The West Virginia Massage Therapy Licensure Board is pleased to provide you with our report 

for the fiscal years 2010 and 2011. The report is hereby submitted in compliance with statutory 

requirements. 

The Board is charged with the administration and enforcement of the provisions of Chapter 30, 

Article 37 of the West Virginia Code governing the profession of Massage Therapy. This report 

is submitted in accordance with Chapter 30, Article 1, Section 12 which requires a financial report 

of total revenues and expenditures and a complete list of names licensed by it during such period. 

Other information enclosed is a list of current board members and other pertinent information. 

The West Virginia Massage Therapy Licensure Board continues to strive for maximum efficiency 

in serving the people of West Virginia.

Wysong brings the meeting to order. Quorum is established. 

A motion is made by Starr to approve the Board minutes from February 22, 2009. 

Meffert seconds. Motion carries. 

The Board reviewed past complaints: 

08-02 Meffert makes a motion to dismiss. Starr seconds. Motion carries. 

08-06 Skelton makes a motion to send an investigator to gather information. White 

seconds. Motion carries. 

08-08 Skelton makes a motion to send an investigator to gather information. White 


09-02, 09-03, 09-05, 09-06 Skelton makes a motion to send a follow-up letter asking the 

licensees to inform the Board of their intent. White seconds. Motion c arries. 

Starr makes a motion to combine The WV Board of Acupuncture phone/fax line with the 

Massage Board’s line. Meffert seconds. Motion carries. 

A discussion was held on the following: 

Lyter will attend the State Auditor’s Conference at Snowshoe Resort. 

Skelton and Wysong will attend the AMTA Conference from September 23 -27, 2009. 

Wysong and Lyter will attend a meeting of FSMBT from October 8 -22, 2009. 

The Annual Licensing and Board Training will be held on October 13, 2009. 

Lyter received CLEAR certification in Austin, Texas.

The Board reviewed the financial report. 

The next meeting will be held November 15, 2009.

A motion is made by Skelton to approve the Board minutes from 8 -2-09 White seconds. 

Motion carries. 

Doug Paxton, former Massage Board investigator, spoke to the Board about his 

termination. 

Our new investigator, Herbert Gardener, introduced himself to the Board and discussed 

some cases he has been working on. 

Skelton makes a motion to rescind the letter of termination for Doug Paxton and replace 

it with a letter of resignation a fter a refund of $200.00 from him. White seconds. Motion 

carries. 

Starr makes a motion to close case #09-03 due to the license being reinstated, and case 

#09-05 and 09-06 because both state they are not practicing massage and we have no 

reason to believe otherwise. White seconds. Motion carries. 

Skelton makes a motion to send case #10-00 another letter stating that myropractic 

techniques do need a license from the Massage Board. White seconds. Motion carries. 

Skelton makes a motion to close case #10-01 due to the complainant withdrawing the 

complaint. Starr seconds. Motion carries. 

Starr makes a motion to contact the complainant and her attorney in case #10 -02. We 

will ask for a response in 10 days or the case will be closed. White se conds. Motion 

carries. 

Starr makes a motion to confirm the forfeiture of the license in case #10 -03. White 

seconds. Motion carries.

White makes a motion to close case #08-06 due to lack of evidence. The establishment 

has a licensed massage therapist. Skelton seconds. Motion carries. 

Starr makes a motion to close case # 08-08 due to lack of evidence. White seconds. 


Starr makes a motion to send case #10-04 a cease and desist letter about practicing 

without a license once we obtain the address. Skelton seconds. Motion carries. 

We tabled the issue of a potential applicant to massage school until the Board receives 

additional information. 

White makes a motion that the use of activators and trigger point therapy are chiropractic 

tools and out of the scope of practice in massage therapy. Starr seconds. Motion carries. 

Lyter presented the financial report for 12 -5-09. 

Discussion included online renewals, SAO annual training at Snowshoe for Lyter, 

AMTA training that Skelton attended, and the FSMTB annual meetings attended by 

Wysong and Lyter. Also discussed was the need to purchase a scanner which will be 

necessary when the Board is required to go paperless. 

The next meeting is scheduled for March 21, 2010.

Review of Complaints: 

09-02 Our investigator, Herbert Gardener, discovered the business no longer 

existed. The business owner called and said she wasn ’t going to pursue a license. 

Meffert makes a motion to close the case. White seconds. Motion carries. 

10-00 A response was received that indicated the requirements for licensure 

would be met. The case will remain open. 

10-02 The Board sent another letter with no response from the licensee or 

attorney. Starr makes a motion to close the case. White seconds. Motion carries. 

10-03 The license was surrendered . Skelton makes a motion to close the case. 

Starr seconds. Motion carries. 

10-04 The offender was supposed to call the office about practicing without a 

license but has not. The case will rem ain open. 

10-05 Meffert makes a motion to send an investigator. White seconds. Motion 

carries. 

10-06 Starr makes a motion that pending receipt of the official complaint or the 

respondent’s arrest, the license will be suspended. White seconds. Motion carries. 

The Board discussed PLANS, The Division of Personnel Reclassification Project and 

Quality Personnel Plans.

Starr makes a motion to accept Lyter’s recommendation to change the Memorandum of 

Understanding (MOV) with the Board of Acupuncture from 10% to 5% for her salary 

and remain at 10% on the rent. Meffert seconds. Motion carries. 

Election of officers is held. 

Skelton makes a motion for Wysong to be reappointed as chairperson. White seconds. 


Meffert makes a motion for Starr to be reappointed as secretary. Skelton seconds. 


Lyter presents the financial report for March 2010. 

Skelton makes a motion to hire Kai Haynes as temporary help with renewals for 3 -4 

months. White seconds. Motion carri es. 

Starr makes a motion for Lyter to purchase office supplies and a filing cabinet. Meffert 


Online renewals for licensure are now available. Skelton makes a motion to add to the 

website that CEU’s must be submitted before the license will be issued. White seconds. 


The next meeting will be held on June 6, 2010.

A motion is made by Meffert to approve the Board minutes from 3 -21-10. White 



10-00 No response has been received in six months. A letter will be sent to ask if 

the requirements for licensure will be met. The complaint will remain open. 

10-04 The Board sent a mail and desist letter with no response from the licensee, 

but we have information that she may still be practicing. The case will remain open. 

10-05 The person who called in the complaint still hasn ’t filed a written 

complaint. A motion is made by Starr that in the event she doesn ’t file, the Board will 

file a complaint. Skelton seconds. Motion carries. 

10-07 The business has closed. Skelton makes a motion to close the case. White 


10-08 The respondent was practicing without a license and billing insurance. The 

complaint will rema in open until the investigation is complete. 

10-06 Starr makes a motion to contract with a hearing examiner for the case. 

White seconds. Motion carries. 

10-06 Meffert makes a motion to submit insurance documents from the complaint 

for review. White seconds. Motion carries. 

A discussion was held concerning Orthotics. The Board will send a letter to the 

practitioner to find out if he is issuing a diagnosis on Orthotics and exceeding the scope 

of practice.

A Massage Therapist has asked th e Board to waive the requirement for the test and 

reinstate her license if she obtains necessary CEUs. Lyter will ask her to appear at the 

next Board meeting to plead her case. 

A potential student has asked if a misdemeanor from seven years ago would pr ohibit 

getting a license. Eates said to apply anyway. 

A discussion was held about offering an advanced level license and what such a license 

would entail. The Board will wait to see if it becomes a national trend, but sees no need 

for an advanced licens e at this time. 

Lyter presents the financial report for June 2010. 

Skelton makes a motion to pay the first half of the year for Retiree Health Benefits. 

White seconds. Motion carries.

A motion is made by Meffert to approve the Board minutes from 6 -27-10. White 


Megan Xenakis appeared before the Board to plead her case. Meffert makes a motion to 

go into executive session. White seconds. Motion carries. 

Meffert makes a motion to come out of executive session. Skelton seconds. Motion 

carries. 

The Board will not take a formal vote regarding Xenakis, but urged her to sit for the 

exam and apply for a WV license. 

Michael Pettry wanted to know if he would be able to obtain a WV license if he attended 

massage therapy school, due to a felony. The Everest Institute told him he would be 

denied a WV license. A motion is made by Starr to send a letter to The Everest Institute 

stating that a felony does not necessarily preclude receiving a WV Massage Therapy 

license. Such issues are decided on a case by case basis. White seconds. Motion carries. 


10-00 Has obtained CEUs but no longer wishes to keep license. There is no 

reason to assume he is still practicing. White makes a motion to close the case. Starr 


10-04 No longer practicing massage. Starr makes a motion to close the case. 

Skelton seconds. Motion carries. 

10-05 There has been no response to a letter sent 8-12-10. The Board will send 

another letter after 30 days have passed. The case re mains open.

10-06 A hearing will be held 10 -29-10. The hearing examiner will be Jeff 

Blaydes. 

10-08 The Board found no basis for the complaint. White makes a motion to 

dismiss the case. Meffert seconds. Motion carries. 

10-09 The Board received a letter that addressed the concerns. White makes a 

motion to dismiss the case. Skelton seconds. Motion carries. 

11-00 The Board feels the complaint is not credible and no massage regulations 

were violated. Starr makes a motion to send a letter to the accused and the complainant 

dismissing the case. White seconds. Motion carries. 

11-01 The Board received a letter stating the business does not do massage and 

has removed all references to massage from its website. White makes a motion to 

dismiss the case. Skelton seconds. Motion carries. 

11-02 The complaint will remain open until a reply is received from the 

respondent. 

Several potential massage therapists have inquired about receiving a license in 

spite of past convictions. Eates said nothing would prevent them from obtaining a license 

after attending school. 

Wysong and Lyter attended the Legislative Committee meetings held in August 

and September. 

Lyter presented a report on the state of the Massage Board and how it operates in 

conjunction with the Acupuncture Board. Members discussed the feasibility of 

combining more Boards with ours to help defray costs. 

Lyter presents the financial report for August 2010.

A motion is made by Skelton to approve the Board minutes from 9 -12-10. White 

seconds. Motion approved. 

Angela Barker, Chairperson of NCBTMB Government Relations introduced herself to 

the Board. She explained that each Board will be assigned a liaison to provide any 

assistance or clarification the Board may need. 


10-05 The case remains open. 

10-06 A hearing will be continued on 2 -9-11. 


Legislative Update: 

House Bill 2502 didn ’t pass in The Legislature. 

House Bill 2815 recommends hiring more Hearing Examiners for the Boards. 

Lyter presented a financial re port for 2-6-11. 

Starr makes a motion to increase the spending authority $5,000 to $8,000 as needed to 

cover any additional expenses due to the hearing for case # 11 -06.Meffert seconds. 

Motion approved. 

Skelton makes a motion that the next meeting will b e held 4-17-11. Meffert seconds.

10-06 The hearing examiner should have a recommendation by 4 -28-11. 

Gardner will investigate a business in Kearneyville, WV that may be giving “happy 

endings”. Lyter will also speak to the Cosmetology Board. 

Anthony Ferrarraccio spoke to the Board about an electrical device called ETPS 1000 

which he has been using in his massage practice for several years. Lyter will speak with 

the Acupuncture Board to get some criteria for its use. 

A student inquired about sitting for the National Board Exam because she had completed 

500 hours of coursework but had not finished massage school. 

A motion is made by Starr that the massage therapy program must be completed as our 

rules state. Meffert seconds. Motion approved. 

Lyter presented a financial report for March 2011. 

Meffert makes a motion to increase the spending authority by $25,000. Skelton seconds. 

Motion approved. 

Skelton makes a motion to increase the Executive Director ’s salary by 5% effective 

August 1, 2011. Starr seconds. Motion approved.

FISCAL YEAR 2010 COMPLAINT SUMMARY 

10-00 Practicing a technique that may fall under massage therapy scope of practice. The 

complaint was submitted to the chiropractic board as well. 

Mailed follow-up letter December 22, 2009. He responded that he will follow 

requirements for licensure. 

September 2010 - Has completed his continuing education, but hasn’t taken the 

national exam yet. He is currently working as a substitute teacher. He may leave the 

state. 

Complaint closed September 12, 2010 

10-01 Professional misconduct. Assigned to investigator. Complaint withdrawn. 

Complaint closed December 6, 2009 

10-02 Professional misconduct - alleged sexual assault. Assigned to investigator. 

Mailed follow-up letter December 22, 2009. No response received back from attorney 

or complainant. Board voted at 3/21/10 board meeting to close this complaint due to no 

response to follow-up letters and lack of evidence. 

Complaint closed. 

10-03 Professional misconduct - alleged sexual assault. 

Voluntary surrender of license. 

Mailed follow-up letter December 15, 2009. No response received back. 

Complaint closed March 21, 2010 with notation made in database. 

10-04 Practicing without a license. 

Have called many times, goes to a fax. No mailing address. 

Received address on 3/25/10. Mailed cease and desist letter on 3/31/10. The letter was 

returned to board office. Board director attended a meeting in the Parkersburg area and 

hand delivered the letter on 6/18/10 to residence. No one was home, so it was left in the 

mailbox beside front door. No response received yet. 

Mailed cease and desist letter again on 8/12/10. She called and stated that she is not 

practicing massage. She was told to respond in writing and submit to the board. No 

written response received. 


10-05 Phone Complaint - called on 1/ 22/10. Client hurt during massage Board voted at 

3/21/10 board meeting to assign case to the investigator. Gave information to 

investigator on 4/1/10. The board voted on 6/27/10 to file and investigate the complaint. 

A letter was mailed to the licensee on 8/12/10. No response submitted. Received 

response from licensee attorney on 10/13/10. Mailed copy to client 10/18/10.

Follow-up letter mailed on 3/21/11 to licensee and a copy to complainant regarding the 

ongoing investigation. Attorney to contact Clifford’s office to obtain copies of legal 

documents relating to civil suit. Mailed follow-up letter on 9/30/11. Board voted on 

consent agreement 10/30/11. Attorney to draft. 

Complaint open. 

10-06 Phone Complaint - called 3/4/10. Alleged sexual assault. Board voted at 3/21/10 board 

meeting to suspend license upon arrest and/or receipt of written complaint. Client 

and board office working in conjunction with state police officer Sgt. Clemons on this. 

Gave information to investigator on 4/1/10. The investigator and board director 

interviewed client on 4/29/10. We returned later in the day to pick up the written 

complaint. Investigator returned to licensee’s business 5/6/10 to serve subpoena and 

notice of license suspension. Licensee surrendered 2 of the 3 copies of his license. 

Investigation pending. The state of Virginia has now suspended his license as well. 

Investigation still pending. Hearing scheduled for 1/20/11. Hearing continued 

and scheduled again for 2/9/11. All attorney responses submitted to hearing 

examiner by 5/26/11. Now waiting on recommendation of hearing examiner. Hearing 

examiner ruled in favor of the board - received 8/8/11. Board voted to revoke license on 

8/28/11. Final order dated 9/2/11. Appeal filed; received in board office on 10/6/11. 

Attorney response to appeal received 10/18/11. 


10-07 Phone Complaint - called on 3/24/10 regarding advertisement on internet. When I 

checked the license database, he was not licensed. Mailed cease and desist letter on 

3/31/10. Gave information to investigator on 4/1/10. Wait on response to cease and 

desist letter, then pursue investigation. Unlicensed practitioner responded 4/12/10 that 

he was in full compliance with the cease and desist letter. Stated he would apply for 

licensure at some date in the future. The investigator followed up with a visit to his 

residence and place of business. It was vacant and overgrown. It is assumed he has left 

the state. 


10-08 Practicing without a license and billing insurance while unlicensed. Mailed cease and

prior to the complaint and specifically told him he could not practice until he was 

licensed. Mailed a copy of the complaint to the Barbers and Cosmetologists board as well 

since his spouse is included in the complaint and is a licensed aesthetician. 

Received response to cease and desist letter on 7/16/10. No counter response from 

complainant. 

Complaint closed September 12, 2010. Obtained licensure.

on 7/19/10. Received response from licensee on 8/5/10. Licensee has updated his website 

regarding the concerns of the board.
