Request for Reconsideration of Board’s Final Order<br />
At the February 24, 2012 meeting, the Board approved the Hearings<br />
Officer’s recommended order as the Board’s final order in the above<br />
case.<br />
Mr. DeMattos submitted exceptions to the Hearings Officer’s<br />
Recommended Order within the deadline of 15 days from receipt of the<br />
order, but he sent it to RICO instead of the Hearings Office, so the<br />
exceptions were not considered by the Board at the February 24, 2012<br />
meeting.<br />
The Board reviewed his exceptions and his request for<br />
reconsideration.

After discussion, it was moved by Mr. Lee, seconded by Mr. Kamai,<br />
and unanimously carried to reaffirm the Board’s Final Order of<br />
February 24, 2012, therefore denying Mr. DeMattos’ request for<br />
reconsideration.<br />
Following the Board’s review, deliberation and decisions in these matters,<br />
pursuant to HRS chapter 91, Chairperson Arita announced that the Board was<br />
reconvening to its open meeting at 8:43 a.m.<br />
Petition for<br />
Declaratory Relief: a. In the Matter of the Petition of Access Lifts of <strong>Hawaii</strong> for Declaratory<br />
Relief<br />
Access Lifts of <strong>Hawaii</strong> (“Access Lifts”) filed a Petition for Declaratory Relief<br />
(“Petition”). After brief discussion, it appeared that Access Lifts was<br />
requesting the Board’s interpretation of the Americans with Disabilities Act and<br />
other federal guidelines and requirements that are outside of the Board’s<br />
jurisdiction.<br />
It was moved by Mr. Dill, seconded by Mr. Sadowski, and unanimously carried<br />
to defer acting on the Petition pending Access Lift’s clarification on the specific<br />
Board statute or rule applicable to their request.<br />

Mr. Sadowski reported on the following bills:<br />
S.B. No. 2412 – This bill initially created new sections in Chapter 444<br />
relating to performance bond and retainage on all projects, and<br />
amended Chapters 103 and 507 (procurement and mechanic liens).<br />
The latest version, S.B. No. 2412, S.D.2, H.D.2, only amends section<br />
444-25, and requires contractors to pay their subs within 10 (instead of<br />
60) days after receipt of invoice and receipt of payment for the work by<br />
the owner. This bill will probably be scheduled for conference between<br />
the Senate and House to work out differences.<br />
H.B. No. 1295 – This is the task force bill that places unlicensed<br />
contractor activity within the penal code. This bill will probably be<br />
scheduled for conference between the Senate and House to work out<br />
differences of the H.D.3 and S.D.2.<br />

F&H Construction<br />
F&H Construction requests determination on whether, as an “A” General<br />
Engineering and “B” General Building contractor, it can perform window<br />
removal and replacement. It is part of the King Kekaulike High School<br />
renovation project on Maui (DAGS Job No. 15-14-7456, Hardening of<br />
Hurricane Shelters) which includes selective demolition, masonry, structural<br />
steel, carpentry, flashing and sheet metal, steel doors and frames, wood<br />
doors, steel windows, skylights, painting, protective metal screens, hurricane<br />
tie-downs, and miscellaneous related work.<br />
Window work involves removal and replacement of prefabricated metal<br />
windows, and no glazing or glass cutting is necessary.<br />
Recommendation: The window work may be performed under F&H’s C-5<br />
Cabinet, millwork, and carpentry remodeling and repairs classification.<br />

and unanimously carried to approve the above scope recommendation.<br />

unanimously carried to move out of executive session and to reconvene to the<br />
Board’s regular order of business.<br />
After discussion, it was moved by Mr. Arita, seconded by Mr. Suehiro, and<br />
unanimously carried to deny Mr. Nelson’s request for a conditional license and<br />
deferred his application pending verification of payment or payment<br />
arrangements of the accounts in question.<br />
