John C. Bates of the county of Franklin and state aforesaid of the other part witnesseth the said John B. Hodson for and in<br />

consideration of one dollar and the consideration hereinafter mentioned in hand paid the receipt whereof is hereby<br />

acknowledged hath granted bargained and sold and by these presents doth grant bargain and sell unto the said John C.<br />

Bates his heirs and assigns forever all that tract or parcel of land situated and in the county of Owen and state aforesaid and<br />

bounded as follows to wit: beginning at three small hickory saplins standing on the north side of Clarks branch thence north<br />

158 poles to two beeches and sugartree thence east 185 poles crossing Cedar Creek to three sugartrees thence south 30<br />

poles to two ironwoods standing on the bank of Cedar Creek thence down the same 72 west 94 poles to two small sycamores<br />

thence across the creek to the mouth of Clarks branch and with the meanders of the same south 10 west 20 poles, south 40<br />

west 25 poles, south 31 west 50 poles, south 49 west 34 poles, south 80 west 20 poles to the beginning containing<br />

ninety-eight acres one rood and thirty five poles also the following property to wit: one bay mare five years old, one two year<br />

old roan colt, 1 black one year old colt, one bay (suckling?) colt, twenty head of sheep, one two year old steer and red milch<br />

cow, two beds and furniture, one (ca--?) and two shovel ploughs, two tables, one bureau, one cupboard and eight head of<br />

hogs together with all and singular the appurtenances thereunto belonging or in any wise appurtaining to have and to hold<br />

the land and personal property hereby conveyed with the appurtenances unto the said John C. Bates his heirs or assigns<br />

forever. And the said John B. Hodson for himself his heirs executors and administrators the aforesaid tract of land and<br />

appurtenances conveyed unto the said John C. Bates his heirs and assigns against the claim or claims of all and every<br />

person or persons whatsoever do and will forever warrant and defend by these presents promised that the grantor is<br />

indebted to the grantee in the sum of three hundred and forty (?) one dollars and seventy five cents due on the 21st day of<br />

July 1840 as will appear by note bearing that date and if he shall on or before the first day of April next or any person for<br />

him well and truly pay said sum of money with interest agreeable to the demand thereof then this indenture to cease and be<br />

of no effect otherwise to remain in full force and virtue in witness whereof the said John B. Hodson hath hereunto set his<br />

Owen County Court I. N.M. Bacon Clerk of the Court for the county aforesaid do certify that this deed of mortgage from<br />

John B. Hodson to John C. Bates was produced to me in my office in Owenton on the 31st day of July 1840 and was proven<br />

by the oaths of Nathan Haster and Thomas M. Claxon witnesses thereunto to be the act and deed of said Hodson. Given<br />

Claxon 168 and Nancy Roe Claxon [Bassett] 167 . William died on 20 November 1872, aged 55, in Merrill-Simpson Cemetery,<br />

Moxley, Owen, Kentucky, United States.<br />
