Introduction 

This version of the descendants of Col. William Leigh recognizes the results summarized under the 

Genealogy Reports II below. The most recent (2009) efforts to track down a Francis Leigh, Governors 

Council 1676, brought to near certainty the probability that the Francis Leigh named above was in fact 

Francis Lee, son of Col. Richard Lee, founder of the Lees of Virginia and not a Leigh at all. This moves 

the Leigh family's founder in Virginia to Col. William Leigh, born ~1654. 

As discussed in Genealogy Reports II, we have no documentation of the descent from William Leigh of 

the families of Gilbert Leigh, William Leigh of Amherst County, John Leigh of Orange County, N.C., 

Francis Leigh who died in Norfolk, Va., or of any connection of these families to the descent of 

Ferdinando Leigh who married Martha Cole and produced both the Benjamin Watkins Leigh line and 

the Claiborne connection. 

Nonetheless we have argued for the descent of Francis Leigh from Col. William Leigh's oldest son John 

and for Gilbert Leigh's descent from Col. William Leigh's youngest son William. Moreover, DNA 

samples from the multiple Leigh lines almost guarantee that Gilbert, Francis, William of Amherst, John 

of Orange, and Ferdinando Leigh share a common ancestor. The common ancestor for the first four was 

almost assuredly Col. William Leigh who in turn shares an ancestor with Ferdinando Leigh. A fifth line 

descending from Gilbert Leigh through his son James has been added to the family in the person of 

Whitmill Whitfield Leigh whose descendant's DNA is a perfect match to other descendants of Col. 

James Leigh. of Perquimans County, N. C. and is less a match to the other Leigh lines. 

English origins of Col William Leigh and of Ferdinando Leigh have not been found. The search is 

discussed elsewhere on this site. The images in the Portrait Gallery include portraits, sketches and 

pictures from many of the descendants of Col. William Leigh. In many cases they bear a decided family 

likeness, so much so that I imagine that an experienced forensic sketch artist might reasonably be tasked 

to produce a fair likeness of the colonel himself using these images of later generations as guidance and 

portraits of his contemporaries for the appearance of his dress. There is probably a computer program 

somewhere which could take the images as input and produce as output a reasonable facsimile of the 

Colonel but I have not found it. 

The data reported here has been the result of a family effort. Title of Principal Investigator probably 

belongs to Virginia Leigh Refo with valuable contributions from John Henry Leigh, Richard Henry 

Leigh and Southgate Leigh. The Ferdinando Leigh line was principally the contribution of Benjamin 

Watkins Leigh of Baton Rouge. The progeny of William Leigh of Amherst County, Va. benefitted from 

work of Ruth Pennington who descended from him via George Ware Leigh and from the contributions 

of William Robert "Rob" Leigh who descends from William's son Ferdinand Leigh. Whitmill Whitfield 

Leigh's line has been the work of Ida Lancaster and Mary Fouts. As in any work of this magnitude there

have been multiple contributors who cannot be individually recognized. 

I put this recognition into the introduction to this report because Col. William Leigh was the mover and 

shaker and also somewhat of a rascal who started it all. I have a feeling that either he arrived in Virginia 

after 1676 or he was too recently arrived to be prominent or he would have been a prime target (or 

sponsor) of Bacon's Rebellion. He would not have been on the sidelines in such a conflict ! The only 

official land deed for William Leigh that I have found occurs in 1699, but this deed, jointly with 

Benjamin Harrison, is obviously from his later, prominent citizen period. 

The genealogy report for Col. Leigh has been truncated to include only 9 generations in order to omit 

most names and details of living individuals. More complete information is given later in the genealogy 

reports for individual Leigh lines with the exception of the line for Francis Leigh.

Introduction to Portraits 


One needs to add several additional images to this section to make the comparisons I am looking for 

more apparent. However, these are the ones available at the moment and several conclusions jump out at 

me. 

The similarity between Edward Augustus Leigh, Richard Henry Leigh (Dick Leigh) and Gardner 

Frierson Leigh are evident. So too the likenesses of Richard Stanford Leigh and John Purviance Leigh, 

Jr. are quite similar. And of course the likeness between Virginia Leigh and James Leigh is striking. 

Whitmill Whitfield Leigh is represented by a charcoal sketch and with a mustache added later and even 

so he is not too far from the pattern. 

To continue the comparisons, William Robinson Leigh out of the Ferdinand Leigh line, as a young man 

compares well with Edward Augustus Leigh. Makes one believe in DNA.

Family Homes 

The homes pictured here are by no means the only Leigh homes available to show. As Virginia Refo has 

noted in another context on this webpage, the Leighs seem to have built to last. 

We show Lands End, Col. James Leigh's home in Perquimans County, N. C. He built this home three 

times replacing homes destroyed by fire and by a hurricane. The present edifice stood up to many 

hurricanes in my lifetime and I am sure, many more before that. 

I also present his neighbor's house from which his son Edward Augustus married Grizelle Emily Jacocks 

when she grew into marriage age at 18. James Leigh was a Col. in the militia but he was outranked by 

his neighbor, General Jonathan Hill Jacocks, Grizelle's father. Both served in the N. C. legislature for 

Perquimans County. 

Richard Stanford Leigh's home is now a park in Orange County, N. C. and has stood the test of time

well being built well before the Civil War.

Genealogy Report for Col. William Leigh 

Generation No. 1 

1. William 1 

Leigh, born about 1654, died before 28 May 1703, in King and Queen County, VA. He 

married Mary about 1675, in King and Queen County, Va. Mary was born in probably New Kent Co., 

Va., died after 1705, in King and Queen County, Virginia. 

On May 28, 1703 Benjamin Harrison wrote to Philip Ludwell who was then in London. " Col. Leigh fell 

from his horse lately and cracked his scull and is dead. Tis said he was drunk at Parson Booker's house 

on the Sabbath and going home happened to the accident".(Colonial Abstracts, Beverley Fleet, 

Genealogical Publishing Co., Vol. II p. 284. Note this was Vol. VII of the original 34 volume issue.) 

This William Leigh was a Burgess from King and Queen County, Militia Colonel, friend of Governor 

Nicholson, Admiralty Judge, etc. He left 6200 acres, mostly in King and Queen County, to his son John 

and apparently not much to his son William. He can be found in Cavaliers and Pioneers and in Beverley 

Fleet's Colonial Abstracts as well as in other Colonial Records. While he was judge of the Vice 

Admiralty Court, Lt. Col. Miles Cary served as registrar.(Va. Colonial Records Project, PRO Class C.O. 

5/1312, SR 381, pp. 24-25) He was on the short list recommended by Governor Nicholson to the Crown 

as qualified to be on the Governor's Council. 

He was an influential man with powerful friends, He made enemies and was willful and dominant. His 

career can be tracked by the records of his alleged misdeeds by his enemies, Benjamin Harrison, Phillip 

Ludwell, Robert Beverley and ohers as they gave depositions attempting to get Gov. Nicholsion 

removed from office, It can also be characterized by his accomplishments. As an aside, politics did not 

stop business. At the height of this feud Col. Leigh and Benjamin Harrison collaborated on a land patent 

for several thousands of acres of land. Members of the landed power structure continued about their 

business of remaining wealthy, politics notwithstanding. 

To paraphrase Ben L. Rose, the idea that the descendants of such a man would without thought give up 

the Leigh name to become Leas is ridiculous and this is not meant to disparage the Lea family. 

After being challenged by Virginia Refo as to documenting Mary Greene as William Leigh's wife I 

searched for eligible Greene families. My best candidate is a Ralph Greene who bought land from 

Richard Lee in 1648, married a widow who promptly died also and assumed title to her husband's (John 

Hartwell's) 50 acres (close to John Utie's land in what probably was York County) in 1649 and who took 

credit for importing at least 20 persons into the Colony. He imported some in partnership with Col. 

Francis Morgan whose lands wound up in King William. The lands generally lay upon the Poropetank 

and were in New Kent and Gloucester Counties which eventially became King and Queen and King

William. His landholdings exceeded 1000 acres and he would have been a neighbor of William Leigh. 

Perhaps he had a daughter named Mary ? There are other Greene families, eg, Oliver Greene, but none 

so close geographically. 

No one ever took credit for importing Ralph Greene into the colony; therefore, perhaps he was born 

here. There are many eligible Greenes to be his father. My favorite, for no particular reason, is Robert 

Greene who along with his wife and an infant are listed as among the living on Feb. 16, 1623 at "The 

Neck of Land" in the Muster of 1623.("Persons of Quality" by John Camden Hotten) Also there is a 

Robert Greene with 200 acres on the Rent Rolls of York County in 1704. Perhaps Mary Greene's 

brother ? 

All of which is a long reach. There is no real evidence that William Leigh's wife was Mary Greene. 

The name is a holdover from Albert Casey's buccaneering foray into Leigh genealogy. There is an 

indication that her name may have been Mary. In 1705 Mary Leigh patented two tracts of land one of 

600 acres and one of 260 acres in King and Queen County with Valentine Ware and William 

Haines.(Library of Virginia Land Records) Valentine Ware was a warden of Stratton Major Episcopal 

Parish in 1718 (Virginia Colonial Abstracts) This Mary Leigh was probably Col. William Leigh's widow 

and it has been assumed that Valentine Ware was her son in law. Ware died between 10 May 1731 and 

11 April 1732. (Virginia Colonial Abstracts) 

It would be unusual for a husband and wife to patent land together in 1700. It would be possible for a 

widow with her dower interest in Col. William Leigh's large estate to join with others to patent land and 

her status would certainly aid in assuring the grant. Valentine Ware was assessed quitrent for 487 acres 

in 1704 before these patents. Some people have assumed from this evidence that both Ware and Haines 

were Mary Leigh's sons in law but no corroborating evidence is found. 

As to dates of birth for Col. Leigh's children. They can only be estimated. John Leigh was a Captain of 

Horse in the King and Queen County Militia in 1701.(Virginia Colonial Records, PRO, London) 

Presumably, despite his father being Colonel, he must have been of age at this time. Therefore, his latest 

date of birth can be judged to be about 1680. William had to be of age to hold land in his own name by 

1711 according to the Guy Smith patent. Also he was a militia Captain by 1698. Therefore his latest date 

of birth can probably be estimated as 1677. If John is to be the eldest son as appears from his 

landholdings after William Leigh's death, he must be born before William. 

Col. Leigh's daughter(s) if any, if they were married by 1705 were probably at least 16 by then so their 

latest birthdates also fall about 1689. These are extremes. William Leigh was born 1654. Married 

probably by age 21 (1675) one would anticipate John's birth about 1676. William between 1677 but after 

John. The daughters anywhere from 1676 to 1689. These are not wide spreads. 

Again, there may be other explanations for the 1705 land patents but for now assuming two daughters is 

probably not too reckless. I have guessed the name Sarah because in one internet genealogy, William 

Leigh is married to a Sarah. Probability of being correct---near zero !

2. John 2 

Leigh (William 1 

), born about 1676, in New Kent County, Va., died after 1729, in King and 

Queen Co., Va. He married Anne. 

John Leigh began to be mentioned in King and Queen County records about 1703 and continued at least 

until 1729 and probably later. In 1726 he was sheriff. (Beverley Fleet, Colonia Abstracts, Vol. II, p.244) 

An unanswered question is who inherited the 6200 acres of land he inherited from his father. As late as 

1725 he was noted as "Gentleman" so he maintained his social status. None of his possible sons, Francis, 

John, or Thomas or William appear to have had the riches he did. In 2005, it seemed strange to me that 

he did not name a son after his father, William. At this point I added a William to his family, born about 

1724. This is a reversion to an old Lea family tree but there are a multitude of William Leighs available. 

The sons John and Thomas are obtained from Virginia Colonial Abstracts, Beverley Fleet but are only 

possibilities. 

King and Queen County was formed in 1691. King William County was formed out of King and Queen 

in 1702, taking with it the only town, Delaware (or West Point) 

In a land patent to him in 1725 for land in Hanover County he is referred to as Captain John Leigh. In a 

patent to William Birch in 1732 he is referred to as Major John Leigh. This may mean he is still alive in 

1732. 

In 1745 and in 1751 a John Leigh and a Thomas Leigh are called upon to appraise the estate of one 

Edwin Thacker in King and Queen County. It is not likely that the elder John Leigh would be tasked 

with this if he were still alive. John and Thomas Leigh could be grandsons of Col. William Leigh. Later 

a William Leigh appears in Albemarle County who is a good candidate to be a son of John Leigh. That 

assumption has been made in this genealogy report. Birthdates are what would be reasonable from the 

context of Beverley Fleet's writing. 

Ben Rose states in "Report on Research on the Lea Family in Virginia and North Carolina before 1800" 

page 73 and 74, "there are rec ords to show that John Leigh was alive in 1739, in 1743, in 1745 and in 

1751, and John Leigh, Jr. was alive in 1732 and 1739." I do not know how Ben can distinguish between 

John Leigh and John Leigh, Jr. in the case of the Thacker estate appraisals min 1745 and 1751 and I 

think this was an assumption on his part.

Ware died between 1731 about 1732. 

Both Valentine Ware and Edward Ware are marked as deceased in the Vestry Book of Stratton Major 

Parish between 10 May 1730 and 10 October 1732. 

There is conflicting information concerning Valentine Ware on the internet. He was certainly a warden 

for Lower Stratton Major Parish by 1710. In Rootsweb databases he is assigned a variety of wives, 

including Sarah Leigh.

), born about 1677, in New Kent Co. Va., died about 1760, in King William 

Co., Va. He married Frances M. Frances M. was born 19 Nov 1688, in New Kent County, Virginia, died 

1783, in King and Queen Co., Va. 

This William Leigh I have assumed to be the father of Gilbert Leigh and his brothers. On Dec. 19, 1711 

a grant to Guy Smith in King and Queen County mentions " Where Mr. William Leigh, son of Colo. 

William Leigh hath a quarter on W. side of Great Harquake Creek in St. Stephens Parish". 

The land described above, while in King and Queen County, is less than 7 miles from West Point, 

Virginia where Gilbert Leigh sold lots and where an unclaimed letter to Gilbert was advertised. 

A Capt. William Leigh is in the militia for King and Queen County in 1698. His troop has 61 members. 

In the next paragraph Col. William Leigh is noted as Colonel and Commander in chief in 1699. I think 

the Captain is Col. Leigh's son. (Virginia Colonial Abstracts, Vol. II, p. 273, Genealogical Publishing 

Company edition, 2000) If William is a Capt. in the militia in 1698, he is probably born by 1677. 

The names of the Leigh brothers are taken from a letter from Sarah Leigh Brown, a daughter of Bascom 

Leigh's, written probably either in the 1940's or later.(The research was done during WW II because the 

Library of Congress was air conditioned !) In this letter she describes a letter written by Elizabeth 

Marshall Robinson to Hezekiah Gilbert Leigh in January, 1898. This was probably HG II as it was 

directed to Petersburg. Elizabeth Marshall Robinson was a grandaughter of Benjamin Watkins Leigh. It 

should be noted that no confirming documentation for the existence of these three brothers has been 

found. 

The Shinn report also states that William Leigh was the father of Ferdinando, Emanuel, and Gilbert

though he mistakenly confuses this Ferdinando with Benjamin Watkins Leigh's ancestor. 

This assignment was originally out of a Lea data base. Two factors operated to lead me to keep it in. 

One. A member of the Major family in this time frame would be more likely to marry a Leigh than a 

Lea. Two. James Leigh of Bath claimed claimed to be "nighest of kin" to a Charles Meagure ("Major" 

?) in acquiring escheated land in 1728. Knowledge of the Leigh/Major family interaction in Virginia 

might have been used to justify this in North Carolina though there was no family connection. 

One has a choice of fathers for Frances Major. In Rootsweb files on the internet one finds John, William 

and George Major are assigned as fathers to Frances Major. All the Frances Majors have roughly the 

same birthdate. I chose George because I was already familiar with this line due to its interaction with 

my Purser line. 

I should emphasize that assigning Frances Major to William Leigh was a conjecture based on small 

evidence. The original assignment by Albert Eugene Casey had her marrying a William Lea and James 

Lea, William Lea's son named a son "Major". This is from Ben Lacey Rose, who usually had things 

right as opposed to Albert Casey who usually had things wrong. In the early 1700's my argument about 

"nighest of kin" above works just as well in Bath County, NC if Frances Major marries a Lea as if she 

marries a Leigh or a Lee. As my grandfather opined, they would have felt sorry for a man who could 

only spell a word one way. 

Based on the Major Leas who show up in William Lea's progeny, another Lea researcher concludes that 

Frances Major must have married William Lea vice William Leigh.since records do indicate that 

William Lea's wife was surely named Frances. (Ben Lacey Rose and other records.) He may very well 

be correct and in recognition of that fact I am removing Frances Major as William Leigh's wife. Neither 

Major nor Frances show up in William Leigh's close descendants. I will leave this note in the rcord to 

show the original reasoning.

Leigh (John 2 

, William 1 

), born about 1717, died about 1782, in Norfolk County, Va. He 

married Elizabeth Roscow about 1750. She was the daughter of William J. Roscow and Lucy Bassett. 

Elizabeth Roscow was born about 1732. 

This Francis Leigh moved from York County to Norfolk County late in life and died in 1782. I have 

taken his children from his will which I have copied. I have given his children birth dates to order them 

as he has them in his will. The naming pattern he applied to his children I believe identifies his father as 

discussed in the main text. 

One might ask why a son of a notable in King and Queen County would move to Warwick County. The 

answer lies in his wife. The Roscows (or Roscoes) were even more prominent in the landed aristocracy 

than were the Leighs. William Roscow was a member of the House of Burgesses for Warwick County 

much of his adult life and his family was also connected to the Bassett and the Burwell and the Cary 

families. Francis followed influence and wealth. He himself was a member of the Committee of Safety 

during the Revolution. 

The naming pattern is as follows: 

Lucy - Mother's mother, John - Father's father, Francis - Father, Roscow - Mother's father (or family), 

William - Father's grandfather (or Mother's grandfather), Elizabeth - Mother, Ann - Father's mother: 

this pattern is almost conclusive. 

Children of Francis Leigh and Elizabeth Roscow: 


8 i. Lucy Leigh, born about 1752. 

ii. John Leigh, born about 1755, died 23 Dec 1796. He married Mary Baker. 

John Leigh took his medical degree at the University of Edinborough about 1785. 

He appears in record in Tarboro, NC in 1787 when he buys a lot. He represented 

Edgecombe County in the House of Commons from 1789 until his death in 1796. 

He was apparently closely linked with attempts to establish the Episcopal Church in 

NC. ( All of this taken from the Dictionary of N. C. Biography from an article by 

Claiborne T, Smith, Jr.) 

On at least one occasion he ran afoul of John Gray Blount of Beaufort County who 

had no high opinion of him.[ John Gray Blount Papers, Volume II.] 

Apparently he also questioned Francis Leigh's handling of Roscow Leigh's estate.

iii. Francis Leigh, born about 1760, died before 1799. 

Francis Leigh's will is dated 17 March 1798 and is brought up in the Aug 1798 

court in Edgecombe County, NC. (Tarboro, NC) The abstract names his brother 

William, nephew John Willoughby, niece Elizabeth Willoughby and a Randolph 

Cotten. Francis Leigh had also apparently been appointed administrator for the 

estate of Roscow Leigh and his administration was challenged by John Leigh, his 

brother. 

In a related entry, Randolph Cotten refuses to qualify as Exr. and execution is 

granted to Whitmell Bell. (maybe, we need the original.)

iv. Roscow Leigh, born about 1763, died 3 Oct 1793. 

There is a notice of the death of Roscow Leigh, merchant, on a voyage from 

"Martinico" on the brig Nancy "on the 3rd ultimo" on the 8 November, 1793 

edition of The Virginia Gazette and Weekly advertiser. 

9 v. William Leigh, born about 1765, died 13 Dec 1809, in Portsmouth, Va. 

vi. Elizabeth Leigh, born about 1767. She married James Willoughby Young. 

vii. Ann Leigh, born about 1769.

Amherst (John 2 

, William 1 

), born about 1724, died before 15 Sep 1794, in Amherst 

County, Va. He married (2) Ann. Ann died Nov 1832, in Albemarle Co., Va. He married (1) Dianna. 

Dianna died about 1780. 

The children here are taken from the will of William Leigh of Amherst County, written Sep. 2, 1788, 

proved Sep. 15, 1794. ("Report of Research of the Lea Family in Virginia and North Carolina before 

1800", Ben L. Rose, p. 53.) (Also, Amherst County, Will Book 3, p. 310, Probated 15 Sept. 1794, 

Virginia Wills and Administrations, microfilm reel 18, Library of Virginia) Succeeding generations are 

based on census data for William Henry Leigh and data provided by William Robert Leigh a descendant 

of William Henry Leigh through his son Charles Q. C. Leigh. Some of his data is based on a letter from 

Edward Oliver Leigh in 1921. Edward Oliver Leigh was also a son of William Henry Leigh. 

Virginia Refo has data showing that this William Leigh bought land in Caswell County, N. C. as 

William Leigh of King and Queen County, Virginia. His land purchases in Albemarle County indicate 

he is from Caswell County, N. C. I believe that there is a high probability that he is the son of John and 

Ann Leigh and the grandson of Col. William Leigh of King and Queen County. Rob Leigh's DNA 

certainly is consistent with this assumption.William came from King & Queen Co. to Mecklenburg, then 

to Caswell Co. then to Albemarle and later apparently bought land in Amherst Co. When he closed his 

land in Mecklenburg, the deed could not be recorded because his wife was not at the Court House to be 

interviewed (probably she had gone on to Caswell Co.) and it was not recorded until the spring of 1780

(the sale was in November). William was in Caswell Co. in Dec. 1778, buying from an estate sale. 

Richard Leigh apparently went with William to Mecklenburg Co. and bought land in 1772. He sold the 

land in 1773 for a loss and returned east to James City Co. Note: the deed by which William obtained 

land in Albemarle Co. was witnessed by John Leigh (with an "X") and Richard and Rachael Leigh. 

Both Richard and Rachael appeared in court to subscribe to the deed. Richard and Rachael went to 

Orange Co. NC. They had one or two daughters, who went to Montgomery County TN. Richard and 

Rachael followed them there, where Richard died in 1814. 

William paid taxes on the land in Albemarle. Later he apparently bought land in Amherst County from 

Thomas Bell. This land was very close to the dividing line between the counties( in fact it is stated that 

Thomas Bell House was the marker in 1761 when Amherst Co. was formed from Albemarle Co.) , 

possibly even spanned them. I can find no record of this deed being recorded, nor of William ever 

paying taxes on this land, either in Albemarle or Amherst. There is mention in Thomas Bell's will of 

money due him from William Leigh. William and Ann sold this land shortly before William's death. 

This sale is recorded in Charlottesville District Court records, not in the Deed Book, and was perhaps 

handled in the higher court because the deed was never recorded. Maybe William purposely did not 

record it to avoid taxes. When the tax man from Albemarle came along the land was in Amherst and 

vice versa. 

I do not know about William's wives. William mentions his older children, John and Elizabeth. Were 

they the children of Dianna, or perhaps even an earlier wife? Records indicate that George Ware and 

Ferdinand were born before 1775, in which case they were Dianna's children. I believe that Jane and 

Ann Pendleton Leigh were Ann's children.

Gilbert Leigh begins to buy land in Chowan County in 1757 (DB H1) when he buys lots in the town of 

Edenton from the town commisioners. He continues to buy land in Chowan County until 1780. There 

are sales in that period with the last being in 1783. Apparently Gilbert moved to Bertie and then to 

Perquimans after 1783 and before 1790. His son James was born in Bertie County. 

Gilbert Leigh was a prominent carpenter and artisan of the Paul Revere mold, able to design and build to 

fit requirements. He has been associated, probably erroneously, with helping to design and build the 

Chowan County courthouse in Edenton. He certainly billed the County Commissioners for frequent and 

extensive repairs. He also took in a partner, John Green during this period. These repairs were in the 

period 1764-67, but he was in Edenton as early as 1757 when he bought lots and made repairs to county 

property. He also gave bond for a friend's marriage before this.(Virginia Refo) 

Gilbert Leigh is listed in the Perquimans County Census of 1790. He writes a will in Perquimans county 

dated 27 November, 1791 (It is mistakenly dated in my copy as 27 November, 1781) The results shown 

in this genealogy report were concluded upon only in February 2004. The logic is contained in the main 

text. Data for his descendants is taken extensively from a talk given by Ray Winslow at a Leigh family 

reunion in 2001or from a newsletter for "The Leighs of Albemarle" originated by Richard H. Leigh of 

Raleigh, NC. Some of the data I have taken from the Leigh and Winslow family bibles. The genealogy 

listed here is consistent with current DNA tests. 

Assignment of Elizabeth's parents as William Foster and Ann Whedbee is taken from a talk given by 

Ray Winslow at a Leigh re-union im 2000. There is a note in his copy of Hathaway by Leigh Winslow 

to the effect that Elizabeth Foster's father was Frederick Foster. The data here as to Elizabeth Foster's 

family is taken from "The History of Perquimans County" by Ellen Goode Winslow. Most of it is under 

the entry for Frederick Foster's will but other supporting data are contained in the book..

Ann Leigh, William Leigh's wife, out lives her husband by decades. In 1819, prior to his leaving 

Virginia for Kentucky, Ferdinand Leigh makes an agreement with Thomas Shelton of Albemarle County

to the effect that Leigh and his heirs will, after the death of Ann Leigh, make a complete fee simple title 

to Thomas Shelton of Ferdinand's 1/8 interest in the tract of land that Ann Leigh is living on in 

Albemarle. The agreement is dated 29 March, 1819. (Albemarle County Deed Book 22, p. 366). It 

should be noted that Ann is still alive in the 1830 census. 

It is interesting that Ferdinand agrees to convey only 1/8th interest. I count only 7 children of William 

and Ann Leigh. 

James Walker Leigh and wife Polly Kinsolving die of cholera in 1833. Ferdinand Leigh assumes 

guardianship of his grandchildren in Eddyville, Kentucky. In 1837 he executes the following document: 

" I Ferdinand Leigh of the town of Eddyville, Caldwell County, State of Kentucky appint George 

Washington Kinsolving of the town, county and state aforesaid my true and lawful attorney in fact for 

me and in the names as guardian for the heirs of James W. Leigh, deceased, to wit: Parthenia, Martha E., 

William H., George E., and VanBuren Leigh, grandchildren of Elizabeth Kinsolving" (Albemarle 

County Deeds, Book 36, p. 6, Nov. 1837) 

In the 1830 census Elizabeth Cash was still alive, age 50-60 but in the 1840 census Ferdinand has no 

wife.Said to have served in the Revolution. His age would indicate that was probably not the case. His 

father, William, served in the Mecklenburg Militia during the Revolution. Perhaps this is what is 

referred to. Records of Caldwell Co., KY would indicate he may have served as Captain in Militia 1825 

- 1833.

James Leigh was the owner and the builder of Land's End on Durants Neck, Perquimans County. He had 

to build three times. The first burned. The second succumbed to a hurricane. The third was of brick and 

with walls a foot thick ! It still stands though Hurricane Isabel in 2003 did damage. 

In the 1850 Perquimans County census he is listed as 70 years of age. His son, Edward is listed as 25. In 

the household of a neighbor, Grizzelle P. Jacocks, Grizzelle Emily Jacocks is listed as being 11 years 

old. This is the girl Edward marries in 1857 when she is 18. James Leigh's children, listed here, were 

obtained from deeds executed by his children to settle his estate in 1855. He died in E. City, NC and 

had written a will but had not signed it. His executors, all son in laws except for his son Edward 

Augustus Leigh, decided to obey his wishes anyway. The necessary deeds to do this are in Deed Book 

DD, pp581-596, Perquimans County Records. 

James Leigh was easily the largest landholder in Perquimans County at the time of his death, and his 

home was a notable example of the architecture of the time. His executors had to post a record bond of 

$500,000. so extensive were his holdings.

The following is taken from a document by Virginia Refo, February, 2005. 

The next we hear of Benjamin in North Carolina is in a petition for divorce dated Sept. 28, 1814 filed by 

Sarah Leigh. "About Twelve Months ago the Aforesaid Leigh [Benjamin] has left her and Removed to 

the State of Tennessee as she is currently informed, taking with him Another woman (whom she is 

informed he has since married) and Also the greatest part of the property which he had by her at the time 

of their intermarriage…" She goes on to say she fears he will return and take away what little she has 

left and asks the legislature to pass an act to secure it for her. The Legislature may have granted her a 

divorce, but it did not approve her petition to secure the remainder of her property. But don't feel too 

sorry for Sarah. Benjamin did not come back for more, and her will, dated April 15, 1831 and probated 

in Perquimans Co Feb. 1833 indicates she still had many assets, particularly in slaves. 

Tennessee property records (Williamson Co Deed Book "C", p 499) show Benjamin Leigh bought from 

William Perry for $1000.00 90 acres on the Big Harpath River, bounded by Perry, Wm Tarkington and 

the middle of the Harpath River. The deed was dated October 7, 1813 and registered Jan. 1, 1814. He 

added in 1817 additional lands on both sides of the Big Harpath. The land backed up to the Nachez 

Trace, the military road between Nashville and New Orleans, and tradition says that Andrew Jackson 

and his men forded the Harpath in back of the Leigh home on their way to New Orleans. There is a 

picture of the Leigh homestead, much altered from its original state, as it was in 1970 in Historic 

Williamson County: Old Homes and Sites by Virginia McDaniel Bowman. I find it amazing that the 

homes of four of Gilbert's five sons remain standing into the twentieth century. They must have been 

really good builders. 

Tennessee marriage records show a bond for the marriage of "Benj. Lee to Patsy Barlett" May 3, 1814, 

Henry Hadger bondsman. Remember "Patsy" was a common nickname for Martha. She was either 

pregnant at the time, or had already given birth to their oldest daughter. My records show that her

maiden name was Whedby. Benjamin and Martha had five children, four daughters and a son. The 1850 

Williamson County census shows Martha [daughter] as 36, Mary 34, Elizabeth 33, Lavina 32, and 

Gilbert, 31, all born in Tennessee. 

Benjamin made his will May 1, 1820; it was probated April, 1831 Court (Williamson County Will Book 

5, pp. 18-19). In it he names his wife, Patsy, "which was the widow of William Barclift in North 

Carolina and moved with me from there and we was married at this place", daughters Patsy [Martha], 

Mary, Betsy [Elizabeth], Levina and son, Gilbert. Wife Martha died also in Williamson County in 1844. 

A curiosity, brought to my attention by Virginia Refo,is that a marriage bond was executed in NC on 

April 30, 1821 for a marriage between Mary Hartley and Benjamin Leigh. This cannot be this Benjamin 

for Martha Barclift survived him. (Or maybe he was indulging in a bit of bigamy ? Again ?) 

Notes for family of Benjamin Leigh and Sarah Knowles: Sarah petitioned for divorce in 1814. She was 

old enough to be Benjamin's mother and he apparently took her money and ran off to Tennessee with 

another woman. The petition for divorce was granted. (Ray Winslow, re-union in 2000).

Both James Walker Leigh and his wife, Polly Kinsolving died on the same night in 1833 from cholera. 

Ferdinand Leigh, James Walker's father, assumed guardianship of his son's children. 

There is a problem in the Ferdinand Leigh, Elizabeth Cash, James Walker Leigh, Polly Kinsolving 

linkage. The Elizabeth Cash data are taken from internet genealogies and have not been confirmed, but 

her birthdate of 1770 and marriage date of 1796 plus James Walker Leigh's birthdate of 1784 present 

problems. Ferdinand Leigh was assumed to be still under age when his father William Leigh wrote his 

will in 1788. It seems unlikely he was father of James Walker Leigh 4 years previously. (The best Cash 

genealogy appears to be the Rootsweb database 1151958 which has a contact person of Donna Evans, 

e-mail cowcrazy78@@hotmail.com. This is April, 2005) 

On the other hand, Polly Kinsolving whom James Walker Leigh married in 1817 was born in 1788 and 

this age comparison tends to support a birthdate for James Walker of 1784. The Kinsolving genealogy 

on the internet seems quite detailed and possibly reliable. (Two of the Kinsolving Rootsweb data bases 

are, "joelouks" contact person e-mail joelouks@@earthlink.com, and "jtr-todd" contact person e-mail 

jorabun@@comcast.net.) Both appear to be documented to a degree, and again this is April, 2005. 

This presents us a trilemma: The William Leigh will: The James Walker Leigh birthdate: The Elizabeth 

Cash wedding date. The birthdate is inconsistent with both will and wedding date. The birthdate is 

consistent with the Mary Kinsolving birthdate and the James Walker Leigh wedding date of 1817. 

In the 1820 census, Ferdinando Leigh in Albemarle County is over 45 which makes him born before 

1775. Ann Leigh is over 45 also but the real information as to her age is in 1830 when she is 80-90 

making her born before 1750. In both the 1830 and 1840 Kentucky censuses there is a Ferdinand Leigh 

between 50-60. I assume 1840 is in error and it should have been 60-70. 

My tentative conclusion is that the assumption that the "younger children" named in William Leigh's 

will were underage is possibly an error. Elizabeth Leigh who married James Kinsolving was born in 

1764. John Leigh "acted" as Executor with William's wife, Ann, but in the will William appoints 

"George" to act as Executor. In the event, William Henry Leigh, Ann, and Samuel Reid post bond for 

the administration of William's estate. (Albemarle County Will Book 3, pp. 327, 335) Ann outlives her 

husband by many years. As stated above in the 1830 Albemarle County census she is recorded as being 

between 80-90. 

With little to guide me I am simply going to record it all and let the reader make his own choices. It is 

clear that Ferdinand Leigh is the father of James Walker Leigh. It is also clear that this Ferdinand is the 

brother of Elizabeth Leigh Kinsolving which makes him the son of William Leigh of Albemarle County.
