<strong>Commission</strong> jurisdiction is required for systems with the capacity to serve<br />

more than 100 persons according to Florida Statutes 367.022. Using 2.5<br />

people per household in the Bluefield <strong>Service</strong> area and assuming an ERC is<br />

effectively one (1) household, the Phase I utility services requirement is<br />

for approximately 100 people which is approximately seven (7) times the<br />

requirement for Comission jurisdiction. Exhibit E contains a :statement<br />

that the Utility will not own the land for the water treatment .Eacilities<br />

3ut will lease it. Appendix IV contains a copy of the lease for water<br />

facilities, as previously discussed, proving the utility has right to the<br />

land that the treatment facility will be on. The legal description,<br />

Exhibit A of the lease, of the leased land is not included at this time.<br />

Upon certification by the <strong>Commission</strong>, the facilities will he exactly<br />

located and a survey of the approximately 20 acres necessary for the<br />

provision of Phase I water service will be conducted and the legal<br />

description of same used to update the water lease agreement, a copy of<br />

which will he provided to the <strong>Commission</strong> for their records. In addition,<br />

there are several minor clarifying changes which will be included such as<br />

the Lessor’s Resource Manager contact information on page four (4) of the<br />

lease. Evans is committed to providing the land necessary for the<br />

provision of utility service in the Bluefield certificated area and as<br />

such will work with <strong>Commission</strong> staff to ensure that they are confortable<br />

with the terms of the water lease. As discussed earlier, the financial<br />

impact of the lease agreements has been included in the Cost of <strong>Service</strong><br />
