Construction Expenses, calculated by dividing the total<br />
Construction Expenses by the total Water Subscriber's number<br />
of parcels and the total Additional Water Subscriber ( s)<br />
parcel(s) plus pay any additional expenses associated with<br />
adding water service to their parcel ( s) from the Mutual.<br />
Upon a written request from Additional Water Subscriber(s) to<br />
the Mutual to provide water service to the newly created<br />
parcel(s), the Mutual shall provide written notice to the<br />
owner(s) of the newly created parcels of the amount of their<br />
cost share(s) of Construction Expenses which shall be due and<br />
payable to the Mutual within twenty ( 2 0) days of their<br />
receipt of the notice. If any of the owner(s) of the newly<br />
created parcels do not make the required payments, they shall<br />
not be included as Additional Water Subscribers and the<br />
amounts owed by the remaining Additional Water Subscribers<br />
shall be recalculated.<br />
Any property owner(s) within the Service Area who are<br />
Initial Subscriber(s) and actively pursuing the sale of their<br />
property(s) for funds available through Proposition 70, for<br />
the Big Sur Viewshed Acquisition Program under the California<br />
Wildlife Coastal and Park Land Conservation Act of 1988, and<br />
choosing not to become a Water Subscriber at the time the<br />
Mutual obtains the Construction Bid and at a later date for<br />
any reason does not complete the sale for Prop. 70 funds may<br />
become an Additional Water Subscriber by paying their share<br />
of the Construction Expenses, calculated by dividing the<br />
total Construction Expenses paid by the total Water<br />
Subscriber's number of parcels and the total Additional Water<br />
Subscriber ( s) parcel ( s) plus pay any additional expenses<br />
associated with adding water service to their parcel(s) from<br />
the Mutual. Upon a written request from Additional Water<br />
Subscriber(s) to the Mutual to provide water service to the<br />
parcel ( s) whose sale for Proposition 70 funds was not<br />
completed, the Mutual shall provide written notice to the<br />
owner ( s) of said parcel ( s) of the amount of their cost<br />
share(s) of Construction Expenses which shall be due and<br />
payable to the Mutual within twenty ( 2 0) days of their<br />
receipt of the notice. If any of the owner ( s) of said<br />
parcel(s) do not make the required payments, they shall not<br />
be included as Additional Water Subscribers.<br />
(i) The anticipated water source for the mutual is<br />
located on Bibbero's parcel. Bibbero will convey to the<br />
Mutual upon commencement of construction of the system the<br />
existing well, well lot easement, and appurtenances to the<br />
well; excluding the existing pump, water line, storage tank<br />
and pressure system serving the Bibbero parcel. Bibbero's<br />
expense for the well is $44,593.76, excluding the costs of<br />
the existing pump, water line, storage tank and pressure<br />
system. This expense shall be included in Construction<br />
Expenses.<br />
