Suspected Hells Angels member arrested for steroid sales in<br />

Live Oak – Sept 17, 2010 – California - By Jennifer Squires;<br />

Santa Cruz Sentinel; www.mercurynews.com - A suspected Hells<br />

Angel wanted for battery in Santa Clara County was caught with a<br />

gun, anabolic steroids & $40,000 cash when the county gang task<br />

force raided his Live Oak home Friday morning, the Sheriff’s<br />

Office reported. William Bettencourt, 38, was arrested on<br />

suspicion of possessing steroids for sale, gang participation, being<br />

a felon in possession of a gun & a warrant from Campbell police,<br />

according to Mario Sulay, gang task force commander. About 10<br />

officers from the gang task force, Watsonville police’s gang team,<br />

the Sheriff’s Office & Campbell police raided Bettencourt’s<br />

home, on the 2200 block of Ivy Lane, early Friday to serve the<br />

arrest warrant, according to Sulay. Finding drugs & the gun<br />

surprised police. “It’s something we just walked into,” Sulay<br />

said. Officers found more than 10 vials of anabolic steroids,<br />

about 25 other vials containing a white powder that Bettencourt<br />

said was human growth hormone & hypodermic needles, Sulay<br />

reported. Authorities weren’t certain how much the drugs were<br />

worth & have not determined who Bettencourt was allegedly<br />

selling to. “We don’t deal with a lot of steroid cases around<br />

here,” Sulay said, explaining officers will continue to investigate<br />

the drugs. There also were items in the house that indicated<br />

Bettencourt is a Hells Angels member, according to Sulay. “Hells<br />

Angels, as a gang, have been known to engage in a pattern of<br />

criminal activity,” Assistant District Attorney Charlie Baum said.<br />

“In this particular case we are looking at him as an active<br />

participant in the gang.” The Hells Angels are recognized as a<br />

criminal street gang under California Penal Code. There is a Hells<br />

Angels chapter that claims Santa Cruz County as its territory, but<br />

it’s rare for one of the members to be arrested & charged under<br />

the gang statute. In addition, Bettencourt was armed with a semiautomatic<br />

handgun when he was arrested, according to Sulay. He<br />

has at least 2 prior felony convictions, Sulay said. He did not<br />

know what the crimes were but said the convictions prohibit<br />

Bettencourt from owning guns. Outlaw motorcycle gang crime is<br />

unusual in Santa Cruz County. However, in January an alleged<br />

member of the Vagos motorcycle club, a rival of the Hells Angels,<br />

was arrested after a street fight involving both gangs. Thomas<br />

Froberg, 37, of Live Oak will go to trial on charges of fighting in<br />

public & gang participation Nov. 8, Baum said. Baum said<br />

Bettencourt has no ties to the fight. Details about Bettencourt’s<br />

battery charge from Santa Clara County were not available<br />

Friday. Campbell police did not return calls seeking comment.

Road Deaths Decline Worldwide: Data published <strong>by</strong> an<br />

international transportation group revealed Britain has the lowest<br />

road death tally of 33 countries surveyed, topping the charts with<br />

just 3.8 deaths per 100,000 population, & the declining global<br />

fatality rate has been heralded as “a record decade for road<br />

safety.” The United Kingdom joins the Netherlands & Sweden<br />

as the countries with the safest roads, according to the report<br />

published <strong>by</strong> the Paris-based International Transport Forum, while<br />

Malaysia , Argentina & Greece rated highest of the 33 countries<br />

detailed in the survey. The United States ranked 27th with a<br />

traffic fatality rate of 11.1, nearly 3 times higher than the UK.<br />

Further data from the survey revealed motorists are least likely to<br />

be killed on Swedish, UK & Swiss roads, while the chances of<br />

being involved in a fatal crash were highest in Korea , the Czech<br />

Republic & Malaysia. The report found motorcycle accidents in<br />

the UK were down 23%, despite a 45% increase in the number of<br />

motorcycles on the road. Figures for motorcycles figured badly<br />

in the worldwide survey, however, with huge rises in fatal crashes<br />

in Finland & Slovenia . On the flipside, bike-related deaths<br />

dropped significantly in Portugal & Korea. The report found<br />

motorcycle deaths were on the rise in many developing countries.<br />

“These increases are only partly explained <strong>by</strong> the rise in the<br />

number of motorcycles,” said Veronique Feypell-de La<br />

Beaumelle, ITF road safety expert. ITF Secretary General Jack<br />

Short hailed the overall figures as “a record decade for road<br />

safety,” adding: “Reducing fatalities around the world will be<br />

accelerated <strong>by</strong> rapid & effective transfer of knowledge, good<br />

practice & information from the best performing countries.”<br />

Indonesian Capital Limits Motorcycle Traffic: City officials in<br />

Jakarta are mulling over schemes to limit the number of<br />

motorcycles allowed in certain areas during peak hours to help<br />

unsnarl the city’s acute traffic jams. The Indonesian Motorcycle<br />

Industry Association estimates there are about 35 million<br />

motorcycles in usable condition in the country, & in the capital<br />

city of 8.5 million people there are nearly one motorcycle for<br />

every person & growing <strong>by</strong> nearly a thousand new bikes every<br />

day. This extraordinarily high number of motorcycles has<br />

exacerbated the city’s already awful traffic, especially during rush<br />

hour, & plans are in place to begin banning bikes from a number<br />

of main thoroughfares in this mostly Muslim nation after the holy<br />

holiday of Ramadan, requiring riders to continue their journeys <strong>by</strong><br />

public transportation. Motorcycle numbers have been increasing<br />

for 6 years throughout the country, driven <strong>by</strong> affluence &<br />

affordable credit schemes. Today, a new motorcycle can be<br />

purchased with an initial down payment of Rp 500,000 (US$50).<br />

Weird Nudes: An 18-year U.S. Marine Corps veteran & his<br />

female passenger were thrown from a motorcycle when they<br />

veered off the road near Camp Lejeune , North Carolina .<br />

According to newspaper reports, both sustained painful injuries<br />

due to total lack of safety gear; no helmet, no gloves, no<br />

boots…and no clothes! The naked riders landed in a ditch, & the<br />

Marine was knocked unconscious & awoke to charges of DUI,<br />

reckless driving, driving without a license, license revoked,<br />

expired inspection, no insurance & no helmet. His passenger<br />

walked nearly a mile for help despite a broken arm & leg, but was<br />

only ticketed for failure to wear a helmet. Apparently, riding in<br />

the buff is not a traffic offence in Onslow County as neither were<br />

charged with exhibitionism or failure to exhibit common sense.<br />

Bar patron killed; 2 undercover cops shot in Camp<br />

Washington – Sept 18, 2010 – Cincinnati, Ohio – By FOX19;<br />

www.fox19.com - One person is dead & another person injured &<br />

2 undercover Cincinnati Police officers were shot inside the JB’s<br />

Honkey Tonk Bar around 7 p.m. It is located at the 2400 block<br />

of Spring Grove Ave. Cincinnati Police say that the 2 undercover<br />

police officers were shot as they walked into the bar. Approx.<br />

10:30 p.m. Sat both vice unit officers were released from<br />

University Hospital. One officer was shot in the leg, the other<br />

shot in the hip. FOX19 is told the bullets entered & exited the<br />

officer’s bodies. Cincinnati Police Chief Tom Streicher says he<br />

will not be releasing the officers names at this time because the<br />

officers are part of the undercover unit. As of 11 p.m. numerous<br />

police crews are still on the scene in the Camp Washington<br />

neighborhood of Cincinnati. Police say 4 or 5 members of the<br />

Iron Horsemen MC have been arrested, but police still have<br />

canine units searching the area to check for the possibility that<br />

more suspects may be in the area. Few details have been released<br />

about the person killed or the other injured person except that<br />

person was shot in the foot. The injured person is at University<br />

Hospital. Police have also surrounded the buildings at that<br />

location on Spring Grove Avenue. Traffic in the area is being<br />

rerouted & there are police cars on the interstate near the scene.<br />

Hamilton County SWAT crews blocked of a 3 block radius to<br />

traffic. This is the 4 th shooting involving police in the past 3 days.<br />

On Thu a Woodlawn Police officer was shot at in Lincoln<br />

Heights. Cincinnati Police say Thu & Fri officers were shot at in<br />

Winton Terrace. The officers were not injured in those shootings.<br />

The Polish Divorce: A Polish man moved to the USA & married<br />

an American girl. Although his English was far from perfect,<br />

they got along very well. One day he rushed into a lawyer’s<br />

office & asked him if he could arrange a divorce for him. The<br />

lawyer said that getting a divorce would depend on the<br />

circumstances, & asked him the following questions: Have you<br />

any grounds? Yes, an acre & half & nice little home. No, I<br />

One dies as bikers, police clash – Sept 18, 2010 - Cincinnati,<br />

Ohio - By Peggy O’Farrell; http://news.cincinnati.com/ - One<br />

man was killed & 3 others wounded, including 2 Cincinnati police<br />

officers, when a shootout erupted between officers & members of<br />

an outlaw motorcycle gang at a tavern Saturday night. The man<br />

killed, who was not identified, was a member of the Iron<br />

Horsemen MC, as was one of the injured men. Investigators with<br />

the Dept’s vice unit arrived at JD’s Honky Tonk & Emporium, in<br />

the 2300 block of Spring Grove Ave. Several members of the<br />

motorcycle club were sitting in a courtyard area outside the tavern<br />

when the officers, some in uniform, some in plainclothes, arrived.<br />

The motorcycle club members fired on the officers “as they got<br />

out of the car,” said Cincinnati Police Chief Tom Streicher.<br />

Police didn’t know what set off the shooting, he said. The officers<br />

were there on an active investigation, not an undercover<br />

operation, he said, & there was no history of clashes between the<br />

club & police. “There’s nothing bad going with the police with<br />

the gang itself. Motorcycle gangs are what they are. They do what<br />

they do & we do what we do. Occasionally, there’s a clash, as<br />

there was tonight,” he said. As Streicher briefed the press on the<br />

incident, a helicopter circled overhead. Search dogs were<br />

deployed in a wooded area near the tavern, he said. Sgt. Danita<br />

Kilgore said police were not searching for the shooter or shooters.<br />

Officers called in the shooting at about 7 p.m. Officers with the<br />

Cincinnati SWAT team still were working to secure the building<br />

at 10 p.m. It was unclear if patrons still were inside the building.<br />

“Four or five” members of the motorcycle club were taken into<br />

custody, Streicher said, as were several other people who were in<br />

the tavern at the time. The 2 officers, whose names were not<br />

released, suffered non-life-threatening injuries & were transported<br />

to University Hospital, where they were listed in stable condition.<br />

One of the officers suffered a leg wound; the other was shot in the<br />

hip, Streicher said. No info was provided on the extent of the<br />

wounded biker’s injuries. He was also transported to University<br />

Hospital. The biker who died had been in contact with SWAT<br />

officers, who were called in to secure the building. The officers<br />

were sent to recover him because police weren’t sure if it was safe<br />

to send in other officers or paramedics, said Lt. Anthony Carter.<br />

The bar was usually pretty quiet, Streicher said, & he didn’t know<br />

it to be a biker hangout.<br />

Two Cincinnati undercover police officers recover after being<br />

shot at a bar – Sept 19, 2010 – Ohio – By Adam Marshall &<br />

Matthew Daniels; www.wcpo.com - Just after 7 p.m. Saturday<br />

Cincinnati police converged at JD’s Honky Tonk Bar in the 2500<br />

block of Spring Grove Avenue in Camp Washington. Police say<br />

the officers drove to the bar in high numbers to investigate a biker<br />

gang. “There were a number of Iron Horsemen, motorcycle club<br />

members that were on the outside of the bar, in an outside beer<br />

garden type area. Several members of our vice squad were going<br />

to go up there & conduct an investigation. They were coming,<br />

accompanied <strong>by</strong> uniform personnel. I do know that when they<br />

pulled up at the scene, as officers got out of the car there was an<br />

exchange of gunfire. Actually the officers were met <strong>by</strong> gunfire,”<br />

said Chief Tom Streicher with the Cincinnati P.D. Police say<br />

officers immediately began firing back. By the time bullets<br />

stopped flying a total of 4 people were shot. One was killed.<br />

“One officer was shot in the thigh. The bullet went through.<br />

There’s tissue damage there on him. At this point, does not<br />

require surgery. Another officer was shot in the hip. The bullet<br />

went through & came out his buttocks. That’s also tissue damage<br />

& no other serious damage there so he is not going to require<br />

shot in the foot. My understanding is, he’s going to be ok. And<br />

there is a fourth person as I said who was deceased here,”<br />

Streicher said. Police removed 14 Iron Horsemen from the bar &<br />

5 are in custody & being questioned. Investigators are not saying<br />

if the 2 men shot are the same men who shot the officers however<br />

they are saying they are not looking for any additional suspects.<br />

“There’s nothing bad going with the police with the group itself.<br />

Motorcycle gangs are what they are. They do what they do & we<br />

do what we do. And occasionally there’s a clash & unfortunately<br />

it happened tonight here.”<br />

one point, police reported a pack of nearly 500 bikers — many<br />

members of the Hells Angels & Sons of Silence motorcycle gangs<br />

— cruising down Hwy. 61. Authorities said a visible police<br />

presence quelled trouble before it started. “We didn’t have to<br />

make any arrests,” Winona County Sheriff Dave Brand said.<br />

Law enforcement agencies across southern Minnesota & western<br />

Wisconsin were geared for conflict after a brawl during the April<br />

version of the biannual run. Wisconsin-based Outlaws gang<br />

members crossed into Hells Angels territory & stomped several<br />

Angels outside 2 Minneiska bars, witnesses said. Officials were<br />

worried the gangs would try for payback during Saturday’s run. It<br />

didn’t happen. “We haven’t seen any Outlaws on this side of the<br />

river,” Brand said early in the evening. “And I don’t think we<br />

will.” The biannual fundraiser takes riders along both sides of the<br />

river between St. Croix Beach, Minn., & Winona. Law<br />

enforcement agencies tracked bikers most of the day, passing<br />

news of biker gang movements over police radio. Authorities<br />

were waiting when the bulk of the bikers thundered into<br />

Minneiska at about 2:40 p.m. About 30 police cars & nearly 50<br />

officers from at least 5 law enforcement agencies funneled the<br />

bikers through town. Hells Angels from chapters across the<br />

Midwest joined Sons of Silence, Warlords & many unaffiliated<br />

motorcyclists in a sea of chrome that stretched the length of the<br />

small town. In the end, sheriff’s deputies from counties on both<br />

sides of the river reported no serious problems. “Some Hells<br />

Angels were stopped for running a stop sign up near Lake City,”<br />

Brand said. “But that was about it. We didn’t have any trouble.”<br />

black leathers & with tattoos showing on muscled arms, maybe<br />

laughing & having a good time — instincts may lead them to<br />

making a beeline for the other side of the room. That may be the<br />

first reaction when wandering into a meeting of Bikers Fighting<br />

Cancer. But it doesn’t take long for the intimidation to melt away,<br />

& <strong>by</strong> the time a stranger leaves this group, that person leaves with<br />

a hug. Many hugs. “A lot of people think we’re rough bikers, but<br />

if they came & talked to us, they would understand we’re unique<br />

in the motorcycle world,” says Patrick “Chemo” Healy, founder &<br />

Pres of the Nat’l nonprofit club. The uniqueness comes from a<br />

bond that goes beyond their obvious passion for motorcycles. The<br />

group’s main mission is to help children with cancer & their<br />

families — & in the process to take care of each other as well.<br />

Each BFC chapter “adopts” families who have a child fighting<br />

cancer & raises money to help those families in any way it can.<br />

About 90 percent of the fundraising efforts go toward those<br />

sponsorships, with money being used for gas & food cards, utility<br />

bills, transportation for out-of-state treatment trips & other needs.<br />

“We find out what they need, so the money goes to the right<br />

thing,” says Sarah Healy, Patrick’s wife.

it the single largest fund raiser held each year, but it also gets our<br />

Suspect in Motorcycle Gang Shootout in Court – Sept 20, 2010<br />

gang member facing charges in connection with deadly shootout<br />

between his gang & police at a Camp Washington bar remains<br />

free after appearing before a judge this morning. 47 year old<br />

Lew Erskine of Bethel is charged with illegal possession of<br />

firearm in a place selling liquor. He is not charged with shooting<br />

anyone or firing during the shootout, which left another gang<br />

member & wounded 2 Cincinnati Police officers & a 2 nd gang<br />

member. The incident happened around 7 p.m. Sat, when some<br />

undercover officers showed up with uniformed Cincinnati Police<br />

officers at J-D’s Honky Tonk Bar on Buck Street in Camp<br />

Washington. They were there as part of an investigation into the<br />

Iron Horse Motorcycle Gang-officials still have not said exactly<br />

what the officers were looking into. But Cincinnati Police Chief<br />

Tom Streicher says as soon as they got out of their vehicles, they<br />

were met <strong>by</strong> gunfire. Police returned fire. In the end, 2 of the<br />

undercover officers were hit & a gang member was killed. Both<br />

officers were treated & released from the hospital & are now<br />

recovering from their injuries at home. Their names have not<br />

been released... neither have the names of the dead or injured<br />

gang members. It’s still not clear who shot that man, who was<br />

found in the courtyard area of the bar. 14 members of the IHMC<br />

were taken from the bar Sat for questioning. Besides the charges<br />

facing Erskine, officials have not said if any of the other members<br />

were charged. Erskine was released on his own recognizance.<br />

Officers Wanted To Talk, Not Arrest Bikers – Sept 20, 2010 –<br />

Ohio – By News5; www.wlwt.com - A Cincinnati police<br />

commander says officers engaged in a shootout with a biker Sat<br />

night didn’t go to the bar to arrest anyone. Lt. Col. Vince Demasi<br />

told News 5’s John London on Monday that the officers only<br />

intended to speak with members of the Iron Horseman MC.<br />

Demasi said that officers had noticed an increasing number of<br />

Iron Horseman members frequenting JD’s Honky Tonk & had<br />

concerns that the club was “taking over” the bar. Demasi said<br />

police also had recent complaints that the club members were<br />

looking for members of a rival club, the Detroit Highwaymen, to<br />

start trouble. When officers noticed a number of IHMC at the bar<br />

Sat, they called for backup & vice units to accompany them inside<br />

to talk to the club, Demasi said. Some bar patrons said Sunday<br />

that the vice officers wore masks, but Demasi & other patrons<br />

said the officers were clearly identified as police. As the officers<br />

walked through the bar, uniformed officers in front, Demasi said<br />

one of the club members stood up & opened fire on them.<br />

Officers returned fire. Police Chief Tom Streicher told London<br />

that 30 shots were fired in all, but only the one club member fired<br />

on police. In the shootout, one member of the club was killed &<br />

another was wounded. Two Cincinnati police officers were<br />

wounded. Several club members were taken into custody, but so<br />

far only one faces any charges, & those are weapons charges<br />

unrelated to the shooting. The club member who opened fire,<br />

believed to be the dead man, has not been identified.<br />

Former Iron Horsemen MC Pres defends members – Sept 21,<br />

2010 – Ohio – By www.fox19.com - Fifteen years ago, Greg<br />

Auterson made the news when he was charged with holding his<br />

girlfriend hostage. It took the SWAT team to get him out of his<br />

house, & it came out during the investigation that he had a long<br />

association with the Iron Horsemen MC. “It was really<br />

misconstrued. My ex-wife’s father had called the chief of police<br />

down here & said that his daughter had been kidnapped <strong>by</strong> an<br />

outlaw motorcyclist,” said Auterson. He said the charges were<br />

later dropped. Auterson says he once served as Pres of the<br />

IHMC. “The horseman ain’t never been ones to open fire on<br />

police, you know,” said Auterson. Auterson says the Cincinnati<br />

chapter of the Iron Horsemen has mostly been about more than<br />

violence. “We all had jobs, & it was like after work everybody<br />

would meet at the bar, shoot pool, & work on our bikes together,<br />

& hang out,” says Auterson. Auterson also said he’d been to JD’s<br />

Honky Tonk Bar before. “Good food, good people, nice<br />

atmosphere. People get off work and, well it’s like most of the old<br />

bars that we used to hang out at,” says Auterson.<br />

Police must pay Hells Angel bikie Zoran Nikolic $3000 after<br />

dropping charges against him – Sept 21, 2010 – Australia – By<br />

www.adelaidenow.com.au - Zoran Nikolic, 44, of Andrews Farm<br />

appeared in court today charged with 2 counts of possessing or<br />

using a prohibited weapon & one count of failing to supply a<br />

handwriting sample. Police withdrew the charges. No reason was<br />

given in open court. Magistrate Bill Ackland ordered police pay<br />

Nikolic’s court costs of $ 3,135. Outside court, Nikolic said he<br />

was relieved the matter was over. Last month, Nikolic’s house<br />

was peppered with bullets for the second time in about a year.<br />

Last year’s shooting was connected to members of the New Boys<br />

& the escalating feud between the 2 groups.<br />

Man killed in gun battle had fired at police – Sept 21, 2010 –<br />

Streicher says a man who was killed during a weekend gun battle<br />

failed to listen to police commands & fired shots at officers.<br />

Streicher said that further investigation revealed the man who died<br />

was a member of the Iron Horsemen who had fired shots at police.<br />

It was originally believed that the victim was an innocent<br />

<strong>by</strong>stander. An atty for the IHMC, Mike Schulkens, says the<br />

victim, whose name is Harold, was guarding the door because<br />

there had been some tension building between the IHMC &<br />

another MC called the Detroit Highwaymen. The Highwaymen<br />

were reportedly trying to start a club in Cincinnati. When Harold<br />

saw 2 men approaching in masks, he assumed they were members<br />

of the Detroit Highwaymen who were there to kill members of the<br />

IHMC, so he opened fire. Streicher said he doesn’t know if the<br />

officers were wearing masks or if they had any clothing or<br />

accessories identifying them as police. Masks are sometimes<br />

worn <strong>by</strong> undercover officers to hide their identity. Police will<br />

only say that the officers were there “conducting an investigation.”<br />

No other info is available on why the officers were there.<br />

Police-biker shootout leaves questions – Sept 21, 2010 – Ohio –<br />

sentry in a doorway, keeping an eye out for a rival motorcycle<br />

gang while about 5 of his cohorts from the Iron Horsemen MC sat<br />

outside in a small courtyard eating & drinking. It was early Sat<br />

evening & about 8 people were inside JD’s Honky Tonk &<br />

Emporium, including a Northern Kentucky teacher with his 2<br />

sons, ages 10 & 12, when all hell broke loose & more than 30<br />

rounds of gunfire exploded into the air, many of the bullets going<br />

inside after more than a dozen police officers showed up. The<br />

man in the doorway fired first at the undercover officers after<br />

shouting out to the gang members that something was going to go<br />

down. Police fired back, one of them about a dozen times. Two<br />

others fired off a few rounds. Two of the undercover officers<br />

were stuck & another IHMC was also hit. The lookout man,<br />

known only thus far as Harold, a biker from the Portland, Maine,<br />

area, was killed & all the patrons at the bar, including the owner<br />

as well as the father with his 2 children, were taken into custody<br />

at police headquarters. Only 1 person was arrested. Lew Erskine,<br />

47, an IHMC from Bethel, had 2 pistols on him as he sat at the bar<br />

with his friends. He has a concealed-carry permit, though<br />

firearms are not permitted in bars. He has no local record. He<br />

was released from jail without having to post bond.<br />

Hells Angels gang member arrested, faces felony charges –<br />

Sept 21, 2010 – North Carolina – By www.wect.com - Deputies<br />

with the Bladen County Sheriff’s Office arrested 2 people Mon<br />

night – one who is a validated Hells Angels motorcycle gang<br />

member. Dennis Carr Jr. of Carthage & his passenger Teresa<br />

Hastings of Saluda were pulled over <strong>by</strong> deputies & K9 units on<br />

NC 87 late Sunday night. According to the police report, the<br />

deputy learned Carr was a full-patch member of the Hells Angels<br />

Motorcycle Gang when he conducted a record check of Carr.<br />

The K9 unit checked the outside of the vehicle & alerted<br />

authorities of narcotics inside the car. After further investigation,<br />

deputies found alcohol, cocaine, 3 concealed firearms & more<br />

than $900 of cash. Authorities also seized the vehicle they were<br />

driving. Carr & Hastings are both being held in the Bladen<br />

County Jail with felony charges.<br />

Street-crack sealer called deadly for motorcyclists – Sept 21,<br />

Crack sealer — which can cause motorcycles to slip — litters the<br />

intersection - For most motorists, the tar that seals cracks on the<br />

road is at most unsightly. But for those who drive on 2 wheels,<br />

that sealant can be deadly, especially when over-applied.<br />

Motorcycle-safety courses warn of what they call “black-tar<br />

snakes,” but accidents still happen, & safety advocates want to<br />

change the way highway crews apply the gunk. Tar snakes litter<br />

the intersection where off-duty Lakeville police Sgt. Brigham<br />

Strole was killed Sept. 1, but investigators say they are still unsure<br />

what caused his motorcycle to sway just before he was thrown<br />

from his bike & killed. “Any irregularities or changes in the road<br />

surface have the potential to be hazardous, especially to a twowheeled<br />

vehicle that doesn’t balance on its own like a car,” said<br />

Lt. Eric Roeske, spokesman for the Minnesota State Patrol, which<br />

is conducting the investigation. Investigators said it likely will be<br />

at least a few weeks before the official cause of the crash, if it can<br />

be determined, is known. Strole, who lived on the Lakeville<br />

street where he crashed, was an experienced rider, Lakeville<br />

Police Chief Thomas Vonhof said. But so is Bob Zick, 64, of St.<br />

Paul, who is still recovering from a July crash in which he slipped<br />

on tar snake while riding around Lake Phalen. “The stuff is<br />

really deadly,” said Zick, who has been riding motorcycles for 40<br />

years. “Especially when you hit it & you don’t expect it.” Zick<br />

crashed on a hot day, when the tar can be particularly slippery.<br />

Zick was wearing a motorcycle jacket & a helmet, which he said<br />

probably saved his life. He underwent surgery for his broken<br />

clavicle & shoulder. Strole was not wearing a helmet. “Wearing<br />

protective gear can really take the bite out of small mistakes,” said<br />

Pat Hahn, information officer with the state Department of Public<br />

Safety. “Protective gear can change a life-changing experience<br />

into a learning experience.”<br />

Bike Week revs up Ocean City economy – Sept 21, 2010 –<br />

thunderous rumble of 100,000 motorcycles cruising down Route<br />

50 this weekend was plenty loud, but for area businesses, the kaching<br />

of their cash registers rang even louder. “The bike clientele,<br />

if you think about it, they eat & drink,” said Rico Rossi of<br />

Seacrets restaurant & bar complex in Ocean City. “They don’t<br />

have coolers or trucks or cars. Wherever they’re going, I don’t<br />

care if it’s a bottle of water, they have to buy it. They spend a<br />

phenomenal amount of money. My staff can’t wait.” Delmarva<br />

Bike Week, now in its 10 th year on the Shore, brought more easy<br />

riders than ever to Worcester & Wicomico counties, event<br />

organizers & participants said. Despite the recent economic<br />

downturn, bikers were spending more money than ever before,<br />

too. “We were just jamming all week long,” said event organizer<br />

Bruce Bennett of H-D of Ocean City. “People said they thought<br />

there was more bikes in Ocean City than they’ve ever seen before.<br />

We base it on year-to-year growth & feedback from vendors on,<br />

basically, how much money they made -- & this is in a bad<br />

economy, so we’re very encouraged <strong>by</strong> that,” he said. Bennett<br />

estimated that there were about 140,000 bikers participating.<br />

There were about 12,000 more people in Ocean City this weekend<br />

compared with the same time last year, said Ocean City<br />

spokeswomen Donna Abbott. Demoflush figures provided <strong>by</strong> the<br />

town showed 200,790 people visited Sept. 18-19, up from<br />

188,180 in 2009. Bennett said he’s encouraged that the<br />

perception of motorcycle enthusiasts is improving, mostly<br />

because resort businesses enjoy a generous end-of-season revenue<br />

Man Identified In Motorcycle Gang Shootout – Sept 22, 2010 –<br />

identity of the Iron Horseman who was shot & killed in a gun<br />

battle with police over the weekend. His name is Harold Walter<br />

Seavey. He’s been living in the East End. He’s originally from<br />

Portland, Maine. Local 12’s Rich Jaffe spent much of the day<br />

talking with Seavey’s family & law enforcement. As often<br />

happens with guys in motorcycle gangs, Harold Seavey was<br />

known <strong>by</strong> a couple of different names. His family knew him as<br />

Butch, but on the street he was known as “Dirty Harry.”<br />

Investigators in multiple different agencies have been aware of<br />

Harold Seavey’s presence in the Cincinnati area for quite a while.<br />

He’s been here for 4 or 5 months & has been living most recently<br />

in a house on Kellogg Ave in California. Police searched his<br />

residence this morning. It’s just a couple blocks away from the<br />

Iron Horseman clubhouse on Eldorado St. Seavey was a Nat’l<br />

enforcer for the Iron Horseman MC. Enforcers are the muscle<br />

men who frequently do the clubs dirty work. Seavey was on<br />

guard duty at the door of J.D.’s Honky Tonk Saturday evening<br />

when police showed up. Moments later, bullets were flying.<br />

Officers wanted to talk to the assembled group of Iron Horsemen<br />

to find out what they were doing at the bar. The bikers presence<br />

at J.D’s was a point of concern because the bar is just a few<br />

blocks away from the clubhouse of what’s becoming a rival gang,<br />

the Detroit Highwaymen. While J.D.’s is not a biker bar, per se,<br />

Highwaymen are also frequent customers there... & word was<br />

circulating that an attack on the Iron Horsemen was a possibility.<br />

Seavey’s brother tells me he’s been in Cincinnati on “vacation...”<br />

& that while his brother is indeed an Iron Horseman, it’s more a<br />

social club in Portland, Maine. He tells me his brother was a<br />

marine who served in Vietnam, & the father of three. He also says<br />

Harold Seavey had a heart of gold, joining other Iron Horseman<br />

around the holidays to distribute toys for tots, & helping the<br />

homeless. John Seavey says he can’t explain why his brother<br />

opened fire on police, saying his death is a shock to the entire<br />

family. The big question that remains, is why did Seavey open<br />

fire? And it’s a question that may never really be answered.<br />

Police should fear retaliation – Sept 22, 2010 – Ohio – By Larry<br />

Shields; www.WCPO.com - An expert on motorcycle gangs said<br />

the death of an Iron Horseman member following a police raid<br />

should be a warning for officers across the country. Two police<br />

officers were wounded & a member of the Iron Horsemen MC<br />

was killed at JD’s Honky Tonk & Emporium on Spring Grove<br />

Ave. in Camp Washington. As police pulled up in front of the bar<br />

for an investigation a gunfight broke out between some of the Iron<br />

Horsemen & the officers. Steve Cook trains police officers across<br />

the country about the dangers of Motorcycle gangs. He conducted<br />

a training course in Hamilton with local law enforcement in late<br />

July. “I think any law enforcement officer that has any contact<br />

with the Iron Horsemen anywhere in the United States needs to<br />

step their game up,” said Cook. Cincinnati police haven’t<br />

released the name of the member killed, but tributes on the club’s<br />

web page send condolences to a man named “Harold” from<br />

Maine. “He was national Sergeant At Arms for the Iron<br />

Horsemen, which is obviously a high rank or position to hold<br />

within that organization. Generally, if they’re bringing in<br />

someone from out of town, it’s something they deem to be a<br />

serious situation,” said Cook. The Iron Horseman’s atty Michael<br />

Schulkens told WLW’s Bill Cunningham he believes “Harold”<br />

thought the undercover police officers were ambushing them.<br />

Schulkens said the Iron Horsemen had problems with a rival gang<br />

from Michigan. The Detroit Highwaymen have a local chapter &<br />

clubhouse in the West End, not far from the site of shooting.<br />

Bikers get attention of authorities – Sept 23, 2010 – Minnesota<br />

No arrests were made Saturday after authorities rounded up about<br />

40 suspected motorcycle gang members in Red Wing. Police<br />

Chief Tim Sletten said the group - which he said involved<br />

members of “an identifiable motorcycle gang” - was pulled over<br />

near Auto Connections for “multiple driving violations.”<br />

Witnesses said officers were seen approaching the bikers with<br />

assault rifles drawn, while another agent was perched on a hill<br />

behind the dealership. Sletten downplayed witness reports that<br />

the hillside officer appeared to be a sniper. However, he said it<br />

was possible operation commanders may have placed an agent on<br />

the hill “to keep an eye on that big of a group.” To call that<br />

hillside officer a sniper, however, is “a pretty big leap,” Sletten<br />

said. The Minnesota State Patrol reportedly asked Auto<br />

Connections officials for permission to conduct the stop there for<br />

safety reasons.<br />

amount of respect where it is due. No disrespect should be shown<br />

towards anyone’s affiliation or association on this board. There<br />

are several different philosophies & ideologies on this board & no<br />

one would be expected to agree with all of them but we certainly<br />

feel that at least in this setting, for the sake of having an open<br />

dialog & some form or semblance of harmony, that we can at least<br />

accept that another is here, or failing that, just not acknowledge<br />

their comments. It serves no good purpose to disrespect or slander<br />

anyone’s name or affiliation here. For any good that’s<br />

accomplished it is difficult to overcome. I have no illusions there<br />

will never be any problems again. If you’ve been so fortunate as<br />

to have never experienced a period of time when a lot of this<br />

“Respect” was being established, I can assure you it’s nothing<br />

you’d be anxious to experience. We have so many other enemies<br />

out there whose very intent is to eliminate our existence, that it<br />

would be good to see us concentrate our efforts in a little more<br />

unified effort towards them, rather than each other.<br />

My intent, if I am to have one, is to put personalities behind<br />

names & to give some of those we have never met a face or a<br />

personality that we might draw on first when we hear that so-andso<br />

did this, or said that, we may stop for a second & think to<br />

ourselves. “You know, that really doesn’t sound like Wolf (or<br />

whomever) & maybe, just maybe, we will think & find out for<br />

sure before we act. I can’t say everyone I know will embrace this<br />

idea, probably not. I can’t say all of you will. I have no idea. But I<br />

can assure you that I speak for myself, when I say, “I’m trying<br />

this & if it works that’s great. If it doesn’t then I can say with a<br />

clear conscience that I tried. It’s not about kindness being a<br />

What police knew about the Iron Horsemen – Sept 23, 2010 –<br />

sources said officers were aware of an increase in motorcycle<br />

gang activity months ago. Bar owners first saw members of the<br />

Highwaymen & Iron Horsemen at their establishments in Jan<br />

2010. Police acted on that information <strong>by</strong> attending training.<br />

They were also knowledgeable of the member who shot 2<br />

Cincinnati police officers. A bar owner agreed to speak about his<br />

concerns of the 2 gangs only if his name & the bar’s name were<br />

protected. Channel 9 met the individual at his bar & was escorted<br />

through a back gate to the basement. The owner said gang<br />

members started showing up in Jan. “We had a couple motorcycle<br />

gang member come in & do a little surveillance on the bar. A few<br />

days later a lot of them came in. They didn’t cause any trouble but<br />

it was very uncomfortable,” he said. The man recalled one day<br />

when 4 bikers entered while he described dozens of motorcycles<br />

& men gathered outside. He said those men stayed a short period<br />

then moved on to another bar in the neighborhood. He believes<br />

the groups are recruiting out of work residents. “I think Chief<br />

Streicher has a little bit of time left but doesn’t want to make any<br />

waves but I don’t believe that’s how the police force feels,” he<br />

said. Police sources told 9 News the department was not only<br />

aware of increased gang activity, but also that Harry Seavey, the<br />

Iron Horseman’s Nat’l enforcer killed Sat, could be hiding out in<br />

Cincinnati. Multiple police sources said an internal memo several<br />

months ago alerted officers. Those sources said officers were<br />

briefed at roll call & told of his possible involve-ment in a<br />

shootout with the ATF near Portland, Maine. The June shooting<br />

followed a Fed indictment of outlawed motorcycle gang members.<br />

Just like the shootout that would follow in Cincinnati months<br />

later, ATF agents said they were met with gunfire when they<br />

showed up at a home where one gang member was killed. The<br />

bar owner has a question for Chief Streicher. “Why are we<br />

pandering to any gang activity that makes any citizen feel<br />

unsafe?” he asked.<br />

Pagan’s bust a boon for tattoo joint - Sept 24, 2010 - New York<br />

of plotting killings at Rocky Point parlor - Business is on the<br />

uptick at the Rocky Point tattoo parlor in which Fed prosecutors<br />

say members of the Pagan motorcycle gang hatched a plan to kill<br />

rival Hells Angels bikers. “Things have definitely picked up<br />

[since the tattoo parlor landed in the news],” said a friend of one<br />

of the men arrested, who did not want his name published. The<br />

House of Tattooing on Broadway was thrust into the national<br />

spotlight after authorities rounded up 19 Pagan’s in a multi-state<br />

sweep last Wednesday morning. The parlor allegedly housed the<br />

gang’s Long Island chapter, whose leader, a Middle Island<br />

resident named Jason “Roadblock” Blair, was viciously beaten <strong>by</strong><br />

Hells Angels members last August, prosecutors said. The planned<br />

killings, using homemade hand grenades, were plotted as payback<br />

for the assault, which occurred outside the tattoo parlor, according<br />

to federal court documents. The local chapter’s former leader,<br />

John “J.R.” Ebeling, also of Middle Island, had climbed higher<br />

into the gang’s hierarchy & was a national leader at the time of his<br />

arrest, according to the court documents. The 2, along with the 3<br />

other Long Island Pagan members, 1 from Holbrook were<br />

arraigned last Wed in Fed courthouses & face charges of murder<br />

conspiracy, assault, drug distribution, extortion, firearms offenses,<br />

witness tampering & racketeering. All pleaded not guilty; both<br />

Blair & Ebeling are being held without bail, as are most of the<br />

others. They will soon be in court again in Central Islip. A<br />

scheduled Sept. 30 appearance was pushed back. Blair is also a<br />

Middle Island Fire Dept member, though sources within the Dept<br />

said the 36-year-old hasn’t been active in several years. The ATF<br />

staged a 21-month investigation that included 300 agents, 2 of<br />

whom went undercover & recorded Pagan members plotting to<br />

murder Hells Angels members with homemade hand grenades.<br />

County Legislator Dan Losquadro, who was privvy to the<br />

investigation, said the Pagan’s had kept a lower profile in the past<br />

6 months, though he had been receiving complaints about the<br />

tattoo parlor from residents & business owners on a regular basis.<br />

“They were drinking outside, cigarette butts were all over the<br />

place,” he said. “It was definitely a nuisance.” He said<br />

surveillance methods had been set up in the area of the parlor,<br />

though he could not speak to specifics. Losquadro praised the<br />

undercover agents who busted the gang. “The individuals who go<br />

under cover knowing these people are murderers & violent felons,<br />

where they know that if they get uncovered their lives will likely<br />

end -- those individuals deserve special credit & special thanks,”<br />

he said. Attorneys for the bikers could not be reached for<br />

comment. Joseph Green, an ATF spokesman, said all planned<br />

arrests were made, but more arrests may result from debriefing<br />

convicted individuals down the road. Keith Sabaletti, a friend of<br />

Ebeling for 5 months, said he never saw the accused Pagan’s act<br />

violently, & that he hopes they don’t see jail time. “They’re good<br />

people & I don’t see why they should go down like this,” Sabaletti<br />

said. “I hope [Ebeling] comes home. I pray.”<br />

Will the real finks please stand up – Sept 24, 2010 – Australia –<br />

force must have better things to do. We are regularly told<br />

Victoria Police is stretched for resources struggles to put enough<br />

officers on the streets. If that’s the case, how can the force’s<br />

hierarchy justify a 10-month investigation to find the source of a<br />

story that caused nothing more serious than a case of<br />

embarrassment? The official answer is they are obliged to<br />

investigate a criminal offence, such as the leaking of a<br />

confidential internal document to a reporter. The truth is more<br />

likely to be that the hierarchy, starting at the very top, is obsessed<br />

with controlling the flow of information on police matters. So<br />

obsessed, they are prepared to devote time, money manpower to a<br />

search for someone to punish. So obsessed, they are prepared to<br />

pay for my personal business telephone records, then require a<br />

carrier to tell them who I’ve phoned who’s called me during the<br />

period when the offending story was written. So obsessed, they<br />

then question - under caution threat of prosecution - police who<br />

have had the misfortune to ring at the wrong time, demanding to<br />

know the reason for the call the nature of their relationship with<br />

me. The story in question, published on Nov 26 last year, was<br />

about the arrival in Victoria of 2 notorious motorcycle gangs, the<br />

Comancheros the Finks. It quoted an intelligence alert from the<br />

force’s gang desk, which said both gangs were establishing their<br />

first chapters in Victoria were looking for suitable clubhouse<br />

premises in the inner suburbs. The “police - in confidence” alert<br />

asked police to report sightings of bikies wearing club colors, or<br />

any other outlaw motorcycle gang activity. The story was<br />

embarrassing to senior police because their public position on<br />

bikie gangs had been: they’re not a problem we don’t need the<br />

same draconian laws proposed <strong>by</strong> other states. One senior officer<br />

even told a federal parliamentary committee the force had “bigger<br />

fish to fry”. There has since been evidence bikies are growing in<br />

power in Victoria. Publication of my story did not jeopardize any<br />

police operation or investigation or cause any personal risk to<br />

anyone. If it had, the story would not have been published.<br />

DPS GIITEM finds evidence Hells Angels is restarting a local<br />

chapter – Sept 24, 2010 – Arizona - By Lisa Irish; Daily Courier;<br />

www.dcourier.com - The Arizona Dept of Public Safety Gang &<br />

Immigration Intelligence Team Enforcement Mission found<br />

evidence that leads it to believe the Hells Angels gang was<br />

restarting the Skull Valley chapter, according to documents<br />

released Thu <strong>by</strong> the Yavapai County Atty’s Office. The evidence<br />

includes patches found on one member’s vest, a ledger, bank bags<br />

found in a suspect’s car, & entries in 2 suspects’ notebooks,<br />

according to the DPS GIITEM report. While looking at cuts, the<br />

leather or denim vests worn to show affiliation with a certain<br />

gang, the detective’s team helping the Yavapai County Sheriff’s<br />

Office investigate the shooting between the Hells Angels & Vagos<br />

gangs last month found a patch that read “Yavapai Co” on cuts<br />

worn <strong>by</strong> Michael Koepke. Koepke was the 1 st Hells Angels gang<br />

member that a DPS GIITEM detective recognized as he walked<br />

through the crime scene. The detective wrote in his report that<br />

Koepke smiled at him & then looked away as the detective<br />

walked <strong>by</strong>. On the left side of the cuts when they’re worn at the<br />

top are patches, also called flashes, indicating Michael Koepke<br />

holds the position of sergeant at arms for the Nomad chapter of<br />

the Hells Angels gang, & below the flashes is a “Yavapai Co”<br />

patch, also called a side rocker. “This indicates to me the Hells<br />

Angels gang is active in Yavapai County,” the detective wrote in<br />

his report. “This is significant since the Hells Angels Nomad<br />

chapter/clubhouse is located at ... North West Street in Flagstaff,<br />

Arizona, in Coconino County. This side rocker, along with other<br />

indicators, indicate that the Hells Angels gang may have been in<br />

the process of re-starting the Skull Valley chapter.” The Skull<br />

Valley chapter of the Hells Angels gang closed after members,<br />

including Teddy Toth, were convicted on charges related to the<br />

2003ATF investigation known as “Black Biscuit.” In Black<br />

Biscuit, 36 suspects were charged with murder for hire, narcotics<br />

offenses, & gun smuggling; 16 Hells Angels gang members &<br />

associates in Arizona were indicted for murder, drug dealing,<br />

racketeering & conspiracy; & many other suspects were arrested<br />

in 4 other states. The last day of Teddy Toth’s probation on<br />

charges related to the Black Biscuit investigation was Aug. 20,<br />

2010 - the day before the shooting in an unincorporated area<br />

northwest of Chino Valley. The shooting took place in the 2600<br />

block of North Yuma Drive in front of the Hells Angels gang’s<br />

old Skull Valley clubhouse where Toth, an ex-Pres for the Skull<br />

Valley chapter now lives, according to the detective’s report.<br />

Toth, sitting in his scooter with his oxygen breathing tubes on,<br />

was the next Hells Angels gang member the detective saw as he<br />

walked through the crime scene. When the detective stopped to<br />

ask Teddy how his health was, Teddy said not so good & asked<br />

when he could return to the house. Inside the home, the DPS<br />

GIITEM team also found Toth’s cuts with a “Filthy 666 Few”<br />

flash. “The Filthy Few flash is earned for committing a crime or<br />

violent act against another person,” the detective wrote in his<br />

report. “The 666 represents the sixth letter of the alphabet, the<br />

letter F or Filthy Few Forever.” Also on Toth’s cuts were a black<br />

& white “Dequiallo” flash that “indicates the wearer committed<br />

an act of violence towards a person with authority or resisted<br />

arrest violently. There are only 3 known wearers of the<br />

‘Dequiallo’ patch in Arizona. Toth is one of them,” the detective<br />

wrote in his report. The detective’s team also found a red notepad<br />

& other paperwork left <strong>by</strong> the front gate to the Hells Angels<br />

home. The detective found an entry in a notepad belonging to<br />

Larry Dean Scott Jr. of Chino Valley, a suspect in the shooting &<br />

a Hells Angels prospect known as Scotty, that read “Painter Death<br />

Date” & wrote in his report that the “note is in-line with current<br />

Hells Angels gang events for the Nomads charter.” The detective<br />

noted in his report that Jeffrey Becket of Kingman, a fully patched<br />

member of the Vagos, is also known as “Painter.” “This page<br />

also has a note to further indicate the note is from Larry Dean<br />

Scott Jr. The entry on the 2 nd line to the bottom states, “My house<br />

- Aug. 21,” the detective noted in his report. The detective also<br />

found a similar entry in a notepad belonging to John Anthony<br />

Bernard of Phoenix, another suspect in the shooting & a prospect<br />

for the Hells Angels Phoenix charter, that read, “Fri church 8:00<br />

PM Scotty’s.” While searching a 1997 H-D motorcycle,<br />

registered to Warren Spencer Kuntz of Flagstaff, the detective<br />

found a Hells Angels Nomads gang ledger, cash, & Hells Angels<br />

West Coast Officers Meeting gang notes for July 17, 2010. Kuntz<br />

is secretary for the Arizona Hells Angels Nomads gang, & “this is<br />

further supported <strong>by</strong> the ledger with gang members dues, fines &<br />

out of club status reported within the ledger,” the detective wrote<br />

in his report. The detective also found blue bank bags with<br />

money inside an unlocked brown briefcase in a 1998 Dodge SUV<br />

registered to Robert Kittredge of Prescott Valley.<br />

2 Hells Angels arrested on drug, weapon charges – Sept 26,<br />

2010 – California – By www.vcstar.com - Two Hells Angels<br />

were arrested Sat <strong>by</strong> county gang investigators. The Ventura<br />

County Sheriff’s Dept reported that its gang unit arrested Steven<br />

Templeton, 28, of Vallejo, & a 25-year-old Ventura man in 2<br />

separate traffic stops while conducting anti-gang operations.<br />

Templeton was stopped for a traffic violation at Hwy 101 & Main<br />

St in Ventura around 2:20 pm. Investigators found Templeton<br />

was under the influence of methamphetamine & was arrested,<br />

according to the report. An investigation of his motorcycle found<br />

a concealed loaded handgun, the Sheriff’s Dept said. Templeton<br />

is being held at Ventura County Jail on $100,000 bail for offenses<br />

including felony being under the influence of drugs while<br />

possessing a loaded firearm & street terrorism. Investigators<br />

stopped the 25-year-old Ventura man around 1 p.m. in Oak View<br />

for a traffic violation at Larmier & Hwy 33, according to the<br />

report. He was found to be under the influence of methamphetamine<br />

& arrested, the Sheriff’s Dept said. He was booked<br />

at Ventura County Jail & was released on $5,000 bail. There was<br />

a large gathering for the funeral of a Hells Angel on Sat afternoon<br />

in Ventura. Local law enforcement was aware of the funeral &<br />

kept an eye on it, but did not have any incidents. Officials could<br />

not say whether the men arrested attended the funeral.<br />

Police Don’t Expect Problems At Biker Rites – Sept 27, 2010 –<br />

Maine – http://wbztv.com - Police in the Maine city of South<br />

Portland say about 300 people attended the calling hours for a<br />

member of the Iron Horsemen motorcycle club killed during a<br />

shootout with police in Ohio. Fifty-one-year-old Harry Seavey Jr.<br />

was killed Sept. 18 during a gun battle in Cincinnati. South<br />

Portland Police say there were no problems at the Monday calling<br />

hours at a local funeral home. South Portland Police Chief Ed<br />

Googins told the Portland Press Herald police had a plan to<br />

manage traffic. He says Wed’s burial isn’t expected to be a<br />

problem because it’s easy to detour traffic away from the<br />

cemetery where Seavey will be buried.<br />

A young man at this construction site was bragging that he<br />

could outdo anyone based on his strength. He especially made<br />

fun of one of the older workman. After several minutes, the older<br />

worker had enough. “Why don’t you put your money where<br />

your mouth is?” he said. “I’ll bet a week’s wages that I can haul<br />

something in a wheelbarrow over to the other building that you<br />

won’t be able to wheel back.” “You’re on, old man,” the young<br />

man replied. “Let’s see what you’ve got.” The old man reached<br />

out & grabbed the wheelbarrow <strong>by</strong> the handles. Then nodding to<br />

the young man, he said with a smile, “All right. Get in.”


Mongols Win Case Again – Sept 27, 2010 – California – By<br />

The Aging Rebel; www.agingrebel.com - The Mongols MC has<br />

won the Mongols MC case again. In a ruling issued Sept 21 st &<br />

filed Sept 24 th , Fed District Judge Otis D. Wright has ruled that<br />

the United States cannot seize the name & patch of the club.<br />

Judge Wright ruled that his previously issued “preliminary order<br />

of forfeiture is rendered invalid.” The issue of whether the Dept<br />

of Justice & the ATF could simply steal the name & the patch of<br />

the Mongols Motorcycle Club was settled definitively in July<br />

2009. But then Christopher Brunwin & Steven Welk, 2 of the<br />

prosecutors in this case, as well as the ATF Agents who had<br />

created the case, just simply refused to believe they had lost & the<br />

Mongols had won. The presiding judge then, the late Florence-<br />

Marie Cooper wrote an angry decision which stated unequivocally<br />

that the Gov’t could not seize the marks. Last week Judge Wright<br />

wrote, “United States District Court Judge Florence-Marie Cooper<br />

already ruled upon the issues relevant to this proceeding.” In<br />

short, the prosecutors in this case have argued for 2 years that<br />

former Mongols Pres Ruben “Doc” Cavazos could forfeit the<br />

Mongols name & patch as part of his “punishment.” Two federal<br />

judges have now ruled the Mongols insignia is not Cavazos’ to<br />

give away. Last week, Judge Wright wrote: “Even if the Court<br />

were to accept the Govt’s evidence that Ruben Cavazos controlled<br />

the use of the mark during his tenure as National President, there<br />

is no support for the notion that a defendant’s control of property<br />

belonging to a RICO enterprise is sufficient to establish a<br />

forfeitable ownership interest in the property. In addition, there is<br />

no evidence that Ruben Cavazos owned a majority interest or any<br />

interest in the Mongol Nation that would equate to an ownership<br />

interest in the mark. There is no evidence that Shotgun<br />

Productions, LLC ever used the mark as a collective membership<br />

mark – to indicate membership in an organization substantially<br />

similar to that of the Mongol Nation. The purported assignment to<br />

Shotgun Productions, LLC is therefore without legal effect.<br />

Moreover, the Government’s evidence demonstrates that the<br />

Mongol Nation began using the collective mark in approximately<br />

1969, & either Mongol Nation or (MNMC) continues to use the<br />

mark to identify their members. (Guevara Decl. 6.) The Mongol<br />

Nation & (MNMC) <strong>by</strong> virtue of having used the collective<br />

membership mark since 1969, having registered the mark in 2005,<br />

& having continued use of the mark to identify members of the<br />

club, have acquired & maintained exclusive ownership in the<br />

collective membership mark at issue.”<br />

Criminal Enterprise: The Gov’t has attempted to prove that the<br />

Mongols is a “criminal enterprise” <strong>by</strong> blackmailing Cavazos &<br />

more than 60 other members of the club into “confessing” that the<br />

government’s allegation is true. The weapon the Gov’t has used to<br />

force these confessions is the severe penalties provided <strong>by</strong> the<br />

RICO Act. Simply <strong>by</strong> accusing these defendants of “racketeering”<br />

the Gov’t was able to cynically manipulate the justice system. In<br />

some cases, defendants confessed only to being members or<br />

officers of the motorcycle club. The actual charges against most<br />

of the defendants were for violations of state law. What Brunwin<br />

& the other prosecutors actually proved was that after being<br />

tortured with a RICO prosecution defendants become like<br />

prisoners of the North Vietnamese: They will confess to anything.<br />

And history may remember Brunwin for that. In most cases the<br />

charges against defendants were either blatantly contrived or<br />

completely invented out of air. The case demonstrates the<br />

evolution of American policing. To this day, most citizens think<br />

“police work” is “solving crimes.” It is common for even cynical<br />

& bright people to still think that professional police “solve”<br />

murders, robberies & rapes. In the Mongols case, the investigators<br />

were evaluated on their ability to create crimes.<br />

What Was Happening Here: What the Gov’t tried to do in the<br />

Mongols case was to outlaw this motorcycle club <strong>by</strong> seizing the<br />

name & the symbol club members wear on their backs – which<br />

bikers call colors. When lawyers cast their magic spells they use<br />

the Latin word indicia. Judge Carter prefers to call these<br />

expressions that Mongols wear on their backs insignia.<br />

Effectively outlawing the Mongols <strong>by</strong> forbidding them the use of<br />

the symbols they use to identify themselves was the original point<br />

of this case. The prosecutors must have thought that seizing the<br />

indicia would be a heartbreakingly brilliant strategy to obviate<br />

Article One, Clause 3 of the Constitution, which is the part of the<br />

American idea that forbids guilt <strong>by</strong> association. The press release<br />

that accompanied the unsealing of the indictment gloated: “The<br />

racketeering indictment seeks the forfeiture of the trademarked<br />

‘Mongols’ name, which is part of the ‘patch’ members wear on<br />

their motorcycle jackets. “‘In addition to pursuing the criminal<br />

charges set forth in the indictment, for the first time ever, we are<br />

seeking to forfeit the intellectual property of a gang,’ said United<br />

States Atty Thomas P. O’Brien. ‘The name “Mongols,” which is<br />

part of the gang’s “patch” that members wear on their motorcycle<br />

jackets, was trademarked <strong>by</strong> the gang. The indictment alleges that<br />

this trademark is subject to forfeiture. We have filed papers<br />

seeking a court order that will prevent gang members from using<br />

or displaying the name “Mongols.” If the court grants our<br />

request for this order, then if any law enforcement officer sees a<br />

Mongol wearing his patch, he will be authorized to stop that gang<br />

member & literally take the jacket right off his back.’”<br />

Successfully seizing the Mongols indicia would have also allowed<br />

the ATF to forbid patch holders & their suspected sympathizers<br />

Constitutional refuge from unreasonable searches & seizures &<br />

summary punishment without due process. It would have worked<br />

like this: Once the indicia was forfeited ATF thugs could have<br />

carried out violent searches of homes & businesses looking for the<br />

forbidden symbol. The searches were common in the summer of<br />

2009 & the point of them was not & would not be to gather or<br />

preserve “evidence” but to summarily punish “bad guys.” Private<br />

places are routinely damaged & wrecked in these searches as a<br />

method of punishment. Children are terrorized, parents are<br />

assaulted, robbed & bullied, pets are gunned down & sometimes<br />

the targets of these searches are murdered as a form of extrajudicial<br />

summary punishment. Judge Wright’s ruling last week is<br />

another small step to slowing all that down, too.<br />

The first blonde guy joke? An Irishman , a Mexican & a Blonde<br />

Guy were doing construction work on scaffolding on the 20th<br />

floor of a building. They were eating lunch & the Irishman said,<br />

‘Corned beef & cabbage! If I get corned beef & cabbage one<br />

more time for lunch, I’m going to jump off this building.’ The<br />

Mexican opened his lunch box & exclaimed, ‘Burritos again! If I<br />

300 Bikers Pay Respects To Gunman Killed In Shootout –<br />

Sept 27, 2010 – Maine – By www.wlwt.com - Police in the Maine<br />

city of South Portland said about 300 people attended a visitation<br />

for a member of the Iron Horsemen MC killed during a shootout<br />

with police in Cincinnati. Harry Seavey Jr. was killed Sept. 18<br />

during a gun battle in Cincinnati, after officers said they went into<br />

a Camp Washington eatery to speak with members of the<br />

motorcycle club. South Portland Police said there were no<br />

problems at the Monday calling hours at a local funeral home.<br />

South Portland Police Chief Ed Googins said officers had a plan<br />

to manage traffic. He said Wednesday’s burial isn’t expected to<br />

be a problem because it’s easy to detour traffic away from the<br />

cemetery where the 51-year-old Seavey will be buried.<br />

Cincinnati’s police chief, Thomas Streicher, said officers had<br />

heard complaints from bars on the west side about Iron Horsemen<br />

blocking doorways & questioning patrons to find members of the<br />

Detroit Highwaymen MC. Streicher said a vice officer spotted a<br />

large number of motorcycles on the day of the shooting & some<br />

Iron Horsemen outside JD’s Honky Tonk & Emporium & called<br />

his supervisor. The chief said a plan was quickly put together to<br />

visit the bar & talk with the club members about the complaints.<br />

But when the caravan of 14 officers, including 3 vice officers<br />

wearing masks, arrived at the bar, Streicher said Seavey pulled<br />

out a 9mm handgun & opened fire. Two officers were wounded<br />

& Seavey was shot to death.<br />

Minnesota Joint Analysis Center Charitable Motorcycle Run<br />

Minnesota Narcotics & Gang Task Force is requesting<br />

information on Outlaw Motorcycle Gang activity that may have<br />

an impact on this year’s Fall Flood Run. The Flood Run is a<br />

charitable motorcycle run that takes place both in the spring & fall<br />

along the St. Croix River & attracts thousands of riders, the<br />

majority of which are law-abiding. However, information has<br />

been received that this year’s Flood Run on September 18, 2010,<br />

is expected to attract an increased number of Hells Angels &<br />

Outlaws gang members, which are rival clubs. Both clubs are<br />

known to be involved in criminal activities such as assault,<br />

narcotics, money laundering, prostitution & thefts & both are also<br />

considered to be “at war” with each other. According to the<br />

Milwaukee Field Division of the FBI, in light of the June 2010<br />

arrests of 27 Outlaws members, including some leadership, the<br />

Hells Angels may attempt to take advantage of the perceived<br />

weakness of the Outlaws to avenge the beating & loss of colors <strong>by</strong><br />

members of the Hells Angels at the hands of the Outlaws during<br />

the Spring 2010 Flood Run. Incidents that occur between rival<br />

clubs nationwide are often retaliated for <strong>by</strong> different club<br />

chapters. Therefore, the MNJAC & WSIC are requesting<br />

information regarding any incidents of violence between the Hells<br />

Angels & the Outlaws, as well as their respective support clubs.<br />

Additionally, information regarding movement of various gang<br />

members gathering & travelling en route to the run would be<br />

appreciated. . . . Any contact with biker gangs should be<br />

considered a high risk situation due to the increased likelihood of<br />

all members being armed in anticipation of any retaliation<br />

Investigation Finds Prosecutor Misconduct Widespread – Sept<br />

American criminal justice system, defendants are entitled to the<br />

presumption of innocence. This is often stated <strong>by</strong> saying that one<br />

is considered “innocent until proven guilty.” In order to convict<br />

the defendant, the prosecution has the burden of proof. The<br />

defendant does not have to speak or otherwise give testimony that<br />

could be damaging to their defense. It is up to the prosecution to<br />

prove the case. The prosecution is in a somewhat unique situation<br />

in that on the one hand their job is to prosecute & convict the<br />

guilty; they are also supposed to let the innocent go free.<br />

However, like any job, there is pressure for a prosecutor to win.<br />

For years members of the defense bar & criminal justice experts<br />

have said that due to prosecutor misconduct, the balance is tipped<br />

too far in favor of the prosecution as prosecutors are cheating the<br />

rules to win convictions. A recent USA Today piece on the<br />

subject supports that conclusion & sheds new light on the fairness<br />

of the criminal justice system. It’s not pretty. According to the<br />

article, in many cases, Fed prosecutors kept key exculpatory facts<br />

from the jury & the defendant. Prosecutors covered up evidence<br />

in a number of ways, failed to disclose the deals that they had<br />

promised convicts in exchange for their cooperation, broke plea<br />

bargain deals & lied to judges & juries. The cheating has come at<br />

a huge cost. USA Today reports that prosecutorial misconduct has<br />

cost millions of dollars in legal fees, landed innocent people in<br />

prison & set guilty people free. It’s an excellent article & it far<br />

more in depth than we have time to go into. Looking for a<br />

takeaway? Innocent or not, it’s best to avoid all contact with the<br />

criminal justice system. You are entitled to the presumption of<br />

innocence, but win or lose, it’s a long, tiring, expensive process &<br />

as the investigation demonstrates, it’s far from perfect.<br />

Judge made ‘serious errors’ in sentencing Hells Angel, appeal<br />

court hears – Sept 27, 2010 – Canada – By Keith Fraser;<br />

www.theprovince.com - Federal prosecutors were in court Tue<br />

appealing a 1-year jail sentence handed to a member of the Hells<br />

Angels who pleaded guilty to conspiracy to trafficking in large<br />

quantities of methamphetamines & cocaine. Crown counsel<br />

Martha Devlin told a three-member panel of the B.C. Court of<br />

Appeal that B.C. Supreme Court Justice Peter Leask had made 4<br />

“serious errors” in principle in his sentencing of Randy Potts.<br />

Devlin noted that the B.C. Court of Appeal had in August more<br />

than quadrupled the sentence that Leask had imposed on Potts’<br />

co-accused, John Punko. The prosecutor said Leask erred in his<br />

“piecemeal” approach to sentencing & had failed to give enough<br />

weight to denunciation & deterrence. She said Leask failed to<br />

properly apply the case law & wrongly determined that the<br />

methamphetamine & cocaine charges should be sentenced<br />

concurrently rather than consecutively. In Dec 2009, Potts was<br />

dealt his one-year sentence after he pleaded guilty to the charges.<br />

He was an “investor” in the scheme to manufacture & distribute<br />

meth, providing $14,000 in cash & 16 kilograms of the precursor<br />

drug ephedrine in order to produce 8 kilos of meth. He received<br />

back $231,500. For trafficking .85 kilos of cocaine, he received<br />

$32,800. Punko was sentenced to 14 months <strong>by</strong> Leask, but the<br />

B.C. Court of Appeal found that the trial judge had erred &<br />

increased his sentence to 5 years, 2 months. Both had pleaded<br />

guilty after Leask dismissed the more serious charge that they had<br />

committed their crimes on behalf of or in association with a<br />

criminal organization. That ruling is being appealed as well <strong>by</strong> the<br />

federal Crown. In addition to the drug convictions, they were<br />

earlier found guilty of various weapons-related offences. A jury<br />

hearing the weapons case found them not guilty of committing the<br />

offences for a criminal organization. Potts & Punko were arrested<br />

in July 2005 as part of the RCMP’s Project E-Pandora crackdown<br />

on the East End chapter of the Hells Angels.<br />

Man arrested in connection with biker shootout booked again<br />

www.dcourier.com - Prescott police arrested a man for resisting<br />

arrest Saturday outside a downtown bar after he allegedly cursed<br />

at officers, would not sign a citation, refused to exit a vehicle<br />

when told he was under arrest, & pulled away from officers. An<br />

officer booked Robert Edward Kittredge, 36, of Dewey, into the<br />

Yavapai County Jail on charges of resisting arrest, criminal<br />

trespassing & disorderly conduct. Kittredge was arrested last<br />

month in connection with the shooting between the Hells Angels<br />

& Vagos motorcycle gangs in an unincorporated area northwest of<br />

Chino Valley. At 10:50 p.m., police arrived at Coyote Joe’s after<br />

the owner called them about a disorderly man, later identified as<br />

Kittredge, near the back door of the bar. “The owner told the<br />

officer that Kittredge yelled a racial slur at the cook & tried to<br />

fight the cook, but Kittredge’s friends pulled him back,” said Lt.<br />

Andy Reinhardt, spokesman for the Prescott Police Department.<br />

“The suspect left when the owner asked him to, but later entered<br />

through the back door & forced his way past the bouncers.” The<br />

owner said the bouncers avoided confronting Kittredge because<br />

they knew he’d already called police. The owner asked police to<br />

trespass Kittredge from Coyote Joe’s for one year, according to<br />

the police report. When officers approached Kittredge, they asked<br />

him to leave the bar with them to talk outside since the music was<br />

loud. Kittredge told the officer that he hadn’t yelled a racial slur<br />

at the cook or tried to fight him. As the officer spoke with<br />

Kittredge he smelled the odor of alcohol coming from Kittredge’s<br />

mouth, noticed his red, bloodshot, watery eyes, & heard his<br />

slurred & mumbled speech. The officer explained the trespass<br />

warning to Kittredge, & while he was filling it out, Kittredge<br />

stared at the other officer. When the other officer asked Kittredge<br />

if he could help him with something, Kittredge challenged the<br />

officer to “step up.” The officer told Kittredge to calm down &<br />

that he did not want to fight him. After signing his trespassing<br />

citation, Kittredge told the officer that he understood he could not<br />

return to Coyote Joe’s for one year. As the officer filled out<br />

paperwork in his patrol car, the bar owner came back & told him<br />

Kittredge tried to enter the bar & he wanted to press charges.<br />

When the officer asked where Kittredge was, the bouncers<br />

pointed toward a parking lot directly across the street. The officer<br />

found Kittredge in the front passenger seat of a vehicle & asked<br />

him it he’d entered the bar again. Kittredge responded, “So what<br />

if I did,” according to the police report. The officer cited<br />

Kittredge for criminal trespassing & disorderly conduct, then<br />

Kittredge cursed at the officer & refused to sign it, Reinhardt said.<br />

The officer told Kittredge he was under arrest, but Kittredge<br />

wouldn’t get out of the vehicle, so another officer grabbed<br />

Kittredge’s arm & told him to get out of the vehicle, Reinhardt<br />

said. Kittredge pulled away from the officer, then the officer<br />

pulled him out of the car, took him to the ground, handcuffed him,<br />

& put him in the patrol car.<br />

Drug conviction against Iowa accountant vacated – Sept 28,<br />

2010 - Iowa - By AP; www.chicagotribune.com - A Fed judge has<br />

vacated a drug conviction against a millionaire Iowa accountant<br />

who prosecutors said handled drug money for the Sons of Silence<br />

motorcycle gang. U.S. District Judge Robert Pratt ruled Monday<br />

that Russell Schoenauer’s defense atty -- James Davis of Omaha,<br />

Neb. -- gave ineffective assistance to Schoenauer during his 2002<br />

drug conspiracy trial. The 59-year-old from Waukee was<br />

indicted in 2001. He received a 17-year prison sentence on the<br />

drug charges & a 10-year sentence on gun charges. The Des<br />

Moines Register reports he could be released from a South Dakota<br />

prison as soon as 2012. Federal agents alleged that Schoenauer<br />

was the gang’s Nat’l treasurer & he was accused of supplying<br />

members of the Sons of Silence with drugs & weapons.<br />

Schoenauer insisted he was innocent, & in Aug his new atty<br />

argued at a hearing that Davis failed to effectively represent<br />

Schoenauer. Pratt, who also oversaw the 2002 trial, ruled<br />

Monday that Davis didn’t research records that could have better<br />

explained millions of dollars in unexplained income attributed to<br />

Schoenauer. However, Davis defends his work in the case & said<br />

he asked for all evidence that would have helped Schoenauer.<br />

“The failure to disclose the evidence was egregious, but I didn’t<br />

do it,” Davis said. U.S. attorney’s office spokesman Mike Bladel<br />

said federal prosecutors are reviewing the ruling. At the time<br />

Schoenauer was indicted, authorities froze his estimated $12.5<br />

million in real estate holdings & $1.5 million in other<br />

investments.<br />

Vagos members file claims against county after raids – Sept<br />

28, 2010 – California – By John Asbury; The Press-Enterpise,<br />

www.pe.com - The Vagos MC has filed 16 claims against<br />

Riverside County & state authorities seeking damages for a March<br />

raid on club members in Hemet, Fontana & Indio. The claims<br />

filed <strong>by</strong> the motorcycle club & 4 families also target Riverside<br />

County District Attorney Rod Pacheco. The claims allege<br />

defamation of character & violation of civil rights related to the<br />

March 17 sweep. During “Operation Everywhere,” district<br />

attorney’s officials, sheriff’s deputies & police arrested 33 people<br />

named as members of the Vagos on suspicion of parole violations<br />

& drug & weapon charges. “The members & associates of the<br />

Vagos & the family members of the Vagos members also suffered<br />

from humiliation & emotional distress as a result of the public<br />

employees’ public defamatory statements about the Vagos & its<br />

members,” the claim states. Riverside County officials said the<br />

claims are under review & a decision on whether to accept or<br />

reject them has not been made. In addition to Pacheco, the claims<br />

name district attorney spokesman John Hall, an unidentified<br />

district attorney’s investigator & a sheriff’s sergeant. The Vagos<br />

accuse authorities of ransacking homes, intimidating &<br />

wrongfully detaining family members & telling some restaurants<br />

not to serve the Vagos members. “This is a ridiculous attempt to<br />

intimidate law enforcement <strong>by</strong> a criminal street gang,” Pacheco<br />

said in a statement last week. Joseph Yanny, an attorney for the<br />

Vagos, said he also has filed claims against state Attorney General<br />

Jerry Brown, Hemet police & other agencies. He said the rhetoric<br />

of the March 17 news conference & reports that followed unfairly<br />

linked the Vagos to the Hemet police attacks. The Vagos were<br />

not named as suspects in the Hemet case but Pacheco made<br />

several references to a history of attacks on law enforcement.<br />

The claims cite Hemet Police Chief Richard Dana’s remark that<br />

the sweep made the Vagos “scatter like cockroaches.” When<br />

asked at the time about their involvement in the attacks, Pacheco<br />

said the “Vagos have got our significant attention in recent<br />

months ... & their time has come.” Less than 4 months later,<br />

Hemet police charged 2 men with conducting the attacks to thwart<br />

a marijuana trial. Pacheco said the 2 men may have had<br />

associations with the Vagos, but were not members. Yanny said<br />

the sweeps were a campaign stunt for Pacheco’s failed June reelection<br />

bid. “The county of Riverside should rein in people of<br />

his position. He does not have the right to use his office in an<br />

attempt to generate fear & opinions to aid political campaigns,”<br />

Yanny said. “This was a very concerted effort prior to the election<br />

to make them the bad boys & beat up them for political purposes.”<br />

It was that lawyer’s fault when he got shot in the face <strong>by</strong> V.P.<br />

Dick Cheney. When Cheney asked him to go hunting - he said:<br />

“If you want to go hunting - I’m game!”


Bolt-cutter extortion leaves family in fear – Sept 28, 2010 –<br />

Australia – By Aja Styles; www.smh.com - A 42-year-old man<br />

linked to the notorious Finks motorcycle gang has admitted to<br />

threatening to use bolt cutters on a Perth mining figure & his<br />

family in a bid to extort $700,000. Darryl Kelvin Stretton, of<br />

Milton, has pleaded guilty in the Perth District Court to 2 counts<br />

of obtaining money using threats. The victim, whose identity has<br />

been suppressed due to fear of reprisals, was threatened <strong>by</strong><br />

Stretton at a South Perth apartment in Oct 2008 because Stretton<br />

had lost money based on an investment involving the victim. The<br />

court was told Stretton had befriended the businessman in 2007 &<br />

they had numerous emails & correspondence about investment<br />

opportunities in the lead up to the Oct 28 meeting in Perth.<br />

Stretton had flown to Perth & organised for the victim to meet at<br />

the King Edward Street apartment, where he was staying with a<br />

friend. In the unit the victim was confronted <strong>by</strong> Stretton & a<br />

heavily tattooed man identified only as “Ox”, who was holding a<br />

baseball bat & hitting it into his hand while asking where the<br />

money was, the court heard. Stretton told the victim he was<br />

responsible for him & his underworld associates investing<br />

$150,000 in shares which had since dropped in value. Stretton &<br />

Ox demanded the man pay $20,000 that day, with another<br />

$90,000 each of the following 2 weeks & bolt cutters would be<br />

used to cut off one of the man’s fingers for each week a payment<br />

was late. The victim, who was too scared to go to police, instead<br />

went to the ANZ bank & drew up a cheque for $200,000, which<br />

was later deposited in Stretton’s brother’s account. A year later<br />

the victim was again contacted <strong>by</strong> Stretton who demanded<br />

$500,000, this time in the company of a known “murderer &<br />

psycho” motorcycle gang member, the court was told. Finks<br />

member Matthew James Coventry has already been convicted to a<br />

12-month suspended prison term for lesser charges after tapped<br />

phone calls recorded <strong>by</strong> police revealed a threat to cut the victim’s<br />

wife’s finger off if he did not pay the money. The victim was<br />

confronted near the Sir James Mitchell Park & told to meet again<br />

at the Atomic cafe in South Perth. He raced home to pack up his<br />

wife & children & move them to an unknown location. He then<br />

went to meet with Stretton, who came flanked <strong>by</strong> Coventry &<br />

Coventry’s cousin who worked in security. They stood guard<br />

providing surveillance for the meeting. The victim & Stretton<br />

communicated using an electronic writing tablet, in which<br />

Stretton warned the victim & his family were going to “get<br />

whacked” <strong>by</strong> the bikies if he didn’t co-operate or went to police.<br />

He was told that they knew everything about him, including all<br />

his children’s names & where their holiday house was located.<br />

Stretton’s lawyer Gary Massey argued that during this<br />

conversation his client admitted he was “in as deep” as the victim<br />

& he was remorseful over the demands since he owed the Finks<br />

the money. Stretton had been involved in a caravan park business<br />

that went broke but still lived the high life in Sydney according to<br />

evidence tendered in the District Court. Stretton was eventually<br />

arrested on Nov 22 at a Batemans Bay motel, in NSW, &<br />

extradited to Perth where he has remained in custody away from<br />

his wife & 2 teenage children. Judge Birmingham showed little<br />

sympathy for Stretton who he described as carrying out<br />

“premeditated & threatening behaviour leaving lasting fear in the<br />

complainant & his family”. The victim feared for his family’s<br />

lives so much that he moved houses & hired 24-hour security<br />

surveillance. Judge Ronald Birmingham ordered a compensation<br />

order for the $200,000 to be paid to the victim <strong>by</strong> Stretton once he<br />

is no longer deemed bankrupt. Although Judge Birmingham<br />

remanded off sentencing until October 1, he told Stretton that it<br />

was a most serious crime that required a strong level of deterrence<br />

& would likely result in “a substantial term of imprisonment”.<br />

Dallas Der<strong>by</strong> Devils fans & volunteers attacked at local bar –<br />

Friends & family of the Dallas Der<strong>by</strong> Devils were attacked last<br />

night at Big Shots Sports Bar in Bedford. Initial reports indicate<br />

no serious injuries. Members of the Boozefighters MC ganged<br />

up on several members of a softball team comprised of the friends<br />

& family of several local der<strong>by</strong> girls. Reports <strong>by</strong> those involved<br />

show that the motorcycle club’s members attacked indiviuals in<br />

groups of 5 or more on one person. An off duty waitress was also<br />

thrown to the ground in the midst of the fight. The bouncers<br />

employed <strong>by</strong> the bar sat idley <strong>by</strong> as the 3 men & 1 woman were<br />

accosted <strong>by</strong> the bikers. Contusions & goose eggs on the head<br />

seem to be the worst of the injuries despite the woman receiving a<br />

beer bottle to the face. Bedford police failed to respond to the<br />

phone call placed seeking assistance. At least those attacked<br />

know that not all motorcycle clubs act in such a manner. Most of<br />

those involved have participated & enjoyed the hospitality of both<br />

the Wind & Fire MC & the Scorpions MC on many different<br />

Biker Brawl Leaves Man with Stab Wounds – Sept 29, 2010 –<br />

Carson City man is recovering from stab wounds after being<br />

involved in a large biker brawl Saturday night. Around 9:40 pm,<br />

police were called to 45 Vista Blvd to break up a fight involving<br />

about 30 people, many of them members of motorcycle gangs.<br />

One man was stabbed & he was taken to Renown Medical Center<br />

& treated for non-life threatening wounds. Police say the fight is<br />

still under investigation…<br />

Court told bikies planned Zervas hit – Sept 29, 2010 -<br />

an order that allegedly came from the top of the Comanchero<br />

bikie gang - & there was to be “no dicking around”, a court heard<br />

yesterday. In the aftermath of his brother’s violent death in a<br />

Sydney Airport brawl last year, Hells Angel Peter Zervas had<br />

allegedly moved to the top of the Comanchero hit list. Police<br />

allege in documents filed in court that a former Comanchero<br />

insider told police of covert meetings to discuss the hit on Zervas.<br />

One meeting of junior members was allegedly told the order to<br />

“knock” Zervas “came straight from Dakka”. Police allege in the<br />

document, tendered to Waverley Local Court, that “Dakka” is the<br />

nickname of Daux Ngakuru - the current boss of the Comanchero<br />

gang. <strong>Brothers</strong> Richard & Christopher Fong are charged with<br />

conspiracy to murder & participating in a criminal gang. Ngakuru<br />

has not been charged. Zervas was shot up to 8 times in his<br />

driveway a week after Anthony was fatally bashed at Sydney<br />

Airport. Patrick Conaghan, acting for the Fongs, yesterday<br />

applied for bail & police tendered a prosecution outline. In it,<br />

they allege rank & file Comanchero were ordered to carry out<br />

“around the clock” surveillance on Zervas until he was<br />

“knocked”. The alleged plot had been stepped up amid fears that<br />

Zervas & his Hells Angels gang members would mount their own<br />

revenge attacks. “It was anticipated that after the funeral [of his<br />

brother] Peter Zervas would go underground to engage in<br />

retaliatory attacks on the Comanchero member- ship & officeholders,”<br />

police alleged. At least 2 surveillance groups were<br />

allegedly organized, even monitoring Zervas as he attended his<br />

brother’s wake, using portable radios. One senior member<br />

allegedly told them: “Come on boys, get it done.” Conaghan told<br />

the court a witness codenamed “SP” was behind the charging of<br />

his clients, but said he was an unreliable witness having lied under<br />

oath in an attempt to disassociate himself from his former gang.<br />

Magistrate Jacqueline Milledge denied both men bail.

Administration told a congressional panel on Sept 28 that he<br />

wants to work with Congress to promote helmet use among<br />

motorcyclists across the United States. Addressing the U.S.<br />

Senate Subcommittee on Consumer Protection, Product Safety &<br />

Insurance, NHTSA Administrator David Strickland said that to<br />

reduce motorcycling fatalities “the most important step we could<br />

take would be to assure that all riders wear a DOT-compliant<br />

helmet, which are 37% effective in reducing fatalities. “We<br />

estimate that helmets prevented over 1,800 fatalities in 2008, &<br />

that more than 800 additional fatalities could have been avoided if<br />

all riders wore helmets,” he said. “NHTSA will actively work<br />

with Congress to promote helmet use.” Strickland’s comments<br />

were part of his overall testimony regarding how safety provisions<br />

in the transportation reauthorization bill (SAFETEA-LU) played a<br />

role in reducing highway fatalities. The American Motorcyclist<br />

Association is concerned that Strickland may be recommending<br />

that Congress try to pressure states into passing mandatory<br />

helmet-use laws. In the past, Congress tried to force states to<br />

approve such laws <strong>by</strong> withholding Fed transportation & safety<br />

dollars to states without mandatory helmet laws. The AMA<br />

supports states’ rights to determine their helmet policies free from<br />

the threat of federal sanctions. Congress affirmed this right as<br />

recently as 1995 in the National Highway System Act, when<br />

lawmakers removed federal penalties placed on states that didn’t<br />

have mandatory helmet laws. “The AMA believes that the best<br />

way for the NHTSA to reduce motorcycle crashes is through<br />

programs such as rider education & increasing motorcycle<br />

awareness among vehicle drivers,” said Ed Moreland, AMA<br />

senior vice president for Gov’t relations. “These programs would<br />

help reduce the likelihood that a crash will happen in the first<br />

place.” In addition, said Moreland, motorcyclists would be much<br />

better served <strong>by</strong> applying any funding that may go toward<br />

requiring motorcyclists to wear helmets to the national motorcycle<br />

crash causation study that is currently under way at Oklahoma<br />

State University. This is a sentiment supported <strong>by</strong> U.S. Rep. Jim<br />

Dress-up bikies: caught with 1174 cosmetic items – Sept 29,<br />

2010 – Australia – By www.SMH.com - Two bikies have been<br />

charged with multiple offences after police officers allegedly<br />

found police uniforms, name badges, a notebook & a mass of<br />

stolen cosmetics at 2 houses in Sydney’s west yesterday. They<br />

also allegedly uncovered a treasure trove of guns & drugs.<br />

Detectives raided a property in Chesham Street, St Marys, about<br />

1.30pm yesterday. As well as the police paraphernalia & 1174<br />

items of cosmetics, police also allegedly found a loaded sawn-off<br />

shotgun, bullets, amphetamines, hydroxybutanoic acid &<br />

cannabis. A 30-year-old man, said to be part of the Rebels<br />

Outlaw Motorcycle Gang, was arrested & charged with multiple<br />

offences, including unauthorised possession of a police outfit. He<br />

was refused bail & is to appear at Penrith Local Court today. A<br />

27-year-old man, said to be with the Lone Wolf bikies, was found<br />

at another address in Chesham St. A search of the premises<br />

allegedly revealed 215.2 grams of cannabis, 10 vials of steroid<br />

liquids & tablets & $7,000 in cash. He has been charged with<br />

possessing cannabis & anabolic steroids & was granted bail to<br />

appear in Penrith Local Court on Oct 20. A third bikie, aged 46,<br />

also found himself in trouble for making too much noise after<br />

turning up during the latter raid on a H-D. Police booked him for<br />

having an expired registration sticker.<br />

City Council Approves Urgency Ordinance Prohibiting<br />

Criminal Street Gangs From City Events – Sept 30, 2010 -<br />

of a proposed urgency ordinance Tuesday night, ended with 2<br />

unlikely groups getting together to solve a problem. Lancaster<br />

City Council members Marv Crist, Sherry Marquez & Ken Mann<br />

with Mayor R. Rex Parris were scheduled to discuss & pass an<br />

ordinance that would amend the city code to prohibit criminal<br />

street gangs from attending city events. The change in the<br />

ordinance would “prohibit members of a criminal street gang from<br />

attending or being physically present at a city event with the intent<br />

of publicizing criminal street gang dominance over a territory to<br />

control it or keep others out or to conceal on-going criminal<br />

activity,” said City Attorney David McEwen. “We’ve carefully<br />

crafted the section so we focused, not them being present, but<br />

being there with the intent to do certain criminal things,” McEwen<br />

added. Some of those crimes included murder, rape, looting,<br />

assault, possession of firearms, illegal drugs, etc. The groups<br />

would have to be engaged in specific course of conduct, Parris<br />

said. “Does it apply to groups that are just flying their colors?”<br />

Crist asked. McEwen said it did not apply to these groups.<br />

However, the ordinance was challenged <strong>by</strong> members of<br />

motorcycle clubs who filled the council chambers saying that it<br />

would infringe on their constitutional rights. Also in attendance<br />

was an attorney who said he represented bikers’ rights & that the<br />

ordinance was unconstitutional. “Which group do you represent?<br />

The rapists, the murderers, the drug dealers. Which group do you<br />

represent? …This ordinance is very clear that this ordinance is<br />

directed at those groups that engage in a consistent pattern of<br />

robbery, rape, murder, extortion, mayhem & the list goes on, &<br />

now there is an attempt to come up & claim it is every motorcycle<br />

group,” Parris said. The groups, which the ordinance is focused<br />

on, are certain groups that terrorize our neighborhoods, he added.<br />

Atty Norman Fernandez said that members of the motorcycle<br />

groups should have the right to liberty & justice. “I do not<br />

support liberty & justice for rapists, murders, drug dealers,<br />

extortionist & thieves. I want them out of my community,” said<br />

Parris. Parris reminded the atty that nowhere in the ordinance did<br />

it mention motorcycle clubs. Fernandez also said it would give<br />

unfettered discretion to law enforcement. “This is<br />

unconstitutional,” he added. However, McEwen said there was a<br />

precondition that they would have to be a member of a criminal<br />

street gang…three or more people who have engaged in criminal<br />

activity. If they haven’t engaged in criminal activity, it doesn’t<br />

apply & they can’t be hassled. Motorcycle club members spoke<br />

out against the ordinance, fearing that it would be abused. Many<br />

said the clubs had no criminal records here in the Antelope Valley<br />

& that they were not a menace to society. Parris agreed that the<br />

ordinance was probably too broad & that he wanted it to go back<br />

to the Justice Commission to rework it. During the meeting, a<br />

disturbance broke out in the audience <strong>by</strong> a few motorcycle club


members. Parris pounded the gavel loudly & Los Angeles<br />

County Sheriff’s deputies had to escort the man creating the<br />

disturbance outside. Afterwards, Bob Fulbright, a member of<br />

the Vagos MC, spoke about being stopped <strong>by</strong> deputies. The first<br />

was a routine stop, he said, but the second resulted in his head<br />

being slammed into a police car. “I’ve done a lot for this<br />

community,” Fulbright said encouraging deputies to work &<br />

communicate with the motorcycle groups. “Up here in the<br />

Mojave Desert we have made a practice to get along,” he added.<br />

Fulbright said the groups are allowed to wear their soft patches –<br />

tee shirts – at Thunder on the Lot. Parris replied that he didn’t<br />

think that would be a problem in the city of Lancaster. “This<br />

really is something I really want to resolve,” Parris told Fulbright.<br />

“I’ll tell you what I am planning. We have the Streets of<br />

Lancaster coming up & so I need an ordinance for that. After<br />

that, I’m going to ask that it go back to the Justice Commission &<br />

be rewritten & I would love to have you involved in that process,”<br />

Parris said. Parris also said that if Fulbright was going to attend<br />

the Lancaster events, he would like for him to be involved in the<br />

ordinance rewriting process early. “The only thing I want to<br />

accomplish is that these families will be absolutely safe,” Parris<br />

added. Fulbright agreed. “I don’t want to be ringing my hands<br />

after the 14-year-old is dead,” Parris said referring the a recent<br />

gang shooting that left a 14 year old Lancaster girl dead. The<br />

council voted 4 to 0, with Councilman Ron Smith absent, in favor<br />

of the urgency ordinance.<br />

Hells Angels motorcyclists driving dangerously – Oct 1, 2010 –<br />

RCMP have seized the Harleys of 2 full-patch Hells Angels after<br />

they allegedly raced across the Lower Mainland at speeds of up to<br />

160 kilometres an hour. The 2 men were wearing their deathhead<br />

patches Tue when they whipped past an unmarked police car on<br />

Hwy 1 near 200th St in Langley. “Police were attempting to<br />

pace the bikes to determine speed but were unable to keep up with<br />

the motorcyclists as they rode side-<strong>by</strong>-side dangerously at<br />

extreme speeds from lane to lane & passing on shoulders,” Sgt.<br />

Peter Thiessen said Friday. The RCMP’s Air 1 helicopter was<br />

near<strong>by</strong> & tracked the bikers as they continued along the Trans-<br />

Canada, evening existing on 1 st Ave in Vancouver, Thiessen said.<br />

The leather-wearing pair was stopped <strong>by</strong> Burna<strong>by</strong> RCMP near the<br />

clubhouse of the elite Nomad Chapter of the Hells Angels on<br />

Grant St just east of Boundary. One driver complied with police<br />

& his Harley was seized under the new excessive speed<br />

legislation. He was presented with violation tickets for excessive<br />

speed & riding in tandem. The other driver continued to the Hells<br />

Angels clubhouse & his motorcycle was seized later on that day.<br />

“There is considerable construction along Hwy 1 & the public<br />

needs to be aware of construction site speed limits, for their own<br />

safety & the safety of those working at these sites,” Thiessen said.<br />

“For those who ignore those speed limits, Air 1 continues to be a<br />

valuable tool for police in the Lower Mainland, allowing us to<br />

track drivers without putting the public at further risk.”<br />

Clearwater RCMP also seized a Lower Mainland man’s vehicle<br />

under the new excessive speed law as he drove to Jasper with his<br />

visiting British parents. Police said the man cruised through<br />

Clearwater in a rental car & was caught on radar going 158<br />

kilometers per hour in a 100 kilometer zone. Sgt. Stuart Seib said<br />

the tourists were stranded & had to figure out how they could<br />

continue on their holiday. “In their minds, the police had wrecked<br />

their holiday. In reality, it was actually the driver of this vehicle<br />

that made the decision to risk everyone else’s well being <strong>by</strong><br />

driving in a manner that is not acceptable,” Seib said. “Had an<br />

animal run out of the ditch or a car pull out of a driveway, the<br />

results could have been devastating.”<br />

with Hells Angels members.<br />

Aug 30: Police appeal for person who posted footage on YouTube<br />

of a vicious Hindley St brawl last year to come forward. Two<br />

northern suburbs’ New Boys gang members, aged 23 & 36, were<br />

charged over the brawl in Oct, 2009.<br />

Aug 20: Police allegedly find enough amphetamines for 1000<br />

street deals in a raid on the West Beach home of an alleged New<br />

Boys associate. A man, 23, was charged.<br />

Aug 14: A home in Kavel Lane, Klemzig, was hit <strong>by</strong> six bullets<br />

about 9pm in a drive-<strong>by</strong> shooting. The home belonged to a New<br />

Boys member who was in custody. Two people inside the home<br />

were not injured.<br />

Aug 3: Andrews Farm home of Hell’s Angel Zoran Nikolic<br />

riddled with bullets in drive-<strong>by</strong> shooting for the second time.<br />

Nobody injured. New Boys suspected to be responsible.<br />

July 29: A alleged New Boys gang associate was stabbed inside<br />

the Tea Tree Plaza Myer store during a gang fight. Hells Angels<br />

associate Seywan Moradi, Hussain Ali Alzuain & Andrew<br />

Hopwood were charged over the stabbing.<br />

July 25: Shot fired through the front door of an Elizabeth East<br />

home where former New Boys member & Central District junior<br />

footballer Dylan Jessen was living.<br />

brawl outside Apple nightclub in Synagogue Place on March 21.<br />

a late Hells Angels member firebombed. Suspected links to<br />

spiralling feud between the Hells Angels & the New Boys.<br />

Police brace for reprisals as bikie violence explodes in Perth –<br />

Police are preparing for violent retaliations between 2 rival bikie<br />

gangs after 3 Finks were hospitalised, including one man who was<br />

shot & another who had 3 fingers sliced off, during a brawl at a<br />

weekend drag race. The brawl between the Finks, which is<br />

establishing a chapter in WA, & the Coffin Cheaters, one of<br />

Perth’s most notorious bikie gangs, erupted at the Perth<br />

Motorplex in Kwinana yesterday. Both gangs were believed to<br />

have attended the Harley Street Bike drag racing event to simply<br />

watch the event & the brawl erupted when one bikie spat on a<br />

rival. Tensions have been high between the Finks & the Coffin<br />

Cheaters since high-profile bikie Troy Mercanti was expelled<br />

from the Coffin Cheaters in January 2008. He then went on to<br />

help the Finks set up the club’s WA chapter. Mercanti is<br />

currently in jail for assault until 2011 but police plan to “keep a<br />

close eye on that situation” in light of yesterday’s brawl. “This is<br />

obviously a concern to everybody, let’s make no mistake about<br />

that, but I can guarantee you that WA Police are not going to<br />

stand <strong>by</strong> & allow this type of incident to occur,” Detective<br />

Inspector Jeff Christmass, from the gang crime squad, said. “We<br />

will put as many resources that we have available into dealing<br />

with this matter & into any subsequent fallout from this matter.<br />

“This is unusual, it is not the type of thing that we see commonly<br />

in WA & that’s why we are treating this with as many resources<br />

that we can put into this & I can guarantee you we will find out<br />

who has done this & we’ll bring them to justice.” He denied it<br />

was the start of a gang war despite the clubs’ notorious<br />

reputations for seeking violent revenge attacks, saying the<br />

incident was simply “out of the blue”. “We are in constant<br />

contact with other law enforcement agencies both within WA &<br />

within Australia & this is just one part of that,” Inspector<br />

Christmass said. WA Police spokeswoman Ros Weatherall said<br />

one man presented himself to Fremantle hospital with a gunshot<br />

wound to the leg & head injuries between midday & 1pm, while a<br />

second presented to the hospital with head injuries. It is<br />

understood senior Fink Stephen Wallace may have been the<br />

member who was shot but police refused to confirm the identities<br />

of those involved. All they would say was that they were all<br />

patch-wearing - or fully confirmed - members of the gang. A<br />

third man presented to Royal Perth Hospital about the same time<br />

with multiple stab wounds. Police said 3 of his fingers were<br />

severed during the attack. He needed help from first aid<br />

volunteers at the scene to staunch the blood flow but quickly left<br />

with other bikies, who drove him to hospital where he had surgery<br />

to reattach the fingers. All 3 men underwent surgery overnight.<br />

Scrambling for evidence: Detectives from the gang crime squad<br />

are still trying to piece together the events that led up to the<br />

violent incident. Police were given an anonymous tip-off to the<br />

brawl, which is believed to have occurred at 1.30pm, but arrived<br />

some time after 2pm, after the injured Finks bikies had fled the<br />

scene. The fight took place during the Harley Street Bike drag<br />

racing event, which pitted a range of enhanced motorcycles<br />

against each other in a competitive drag racing contest. However<br />

officers did not have any intelligence that “outlaw” motorcycle<br />

gangs were attending. “There was no indication whatsoever that<br />

any outlaw motorcycle gang members were involved in either the<br />

promotion of this event or (that they were) going to be in<br />

attendance of this event,” Inspector Christmass said. “I can<br />

assure you that if we did know, we would have been there & had<br />

the appropriate response.” Police this afternoon revealed the<br />

brawl took place inside the complex, near the area where the bikes<br />

are prepared for their races. The loud noise in the area likely<br />

masked the sound of the gunshot during the fight. “They are<br />

normally a family-orientated event & it’s unfortunate that the 2<br />

clubs that were involved, the Finks & the Coffin Cheaters,<br />

decided to take advantage of this event & arrive with numbers &<br />

an altercation has taken place to the side of the event but inside<br />

the compound,” Inspector Christmass said. “It appears that<br />

throughout the altercation that it escalated to the point where<br />

implements were used & a knife, where one of the members<br />

received serious hand wounds resulting in 3 fingers being severed,<br />

which later received quite extensive medical treatment. “During<br />

the incident a hand gun was used to fire a shot which struck one<br />

of the victims in the leg, that person has been taken to hospital &<br />

received treatment & that bullet has been removed.” The event<br />

attracts thousands of spectators each year & was described <strong>by</strong><br />

organizers on the website as being a sunny & successful event.<br />

None of the men are co-operating with authorities but it is<br />

understood that police are at the hospitals, where 2 Finks<br />

members remain. The third man was already discharged <strong>by</strong><br />

Fremantle Hospital since this morning. Motorplex spokesman<br />

David Christison said management were aware of one man being<br />

injured during the brawl. He received preliminary treatment for<br />

lacerations from a qualified first aider but once approached <strong>by</strong> his<br />

colleagues he walked away & left the complex in a private vehicle<br />

without seeking further medical treatment. He said venue<br />

operators were unaware of any other people being injured or of<br />

any shots being fired. A manager of a prominent Perth<br />

motorcycle shop, who was at the drags yesterday, said most<br />

people were taken <strong>by</strong> surprise about news of the incident. “I<br />

didn’t see anything at all,” he said. Finks New South Wales<br />

spokesman Ferret refused to comment on last night’s incident.<br />

Club Deroes & United Motorcycle Council of WA spokesman<br />

Eric Meehan said: “Nobody knows what’s going on. I’m a bit<br />

stunned myself.” Club Deroes had a marquee at the event but<br />

Meehan said none of the so-called “outlaw” motorcycle clubs<br />

raced in the drags. He said while Finks members were identified<br />

as being injured in the brawl, there had still been no confirmation<br />

that any other clubs were involved. “It has nothing to do with the<br />

UMCWA,” he said. A UMCWA spokeswoman said a meeting of<br />

the clubs scheduled for tonight would still be going ahead.<br />

However the Finks will not be represented at the meeting because<br />

they do not have a member on the council.<br />
