Jacques F. Aubert described most <strong>of</strong> his taxa in <strong>the</strong> accepted nomenclatural ranks (i.e. genus, species and subspecies).<br />

However, he also defined his own categories, for instance <strong>the</strong> “forme-sous-espèce”, “forma aut subspecies”<br />

and “forma aut species” (Aubert 1963d). He erected <strong>the</strong>se categories primarily to express his uncertainty about <strong>the</strong><br />

actual biological status <strong>of</strong> a taxon. Accordingly, a “forma aut subspecies” reflect that Aubert hesitated between giving<br />

<strong>the</strong> taxon <strong>the</strong> rank <strong>of</strong> a form or that <strong>of</strong> a subspecies, and “forma aut species” denotes a taxon for which he was<br />

not sure whe<strong>the</strong>r it represented a true biological species or merely a morphological form. In <strong>the</strong> treatment <strong>of</strong> <strong>the</strong>se<br />

categories, we follow <strong>the</strong> Code (articles 10.2, 45.5., 45.6.). Accordingly, categories containing <strong>the</strong> expression<br />

“forma” correspond to an infra-subspecific level, and <strong>the</strong> names created under such a rank are not available. The<br />

only exception we make is for Aubert’s category “forme-sous-espèce” or “forma subspecia” which he uses for geographically<br />

defined taxa that can be interpreted as subspecies (Aubert 1963a). Dispite <strong>the</strong> misleading name, we<br />

treat this category as being <strong>of</strong> subspecific rank and accept names generated under this category as valid.<br />

When a name generated under an infra-subspecific rank was subsequently used for a species or subspecies in a<br />

way that made it available, a new name with its own authorship and date was <strong>the</strong>reby established (Arts. 10.2. and<br />

45.5.1.). In most cases, Aubert himself later raised unavailable names to a level conforming to <strong>the</strong> Code. As an<br />

example, <strong>the</strong> name Scambus nitida rufator was first described by Aubert (1963b) as a “f. aut. ssp. n.” and thus had<br />

an infra-subspecific rank. In a later paper (Aubert 1964c), Aubert stated that <strong>the</strong> taxon described under this name<br />

was a new species; hence <strong>the</strong> date <strong>of</strong> publication <strong>of</strong> <strong>the</strong> name rufator is 1964. In some cases, <strong>the</strong> authorship for a<br />
