1.2 Scope 

As there are no New Zealand legislative requirements for certification of exported 

plant products, the technical phytosanitary requirements are determined by the 

importing country for plant produce being imported into their country. In this respect, 

ICPRs are MPI’s summary of the importing country’s legal requirements and thus 

forms a basis upon which export phytosanitary certification is provided. 

Where an importing country operates on the basis of issuing import permits to their 

importers, the import permit conditions take precedence over any technical 

conditions contained in the MPI ICPR for that country. 

This standard specifies the European Union’s phytosanitary requirements for the 

stated commodities and commodity classes only. If a commodity or commodity 

grouping is not identified within this ICPR exporters should contact, if unsure: 

Ministry for Primary Industries (Plant Exports). Please note the determination of 

phytosanitary requirements is undertaken on a cost recovery basis. The import 

requirements for the EU stipulate the requirements that particular genus/species 

have to fulfil prior to import. If there are no requirements listed for a particular 

genus/species then there are only the general import requirements that need to be

2.2 Phytosanitary Import Permits 

Phytosanitary import permits are not required for plants or plant products to enter the 

European Union. 


2.3 Exemption for Prohibited Items (derogation) 

Under Commission Directive 2008/61/EC of 17 June 2008, certain prohibited 

organisms, plants, plant products and other objects may be introduced or moved 

within the European Union or certain protected zones thereof, for trial or scientific 

purposes. This directive acts as a special permit (letter of authority) which may be 

used by European Union member states for the above trial / scientific purposes. 

New Zealand exporters (commercial or scientific institutions), wishing to send 

prohibited material to the European Union need to obtain a letter of authority from the 

importer in the country to which the material is being sent. The importer in the 

destination country must apply to the phytosanitary authorities of that country in order 

to obtain the letter of authority. The letter of authority will specify conditions from 

which the consignment is exempted. 

Prior to issuance of the phytosanitary certificate, certifying officers are to forward the 

letter of authority to the Ministry for Primary Industries. 

The phytosanitary certificate accompanying any consignment imported under a letter 

of authority (Commission Directive 2008/61/EC) must include the Additional 

Declaration as per the statement on the Letter of Authority. 

2.4 Phytosanitary Certificates 

Refer to the commodity specifically to identify whether a phytosanitary certificate is 

required for the commodity to be exported. 

Additional declarations must reference the EC Plant Health Directive 2000/29/EC on 

the phytosanitary certificate.

If unsure of the phytosanitary requirements for specific commodities in these 

sections, please contact MPI. However, the import requirements for the EU stipulate 

the requirements that particular genus/species have to fulfil prior to import. If there 

are no requirements listed for a particular genus/species then there are only the 

general import requirements that need to be followed – for example AD’s 1-19.

Phytosanitary certificates must not be issued more than 14 days prior to export. 

Where a Phytosanitary Certificate is issued after a consignment has been dispatched 

the inspection date must be stated in the Additional Declaration section of the 

Phytosanitary Certificate. 


Notes: 

I. As of 15/09/2011 France requires phytosanitary certificates to be signed in ink 

(“wet signature”) rather than in an electronic form. The certificates must be 

verified by the Independent Verification Agency (IVA). Verified certificate 

numbers can be forwarded to MPI Plant Exports (either by the exporter or 

the IVA) to be printed out, countersigned and couriered back to the exporter.

attached to the outside of the package on entry into the EU.

have to fulfil prior to import. If there are no requirements listed for a particular 

genus/species then there are only the general import requirements that need to be

3.4 Seeds, Grains and Nuts

3.4.2 Entry of seeds for sowing into the UK 

Conditions: 

Where a consignment of seed destined for the UK has been subjected to a preexport 

treatment by a MPI approved Organisation/treatment supplier, the treatment 

undertaken may be stated on the MPI phytosanitary certificate. 

If this option is selected: 

• It will enlighten Fera, the UK import phytosanitary inspectors, as to why they may 

detect dead insects within the consignment, 

• Minimise the chance of Fera requiring a second fumigation. 

Note: If seed is less than 6 months old and a dead pest is found, Fera is likely to 

require destruction, re-export or treatment. If seed is more than 6 months old and a 

dead pest is found, Fera is less likely to take action. 

3.5 Growing Media and Packing Material

1) Specified plants originating in Third countries shall be accompanied by a 

phytosanitary certificate, as referred to in the first subparagraph of Article 

13(1)(ii) of Directive 2000/29/EC. 

2) The certificate shall include the information that one of the following points is 

fulfilled: 

(a) The specified plants have been grown throughout their life in a country where the 

specified organism is known not to occur. 

(b) The specified plants have been grown throughout their life in a pest free area, 

established as regards the specified organism by the National Plant Protection 

Organisation (hereinafter ‘the NPPO’) of the country of origin in accordance 

with the FAO International Standard for Phytosanitary Measures (hereinafter 

‘ISPM’) No 4 ( 1 ). 

(c) The specified plants have been produced in a pest free place or a pest free site of 

production, established as regards the specified organism by the NPPO in 

accordance with the FAO ISPM No 10 ( 2 ). The specified plants have been 

grown in a structure with a degree of isolation and protection from the outside 

environment that effectively excludes the specified organism. At that place the 

specified plants have been officially inspected twice at the most appropriate 

times for detecting symptoms of infection during the last complete cycle of 

vegetation prior to the export and found free from the specified organism. 

That place of production is surrounded by a zone with a radius of at least 500 m, 

where official inspections were carried out twice at the most appropriate times 

for detecting symptoms of infection during the last complete cycle of vegetation 

prior to the export and any plants showing symptoms of infection which were 

found during those inspections and all adjacent specified plants within the 

distance of 5 m were immediately destroyed. 

(d) The specified plants have been produced in a pest free place of production 

established as regards the specified organism by the NPPO in accordance with 

the FAO ISPM No 10 ( 2 ). 


That place of production is surrounded by a zone with a radius of 4 500 m. Official 

inspections, sampling and testing have been carried out at that place of 

production and throughout that zone twice at the most appropriate times for 

detecting symptoms of infection during the last complete cycle of vegetation 

prior to the export. The specified organism has not been found during the 

official inspections, sampling and testing. 

(3) Where the information set out in point (2)(c) or (2)(d) is given, the certificate shall, 

in addition, include the information that one of the following points is satisfied: 

(a) The specified plants have been directly derived from mother plants grown under 

conditions compliant with point (2)(a) or (2)(b) or 2(c). 

(b) The specified plants have been directly derived from mother plants, which were 

subject to prior individual testing confirming their freedom from the specified 

organism. 

(c) The specified plants have been tested according to a sampling scheme able to 

confirm with 99 % reliability that the level of presence of the specified organism 

in the specified plants is below 0,1 %. 

(4) Where the information set out in point (2)(b) is given, the name of the pest free 

area shall be included under the heading ‘Place of Origin’ of the certificate.

The EU stipulates requirements that particular genus/species have to fulfil 

prior to import. If there are no requirements listed for a particular 

genus/species then there are only the general import requirements that need 

to be followed – for example AD’s 1-19. (FERA correspondence 9 June 2009) 

1. Soil and growing medium, attached to or associated with plants, 

consisting in whole or in part of soil or solid organic substances such 

as parts of plants, humus including peat or bark or consisting in part of 

any solid inorganic substance, intended to sustain the vitality of the 

plants. 


Note: “the growing medium at the time of planting …” only applies when there 

is soil or growing medium attached to, or associated with, the commodity at 

the time of import (FERA correspondence 4 August 2010). MPI interprets this 

as saying it only applies if the roots have not been washed free of soil and 

have been inspected to confirm this.
