, “but I have a huge<br />

family with the brothers.” Across the street from the handshakes<br />

& hugs, federal agents watched; serving as a reminder into the<br />

troubled past of the Hells Angels. “That patch carries so much<br />

power, weight & so much fear & intimidation,” retired DPS<br />

Officer Steve Trethewy said. Few people know the troubled past<br />

of the Hells Angels like Trethewy -- who headed the Dept’s<br />

outlaw biker unit for 27 years. “Most of them have jobs. You<br />

know, personally, talking to them one-on-one is fine, even as a<br />

law enforcement officer talking to them is fine, but they live by a<br />

different set of rules,” Trethewy said. “I don’t think anybody<br />

could live under the scrutiny we do by the police without having a<br />

few guys get in trouble,” Cole responded. Tears flowed, but no<br />

words were said as friends & family looked over Baker’s custom<br />

coffin. After an hour, it was loaded into a hearse & taken to a<br />

cemetery in Tempe. Despite heavy rains, hundreds of bikers rode<br />

in the procession. “We’re going to give the best send-off we can<br />

& then get together & have a good time,” Cole said. Baker’s<br />

coffin was immediately lowered into the ground, where members<br />

took turns draping the red coffin with mementos. “We were<br />

Boomer’s family & I think people need to see that side of us as<br />

well,” Cole said. The service officially ended with each with<br />

member of the Hells Angels taking turns filling in the grave plot;<br />

a time honored tradition.<br />

killed outside of a Danville bar 7 years ago were awarded a multimillion<br />

dollar judgment. Chad Spires died in 2004 during an<br />

incident outside the now-closed Lowe’s Big Barrel Tavern. He<br />

was hit blindside by Davion Isaac during an argument with Loriel<br />

Williams. The blow sent Spires to the ground where the back of<br />

his head hit the concrete, causing blunt force trauma that led to his<br />

death. Spires father, Bruce Spires, filed a lawsuit in 2005 in<br />

connection with the death against Isaac, Williams, the Big Barrel<br />

Tavern & the Untouchables Motorcycle Club. The Untouchables<br />

MC & Lowe’s Big Barrel Tavern settled in 2006 & 2008<br />

respectively. On Jan. 24, a $2 million judgment was issued<br />

against Isaac & Williams by Vermilion County Circuit Judge<br />

Craig DeArmond. According to press release from Barker Law<br />

Offices, which represented Bruce Spires, the proceeds from the<br />

lawsuit will be held in a trust at a local bank until the children —<br />

all minors — reach 18 years old. After originally being charged<br />

with first-degree murder, Isaac & Williams were both sentenced<br />

in 2004 to 30 months probation on individual charges of<br />

involuntary manslaughter. Within 3 years following the sentence,<br />

both were sentenced to time in the Illinois Dept of Corrections<br />

after violating the terms of their individual probation.<br />

Police seek to destroy gang patches – Feb 21, 2011 – New<br />

Tauranga’s Filthy Few motorcycle gang are able to keep their<br />

patches despite police efforts to have the insignia confiscated &<br />

destroyed. About 14 members of the gang appeared in Tauranga<br />

District Court this morning for sentencing after pleading guilty to<br />

unlawful assembly charges following an ‘altercation’ in Matapihi<br />

on Feb 5. Police prosecutor, Sergeant Sean Brennan, made an<br />

oral application during sentencing that Judge Louis Bidois order<br />

their patches be forfeited & destroyed. “We are seeking a<br />

destruction order for the patches. This is a deliberate act to<br />

intimidate members of the public & the patches are used in that<br />

process,” says Sean. Members of the Filthy Few were involved in<br />

an “altercation” with gang members from the Greasy Dogs in<br />

Matapihi on Feb 5 at about 11.30 am. At sentencing, police were<br />

unable to provide Judge Bidois the exact details of the altercation.<br />

Judge Bidois was left to interpret this himself, which he says<br />

could be a range of acts including revving their motorcycle<br />

engines, verbal abuse, aggressive gestures or assault, although<br />

there was “no indication of that.” He questioned whether it was<br />

the intention of the gang members to intimidate the public on that<br />

day, although he admitted it is possible they went there to engage<br />

in a confrontation with the Greasy Dogs. Judge Bidois denied the<br />

request to have the patches seized but ordered the Filthy Few<br />

members to each pay $500 & court costs. “This is going to cost<br />

the club a fair whack,” says Judge Bidois. Defense lawyer Glenn<br />

Dixon also asked that police return property seized from his<br />

clients after the Feb 5 incident, but that was declined because<br />

Judge Bidois stated he did not have the power to approve that.<br />

Three Notorious bikie gang members charged – Feb 22, 2011 –<br />

members of the Notorious bikie gang face charges after<br />

investigations into the shooting of a high-ranking member in<br />

Sydney’s west last year. State Crime Commands Gangs Squad<br />

detectives arrested the 3 on Tuesday after raiding 5 homes. The<br />

officers had been investigating an attack on a high-ranking<br />

Notorious member who was shot twice in the leg during a driveby<br />

shooting outside a house at Doonside on Nov 29. Police were<br />

also investigating an alleged assault at a cafe in Mount Druitt a<br />

day later. On Tue, police raided 5 homes in Abbotsford,<br />

Blacktown, Greenacre, Granville & Fairfield Heights, seizing<br />

clothing, mobile phones, more than $13,000 cash, a H-D<br />

motorcycle & prohibited drugs including steroids. About 6.30<br />

am, a 23-year-old man was arrested at the Abbotsford home &<br />

later charged with affray & armed with intent. A 23-year-old<br />

Blacktown man went to Merrylands Police Station where he was<br />

charged with affray & assault occasioning grievous bodily harm<br />

with intent. A third man, aged 30, was arrested about 7.45 am at<br />

the Greenacre home & later charged with breach of bail offences<br />

& refused bail to appear at Penrith Local Court on Friday. Police<br />

allege all 3 men are members of the Notorious outlaw criminal<br />

group. The Abbotsford man has been granted conditional bail to<br />

appear at Burwood Local Court on March 10 while the Blacktown<br />

man has been granted conditional bail to appear at Fairfield Local<br />

Court on March 16.<br />

Ban gang patches in our town – Feb 22, 2011 – New Zealand –<br />

cop is asking the council to consider banning gang patches in the<br />

city. In a report to the Whangarei District Council, Whangarei<br />

police area commander Inspector Paul Dimery said Northland was<br />

seen as a “cash cow” by gangs, particularly around the<br />

manufacture & distribution of methamphetamine. He said it was<br />

“time to be brave & put a mark in the sand”. He wants the<br />

council to give consideration to a bylaw banning gang patches.<br />

The report is to be discussed at a district council meeting<br />

tomorrow. “I believe that the council can send out a clear<br />

message that these criminal enterprises are a scourge on our<br />

community; they are unwelcome & they contribute nothing to a<br />

healthy society,” Dimery’s report says. He goes on to say gangs<br />

are criminals banding together to carry out criminal offending.<br />

Over the past month, members of the Australian gang the Rebels<br />

MC have been “patching over” members of the Tribesmen gang.<br />

A police operation saw 6 Northland men - with links to the Rebels<br />

- arrested in relation to drugs & firearms offences. Dimery said<br />

the introduction of the Rebels had created some tension between<br />

ownership of the “patches” & the Rebels were interested in setting<br />

up business in Whangarei. “The council can send out a clear<br />

message to these groups by ensuring legal compliance with any<br />

premises they own,” his report says. That would include any<br />

illegal fortification of any “pads” or modifications to any premises<br />

bought for a gang pad. Whangarei Mayor Morris Cutforth said<br />

the council would decide what action if any would be taken. “A<br />

bulk of Whangarei citizens are not gang-friendly & so any move<br />

to outlaw them will probably be welcomed by most people,”<br />

Cutforth said. However, Denis O’Reilly, the Hawke’s Bay-based<br />

Black Power spokesman & life member, questioned whether<br />

banning gang patches was actually effective. He said there was<br />

no evidence the banning of patches had seen a drop in the number<br />

of gang members or a decrease in crime. The Hells Angels had<br />

challenged the Wanganui bylaw in the Supreme Court saying it<br />

breached human rights, O’Reilly said. “Let’s see what the<br />

Supreme Court comes out with in the Wanganui case. “It’ll be<br />

interesting. “Why put the citizens & ratepayers of<br />

Whangareithrough legal costs & all that stuff?” O’Reilly said<br />

there were plenty of laws that gave police the power to arrest any<br />

gang members gathering & acting in an intimidating way. “I<br />

don’t condone inexcusable behavior. “It’s more about behavior<br />

rather than what they wear.”<br />

Jury finds James Salkil guilty of kidnapping – Feb 22, 2011 –<br />

faces a mandatory life sentence in connection with the brutal<br />

beating of Anthony McFarland, who was dumped in a ditch in<br />

rural Davenport on March 11, 2010. Even after a Scott County<br />

jury found Salkil guilty of first-degree kidnapping Monday<br />

morning, questions remain why he & 2 others committed the<br />

crime. “Salkil has this club, & he’s the boss,” prosecutor Jerry<br />

Feuerbach said following the verdict. “He makes the rules. He<br />

thinks he’s the godfather.” Feuerbach, recalling testimony at<br />

Salkil’s week-long trial, said McFarland, 20 years old at the time,<br />

was “acting up” & “wouldn’t be quiet” when the victim was<br />

celebrating Salkil’s 35th birthday with Nathan Johnson &<br />

Benjamin Border the night before he was found in the ditch. In the<br />

early morning hours of March 11, the 4 went back to Salkil’s<br />

Davenport home to continue partying. According to Border’s<br />

testimony, Salkil hit McFarland in the head numerous times with<br />

an aluminum baseball bat in his living room. The victim was then<br />

stuffed into the trunk of Border’s car, driven to a secluded part of<br />

the city & left for dead beside Utah Ave. “It was up to the<br />

defendant to handle things,” Feuerbach said of Salkil. Testimony<br />

revealed that Salkil was “captain” of a local motorcycle club<br />

called “Pirates Corp.” Border & Johnson also were members. An<br />

investigation determined the suspects were involved in a largescale<br />

marijuana distribution conspiracy in Davenport around the<br />

time the beating occurred. The same day McFarland was found,<br />

police seized approximately 12 pounds of marijuana, packaging<br />

materials, travel documents & $12,354 from Salkil’s home.<br />

Feuerbach said there is no indication McFarland was in a dispute<br />

with the suspects over money or drugs. Salkil did not testify in<br />

his defense. The only explanation Border gave during his<br />

testimony as to why Salkil struck McFarland is because the victim<br />

had argued with Johnson & another friend, Charles Ray, that<br />

night. Ray testified that he & McFarland “got into it” when the<br />

group was at Tuxedo’s Show Club, a strip club on Grand Ave.<br />

Border, 25, & Johnson, 29, each pleaded guilty last year to the<br />

lesser charge of third-degree kidnapping & are serving 24-year<br />

prison sentences. Salkil’s jury had the option to convict him of<br />

third-degree kidnapping or false imprisonment. After a few hours<br />

deliberating Friday afternoon & Monday morning, the jury<br />

returned a guilty verdict on first-degree kidnapping, which carries<br />

a mandatory life sentence in Iowa. The jury also convicted him on<br />

simple assault & assault resulting in serious injury. “Overall the<br />

most important piece of evidence were various phone records,”<br />

Feuerbach said. Data from cell phone towers had Salkil making<br />

calls along the route to the dump site in the hours before<br />

McFarland was found. His defense claimed Salkil wasn’t with<br />

Border & Johnson when they dumped McFarland. Defense<br />

attorney Dave Morrison also tried to have the first-degree<br />

kidnapping charge dropped, saying McFarland didn’t suffer<br />

serious injury while he was being transported in the trunk of<br />

Border’s car. Morrison declined to comment Monday about the<br />

verdict. “You have a person who clearly suffered a severe head<br />

injury,” Feuerbach said. “These people wrap him up, pick him up<br />

& haul him out. “They take the person away in the trunk of a car.<br />

They bounce him around for 15 or 20 minutes & then dump his<br />

body alongside a road on a cool morning in March. “The jury<br />

could find, & obviously did, that that also caused serious injury.”<br />

McFarland, who now is 21, suffers permanent brain damage<br />

because of what happened, he testified at Salkil’s trial. He’s still<br />

undergoing surgery 11 months later. Salkil’s family has turned<br />

down several requests to be interviewed. Salkil is scheduled to be<br />

The guys were all at a deer camp. No one wanted to room with<br />

Bob, because he snored so badly. They decided it wasn’t fair to<br />

make one of them stay with him the whole time, so they voted to<br />

take turns. The first guy slept with Bob & comes to breakfast the<br />

next morning with his hair a mess & his eyes all bloodshot. They<br />

said, “Man, what happened to you? He said, “Bob snored so<br />

loudly, I just sat up & watched him all night.” The next night it<br />

was a different guy’s turn. In the morning, same thing, hair all<br />

standing up, eyes all bloodshot. They said, “Man, what happened<br />

to you? You look awful! He said, ‘Man, that Bob shakes the roof<br />

with his snoring. I watched him all night.” The third night was<br />

Fred’s turn. Fred was a tanned, older cowboy, a man’s man. The<br />

next morning he came to breakfast bright-eyed & bushy-tailed.<br />

“Good morning!” he said. They couldn’t believe it. They said,<br />

“Man, what happened?” He said, “Well, we got ready for bed. I<br />

went & tucked Bob into bed, patted him on the butt, & kissed him<br />

good night. Bob sat up & watched me all night.”<br />

I’m sick to death of people knocking on my door looking for<br />

donations. Just had one from the sperm bank. Boy, did I give her<br />

a mouthful.

place to test Balance.” “Balance?” Inquired Michael, “I’m still<br />

confused.” God explained, pointing to different parts of Earth.<br />

“For example, northern Europe will be a place of great<br />

opportunity & wealth, while southern Europe is going to be poor.<br />

Over here I’ve placed a continent of white people, & over there is<br />

a continent of black people. Balance in all things.” God<br />

continued pointing to different countries. “This one will be<br />

extremely hot, while this one will be very cold & covered in ice.”<br />

Then Archangel, impressed by God’s work, then pointed to a land<br />

area & said, “What’s that one?” “That’s Minnesota, the most<br />

glorious place on earth. There are beautiful mountains, rivers &<br />

streams, lakes, forests, hills, & plains. The people from<br />

Minnesota are going to be handsome, modest, intelligent, &<br />

humorous, & they are going to travel the world. They will be<br />

extremely sociable, hardworking, high achieving, carriers of<br />

peace, & producers of good things.”<br />

Michael gasped in wonder & admiration, but then asked, “But<br />

what about balance, God? You said there would be balance.”<br />

Members of the area’s new Rolling Thunder chapter don’t want to<br />

alarm anyone when they hit the streets. “We’re not a motorcycle<br />

gang & we’re not a motorcycle club,” explained Daren Bowen,<br />

vice president of the group. “We support POW, MIA & veterans’<br />

causes. When people see us coming down the road, we want<br />

them to know what we’re about.” Bowen, a National Guard<br />

recruiter, said he’s been involved with a Rolling Thunder chapter<br />

in Glasgow and, after seeing the influence the group had on that<br />

community, “I wanted that same impact in my own community.”<br />

While most Rolling Thunder members ride motorcycles & many<br />

are veterans, neither is required for membership. “You just have<br />

to support the cause,” Bowen said. The Rolling Thunder Chapter<br />

3 in Bowling Green got its charter in Jan & Bowen said it has<br />

about 35 members. “Now that we’ve got it going, we really want<br />

to get the word out,” Bowen said. “We’re just excited about the<br />

opportunity that’s here in Bowling Green.” Rolling Thunder is a<br />

national organization with more than 88 chapters across the<br />

United States. The nonprofit organization began in 1987 when 2<br />

Vietnam War veterans in New Jersey met to discuss their<br />

concerns about unresolved prisoner-of-war & missing-in-action<br />

cases. They were troubled by the lack of attention given to the<br />

soldiers whose fate was unknown. The men organized a gathering<br />

in Washington, D.C., on Memorial Day weekend in 1998, &<br />

about 2,500 motorcycles converged on the Capitol that year. The<br />

event is now known as the Ride for Freedom & has grown to an<br />

estimated 900,000 participants. While the Ride for Freedom is<br />

Rolling Thunder’s biggest national event, chapters throughout the<br />

country work to be a positive force in their communities<br />

throughout the year. “Rolling Thunder does so much,” Bowen<br />

said, describing how the Glasgow chapter recently bought<br />

materials & built a ramp for a handicapped veteran there & how<br />

members take gifts to hospitalized children. The chapter hosts<br />

fundraisers such as rides & chili suppers. All money raised goes<br />

to help veterans. Doug Medlock, chapter secretary, said he hopes<br />

the group can offer support to local veterans. “It lets them know<br />

that there’s a group of people out there who really care about their<br />

issues,” Medlock said. Art White of Bowling Green is not a<br />

veteran but is a member of the new Rolling Thunder chapter. “I<br />

want to support our veterans,” White said. “I hope it improves<br />

some of the veterans’ lives.” For Todd Partain, who is a veteran,<br />

the Rolling Thunder organization is a great way to combine 2<br />

things he loves: the military & motorcycles. “It’s an awesome<br />

cause to be riding & standing for,” Partain said. Bowen said<br />

anyone who is interested is welcome to come by for a meeting or<br />

to call him. Organizers are looking forward to growing the chapter<br />

& inviting veterans, non-veterans, men, women, couples & people<br />

all ages to join them. “It’s really a great organization,” Partain<br />

said. “Hopefully, we’ll get rolling & do a lot for our community.”<br />

Martin says biker club killed Gibson – Feb 23, 2011 – Ohio –<br />

2007-08, murder suspect Michael Martin provided info to state<br />

officials about the Outlaws MC. Larry Ward Jr., a special agent<br />

with the state ATF, testified Tue afternoon in Erie County<br />

Common Pleas Court that he met with Martin about 5 times. He<br />

said he also talked with Martin on the phone several times during<br />

a 3-month period that winter. Their conversations ended when<br />

Martin told Ward he had been asked, & was considering,<br />

becoming a probationary member of the Outlaws. Martin now<br />

blames the Outlaws bike club for the death of Amanda Gibson.<br />

While Martin, 54, is on trial for Gibson’s 2010 strangling death,<br />

Martin’s atty points the finger at the Outlaws, saying they were<br />

after Martin because he refused to join their club & because he<br />

was considered a snitch for the Gov’t. “I told him we could not<br />

work with him,” Ward testified. Martin’s atty, Joseph Patituce,<br />

has said Gibson was preparing to move back home to New Jersey.<br />

His client has said he picked Gibson up at her Lawrence Street<br />

apartment in Sandusky & took her to his 903 2 nd St. home to<br />

collect items she’d stored in his garage. Leaving her in the<br />

garage, Martin went into his house to bathe, getting ready for an<br />

appointment with Dr. Robert Daniels, a psychiatrist on West<br />

Bogart Road. Not an hour later, Martin peeked into the garage &<br />

saw Gibson dead on the ground, Patituce said. Martin saw a truck<br />

with 3 occupants driving away. Inside the truck, he said, were<br />

people Martin recognized as members of the Outlaws bike club.<br />

Prosecutor Kevin Baxter has maintained Martin strangled Gibson<br />

on June 7 in his garage & dumped her body along a path leading<br />

back to a pond in Groton Township. Martin denied to detectives<br />

he had any role in Gibson’s death, but later admitted in a letter to<br />

his girlfriend Tami Bollinger that he moved Gibson’s body. That<br />

letter, along with hundreds of other documents, were seized from<br />

Martin’s jail cell & from Bollinger’s home.<br />

me, & I was a bit surprised myself. You know, he’s only been<br />

there twice in the last 4 years. Once he fell asleep, & the other<br />

time I had to pull him by the ears to make him come.’


Pair turn informants, guilty in homicide cases – Feb 23, 2011 –<br />

Two brothers from Nova Scotia became police informants late last<br />

year & have supplied information involving 3 Montreal-area<br />

homicides. Robert Simpson, 48, & his brother Shawn Simpson,<br />

45, appeared before Superior Court Justice André Vincent Tue<br />

morning at the Montreal courthouse & entered guilty pleas to 3<br />

counts of 1 st -degree murder. According to the court documents<br />

filed when they pleaded guilty, both men have agreed to testify in<br />

other cases related to the 3 murders. They admitted to taking part<br />

in the Jan. 24, 2010, deaths of Kirk Murray & Antonio Onesi. The<br />

men were shot to death while they waited outside a car in the<br />

parking lot of a McDonald’s restaurant. The brothers were<br />

arrested months after the double-murder along with Jeffrey Lynds,<br />

42, a former member of a Hells Angels chapter in Nova Scotia.<br />

Police sources have told The Gazette in the past the slayings<br />

probably were tied to a drug deal that went bad. The brothers<br />

also pleaded guilty to a murder they had yet to be charged with<br />

until Tue. The victim, Mark Stewart, disappeared from the South<br />

Shore in Feb 2010 & his body was later found months later.<br />

According to documents filed in court, the brothers began making<br />

statements about all 3 murders in Nov & took polygraph tests on<br />

Nov. 16. The Montreal police have paid more than $7,000 &<br />

$5,000 to cover the cost of the older brother & younger brother’s<br />

meals & medication since Nov. 2. Their contracts call for further<br />

payments down the road. For example, they will be paid monthly<br />

installments of $50 each for the duration of their detention. They<br />

will also be paid $3,500 for “the expenses of an academic<br />

formation or post-secondary studies.” Both men were sentenced<br />

to life sentences & are eligible for parole after they serve at least<br />

25 years. Sabin Ouellet, the prosecutor who handled the guilty<br />

pleas, told Vincent that the murders were ordered by someone<br />

else, but he held back on naming the person. But it has become<br />

apparent someone has been providing the police with evidence<br />

involving Lynds. In Dec, the former Hells Angels was named,<br />

but not charged as being responsible for a long unsolved murder<br />

in Nova Scotia.<br />

& rode up to Leppington for the service. More than 1000 people<br />

turned out to honor Bartosik who died at the age of 63. Club<br />

member Trevor said Bartosik had been with the club for 42 years.<br />

“He was a staunch & loyal member to the day until he passed<br />

away due to ill health,” Trevor said. “He was one of the original<br />

members when the club started in 1969 & has been there for all<br />

those years. He was an old-school bikie.” Trevor said mourners<br />

travelled from across the world to attend the funeral. “There were<br />

hundreds Gypsy Joker members coming from all over the country<br />

& the world to farewell him. He will be sadly missed.”<br />

Bandidos Arrested In Hondo Drug Roundup – Feb 25, 2011 –<br />

investigation into the Bandidos motorcycle gang has resulted in at<br />

least 10 arrests on Wednesday in California, San Antonio &<br />

Hondo, Texas, federal, state & local enforcement announced at a<br />

joint news conference on Friday. They also said an assortment of<br />

drugs, weapons & cash were seized. Mauricio Fernandez,<br />

assistant DEA special agent in charge in San Antonio, said over<br />

the past year, the Bandidos had sold an estimated $600,000 worth<br />

of methamphetamine that was 98 to 100 percent pure & was<br />

supplied by Mexican drug cartels, as well as cocaine smuggled in<br />

from California. He said the drugs were hidden inside motorcycle<br />

parts that also were used to conceal the cash proceeds. He said<br />

shipments were made every 2 weeks to & from California. He<br />

said a total of 18 members of the Bandidos have been arrested<br />

since last Nov, when there was a similar roundup. Fernandez said<br />

they face criminal conspiracy & drug charges that carry possible<br />

sentences of 10 years to life in prison. Fernandez said the alleged<br />

operation also involved money laundering. The Internal Revenue<br />

Service was among the federal, state & local law enforcement<br />

agencies who joined forces with the city of Hondo. “Take the<br />

money. Take the assets. Take the drugs & cripple them,” said<br />

Hondo Police Chief John Martinez. He said his Dept & his<br />

community had always been aware of the Bandidos presence in<br />

Hondo. “Some of them are residents of Hondo,” said Mayor Jim<br />

Danner. “Being on Hwy 90 between the border & San Antonio,<br />

we have a drug problem,” Danner said. The mayor said he was<br />

proud of his police chief. “He has a great Dept, small but very<br />

effective,” Danner said.<br />

Ex-motorcycle club leader gets prison – Feb 25, 2011 –<br />

former Nat’l VP of the Pagan’s MC was sentenced Friday to 4<br />

years & 9 months in prison for his Fed racketeering conviction.<br />

Floyd “Jesse” Moore showed no emotion when U.S. District<br />

Judge Thomas Johnston announced the sentence, which included<br />

a $3,000 fine. Moore would also serve 3 years of supervised<br />

release after he gets out of prison. Moore, 65, pleaded guilty in<br />

Dec 2009 to charges involving conspiracy to kill a woman &<br />

participating in illegal raffles. The murder was never carried out.<br />

Moore’s attorney, James Earhart, noted that Moore had<br />

cooperated with prosecutors, was no longer involved in the outlaw<br />

biker gang. He said Moore also had adamantly discouraged drug<br />

use within the club, is devoted to his children & involved in<br />

community projects such as Toys for Tots, among other things.<br />

However, Johnston said, “this sentence needs to deter others for<br />

racketeering & violence.” The sweeping Fed racketeering case<br />

brought in Oct 2009 targeted dozens of Pagan’s leaders &<br />

associates from West Virginia, Maryland, New Jersey & several<br />

other states. Many of the charges detailed violent efforts to<br />

intimidate & extort smaller biker gangs & clubs, & illegal<br />

gambling centered on raffles for nonexistent motorcycles. Other<br />

crimes involved drug dealing & weapons violations. Federal<br />

prosecutors alleged threats were carried out in order to consolidate<br />

the club’s power in the eastern United States. “I’ve been with this<br />

case for a long time now,” Johnston told Moore. “I have no<br />

illusions you were the center at most if not all of this case. “You<br />

are clearly intelligent, strong willed ... there’s no question in my<br />

mind that you were firmly in control of this organization. I’ve<br />

seen the fear that presents itself with those that failed to follow<br />

your instructions.” David Keith Barbeito, the club’s former Nat’l<br />

Pres, was sentenced in Dec to 2 & 1/2 years in prison on weapons<br />

& racketeering charges. He was the lead defendant in the Govt’s<br />

case against the biker gang & left the club’s top spot after his<br />

arrest. Charges against many of the out-of-state defendants were<br />

dismissed in exchange for guilty pleas to state misdemeanor<br />

gambling charges. One defendant died of natural causes while in<br />

custody. Moore had been confined to his St. Albans home with<br />

electronic monitoring since Sept after being jailed for 11 months.<br />

Johnston declined a defense request that Moore’s sentence be<br />

reduced by the time he spent at home.<br />

Family Hopes For Clues In Case of Woman Missing Since<br />

1999 – Feb 25, 2011 – Clermont County, Ohio - The case of<br />

Sharon Apgar is still open & active, nearly 11 years since her<br />

disappearance. Donna Penker said not a day goes by that she<br />

doesn’t think about her big sister. Her grief is compounded<br />

because the family has no closure, & no place to grieve.<br />

Detectives believe Apgar was murdered, but they still don’t know<br />

what happened to the young mother. The last time anyone saw or<br />

heard from her was in Nov 1999, at a Fort Mitchell hotel. She told<br />

a friend she was going to meet her ex-husband, a member of the<br />

Iron Horsemen motorcycle gang. Thanksgiving came & went.<br />

Family members like Penker, who talked to Apgar on a daily<br />

basis, got worried, & filed a police report. Lori Saylor, an<br />

investigator with the Clermont County Sheriff’s Office, was<br />

handed the case. She said she’s come to know a person she’s<br />

never met. “She just literally disappeared & that’s not like her.”<br />

Saylor has interviewed dozens of people, & she’s kept meticulous<br />

notes. However, speculation still surrounds the case, as the people<br />

who likely know what happened won’t come forward. “If we<br />

could just figure out a way to get around that fear with people, I<br />

feel this case could be easily solved & we could find her,” she<br />

said. They’ve had dozens of phone calls, rumors, & “tips” about<br />

what may have happened to Apgar. “Everything from strangled to<br />

dismembered to thrown in a well to a drug overdose, so quite<br />

honestly, all of those are possible,” Saylor said. All are possible,<br />

& none of them are substantiated. Family & friends say Apgar<br />

had hit a low point in life. She was surrounded by volatile<br />

relationships. Just when it couldn’t get worse, Apgar discovered<br />

she was pregnant. Penker said her sister was struggling. “She was<br />

living in a lot of fear, very confused, & not real well, I’d say, not<br />

well.” Penker has done her own research. She traced Apgar’s last<br />

steps & wonders about members of the Iron Horsemen. She knew<br />

her sister was running with the wrong crowd. “I think she’d been<br />

around it for a very long time. It’s just not something you walk<br />

away from quietly,” she said. Penker said she hopes her sister’s<br />

case will remain in the public eye, maybe encourage someone to<br />

come forward. “I think it’s time & I hope that somebody believes<br />

it’s time that we put her where she needs to be .” New technology<br />

has helped move the investigation along. A new federal database<br />

called NAMUS, or the NAtional Missing & Unidentified persons<br />

System, has Apgar’s DNA on file. It’s already been compared in<br />

9 different cases, but none of them matched the missing mom.<br />

Two Hells Angels jailed – Feb 25, 2011 – Canada - By Dean<br />

caught up in an undercover sting targeting organized crime have<br />

been sentenced to 38 months in prison. Shane Kirton, 42, &<br />

Anthony McLennan, 36, pleaded guilty to participating in a<br />

criminal organization. Kirton & McLennan were among 35<br />

suspects arrested in 2009 & 2010 as part of Project Divide. As in<br />

similar stings, police used a paid criminal agent, Zig-Zag Crew<br />

member Michael Satsatin, to trap targets. Court heard police<br />

surveillance captured Kirton & McLennan accepting dues<br />

payments for the Zig-Zag Crew, the so called “puppet club” of the<br />

Manitoba Hells Angels. “The money supply allows the (Hells<br />

Angels) chapter to grow & grow over time,” said Crown attorney<br />

Chris Mainella. Kirton & McLennan each received 8 months<br />

credit for time served. Justice Glenn Joyal ordered that they serve<br />

half of their remaining sentence before they are eligible for parole.<br />

Judge denies motions to dismiss & remand in Hells Angels<br />

Yavapai County Superior Court Judge Celé Hancock denied<br />

motions this past week filed by lawyers for 2 men charged in<br />

connection with a shootout between the Hells Angels & Vagos<br />

motorcycle gangs in an unincorporated area northwest of Chino<br />

Valley on Aug. 21, 2010. Hancock denied a motion to dismiss the<br />

case filed by James O’Haver, attorney for Larry Dean Scott Jr., &<br />

also denied a motion filed by Richard Gaxiola, attorney for<br />

Michael Trevor Koepke, to send the case back to the grand jury to<br />

redetermine probable cause. O’Haver wrote in his motion to<br />

dismiss the case filed on Jan. 1, 2011, that the state failed to<br />

apprise grand jurors of all necessary laws, & interfered with the<br />

performance of their duties by selective presentation of witness<br />

statements. In response, Deputy Yavapai County Attorney Dana<br />

Owens noted the grand jury had already been apprised of relevant<br />

laws when Scott & other defendants’ cases were brought before<br />

them. “To allege Scott’s case should be dismissed because (two<br />

statutes) were not read in their entirety to the grand jury is no<br />

more than a deliberate defense ploy to confuse the issues at hand,”<br />

Owens wrote. Owens also wrote that charges were filed after<br />

careful review of everything that happened that day & not based<br />

solely upon information from witnesses.<br />

Hells Angels’ deadly enemy moves in – Feb 27, 2011 –<br />

Mongol MC - a vicious southern Californian outlaw bikie gang<br />

that is the sworn enemy of the Hells Angels - is setting up in<br />

Sydney. In the US, Mongols are under instructions to kill Hells<br />

Angels on sight. They also have a reputations for shooting at &<br />

blowing up police stations. The Mongols set up a six-member<br />

chapter on the central coast in December & plan another chapter<br />

in Sydney, gang squad police sources say. They fear it will add to<br />

tensions between the Hells Angels, Comanchero, Nomad &<br />

Notorious bikie gangs over control of the drug trade & protection<br />

rackets. Mongol Nation, as it is also known, was formed in 1969<br />

by Hispanic Vietnam War veterans who were refused entry to the<br />

Hells Angels because of their race. There are chapters in Mexico,<br />

New Zealand, Germany & Italy.<br />

Hells Angel jailed over police shooting – Feb 27, 2011 –<br />

Germany – By www.theLocal.de - A member of the Hells Angels<br />

biker gang was sentenced to 9 years in prison by a Koblenz court<br />

Monday for killing a police officer. The district court in the state<br />

of Rhineland-Palatinate declared the 44-year-old from Anhausen<br />

guilty of manslaughter, coercion, & attempted extortion. On<br />

March 17, 2010 the man fired 2 shots through the closed door of<br />

his home, hitting a 42-year-old police officer, who was killed.<br />

The member of the special police force had been trying to open<br />

the door to conduct a search with another colleague as part of a<br />

larger investigation of the Westerwald region’s red light milieu.<br />

The coercion & attempted extortion charges against the defendant<br />

came in connection with this investigation. During the trial the<br />

defendant admitted to shooting through the door, but maintained<br />

he did not know a police officer was on the other side. Instead he<br />

believed he was being threatened by member of rival biker gang<br />

the Bandidos, he said. This claim prompted state prosecutors to<br />

downgrade their original charge of murder to manslaughter,<br />

bringing the maximum sentence down to 9 years from 12. The<br />

defence plead for the biker to be pardoned because he acted in<br />

self-defence & was the result of a “chain of unhappy<br />

circumstances.”<br />

gangs. It could be the most significant event since the<br />

dead. ‘‘We’ve had small numbers move around before but this<br />

number is unheard of,’’ a senior law enforcement source told The<br />

Sun-Herald. The underworld has been abuzz since a deal,<br />

apparently months in the making, was cemented 11 days ago.<br />

Between 50 & 60 men left the Bandidos & joined the Hells<br />

Angels. It is understood the deal was organized by Felix Lyle, a<br />

rising force within the Angels & a former Bandido. Offers to<br />

defect & join the Angels were also made to other clubs. Leaving<br />

one club for another is considered the most serious of<br />

transgressions & often leads to outbreaks of violence. It is<br />

believed the main motive for the deal was to bolster Angels<br />

numbers to provide a strong front against the Comanchero. It<br />

may also be in response to the establishment of a chapter of<br />

another traditional Angels foe, the Mongols, on the central coast.<br />

The clubs have been feuding since a Hells Angels tattoo parlor<br />

was firebombed by the Comanchero in 2008. The fatal airport<br />

brawl of March 2009 & subsequent shooting of Hells Angels<br />

member Peter Zervas were allegedly results of that. It is<br />

understood Bandidos were paid to defect & all were granted full<br />

membership, which usually takes at least a year. Some got H-D<br />

motorbikes as a reward. Last week the Bandidos announced on<br />

their website: ‘‘Chapter Parramatta is no longer part of the<br />

Bandidos MC Australia!!!’’ The defection rumors were<br />

confirmed on Friday when Strike Force Raptor officers watched<br />

20 to 30 former Bandidos meet at a Parramatta restaurant.<br />

Wearing Hells Angels T-shirts & other club gear, they were<br />

joined by several senior Hells Angels. A law-enforcement source<br />

who has investigated outlaw clubs for decades said: ‘‘If it was just<br />

one chapter that would be one thing but what’s strange here is it’s<br />

bigger than that.’’ Police are concerned that the move also<br />

mirrors recent action in Europe. Last year 80 Bandidos defected<br />

to the Berlin Hells Angels. The defections are indicative of a<br />

remarkable morphing of Australia’s outlaw clubs. They have<br />

moved up several notches to form formed links with international<br />

syndicates suspected of organized crime. Some bikies are also<br />

involved in multimillion-dollar property developments with loans<br />

from Australia’s top banks. The Hells Angels have at least<br />

doubled their size overnight. With at least 110 members they are<br />

now the third-largest outlaw club in NSW, after the Comanchero<br />

& the Rebels. In June police asked the NSW Supreme Court to<br />

declare the Hells Angels a criminal organization. But a source<br />

said the defectors ‘‘couldn’t care less. What do you think they<br />

really think about - getting a shitload of money or worrying about<br />

the cops arresting them in a week?’’ The Pres of the new Hells<br />

Angels Parramatta chapter, former Bandido Mostafa Jouayde, was<br />

refused bail in Parramatta Local Court yesterday for allegedly<br />

breaching bail conditions that he not enter the Parramatta CBD<br />

except to work at his tattoo shop.<br />

Authorities Concerned About Bad Blood Between Mongols,<br />

to expand their chapter here. The official website of the Mongol<br />

Nation portrays its members as reasonable, likable guys. The<br />

group, founded 40 years ago by Hispanic Vietnam veterans, even<br />

tries to be politically correct. However Spokane Police Chief<br />

Anne Kirkpatrick says both the Mongols & Hells Angels are more<br />

criminal enterprises than fun loving clubs. “The enterprise they<br />

are involved in are drugs, weaponry & prostitution, & those will<br />

corrode the fabric of any community,” Chief Kirkpatrick said.<br />

Kirkpatrick says the opportunity to expand those illegal<br />

operations in the area may be why Mongol recruiting is on the rise<br />

in Spokane. The group was spotted wearing their colors in<br />

Sprague Ave bars 2 weekends ago & rival Hells Angels chapter<br />

members showed up to defend their territory. “We had between<br />

20 & 30 gang members from 2 rival gangs that were congregating<br />

downtown & we received a telephone call & took immediate<br />

action to bolster our presence,” Kirkpatrick said. While the<br />

Spokane P.D. shifted all available officers from around the city to<br />

the bars where the Mongols & Hells Angels were facing off, the<br />

Spokane County Sheriff’s Office shifted some of its deputies to<br />

cover outlying areas around the city until the situation between<br />

the 2 motorcycle clubs was resolved. The bad blood between the<br />

Mongols & Hells Angels goes back many years. In 2002 the<br />

gangs clashed during the Laughlin River Run. A fight inside<br />

Harrah’s Laughlin Casino between the Mongols & Hells Angels<br />

left 3 dead & 13 injured. Chief Kirkpatrick & Sheriff Ozzie<br />

Knezovich don’t want that type of violence to spill over into<br />

Spokane County. “We’re not going to make Spokane a place<br />

where any of this can breed. We’re going to make Spokane the<br />

safest city of our size in America,: Kirkpatrick said. If the<br />

Mongols are trying to recruit in Spokane, they’re working against<br />

a deadline. “Smilin’ Rick” Fabel, the Pres of the local chapter of<br />

the Hells Angels, has been in federal prison since 2007 but is<br />

scheduled to be released next year. Once Fabel is released, the<br />

Mongols may find it a lot tougher to move in on Angels territory.<br />

Biker Gang Resurfaces In Stabbing – March 1, 2011 – New<br />

Stabbing Sends 4 To Hospitals… A man is stabbed 20 times in<br />

downtown Albuquerque after, police said, he started a brawl<br />

outside a strip club. Albuquerque police said they are more<br />

concerned with a biker gang the man is connected with. Police<br />

said the instigator, Ervin Halmayr, & his friend admitted they are<br />

members of the Banditos biker gang that has been around the city<br />

for a long time. Investigators said the gang has been quiet for<br />

several years, & now that one of the members is behind bars,<br />

authorities are worried his fellow gang members could retaliate.<br />

Albuquerque police swarmed Knockouts at 3 rd St & Central Ave<br />

late Mon night after a bloody fight in the club’s back alley landed<br />

4 people in a hospital. Police said Halmayr & his friend attacked<br />

2 brothers leaving the club. A police report said Halmayr threw a<br />

bottle at them & pulled out a knife to attack the men. But one of<br />

the brothers grabbed the weapon & stabbed Halmayr 20 times in<br />

self-defense, police said. Police said Halmayr was arrested in<br />

connection with the incident, but they still have a lot of questions<br />

about the case. Police said the biker gang’s members don’t<br />

typically go downtown, & their crimes haven’t been frequent.<br />

“I’m not aware of anything they’ve been involved in recently or<br />

that we’ve come across,” said Trish Hoffman, of the Albuquerque<br />

Police Dept. Hoffman said they are still investigating if the<br />

incident was gang-related or an isolated incident. Police said all 4<br />

men were treated at hospitals across Albuquerque. Halmayr was<br />

taken to the Metropolitan Detention Center & was facing a<br />

number of charges, including aggravated battery with great bodily<br />

harm.


Hells Angels’ bench dis-barred – March 1, 2011 – New York –<br />

just been benched. After bizarrely installing a metal bar across<br />

the bench outside its East Village headquarters to keep tourists off<br />

it, the Hells Angels -- pressured by city transportation bigs -- have<br />

now removed the barrier. The city cracked down on the club<br />

after The Post recently publicized its efforts to keep pedestrians<br />

off its pew, said the Angels’ lawyer, Ron Kuby. Only members<br />

had been given keys to unlock the bar so they could sit down.<br />

Dept of Transportation officials noted that the bench was on city<br />

property & the organization would now need a permit for it, Kuby<br />

said. A DOT spokesman said the 2 sides are trying to work out a<br />

solution to keep the bench.<br />

High ranking Bandido member arrested for firearm offences<br />

Strike Force Raptor officers have arrested a high-ranking Outlaw<br />

Motorcycle Gang member, as well as an associate & a woman for<br />

alleged firearm & drug related offences. About 7 pm (Feb 28,<br />

2011), Strike Force Raptor officers executed a search warrant at a<br />

residential premise at Daphne Place at Lalor Park. During the<br />

warrant police located & seized a sawn off .22 calibre rifle, 2<br />

firearm magazines, ammunition, a bullet resistant vest, a police<br />

uniform patch, a flick knife, a pair of stolen number plates, as well<br />

as Bandido clothing & paraphernalia. A 52-year-old man, an<br />

alleged high-ranking member of the Bandido OMCG, was<br />

arrested at the scene & taken to Blacktown Police Station &<br />

charged with possessing a shortened firearm/ammunition/police<br />

uniform/bullet resistant vest & goods in custody. He was<br />

conditionally bailed to appear at Blacktown Local Court on 21<br />

April. In a separate residence police located & seized an<br />

unlicensed .45 calibre semi automatic pistol, ammunition, a<br />

silencer, an unlicensed .45 lever action rifle, cannabis, & plants, 4<br />

rifles. A 45-year-old man, an alleged associate of the Bandido<br />

OMCG, was arrested at the scene & taken to Blacktown Police<br />

Station where he was charged with possessing an unlicensed<br />

pistol & possession of a prohibited drug. He was conditionally<br />

bailed to appear at Blacktown Local Court on 21 April 2011. A<br />

34-year-old woman was also arrested at the scene. Police found<br />

she was in possession of substances, believed to be a prohibited<br />

drug. She was taken to Blacktown Police Station & charged with<br />

the possession & supply of a prohibited drug. She will appear in<br />

Blacktown Local Court on 21 April. Strike Force Raptor was<br />

Patriot Guard Riders Speak Out Over Funeral Protest Ruling<br />

Supreme Court ruled 8 to 1 that the first amendment protects<br />

Westboro Baptist Church members’ anti-gay protests outside<br />

military funerals. Wed several Patriot Guard Riders of north<br />

Alabama share their concerns. Members of the Westboro Baptist<br />

Church travel the country picketing at fallen soldiers’ funerals.<br />

The Patriot Guard Riders formed to protect military families from<br />

what the riders call a verbal attack but some riders still believe the<br />

funeral protests may be illegal in the future. The Patriot Guard<br />

Riders are volunteers who, when invited, attend the funerals of<br />

fallen service members. Their motto is ‘Standing for Those Who<br />

Stood for Us.’ The group formed in 2005 after Westboro Church<br />

started protesting during military funerals. “We form a barrier, a<br />

shield holding a flag line, an American flag & try to keep the<br />

protestors from even being seen by the family members,” said<br />

Patriot Guard Member Mark Hooper. The Patriot Guard is a<br />

national group with more than 300,000 volunteers. Mark Hooper<br />

is one of these patriotic riders. He was hoping the Supreme Court<br />

would not allow military funeral protests. “They can have their<br />

protests & protest the war whatever they want to do numerous<br />

other places besides at the funeral of a fallen hero,” said Hooper.<br />

Westboro Church member, Margie Phelps says the protests are for<br />

the greater good. Members claim military deaths are God’s<br />

punishment for the nation’s tolerance of homosexuality. “You<br />

want to keep blathering about our motive being unkind. We are<br />

trying to warn you. Flee the wrath of God. Flee eternal<br />

destruction. What could be more kind than that?” said Margie<br />

Phelps. Patriot Guard Riders say as long as the funeral protests<br />

continue, they will be there if requested to protect the soldiers’<br />

families. Hooper continues to hope the funeral protests will one<br />

day be illegal. “There is a bill in Congress now to make it illegal<br />

to protest military funerals or any type of funeral. So were hopeful<br />

that that goes through & that it gets passed,” said Mark Hooper.<br />

Even though the funeral protests are legal local law enforcement<br />

can establish a distance between the funeral & the protestors. The<br />

Huntsville P.D. is now considering what that distance should be.<br />

McGurk associate faces charges over mortgage scam – March<br />

being part of a scheme to rip off banks using fake home loan<br />

documents, but blamed the bikie boss, Felix Lyle, for stealing the<br />

money. The pair are linked to a fake certificate of title for a house<br />

in Stanmore, which they allegedly used to borrow $539,000.<br />

State Patrol expanding motorcycle safety initiative – March 3,<br />

Dept of Public Safety has received a grant from the National<br />

Highway Traffic Safety Administration to collect data over the<br />

next 2 years to improve motorcycle safety. The $70,000 grant will<br />

be used to conduct six, one-day safety checkpoints between<br />

March 1 of this year & December 31, 2012. Lt. Colonel Mark<br />

McDonough, DPS Deputy Commissioner, said the goal of the<br />

checkpoints is to reduce the number of crashes involving<br />

motorcyclists that result in injuries & fatalities. “In a six-year<br />

period, Georgia has seen the proportion of fatal motorcycle<br />

crashes grow to 12 times greater than that of passenger cars,” he<br />

said. “Additionally, traffic crashes involving motorcyclists result<br />

in injury or death for 72 percent of the motorcycle operators<br />

compared to 16 percent of occupants of passenger cars.” Georgia<br />

saw a sharp increase in the number of fatal crashes involving<br />

motorcyclists between 2005 & 2008 as the number of motorcycles<br />

registered in the state reached an all-time high. There were 167<br />

motorcycle operators or passengers killed in crashes in 2008. Lt.<br />

Colonel McDonough said the Department initiated a public<br />

education project in 2009 to raise awareness among all drivers of<br />

the need to watch for motorcyclists.<br />

Spokane headquarters of HAs raided by police - Mar 3, 2010 -<br />

leader of the Washington State chapter of the Hells Angels was<br />

arrested Thu during a raid at the outlaw motorcycle gang’s<br />

Spokane headquarters. Ricky Jenks, who was among those<br />

indicted in 2006 with now imprisoned chapter Pres Richard<br />

“Smilin’ Rick” Fabel, is being held without bail at the Spokane<br />

County Jail on a federal charge of being a felon in possession of a<br />

firearm. The charge relates to 6 firearms found in the clubhouse<br />

when Fed agents & Spokane police executed a search warrant<br />

there about 10:30 a.m. Heavily armed Fed, state & local law<br />

enforcement officers detained Jenks & 5 others who were in the<br />

club, but only Jenks, the club’s sergeant of arms, has been<br />

arrested, said Assistant U.S. Atty Tom Rice. Authorities would<br />

not say why they were authorized to search the clubhouse, located<br />

at 1308 E. Sprague Ave. Armored support vehicles were<br />

stationed nearby. Raids also took place at least 2 other locations<br />

in Spokane, the FBI confirmed. In addition to loaded guns,<br />

investigators say they found 2 bags of marijuana in the clubhouse.<br />

Frank Harrill, supervisory agent for the FBI in Spokane, said the<br />

regional gang task force is leading the investigation. Jenks, 33,<br />

appeared in U.S. District Court this afternoon wearing jeans & a<br />

black-t-shirt commemorating the “Hells Angels 1st Regina<br />

Anniversary.” He was booked into jail afterward. A hearing to<br />

determine if he can be released on bail is scheduled Tue. In<br />

recent years, the motorcycle club had been linked by authorities in<br />

Washington State to extortion schemes & murder. 3 members of<br />

the Spokane chapter were convicted in 2007 of using the club as<br />

an organized crime ring, & some of its members have been tied to<br />

shootings & other violence throughout the western United States.<br />

In 2001, Jenks & a man considered a club associate were arrested<br />

in the shooting death of a man making meth in a Spokane Valley<br />

home. Jenks later pleaded guilty to 2 nd -degree manslaughter &<br />

was sentenced to 21 months in prison. Shortly after his release,<br />

Jenks was arrested under a Fed racketeering indictment that led to<br />

Fabel’s conviction in Seattle. Fabel is scheduled to be released in<br />

July 2012. Jenks was tried on racketeering charges in 2007 but a<br />

jury couldn’t reach a verdict. Jenks later pleaded guilty to<br />

interference with commerce by threats or violence & was<br />

sentenced to 16 months in prison with credit for time served in jail<br />

awaiting trial. He’d already been out of custody on bail since July<br />

2007. In the plea agreement, Jenks admitted to forcing a man to<br />

make regular cash & drug payments, then threatening him when<br />

he stopped paying. The man paid Jenks $5,000 out of fear,<br />

according to the plea deal. Letters of support from Jenks’ family<br />

& friends in 2007 describe Jenks as a hard-working construction<br />

worker who devoted himself to his 1-year-old son after his release<br />

from prison. “It’s amazing how much a child can change your life<br />

& in Rickys (sic) case it has been for the best,” one letter read.<br />

His probation requirements prohibited him from associating with<br />

Hells Angels & other members of gangs or outlaw motorcycle<br />

clubs. Investigators say Jenks was at the Hells Angels Spokane<br />

headquarters when they arrived with a search warrant this<br />

morning. The convicted felon’s coat was “within 15 feet” of the 6<br />

firearms at the clubhouse when agents arrived, according to court<br />

documents. Seized were a Kel-Tec 9 mm semi-automatic pistol, a<br />

Ruger 10-22 Rifle, a Riot 18-7 12 gauge shotgun, a Glock .45<br />

caliber semi-automatic pistol, a Taurus .38 caliber revolver & a<br />

Smith & Wesson 9 mm semi-automatic pistol. All were loaded.<br />

New Bill Against Motorcycle Checkpoints – March 3, 2011 –<br />

Sensenbrenner, Tom Petri & Paul Ryan, today introduced a bill in<br />

the U.S. House of Representatives that would prohibit the U.S.<br />

Secretary of Transportation from providing funds to state & local<br />

Gov’ts for the use of creating motorcycle-only checkpoints. “We<br />

introduced this important piece of legislation because Secretary<br />

LaHood & NHTSA remain adamant that mandating helmet use<br />

will prevent motorcycle crashes,” Sensenbrenner said. “The first<br />

step in motorcycle crash prevention should be rider education &<br />

increased awareness. Taxpayer money should not be spent on<br />

helmet checkpoints that do not prevent crashes.” Last year,<br />

Sensenbrenner & Petri took the lead in sending a letter to<br />

Transportation Secretary Ray LaHood regarding their concerns<br />

with the National Highway Traffic Safety Administration’s<br />

Motorcycle Law Enforcement Demonstrations Grant Program. In<br />

their letter, Sensenbrenner & his colleagues urged Secretary<br />

LaHood to suspend NHTSA Administrator Strickland’s<br />

Motorcycle Law Enforcement Demonstrations Grant program<br />

until their concerns were addressed. The letter further stated that<br />

until evidence suggests otherwise, motorcycle safety funding<br />

should focus on awareness programs & crash causation studies.<br />

“The checkpoints go beyond the helmet issue & also includes<br />

motorcycle safety inspections,” Petri said. “But we have limited<br />

resources, & motorcycle checkpoints won’t get us the biggest<br />

bang for the buck. Also, it’s outrageously intrusive. Nobody is<br />

suggesting pulling cars off the road for unscheduled inspections,<br />

so why are motorcycle riders being harassed?” Since Secretary<br />

LaHood & NHTSA continue their efforts to use big Gov’t tactics<br />

to accomplish their goal of mandatory helmet laws,<br />

Sensenbrenner, Petri & Ryan decided to take the additional step of<br />

introducing legislation to prohibit any future funding for<br />

motorcycle-only checkpoints as they remain committed to<br />

ensuring the rights of motorcyclists.<br />

Bike Week 2011 roars into Daytona Beach, drawing<br />

thousands of motorcycle riders to Florida – March 3, 2011 –<br />

Week 2011 officially opens Friday, but the roaring & rumbling on<br />

Main St proves there are plenty of early arrivals to what many<br />

consider the world’s largest motorcycle rally. Organizers are<br />

hoping for a strong turnout, providing a badly needed boost to the<br />

local economy, but also for a safe & trouble-free event.<br />

Traditions: What brings the throngs back year after year isn’t<br />

what changes, but what stays the same. Bike Week 2011 is the<br />

70th annual event, dating to the 1937 motorcycle race on the<br />

beach. Only World War II pre-empted it. It’s still all about the<br />

best-looking bikes, the smell of leather, the ear-splitting pipes,<br />

Old Glory waving, tributes to veterans, the beer & the biker<br />

babes. Coleslaw wrestling is scheduled for Wed, bike blessings<br />

for Sunday, & the Daytona 200 motorcycle race next weekend.<br />

Main Street vendors: Tents & temporary stages are filling up<br />

every square inch of Main Street, the row of saloons where<br />

motorcycle riders have always partied. Daytona Beach officials,<br />

though, lament that the street is nearly vacant for 50 weeks of the<br />

year. City commissioners want to make the street viable all year<br />

but for now are happy to see the temporary tents.<br />

Crowds: Bike Week at its peak brought in more than a halfmillion<br />

motorcyclists to Central Florida. It has become harder to<br />

estimate crowd size, although 400,000 motorcyclists is the best<br />

guess. Hotels are filling up, & traffic on the roads is building.<br />

Weather: The Florida weather remains one of the biggest reasons<br />

for Bike Week’s success. Snowbound riders stream to Daytona by<br />

the thousands, seeking an escape from winter weather. Early<br />

arrivals to Bike Week 2011 include riders from Ohio,<br />

Pennsylvania & even Ontario. “It is 10 degrees & 3 feet of snow<br />

back home,” said Ron Germaine of Springfield, Mass. “We’re<br />

here to enjoy ourselves, the sun, the people, & frankly, the<br />

women.” Even day-to-day changes have an effect: Cool weather


makes leather merchants cheer, but warmer weather means the<br />

attire gets more risqué.<br />

Accidents: Fatal Bike Week crashes peaked with 21 people killed<br />

in the region in 2006. Recent years have seen fewer Bike Week<br />

deaths, but state transportation officials said Volusia, Orange &<br />

Brevard are among the leading counties in Florida for deadly<br />

motorcycle accidents. Safety ads on billboards remind other<br />

motorists to look out for motorcycles. Research from the Florida<br />

Motorcycle Safety Coalition shows motorists are at fault in more<br />

than 60 percent of crashes with motorcycles.<br />

Crime: Not only are accidents down, but Daytona Beach police<br />

are seeing less crime. Police Chief Mike Chitwood said 62<br />

motorcycles were stolen in the city during the 2006 event, but a<br />

program that lures thieves with “bait bikes” has reduced that<br />

number. Enforcement remains strict, yet citations are down too,<br />

the chief said. And the nights when residents lost sleep from the<br />

roaring sound of exhaust pipes has long been over.<br />

Souvenirs: You can’t leave Bike Week without a souvenir T-shirt,<br />

but the Bike Week name itself is in some controversy. A<br />

Brooklyn company wants the Fed trademark for it. The Daytona<br />

Regional Chamber of Commerce has been fighting the company<br />

since threatening letters were sent to competing vendors. The<br />

chamber’s federal lawsuit is pending, & the T-shirt sales continue.<br />

New this year, though, are tents with officially sanctioned shirts.<br />

Racing: Motorcycle racing started it all, & racing fans can look<br />

Coffin Cheaters agree to tear down Bayswater fortress walls –<br />

agreed to remove fortifications from their Bayswater clubhouse,<br />

avoiding a stand-off with police & lengthy court battle. Today,<br />

police announced that Cheetah Investments Pty Ltd, the owner of<br />

the Coffin Cheaters’ Raleigh Rd CH, had accepted conditions set<br />

out in a fortifications removal notice. Under the directive, WA’s<br />

biggest bikie gang must remove sleepers from the front wall of the<br />

Bayswater headquarters & replace the fixtures with steel mesh or<br />

see-through material. The gang has also been ordered to remove<br />

the small front gate & replace it with steel mesh & an unlockable<br />

gate so the courtyard & public areas are accessible. In addition,<br />

external surveillance cameras which monitor the street must be<br />

removed & hardwood internal doors replaced with “normal”<br />

interior doors. Coffin Cheaters spokesman Peter “Fuzzy” Godfree<br />

said the club had been liaising with the Police Commissioner’s<br />

office for several weeks & had come to an arrangement on several<br />

terms. It is likely building works would start next week, he said.<br />

But Godfree said the clause of greatest concern to the club was<br />

the order for an unlockable front gate that would make the<br />

premises ``accessible to the general public’’. “We’ve worked<br />

through most of it without too much drama,’’ Godfree told<br />

PerthNow. “The main thing is that little gate out the front they<br />

want unlockable & accessible to the public, which seems a bit<br />

ridiculous but at this stage we’ll probably go with that & work it<br />

from there.’’ On Jan 24, the Corruption & Crime Commission<br />

issued a fortification warning notice to the property owners,<br />

giving them 14 days to respond before a fortification removal<br />

notice could be issued. In a statement issued today, police said<br />

that after consideration of submissions from lawyers representing<br />

Cheetah Investments Pty Ltd, Assistant Commissioner Nick<br />

Anticich issued a fortification removal notice on behalf of Police<br />

Commissioner Karl O’Callaghan. Cheetah Investments Pty Ltd<br />

had until Feb 25 to either agree to remove the fortifications or<br />

make an application to the WA Supreme Court to appeal the<br />

fortification removal notice. “The owners have consented to<br />

remove or modify the fortifications in accordance with the<br />

Fortification Removal Notice & have been granted 4 weeks to<br />

make these changes,’’ police said in the statement. If the<br />

fortifications are not removed or modified by March 25, the<br />

Police Commissioner can order action be taken to remove the<br />

fixtures. WA’s anti-fortification laws have been used once since<br />

being introduced in 2003 after the car bomb assassination of<br />

former CIB boss Don Hancock. In August 2008, WA Supreme<br />

Court Justice Peter Blaxell ordered the Gypsy Jokers to remove<br />

forticiations at their Maddington clubhouse, including a 2m-high<br />

wall, remote-controlled gates, surveillance cameras & floodlights.<br />

Hells Angels challenge topples gang patch bylaw – March 4,<br />

2011 – New Zealand – By www.NZHerald.co.nz - Wanganui’s<br />

anti-gang-patch bylaw has been ruled unlawful by the High Court<br />

after a challenge by the Hells Angels. Hells Angels member Philip<br />

Schubert of Auckland challenged the Wanganui District Council<br />

bylaw banning people wearing gang insignia in public. The<br />

bylaw, which came into force on Sept 1, 2009, bans the patches,<br />

insignia & colours of 10 gangs in public places in Wanganui,<br />

Mowhanau, Kai Iwi & rural community halls. Gang members<br />

breaching the ban can be fined $2,000 & have the insignia<br />

confiscated. In a ruling issued yesterday, Justice Denis Clifford<br />

said the ban was not lawful because it covered such a wide area &<br />

the council had not considered all the issues related to the right of<br />

freedom of expression. Last night, former mayor Michael Laws,<br />

who introduced the bylaw, said he had not read the full judgment<br />

but the High Court was wrong in fact. Laws said the ban covered<br />

only 10 per cent of the district, & the council had considered<br />

freedom of expression issues. He said the council had 2 options -<br />

appeal against the ruling or amend the bylaw. The court had<br />

upheld the right of the council to create a bylaw to ban gang<br />

patches, & that was the most important finding. “It will be for my<br />

council colleagues to choose which course they will adopt but the<br />

gang-patch ban is here to stay,” Laws said. Wanganui District<br />

councilor Rangi Wills said the gang-patch ban had curtailed<br />

public intimidation by gang members & quietened things down in<br />

the city. Last year, when Schubert applied for a judicial review of<br />

the ban, his lawyers described the bylaw as a “sledgehammer used<br />

to crack a nut”. Lawyers Steven Rollo & Duncan Webb, from the<br />

Christchurch firm of Lane Neave, told the court the geographical<br />

area the bylaw covered was too vast in its scope & amounted to<br />

prohibition throughout the district. Webb said the definition of<br />

the types of insignia banned under the bylaw was “hugely broad<br />

& vague” for the geographical area it covered, & said the wider<br />

area would be permissible if a narrower scope for the insignia<br />

were given. The ban was basically prohibition, which breached<br />

the Bill of Rights Act, & Parliament hadn’t given the council the<br />

power to do this, Webb said. Last month, the Whangarei District<br />

Council said it planned to meet police to examine the possibility<br />

of banning gang patches from the central city. Police area<br />

commander Inspector Paul Dimery said Northland was seen as a<br />

“cash cow” by gangs, particularly through the manufacture &<br />

distribution of methamphetamine. In his monthly report to the<br />

council, he said it was “time to be brave & put a mark in the<br />

sand”, & suggested the council look at a bylaw banning the<br />

patches.


Swamp the Commission with comments – Mar 4, 2011 – USA -<br />

year ended on a note of great victory for crack cocaine sentencing.<br />

With passage of the Fair Sentencing Act, we eliminated a<br />

mandatory minimum sentence & significantly lowered the<br />

mandatory minimum for crack cocaine offenses. These changes<br />

are real & profound. But we didn’t get everything we wanted.<br />

For example, those new, lower sentences do not apply to people<br />

already in prison. Also, drug sentences overall remain too long.<br />

You can help us change these problems! You’ve asked to help,<br />

& we need it. Taking action is easy & quick & we need everyone<br />

to chime in. Please keep reading & then send a letter to the chair<br />

of the U.S. Sentencing Commission. Each year the U.S.<br />

Sentencing Commission asks the public to comment on the<br />

sentencing guideline changes they are thinking of making. This<br />

year, there are 2 that are of particular importance to FAMM<br />

members: a) Whether to make the new crack cocaine guideline<br />

sentence retroactive (likely to receive a vote by Nov. 1); &<br />

b) Whether to reduce all drug sentences by 2 levels under the<br />

sentencing guidelines. This is sometimes referred to as ‘drugs<br />

minus two’ (unlikely to receive a vote this year). If both of these<br />

sentencing guideline changes are approved, thousands of<br />

nonviolent drug offenders would be affected. We need you to tell<br />

the Sentencing Commission that you want to see these “amendments”<br />

passed. When they hear from thousands of people, it<br />

Dear Judge Saris: I write to urge the Sentencing Commission to<br />

take 2 steps to make federal drug sentencing more just: first, make<br />

the crack cocaine guidelines retroactive. Second, lower all drug<br />

guidelines by 2 levels. Congress passed the Fair Sentencing Act<br />

of 2010 to reduce harsh sentences for crack cocaine, sentences<br />

that were condemned as unfair, excessive, & a key contributor to<br />

racial disparity in sentencing. Accordingly, the Sentencing<br />

Commission changed the guidelines & now should make the<br />

crack cocaine guidelines retroactive. Thousands of defendants<br />

sentenced under the old crack guidelines remain in prison today<br />

serving sentences everyone agrees are unjustifiably long. Forcing<br />

these prisoners to serve sentences that Congress, the Commission<br />

& the President have soundly repudiated is simply wrong. Making<br />

the guideline changes retroactive would help to right a wrong &<br />

restore faith in our criminal justice system. In general, federal<br />

drug sentences are too long & come at too high a cost to families,<br />

communities & taxpayers. Part of the problem is that the drug<br />

sentencing guidelines are higher than mandatory minimum drug<br />

sentences. There is no evidence that Congress intended that to be<br />

the case. The Commission should change the guidelines to reduce<br />

all drug sentences by 2 levels, as it did with crack cocaine<br />

sentences in 2007. The Commission should take this straight<br />

on the NSW central coast but the notorious US outlaw motorcycle<br />

club has no plans to ‘‘step on anyone’s toes’’ by expanding to<br />

Sydney, its national Pres says. The club’s Australian president,<br />

Peter ‘‘Chop’’ Emerton, told The Sun-Herald the idea that the<br />

club was establishing a Sydney chapter was ‘‘complete & total<br />

bullshit’’ which police had promoted to destabilise relations with<br />

other clubs. Officers from Strikeforce Raptor & the tactical<br />

response group had raided his property recently & ‘‘found nothing<br />

because there was nothing to find’’, Emerton said. ‘‘We are not<br />

trying to establish drug turf or to seek conflict with other clubs,’’<br />

he said. ‘‘That’s not what our club is about.’’ Emerton said the<br />

Mongols had kept their central coast presence secret for about 2<br />

years until posting photographs of members on Facebook last<br />

year. The club now numbered more than 2 dozen, contrary to<br />

reports of only 6 members, he said. ‘‘But we are very happy to<br />

remain on the central coast. We have deliberately stayed out of<br />

Sydney. We don’t need to step on anyone’s toes unless someone<br />

steps on ours first.’’ Bikie insiders are concerned that if the<br />

Mongols came to Sydney it could spark deadly tension. Police<br />

fear the recent defection of more than 50 Bandidos to the Hells<br />

Angels, has created the potential for violence between the clubs.<br />

‘‘The Mongols should know that going to Sydney would be a<br />

suicidal move,’’ one insider said. ‘‘There’s too much tension<br />

between existing clubs. There’s just no room for another club,<br />

especially one that has history with other major clubs in the US.’’<br />

The Mongols, based in southern California, have been considered<br />

among the most notorious of the ‘‘1%’’ bikie clubs - the ones that<br />

give the 99 per cent a bad name. They have 1500 members in<br />

chapters in the US, Germany, Mexico, Italy & now Australia. In<br />

2008 a US judge granted an injunction banning club members,<br />

family & associates using the club colors, which feature a Mongol<br />

warrior wearing sunglasses. This followed Operation Black Rain,<br />

in which officers from the ATF infiltrated the club, resulting in<br />

the prosecution of senior members for racketeering. Last year the<br />

Mongols won back the right to wear their colors after a long legal<br />

battle. Emerton said after Black Rain the club had changed<br />

direction, voting out all the ‘‘part-time gangsters & drug dealers’’<br />

in an attempt to renew the club’s values. ‘‘Believe it or not, our<br />

club is drug-free. If you are caught selling or using drugs you are<br />

kicked out, no questions asked.’’ Members are expected to have<br />

jobs or be seeking employment under new club rules. Emerton<br />

runs a custom motorcycle business & works in the mining<br />

industry as a training assessor. He conceded he had a juvenile<br />

criminal record & another member had a conviction for petty<br />

assault. His connection with the Mongols had followed meeting<br />

US members in the motorcycle business. He had been asked to<br />

join other outlaw clubs in the past but had declined. ‘‘It wasn’t<br />

for me, but once I got to know the Mongols I knew this was where<br />

I belonged. It’s a religion for the members. We’re going in a<br />

different direction to other ‘1%’ clubs but we don’t judge what<br />

they do, either.’’<br />

Only in Minnesota: Each Friday night after work, Ole would fire<br />

up his outdoor grill on the shore of Big Stone Lake & cook a<br />

venison steak. But, all of Ole’s neighbors were Catholic... And<br />

since it was Lent, they were forbidden from eating meat on<br />

Friday. The delicious aroma from the grilled venison steaks<br />

wafted over Ortonville all the way to Clinton, & was causing such<br />

a problem for the Catholic faithful that they finally talked to their<br />

priest. The Priest came to visit Ole, & suggested that he become a<br />

Catholic. After several classes & much study, Ole attended<br />

Mass.....and as the priest sprinkled holy water over him, he said,<br />

“You were born a Lutheran, & raised a Lutheran, but now you are<br />

a Catholic.” Ole’s neighbors were relieved, until Friday night<br />

arrived, & the wonderful aroma of grilled venison filled the<br />

neighborhood. The Priest was called immediately by the<br />

neighbors, and, as he rushed into Ole’s yard, clutching a rosary &<br />

prepared to scold him, he stopped & watched in amazement.<br />

There stood Ole, clutching a small bottle of holy water which he<br />

carefully sprinkled over the grilling meat & chanted: “You vuz<br />

born a deer, you vuz raised a deer, but now you is a walleye.”


2nd man in Hells Angels raid leaves jail - March 5, 2011 –<br />

member arrested on a marijuana charge Thu in Spokane was<br />

released from jail on his own recognizance Friday. Michael<br />

Fitzpatrick, 33, was booked into jail Thu on 1 felony charge of<br />

delivery of a controlled substance after selling marijuana in a<br />

“controlled drug buy” set up by the Spokane Regional Drug Task<br />

Force last fall, according to a probable cause affidavit. The oneparagraph<br />

affidavit, signed Thu by Jeff Barrington, alleges the<br />

transaction occurred in Oct. Superior Court Judge Michael Price<br />

allowed Fitzpatrick to leave jail Friday without posting bail,<br />

which pre-trial services recommended & is common in marijuana<br />

cases. Fitzpatrick has 3 felony convictions from several years<br />

ago, Price said. The affidavit contains no information about<br />

Fitzpatrick’s arrest, which occurred Thu after federal agents &<br />

Spokane police searched the Hells Angels clubhouse at 1308 E.<br />

Sprague Ave. Fitzpatrick was not at the club at the time but was<br />

arrested at a different location. Also arrested was Hells Angels<br />

sergeant of arms Ricky Jenks, 33. Jenks remains in jail without<br />

bail on a federal charge of felon in possession of a firearm.<br />

Investigators say they found 6 loaded firearms in the clubhouse.<br />

Jenks was among those indicted in 2006 with now imprisoned<br />

chapter Pres Richard “Smilin’ Rick” Fabel.<br />

MC Iceland Members Deported – March 7, 2011 – Norway –<br />

had been in isolation in Oslo since they arrived there on Friday<br />

morning. They added that they had received confirmation before<br />

they departed Oslo that they had become fully-registered Hells<br />

Angels members but would otherwise not comment to the media.<br />

Gang patch ruling appeal could cost $40,000 – Mar 8, 2011 –<br />

city’s gang insignia bylaw overturned in the High Court by Justice<br />

Denis Clifford last week. But instead, the council voted<br />

unanimously to adjourn discussion on the matter for a week to<br />

obtain more legal advice. Former mayor Michael Laws, who is<br />

still a councillor, urged his fellow councillors to approach police<br />

national headquarters for its view on appealing against the<br />

decision & whether it would help provide funds.<br />

Biker snitch under heavy security; Testifies in Hells Angels<br />

surprise that Franco Atanasovic’s appearance in a Winnipeg<br />

courtroom Monday came under heavy police security. His work<br />

as a secret agent made him many enemies in the criminal<br />

underworld & justice officials weren’t going to take a chance that<br />

somebody wouldn’t try to mete out some public payback. In the<br />

end, Atanasovic’s testimony against former Hells Angels<br />

president Ernie Dew went off without incident. It was a case of<br />

déja vu for the former good friends & criminal associates, whose<br />

lives took drastically different paths following a 2006 sting<br />

operation that caught Dew in its net.<br />
