AM ORDINANCE PROHIBITING ALL STORE OWNERS AND<br />
ESTABLISHMENTS FROM PUTTING-UP SIGNS FOR "EXCLUSIVE USE" OR<br />
"RESERVE PARKING ONLY" AND OTHER OBSTACLES IN FRONT OF THEIR<br />
STORES AND BUSINESS ESTABLISHMENT AS THE SPACE IS FOR PUBLIC USE<br />
AND PROVIDING PENALTIES FOR VIOLATION THEREOF<br />
WHEREAS Section 458 &) (vi) of Republic Ad <strong>No</strong> 7160 otherwise known as the<br />
Local Government Code of 1991 slates that the Sangguniang Panlungsod can regulate<br />
traffic nn all streets and bridges prohibit encroachment or obstructs thereon and when<br />
necessary in Hie interest of public welfare authorize the removal of encroachment and<br />
illegal construction in public places<br />
WHEREAS some business commercial establishments and other entities are<br />
putting up signs designating of appropriating certain portions of the city street as<br />
"Reserved Parking Only" or "Fxclusively For' in front of their store office or<br />
establishments depriving other motorist to avail of the parking spaces<br />
WHEREAS there are several business or commercial establishments who install<br />
sign* oi obstruction in front of their stores or business establishments depriving ordinary<br />
motorist not their customers or clients to park, making the city as "business-unfriendly"<br />
WHEREAS this ordinance is aimed of helping the city government to free the<br />
toads and sidewalks from obstruction by putting signs like. "Reserved Parking Only" or<br />
"FKclusivety For" and minimise traffic, caused by illegally parked vehicles<br />
WHEREAS it is high time to return the use of allowable street or parking areas to<br />
ail motorist who are taxpayers Just as entitled in them as those who pre-empt them illegally<br />
for their own exclusive use<br />
WHEREAS ibis ordinance will apply only to the streets where parking of motor<br />
vehicle is allowed by the city otdinance or any traffic laws, enforced by the Traffic<br />
fylsnagftrnent Unit of the city and Department of Public Works and Highway (DPWH)<br />
MOW THEREFORE be il ordained by the Sangguniang Panlungsod of the <strong>City</strong> of<br />
Bacoiod m regular session assembled that<br />

This <strong>Ordinance</strong> shall be known as an ordinance "Reserved Parking Only" or<br />
'Exclusively For <strong>Ordinance</strong>.

ARTICLE I<br />

traffic legislation tutes and regulation of its own contain, all vehicular traffic such as<br />

^oncs. parking and parking areab and other traffic rules in order to ensure effective<br />
delivery nf hasic services and facilities lo lis motorist constituents<br />
ARTICLE It<br />
Definition of Terms<br />
As used in this ordinance, are hereby defined:<br />
(a) Exclusively - resistant to the admission of outsiders,<br />
(b) Long-term parking - generatty four hours or more.<br />
(c) Parking or Parked - for the purpose of Ihis ordinance shall mean that a motor<br />
vehicle is parked or parking, if it has been brought to stop on the shoulder or<br />
in proper edge of street and remains in-active that place or close thereto for<br />
an appreciable period of time,<br />
(dj Reserved - to kept held, set apart for future used;<br />
(e) Short-term parking - generally three (3) hours or less<br />
(f) Signage - as used in this ordinance shall mean any movable structure or<br />
object with painted signs showing caution attention or notice, which is<br />
placed or installed in a specific area designating exclusivity of use showing a<br />
Resetved Parking for Customers Only" or other similar markings or any<br />
structure of whatever kind for the same purpose.<br />
(g) Traffic - refers to the flow and motions ingress and egress transit and stops,<br />
terminal and waiting stations of motored and uu-motored vehicles and<br />
pedestrians<br />
ARTICLE III<br />
Violation<br />
Section 1 It shall be unlawful for any store owner, business establishment or any<br />
peison. natural or juudlcaS, to place a signage or obstacle in any portion of a public streets,<br />
sidewalks and other public spaces for his/her its exclusive use as parking space.<br />

Section ?. In accordance with the above section, any individual, security guard,<br />
owner Of operatot of establishment and business firm shall be prohibited from inslalfing or<br />
pntting-up of any signage of "Reserved Parking for Customers Only" or any similar<br />
signage, any other obstacle markings or materials of any kind in public streets sidewalk<br />
and public place of the <strong>City</strong><br />
Section 3. Any peace officer, traffic police officer and enforcement unit of the<br />
Traffic Management Unit of the <strong>City</strong> and Barangay Tanods, any driver of a motor vehicle is<br />
authori-e&o remove the "Reserve Patking for Customers Only" signage or any similar<br />
signage and othet obstacles or markings or materials of any kind placed on public street,<br />
sidewalks and other public spaces, without prejudice to imposition of fines and penalties<br />
under Article VI,<br />
Section 4. Where a portion of the private property is used as public road,<br />
sidewalk or public space, parking on the same is covered by this ordinance.<br />
ARTICLE IV<br />
Exemption<br />
All hotels, pension houses restaurants, banks and business establishment were<br />
their parking are situated on city street are exempt in putting up signs ("Reserved Parking<br />
Only" or "Fxclnsivety For") or blockage only during special events h«fd in their<br />
establishment, such as, space for bridal car, and hotel vans and other vehicles for a shortterm<br />
parking, otherwise known as "the private automobile park-and-ride or pick-up/drop<br />
off jone' The signage or any obstacles place during the special event can be removed,<br />
by the owner/employee of the business establishment after the event has terminated. The<br />
putting up of signage shall be coordinated with the Traffic Management Unit (TMLf) Office,<br />
Twenty Four (?4) hours before such event will be held in the area. Any signage and other<br />
obstacles placed in private open spaces or sidewalks where parking is allowed shall be<br />
considered as privately owned by the store owner business and commercial<br />
establishment shall be exempted in installing and putting-up of any signage or obstacles<br />
provided thai the. owner shall coordinate wilh the enforcement unit.<br />
ARTICLE V<br />
Enforcement<br />
The Traffic Management Unil (TMU), <strong>Bacolod</strong> Traffic Authority Office (BTAO) or<br />
agents of Public Order and Safety Office.(POSO), Barangay Officials and Tanods. and<br />
<strong>City</strong> 1 ega! Fnforcement Unit are mandated to cairy-out and enforce this ordinance within<br />
their respective jurisdiction, and are authorized to remove all traffic obstructions on the<br />
street where the signs are illegally constructed or placed fronting the business or<br />
commercial establishment are located or demand that the owners of the illegal signage be<br />
removed at their own expense Those structure or obstruction on the cily streets are<br />
considered as nuisance.<br />
