liable to reimburse the Carrier therefore.<br />

For the purposes of the Customs entry<br />

the consignment is deemed to be consigned<br />

from the Shipper named on<br />

this document to the Consignee named<br />

at the Delivery Address. After Customs<br />

clearance the consignments shall be<br />

delivered to that Consignee at the<br />

Delivery Address. The Shipper guarantees<br />

payment of all charges and advances.<br />

6 If the Consignee refuses to accept<br />

delivery at the Delivery Address, or the<br />

Carrier is unable to deliver to that<br />

address, or the address is incorrectly<br />

completed, the consignment shall be<br />

dealt with in accordance with the<br />

Carrier’s Conditions of Carriage for<br />

<strong>Cargo</strong>.<br />

Notices of Claims and Time Limitations on<br />

Actions<br />

7a No action shall be maintained in the case<br />

of damage to goods unless a written notice,<br />

sufficiently describing the goods concerned,<br />

the approximate date of the damage, and the<br />

details of the claim, is presented to an office<br />

of Carrier within 7 days from the date of<br />

receipt thereof, in the case of delay unless<br />

presented within 14 days from the date the<br />

goods are placed at the disposal of the<br />

person entitled to delivery, and in the case of<br />

loss (including non-delivery) unless<br />

presented within 120 days from the date<br />

of issue of the Consignment Note.<br />

7b Any rights to damages against the<br />

Carrier shall be extinguished unless an<br />

action is brought within 2 years after the<br />

occurence of the events giving rise to<br />

the claim.<br />

Compliance with Laws and Regulations<br />

8 The Shipper shall comply with all<br />

applicable laws. Customs and other<br />

government regulations of any country<br />

to, from, through, or over which the<br />

goods may be carried, including those<br />

relating to the packing, carriage or<br />

delivery of the goods, and shall furnish<br />

such information and attach such<br />

documents to the Consignment Note as<br />

may be necessary to comply with such<br />

laws and regulations. Carrier is not liable<br />

to the Shipper or any other persons for loss<br />

or expense due to Shipper’s failure<br />

to comply with this provision.<br />

Agents<br />

9 No agent, servant or representative<br />

of Carrier has authority to alter, modify<br />

or waive any provision of this contract.<br />

Any exemption from or limitation of<br />

liability shall apply to Carriers servants<br />

or agents.<br />

Notice<br />

10 If the carriage involves an ultimate<br />

destination or stop in a country other<br />

than the country of departure, the<br />

Warsaw Convention may be applicable<br />

and the Convention governs and in most<br />

cases limits the liability of carriers in<br />

respect of loss or damage to cargo.<br />

Screening<br />

11 The Carrier reserves the right to<br />

open and inspect any shipment for<br />

security screening.
