CHAPTER XI<br />

PENALTIES<br />

Article 38<br />

All penalties shall be limited to impris<strong>on</strong>ment.<br />

Article 39<br />

Those who have committed any crime as provided in Articles 3 new, 4, 5, 6, 7 and 8<br />

shall be sentenced to a pris<strong>on</strong> term from five years to life impris<strong>on</strong>ment.<br />

In additi<strong>on</strong> to impris<strong>on</strong>ment, <strong>the</strong> <strong>Extraordinary</strong> Chamber <strong>of</strong> <strong>the</strong> trial court may order<br />

<strong>the</strong> c<strong>on</strong>fiscati<strong>on</strong> <strong>of</strong> pers<strong>on</strong>al property, m<strong>on</strong>ey, and real property acquired unlawfully<br />

or by criminal c<strong>on</strong>duct.<br />

The c<strong>on</strong>fiscated property shall be returned to <strong>the</strong> State.<br />

CHAPTER XII<br />

AMNESTY AND PARDONS<br />

Article 40 new<br />

The Royal Government <strong>of</strong> Cambodia shall not request an amnesty or pard<strong>on</strong> for any<br />

pers<strong>on</strong>s who may be investigated for or c<strong>on</strong>victed <strong>of</strong> crimes referred to in Articles 3, 4,<br />

5, 6, 7 and 8 <strong>of</strong> this law. The scope <strong>of</strong> any amnesty or pard<strong>on</strong> that may have been<br />

granted prior to <strong>the</strong> enactment <strong>of</strong> this <str<strong>on</strong>g>Law</str<strong>on</strong>g> is a matter to be decided by <strong>the</strong><br />

<strong>Extraordinary</strong> <strong>Chambers</strong>.<br />

CHAPTER XIII<br />

STATUS, RIGHTS, PRIVILEGES AND IMMUNITIES<br />

Article 41<br />

The foreign judges, <strong>the</strong> foreign Co-Investigating Judge, <strong>the</strong> foreign Co-Prosecutor and<br />

<strong>the</strong> Deputy Director <strong>of</strong> <strong>the</strong> Office <strong>of</strong> Administrati<strong>on</strong>, toge<strong>the</strong>r <strong>with</strong> <strong>the</strong>ir families<br />

forming part <strong>of</strong> <strong>the</strong>ir household, shall enjoy all <strong>of</strong> <strong>the</strong> privileges and immunities,<br />

exempti<strong>on</strong>s and facilities accorded to diplomatic agents in accordance <strong>with</strong> <strong>the</strong> 1961<br />
