Laval's English Paper, Since 1993 Stop sign refused The city traffic division (Engineering Department) has studied a request by Issam Elmashtouh for of a stop sign at the intersection of Chemin du Bord-de-L’Eau and Avenue de la Seigneurie. According to Quebec’s atlas of road signalization, the intersection in question does not meet the minimum criteria for the installation of a stop sign and it clearly states that a stop sign is not to be used for the sole purpose of slowing down traffic. Chemin du Bord-de-L’Eau is considered a primary artery of the local road network leading to Samson Boulevard and Autoroute 13 therefore traffic flow must be fluid and free of impediment. Excessive use of stop signs on such roads ultimately leads to the non respect of road signs creating safety hazards. However a request by Madame Dominique Cyr, of 329 Avenue de la Seigneurie, to correct poorly marked road lines and signs has been approved. According to the traffic department, the use of a stop sign at this particular intersection is not justified because the volume of traffic entering via Géraniums Street is far from the volume that passes via Chemin du Bord-de-L’Eau. Also, a stop sign already exists at the intersection of Lynne Street just east of the intersection in question and it would be very difficult to move an existing sign as residents on that street have become accustomed to this access. As a result theses signs will be placed at several sites along the street including close to the Cléroux Boulevard intersection. City to invest in rehabilitating major artery Berlier Street in the center Industrial Park A survey of the state of roads in Chomedey’s Central Industrial Park in 2001 determined that Berlier Street and part of Industrial Boulevard were in a minimally acceptable condition. In the last five years the road conditions have deteriorated significantly and now require immediate intervention. In 2006 the engineering department prepared a preliminary technical report on the renovation of Berlier Street and part of Industrial Boulevard between Berlier and Autoroute 440. The initial technical plans and cost estimates to complete the rehabilitation of this road network was estimated at approximately $2,970,000 and included close to $429,000 of professional engineering and laboratory consulting fees. In view of the large amounts involved in realizing this project it was decided to out the professional and laboratory services to tenders. A selection committee of four, three members of the engineering department and one member of the city’ clerk office will determine the winning bid. The bidding process will be opened for December 12 th 2006. Administration contracts out municipal tax bills The City will spend approximately $100,624 to have a private company, Formules d’ Affaires Data, design and print the 2007 tax bills. The vehicles, which are made by the Ford Company, are the Fusion sedan models. The purchase price is estimated at $195,000 before taxes. These vehicles will replace six cruisers whose existing mileages require major repairs and whose projected useful life spans do not justify the repair costs. City to pay ‘no smoking’ fine The City was fined for breaking the ban on smoking in a public building as a worker or workers were caught smoking where it was no longer permitted. After an internal investigation the executive has concluded that the fine would have to be paid. The cost of the fine and contribution is $410. September construction statistics show continued strength The city urban development office issued 100 construction permits this past September 2006 for new housing developments that created 344 housing units. The total value of these investments reached $56.3 million. In the industrial, commercial and institutional categories 4 permits were issued for new construction with property values estimated at $43.2 million. Over 222 renovation permits were issued for an additional value of $18.7 million bringing the total value of all permits in all categories to $118 million. This compares with $50.4 million and $32.7 million in 2005 and 2004 respectively. The projects of importance include Residence Soleil on 1455 Avenir Boulevard which is a $40 million senior’s residence project, Boisé Notre Dame on 3199 Notre Dame Boulevard another $25 million senior’s residence housing development and the addition of phase 3 of a multi-unit housing project valued at $7.5 million on 4605 St. Rose Boulevard. Since the beginning of the year the total number of permits for new construction issued by the urban development office has reached 1080 resulting in the creation of 2028 new housing units. The property value of all new construction has reached $364 million compared to $473 million and $367 million in 2005 and 2004. The total property value of all construction and renovations permits issued in 2006 to date is $585 million which compares favorably with the $614 million and $537 million achieved in 2005 and 2004 respectively. Local MPs applaud Tories’ Quebec Nation motion nanCy GirGiS Prime Minister Stephen Harper’s motion to define Quebec as a nation within a united Canada passed through a decisive Parliamentary vote last Monday evening, and local Bloc Quebecois MPs could not be happier about this highly controversial decision. The issue began last week as the Bloc Quebecois attempted to capitalize on divisions within the Liberal and Conservative parties by tabling a motion recognizing Quebecers as a nation. PM Harper surprised many when he responded with a motion of his own, which recognizes the Québécois people as a nation within a united Canada. Although BQ leader Gilles Duceppe originally opposed Harper’s motion, he stunned many by reversing his position and lending his support to the Tories’ proposition, which passed in a landslide 266-16 vote. Laval Bloc MP Nicole Demers says Duceppe was right in reversing his position. “What was important for us was to ensure that the Chamber of Commons recognized that the Quebecois people form a nation, and when we presented the motion last week we saw that it bothered the Harper government,” Demers said. “The ending of the motion (within a united Canada) has no incidence on the fact that the nation was recognized.” Marc-Aurèle-Fortin MP Serge Ménard says that although many Quebecers were happy about the adoption of this motion, no one was left surprised. “Quebec as a nation is not something we ask ourselves anymore, I mean the National Assembly adopted a similar motion twice,” he said. Hopes that the provincial smoking ban would be temporarily suspended for the holiday season were quashed on November 20 when a judge rejected a plea for a temporary injunction from Quebec bar owners. The next step for the Union des Tenanciers de Bars du Quebec (UTBQ), spearheaded by bar owners Peter Sergakis and Voula Demopoulos, is a full constitutional contest of the entire law, to be submitted in Quebec Superior Court in the spring. Demopoulos, owner of the Skratch bar in Laval, says she was surprised by Justice Helene Le Bel’s decision to reject the injunction. “I was surprised because I believed the judge was aware of the human rights and economic impact of the smoking ban,” Demopoulos explained. “However she saw that we brought up some interesting points.” In fact, Justice Le Bel recognized that many bars have seen a general drop in business and that many bar owners were forced to fire some employees. Without wanting to minimize the impact of these losses, the judge could simply not see that a serious or irreperable prejudice was committed in this case. “Unfortunately, in our society, other companies or industries have suffered or will suffer the consequences of important changes in regulations, the market or competition,” she wrote before rejecting the request. The smoking ban, which went into effect on May 31 and prevents anyone from smoking in a public place, may cause extensive damage as cold winter temperatures are right around the corner according to bar owners. Demopoulos believes that more and more bars will be closing down as the temperature gets colder. Once winter comes around, it will become harder for people to tolerate the temperature to go smoke outside, thus encouraging them to stay at home instead. 10 bars have already closed down since May 31, and many more will be closing their doors soon. “We’ll be see- Demers says the impact of this decision will be dictated by what the Bloc Quebecois decides to do with it. She hopes it will give Bloc MPs the strength to keep fighting for the wellbeing of Quebecers. “First we will press on the government to transfer the money to Quebec to solve the problem of fiscal imbalance, and we hope it will stop Ottawa from intervening with Quebec competencies,” she said. Recent federal initiatives such as the national strategy on cancer and the environmental policy should be left out of Quebec, which already possesses similar policies. “We hope to pressure the government to pull out its pan-Canadian strategies and to give us the funds to pursue our own programs, to make sure that the money is well-used.” Although Menard recognizes that the Quebec nation motion may only be symbolic, he believes it will help the sovereignty process in the future. “This recognition is only symbolic; it does not translate into concrete measures. However, once Canada becomes aware that Quebec is its own nation, the rest of the country will realize that a sovereign Quebec is a better idea and we will be able to leave Canada without bad feelings between both nations,” Ménard explained. Although many have criticized Duceppe for going along with Harper’s motion, Demers supports Duceppe’s view that the Bloc outmaneuvered Harper. “It gives us a step-up; the Tories must now prove that they respect Quebecers and that this motion is not only a word, not only symbolic, but that it means a lot more,” she said. “Once Quebec is really recognized and respected, we can truly have a Quebec nation that can prosper with its own programs and with federal money meant to fund them.” Judge butts smoking ban injunction out nanCy GirGiS ing a majority of smaller bars closing down, much more than what has come about so far,” Demopoulous said. “Due to the cold weather, a lot less people will be going to bars, which will be very detrimental to our business, especially the smaller ones.” She adds that most bars have seen a drop in business from 15 to 40 per cent. Not one bar has gained from the smoking ban according to Demopoulos. Supporters of the smoking ban believe that bar owners are exaggerating these numbers and point to several studies that show that businesses in other areas first suffered a loss prior to regaining some ground following the implementation of a smoking ban. Hellmut Novotny, former owner of the Resto-Bar l’Amical, in Laval, says he was forced to close down due to poor business numbers less than three months after the smoking ban was implemented. “They keep saying that businesses will bounce back but just now, in Ontario, businesses are bouncing back from the smoking ban in 1999,” he points out. “If you’re at the same level you were seven years ago, you’re losing; period. This means a lot of bar closures and a lot of job losses in the industry.” Demopoulos echoed Novotny’s argument with her own experience with the Skratch bar in Oshawa, Ont. “The establishment in Oshawa has been consistently losing money for the past two years, and has never went back to what it was before,” she deplored. Demopoulos said that she and Sergakis, with the help of their lawyer Julius Grey, are encouraged by the Judge’s comments and will spend the next few weeks planning their next step. “We’ll be talking strategic decisions, but we’ll also have to see what the next few months will bring in terms of businesses losses, and take it from there. Our main constitutional action is to be heard sometime in the spring, and we are now concentrating fully on that, we are not giving up,” she said.
