X. NAMED PLAINTIFFS SHOULD BE GRANTED A CASE CONTRIBUTION<br />
AWARD<br />
159. Last but by no means least, we wish to note the considerable efforts made by<br />
Named Plaintiffs Carl Esposito, Barbara Bol<strong>and</strong>, Alan Maltzman, <strong>and</strong> Mary Gidaro. These<br />
Plaintiffs have been active, h<strong>and</strong>s-on participants in this litigation, expending significant<br />
amounts <strong>of</strong> their own time to benefit the Class. They came forward to initiate this action, <strong>and</strong><br />
thereafter remained in contact with Counsel. They provided documents <strong>and</strong> information; had<br />
agreed to respond to document requests <strong>and</strong> interrogatories <strong>and</strong> sit for their depositions;<br />
reviewed <strong>and</strong> approved pleadings; <strong>and</strong> participated in the settlement process by consulting with<br />
Plaintiffs’ Counsel on the adequacy <strong>of</strong> Defendants’ settlement proposals. See Exhibits B through<br />
E. Each <strong>of</strong> these individuals devoted considerable to help the Class prevail on behalf <strong>of</strong> the<br />
Plans <strong>and</strong> we ask the Court to recognize their efforts by awarding each <strong>of</strong> them a case<br />
contribution award in the amount <strong>of</strong> $5,000.<br />
160. The Class Notice disclosed that the Named Plaintiffs would seek awards <strong>of</strong><br />
$5,000 each for their initiative <strong>and</strong> efforts in the litigation. No objection to the proposed award<br />
has been received to date.<br />
161. We therefore, believe that payment <strong>of</strong> modest case contribution awards to Named<br />
Plaintiffs Carl Esposito, Barbara Bol<strong>and</strong>, Alan Maltzman, <strong>and</strong> Mary Gidaro is well deserved <strong>and</strong><br />
wholly appropriate given the effort these individuals devoted to this case.<br />
XI. CONCLUSION<br />
162. For the reasons discussed herein, the Settlement is a fair, adequate, <strong>and</strong> reasonable<br />
resolution <strong>of</strong> the claims in this complex <strong>and</strong> hard-fought ERISA class action. The requested<br />
fees, expenses <strong>and</strong> case contribution awards are well warranted. Thus, Plaintiffs <strong>and</strong> Plaintiffs’<br />
Counsel respectfully request that the Court grant their motions in their entirety.<br />
