Dear Mr. Jackson: 

We have received your letter to Mr. Dan Hoppe concerning whether Woodlands of Lake Placid 

(Wood1,ands) must file a 1999 annual report, even though they are not currently certificated. 

Rule 2530.1 10(3), Florida Administrative Code, states that an annual report shall be filed by 

"any utility which is subject to this Commission's jurisdiction as of December 3 1 of that year, 

whether OP" not the utility has actually applied for or has been issued a certi$cabe.'* (emphasis 

added). Woodland became subject to this Commission's jurisdiction as early as February of 1997, 

when we were informed that Woodland was providing water service to the public for compensation. 

- See 367.02 1 (1 21, Florida Statutes, (1 999). Therefore, WoodIand must file an annual report with the 

Commission on or before March 31 for the preceding year ending December 31. Sef: Rule 25- 

30.1 10(3)(a), Florida Administrative Code.

On June 5,20000 T sent a Fax indicating that the Utility is requiring the property 

owners { 145) to insta!I water meters; whereas there are 397 fots in Camp Florida 

Kesorlsthe 252 fots are owned by Camp Florida Resorts, L.P. WoodIands states 

Ihat at some future date this will be completed. 

We were advised that after the meters are installed individual billing will be made 

in accordance tu the rate structure approved by the PubliE Service Commission, 

On February 17, 1997 we corresponded with Mr. Bob Crouch af your office 

advising that the abuve utility was increasing the fees; however was not registered. 

My understanding it took over two years before they registered -during that time 

the increase was billed and continues to date. The rate is a flat rate of 535 per 

month. They required payments three months in advance. We understand billing 

will begin on a monthly bases beginning in July -subject to your mte approval. 

We understand that he Southwest Water Management does not require water meters 

be installeddoes the Commission? 

Woodlands is servicing south ofcamp Florida to two sub-divisions and a Motel 

and on Highway 29 anothcr small subdivision along with Kash & Kany. 

At any rate hearing the 252 tots for Camp Florida Resort5,L.P. should be included 

even though thcy are not being billed for the gross and nct profit will bc effected. 

Camp Florida Resort,L.P. and Woodlands are controlled by the same management. 

'I'he records should show this billing even though there may be no money transfer. 

Could you advise me if there has been any rate hearing ,or approval ? 

We would appreciate being advised on any activity with this utility since they do not 

Freely correspond with the users.

Dear Ms. Keller: 

We have received YOU facsimile concerning the Woodlands of Lake Placid. You were 

concerned about the rate increase in 1998 and wanted to know the justification for increasing the 

rates for only a portion of the customers. You also questioned why the Commission required the 

installation of individual meters for the 145 homeowners of Camp Florida Resort, at the exclusion 

of the 252 metered lots owned by Camp Florjda Resort, LP. 

The WoodIands of Lake Placid has applied for an original certificate for its water system. 

When the Commission grants an original certificate, the utility is required to keep the charges 

currently in effect, until authorized to change by the Commission in a subsequent rate proceeding. 

Consequently, the rates you are currently charged will remain in effect until the next rate proceeding. 

The homeowners in the campground are having water meters installed and will be charged 

based on their consumption in the future. The Southwest Florida Water Management District, not 

the Commission, required the utiIity to install meters and is also requiring the utility to implement 

' a conservation rate structure. The remaining lots owned by Camp Florida Resort, LF are not being 

metered. Camp FIorida Resort, LP pays a bulk water rate and allocates that cost to each lot in the 

lot rent fee. 

Placid Lakes Utilities, Inc. has applied €or a rate increase in Docket No. 000295-WU. If you 

are responding to the notice sent by Placid Lakes Utilities, Inc., please reference Docket No. 000295- 

W - Application for increase in water rates in Highlands County by Placid Lakes Utilities, Inc., 

in any hture correspondence. 

There has not been any rate proceeding fur the Woodlands of Lake Placid. Staff is still 

awaiting the utility's application for original certificate for the wastewater system to process the

Jason, I listened to the tape of this item, specifically Comm. Deason's rnotlon on Issues 3 and 6. Me didnY include 

mention of the $25 or $35 rates, though the Chairman did ask after his motion if staff needed clarification on "the $35 

being temporary pending the outcome of the staff-assisted rate case," and then "If you did, I've just done it for you." In 

other words, this wasn't specifically stated in the Commissioner's motion. Neither did the motion specifically include 

leaving the docket open. 

However, based on the Chairman's questlon concerning the rate, I will add to the decision in issue 6, "The $35 rate is 

temporary pending outcome of the staff-assisted rate case," and change issue 8 to "decision consistent with 

modifications in issues 3 and 8."
