The Secretary-General <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s shall submit a list <strong>of</strong> at least two<br />

candidates for foreign Co-Prosecutor to <strong>the</strong> Royal Government <strong>of</strong> Cambodia, from<br />

which <strong>the</strong> Supreme Council <strong>of</strong> <strong>the</strong> Magistracy shall appoint <strong>on</strong>e prosecutor and <strong>on</strong>e<br />

reserve prosecutor.<br />

Article 19<br />

The Co-Prosecutors shall be appointed from am<strong>on</strong>g those individuals who are<br />

appointed in accordance <strong>with</strong> <strong>the</strong> existing procedures for selecti<strong>on</strong> <strong>of</strong> prosecutors who<br />

have high moral character and integrity and who are experienced in <strong>the</strong> c<strong>on</strong>duct <strong>of</strong><br />

investigati<strong>on</strong>s and prosecuti<strong>on</strong>s <strong>of</strong> criminal cases.<br />

The Co-Prosecutors shall be independent in <strong>the</strong> performance <strong>of</strong> <strong>the</strong>ir functi<strong>on</strong>s and<br />

shall not accept or seek instructi<strong>on</strong>s from any government or any o<strong>the</strong>r source.<br />

Article 20 new<br />

The Co-Prosecutors shall prosecute in accordance <strong>with</strong> existing procedures in force. If<br />

<strong>the</strong>se existing procedures do not deal <strong>with</strong> a particular matter, or if <strong>the</strong>re is uncertainty<br />

regarding <strong>the</strong>ir interpretati<strong>on</strong> or applicati<strong>on</strong> or if <strong>the</strong>re is a questi<strong>on</strong> regarding <strong>the</strong>ir<br />

c<strong>on</strong>sistency <strong>with</strong> internati<strong>on</strong>al standards, <strong>the</strong> Co-Prosecutors may seek guidance in<br />

procedural rules established at <strong>the</strong> internati<strong>on</strong>al level.<br />

In <strong>the</strong> event <strong>of</strong> disagreement between <strong>the</strong> Co-Prosecutors <strong>the</strong> following shall apply:<br />

The prosecuti<strong>on</strong> shall proceed unless <strong>the</strong> Co-Prosecutors or <strong>on</strong>e <strong>of</strong> <strong>the</strong>m requests<br />

<strong>with</strong>in thirty days that <strong>the</strong> difference shall be settled in accordance <strong>with</strong> <strong>the</strong> following<br />

provisi<strong>on</strong>s;<br />

The Co-Prosecutors shall submit written statements <strong>of</strong> facts and <strong>the</strong> reas<strong>on</strong>s for <strong>the</strong>ir<br />

different positi<strong>on</strong>s to <strong>the</strong> Director <strong>of</strong> <strong>the</strong> Office <strong>of</strong> Administrati<strong>on</strong>.<br />

The difference shall be settled forth<strong>with</strong> by a Pre-Trial Chamber <strong>of</strong> five judges, three<br />

Cambodian judges appointed by <strong>the</strong> Supreme Council <strong>of</strong> <strong>the</strong> Magistracy, <strong>on</strong>e <strong>of</strong> whom<br />

shall be President, and two foreign judges appointed by <strong>the</strong> Supreme Council <strong>of</strong> <strong>the</strong><br />

Magistracy up<strong>on</strong> nominati<strong>on</strong> by <strong>the</strong> Secretary-General <strong>of</strong> <strong>the</strong> United Nati<strong>on</strong>s. The<br />

appointment <strong>of</strong> <strong>the</strong> above judges shall follow <strong>the</strong> provisi<strong>on</strong>s <strong>of</strong> Article 10 <strong>of</strong> this <str<strong>on</strong>g>Law</str<strong>on</strong>g>.<br />

Up<strong>on</strong> receipt <strong>of</strong> <strong>the</strong> statements referred to in <strong>the</strong> third paragraph, <strong>the</strong> Director <strong>of</strong> <strong>the</strong><br />

Office <strong>of</strong> Administrati<strong>on</strong> shall immediately c<strong>on</strong>vene <strong>the</strong> Pre-Trial Chamber and<br />

communicate <strong>the</strong> statements to its members.<br />
