CONCEPTS AND PRINCIPLES<br />

1. It is <strong>the</strong> birthright <str<strong>on</strong>g>of</str<strong>on</strong>g> all Moros and all Indigenous peoples <str<strong>on</strong>g>of</str<strong>on</strong>g> Mindanao to identify<br />

<strong>the</strong>mselves and be accepted as Bangsamoros. The Bangsamoro people refers to<br />

those who are natives or original inhabitants <str<strong>on</strong>g>of</str<strong>on</strong>g> Mindanao and its adjacent islands<br />

including Palawan and <strong>the</strong> Sulu archipelago at <strong>the</strong> time <str<strong>on</strong>g>of</str<strong>on</strong>g> c<strong>on</strong>quest or col<strong>on</strong>izati<strong>on</strong><br />

and <strong>the</strong>ir descendants whe<strong>the</strong>r mixed or <str<strong>on</strong>g>of</str<strong>on</strong>g> full native blood. Spouses and <strong>the</strong>ir<br />

descendants are classified as Bangsamoro. The freedom <str<strong>on</strong>g>of</str<strong>on</strong>g> choice <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong><br />

Indigenous people shall be respected.<br />

2. It is essential to lay <strong>the</strong> foundati<strong>on</strong> <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Bangsamoro homeland in order to address<br />

<strong>the</strong> Bangsamoro peoples humanitarian and ec<strong>on</strong>omic needs as well as <strong>the</strong>ir political<br />

aspirati<strong>on</strong>s. Such territorial jurisdicti<strong>on</strong>s and geographic areas being <strong>the</strong> natural<br />

wealth and patrim<strong>on</strong>y represent <strong>the</strong> social, cultural and political identity and pride <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

all <strong>the</strong> Bangsamoro people. Ownership <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> homeland is vested exclusively in<br />

<strong>the</strong>m by virtue <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir prior rights <str<strong>on</strong>g>of</str<strong>on</strong>g> occupati<strong>on</strong> that had inhered in <strong>the</strong>m as sizeable<br />

bodies <str<strong>on</strong>g>of</str<strong>on</strong>g> people, delimited by <strong>the</strong>ir ancestors since time immemorial, and being <strong>the</strong><br />

first politically organized dominant occupants.<br />

3. Both Parties acknowledge that <strong>ancestral</strong> <strong>domain</strong> does not form part <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> public<br />

<strong>domain</strong> but encompasses <strong>ancestral</strong>, communal, and customary lands, maritime,<br />

fluvial and alluvial <strong>domain</strong>s as well as all natural resources <strong>the</strong>rein that have inured<br />

or vested <strong>ancestral</strong> rights <strong>on</strong> <strong>the</strong> basis <str<strong>on</strong>g>of</str<strong>on</strong>g> native title. Ancestral <strong>domain</strong> and <strong>ancestral</strong><br />

land refer to those held under claim <str<strong>on</strong>g>of</str<strong>on</strong>g> ownership, occupied or possessed, by<br />

<strong>the</strong>mselves or through <strong>the</strong> ancestors <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Bangsamoro people, communally or<br />

individually since time immemorial c<strong>on</strong>tinuously to <strong>the</strong> present, except when<br />

prevented by war, civil disturbance, force majeure, or o<strong>the</strong>r forms <str<strong>on</strong>g>of</str<strong>on</strong>g> possible<br />

usurpati<strong>on</strong> or displacement by force, deceit, stealth, or as a c<strong>on</strong>sequence <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

government project or any o<strong>the</strong>r voluntary dealings entered into by <strong>the</strong> government<br />

and private individuals, corporate entities or instituti<strong>on</strong>s.<br />

4. Both Parties acknowledge that <strong>the</strong> right to self-governance <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> Bangsamoro<br />

people is rooted <strong>on</strong> <strong>ancestral</strong> territoriality exercised originally under <strong>the</strong> suzerain<br />

authority <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong>ir sultanates and <strong>the</strong> Pat a Pangamp<strong>on</strong>g ku Ranaw. The Moro<br />

sultanates were states or karajaan/kadatuan resembling a body politic endowed with<br />

all <strong>the</strong> elements <str<strong>on</strong>g>of</str<strong>on</strong>g> nati<strong>on</strong>-state in <strong>the</strong> modern sense. As a domestic community<br />

distinct from <strong>the</strong> rest <str<strong>on</strong>g>of</str<strong>on</strong>g> <strong>the</strong> nati<strong>on</strong>al communities, <strong>the</strong>y have a definite historic<br />

homeland. They are <strong>the</strong> First Nati<strong>on</strong> with defined territory and with a system <str<strong>on</strong>g>of</str<strong>on</strong>g><br />

government having entered into treaties <str<strong>on</strong>g>of</str<strong>on</strong>g> amity and commerce with foreign nati<strong>on</strong>s.<br />

The Parties c<strong>on</strong>cede that <strong>the</strong> ultimate objective <str<strong>on</strong>g>of</str<strong>on</strong>g> entrenching <strong>the</strong> Bangsamoro<br />

homeland as a territorial space is to secure <strong>the</strong>ir identity and posterity, to protect<br />

<strong>the</strong>ir property rights and resources as well as to establish a system <str<strong>on</strong>g>of</str<strong>on</strong>g> governance<br />

suitable and acceptable to <strong>the</strong>m as a distinct dominant people.<br />
