Elected letting agents<br />

3.9 Where there is a chain of letting agents, the last letting agent<br />

and any other letting agent in the chain can jointly elect to<br />

transfer the responsibility for operating the <strong>Scheme</strong> from the<br />

last letting agent to the other letting agent making the election.<br />

3.10 For example, ABC Ltd collects rents from tenants of a property<br />

owned by a non-<strong>resident</strong> landlord. It pays the rents to John,<br />

who is responsible for meeting the costs of repairs to the<br />

property and paying the balance of the rents into the landlord’s<br />

bank account. John is responsible for operating the <strong>Scheme</strong><br />

because he is the last letting agent in the chain. But, if they<br />

both wish, ABC Ltd and John can jointly elect for ABC Ltd to<br />

operate the scheme.<br />

3.11 Letting agents who wish to make an election should write to<br />

PTI providing the following information:<br />

• the name and address of the elected letting agent;<br />

• the name and address of the other letting agent;<br />

• the name and address of the non-<strong>resident</strong> landlord or<br />

landlords; and<br />

• the date from which the election is to take effect (the<br />

letting agents can choose this date but it cannot be<br />

earlier than the first day of the quarter in which the<br />

election is made).<br />

<strong>The</strong> election must be signed by both letting agents making the<br />

election. <strong>The</strong>y can make an election by sending in one letter<br />

signed by both parties or by writing in separately and each<br />

providing the same information. <strong>The</strong>re is no special form for<br />

making an election.<br />

3.12 Letting agents may wish to make an election in respect of only<br />

part of a landlord’s rental business. <strong>The</strong>y can do this by<br />

identifying the property to which the election relates.<br />

3.13 Either letting agent may revoke the election by notice in writing<br />

to PTI. Such a revocation will take effect from:<br />

• the first day of the quarter next following the date on<br />

which notice of revocation is received by PTI; or<br />

• 30 days following the date on which the notice of<br />

revocation is received by PTI;<br />

whichever is the later.<br />
