Rate hikes of up to 25 percent<br />

and tighter eligibility for<br />

Citizens Property Insurance<br />

Corp. policyholders are<br />

among the raft of property<br />

insurance overhaul proposals<br />

floating through the <strong>Florida</strong><br />

Legislature this session.<br />

One measure,<br />

Republican Sen. Alan Hays’<br />

SB 1714, would allow the<br />

state-backed Citizens to<br />

increase policyholders’ rates<br />

by up to 25 percent — the<br />

current cap is 10 percent —<br />

and bar coverage for<br />

Floridians who can find<br />

policies for up to 25 percent<br />

more on the private market.<br />

(The current threshold is<br />

only 15 percent.)<br />

Hays’ measure would<br />

also set staggered deadlines<br />

for Citizens to drop policies<br />

covering homes that would<br />

cost $500,000 and up to<br />

replace and bar Citizens policyholders<br />

from hiring a<br />

public insurance adjuster to<br />

represent them in claims<br />

disputes.<br />

An identical bill will be<br />

making its way through the<br />

House.<br />

While SB 1714 calls for<br />

the gradual elimination of<br />

Citizens’ coverage on<br />

homes with an insured value<br />

of more than $500,000,<br />

Citizens says that would<br />

affect only 4,957 policies in<br />

the state — at least as currently<br />

written.<br />

“The key to the language<br />

in the bill is that it designates<br />

the reduction to ‘a structure<br />

insured in the personal lines<br />

account,’” explained<br />

Christine Ashburn, Citizens’<br />

director of legislative and<br />

external affairs.<br />

Hays’ bill is just the latest<br />

in a series of proposals<br />

aimed at revamping public<br />

and private insurance coverage<br />

during the session that<br />

started March 1.<br />

Republican Gov. Rick<br />

Scott and many GOP lawmakers<br />

have expressed support<br />

for sweeping changes,<br />

making some kind of overhaul<br />

likely to succeed.<br />

The state-backed<br />

Citizens, which has swelled<br />

to nearly 1.3 million policies<br />

since the destructive 2004<br />

and 2005 hurricane seasons,<br />

contends its rates are too<br />

low to cover potential losses<br />

from future storms. It just<br />

came off a three-year rate<br />

freeze with the legislative<br />

go-ahead to raise rates up to<br />

10 percent a year.<br />

While Citizens is meant<br />

to be an insurer of last<br />

resort, it’s pretty much the<br />

only insurer willing to write<br />

windstorm policies for<br />

homes and businesses in the<br />

<strong>Florida</strong> <strong>Key</strong>s. Ashburn<br />

noted that the <strong>Florida</strong><br />

Windstorm Underwriting<br />

Association got its start in<br />

Monroe County in 1970 for<br />

precisely that reason.<br />

Citizens had 24,166 personal<br />

residential policies in<br />

Monroe County as of Feb.<br />

28. The vast majority of<br />

those — 21,773 — are<br />

wind-only policies; another<br />

2,393 homeowners have<br />

what’s known as multiperil<br />

coverage, which combines<br />

windstorm with fire and<br />

theft coverage at a discount.<br />

Consumer stand<br />

<strong>Florida</strong> <strong>Key</strong>s policyholders,<br />

who pay among the<br />

highest rates in the state,<br />

have been fighting for years<br />

for what they call parity<br />

with the mainland.<br />

Grassroots group Fair<br />

Insurance Rates in Monroe<br />

has argued, with mixed success,<br />

that <strong>Key</strong>s windstorm<br />

rates in particular are out of<br />

whack with the actual risk.<br />

FIRM representatives<br />

have already made two trips<br />

to Tallahassee to address<br />

legislative committees on<br />

behalf of consumers, and<br />

Executive Director Annalise<br />

Mannix says they’ll keep up<br />

the drumbeat throughout the<br />

session.<br />

“We’re going to address<br />

every single bill and make<br />

suggestions to the committees,<br />

our representatives and<br />

anyone else who will listen,”<br />

Mannix said.<br />

While FIRM’s long-term<br />

goal is an overhaul of the<br />

computer models that are<br />

used to determine risk and<br />

rates, the group’s short-term<br />

goal is to keep a reasonable<br />

cap on rate increases and<br />

defend consumer interests<br />

on other policy fronts.<br />

“Ten percent is a huge<br />

number for people in<br />

Monroe County,” Mannix<br />

said. “Most people in<br />

<strong>Florida</strong> aren’t paying what<br />

we’re paying here… It’s a<br />

real hardship. And if they<br />

increase it to what Citizens<br />

wants to, it would be disastrous.”<br />

Mannix is referring to<br />

what Citizens calls its actuarially<br />

sound rate structure.<br />

In a quirk of state law, the<br />

company each year is<br />

required to file what it<br />

would charge if there wasn’t<br />

a cap in place, as well as<br />

what it will charge under<br />

the cap. In Monroe County,<br />

those increases would top<br />

50 percent for many <strong>Key</strong>s<br />

wind-only policyholders.<br />

watchful eye on insurance<br />

<strong>Florida</strong> economy — of<br />

which real estate is a key<br />

in the <strong>Key</strong>s, where it’s not<br />

unusual to see principal and<br />

interest payments eclipsed<br />

by insurance premiums.<br />

“We don’t want to cause<br />

a problem with a market<br />

that’s just starting to move,”<br />

Brown said.<br />

Too exposed<br />

Hays said Citizens has<br />

$400 billion in exposure in<br />

coastal regions of the state<br />

but only $4.5 billion in<br />

reserves. One big storm —<br />

or a series of smaller ones<br />

— could create a deficit in<br />

the millions, he said.<br />

Citizens would cover<br />

any deficit by tacking an<br />

assessment on to all of<br />

<strong>Florida</strong>’s property and vehicle<br />

insurance policies, a<br />

scenario that Hays calls<br />

“dead wrong.”<br />

Hays doesn’t mince<br />

words about his ultimate<br />

aim, which is to get the state<br />

out of the insurance business<br />

and restore what he<br />

calls a competitive private<br />

<strong>Key</strong>s Sunday<br />

market.<br />

“My goal is to depopulate<br />

Citizens, to make it as<br />

small as we can make it, as<br />

rapidly as we can,” Hays<br />

said.<br />

In the meantime, he said,<br />

steeper rate increases will<br />

help fill Citizens’ coffers<br />

quicker, bulking up its<br />

reserves.<br />

“This is not a linear<br />

equation that has to be<br />

solved. It’s a multifaceted<br />

problem,” Hays said. “We<br />

have to get sufficient<br />

reserves to pay the claims<br />

that will be coming.”<br />

‘Consumer choice’<br />

Hays places the blame<br />

for <strong>Key</strong>s’ policyholders lack<br />

of insurance options at the<br />

feet of state insurance regulators,<br />

who have been<br />

unwilling to allow private<br />

insurers to charge the rates<br />

they want to in this or any<br />

other market in the state.<br />

That’s why he introduced<br />

another piece of legislation,<br />

SB 1330, which he<br />

calls “the consumer choice<br />

bill.” It would allow private<br />

insurers to raise individual<br />

rates annually by up to 30<br />

percent — and the<br />

statewide average premium<br />

by 15 percent — without<br />

state approval.<br />

The Senate Banking and<br />

Insurance Committee<br />

passed the measure<br />

Wednesday. There’s a similar<br />

bill in the House that has<br />

yet to receive a hearing.<br />

“This is a complete<br />

deregulation bill,” said<br />

Gary Farmer, a lobbyist for<br />

the <strong>Florida</strong> Justice<br />

Association, which opposes<br />

the idea. “[The Office of<br />

reject a rate as being excessive.”<br />

While Hays sees the<br />

measure as a way to entice<br />

private insurers back into<br />

the market, opponents of<br />

the measure said deregulating<br />

rates is an untested<br />

attempt to strengthen a market<br />

that has already jettisoned<br />

its riskiest policies to<br />

Citizens, which they contend<br />

will grow if the bill is<br />

ultimately approved.<br />

“I would like to see a<br />

free market system on<br />

everything we do,” said<br />

Sen. Eleanor Sobel, D-<br />

Hollywood. “But this is a<br />

statewide experiment. I<br />

think there will be a lot of<br />

disgruntled people across<br />

the state of <strong>Florida</strong>.”<br />

Merger ahead<br />

for TIB Bank<br />

TIB Bank, a staple in the<br />

<strong>Florida</strong> <strong>Key</strong>s for more than<br />

three decades, will be operating<br />

under a new name by the<br />

end of the year.<br />

North American Financial<br />

Holdings Inc., the majority<br />

stakeholder in TIB Financial<br />

Corp., plans to merge three<br />

banks and operate under a<br />

common charter and a common<br />

name — Capital Bank.<br />

NAFH has applied to federal<br />

regulators to merge the<br />

banks. If the move gets federal<br />

OK, the merger should be<br />

complete sometime next<br />

quarter, with the name<br />

change coming in the third,<br />

said market President Thomas<br />

Longe.<br />

Adopted from another<br />

recent acquisition, Longe said<br />

the Capital Bank name made<br />

more sense for the growing<br />

regional company.<br />

Once the merger is complete,<br />

Capital Bank will have 83<br />

branches and $5 billion in<br />

assets, Longe said. He said the<br />

bank would be based in Miami,<br />

with branches in South <strong>Florida</strong><br />

and North and South Carolina.<br />

TIB Financial employs<br />

about 400 people, and Longe<br />

said that during the merger<br />

and beyond, TIB customers<br />

can bank on seeing “the same<br />

friendly faces.”<br />

The end result will be a<br />

streamlined and financially<br />

strong operation, Longe said.<br />

Customers will benefit from a<br />

“more robust” online banking<br />

system, he said.<br />

Longe said NAFH will continue<br />

to look for opportunities<br />

to grow. There will be a huge<br />

geographic gap between the<br />

bank’s <strong>Florida</strong> and Carolina<br />

footprints, with ample room<br />

to expand in South <strong>Florida</strong><br />

and the rest of the state.<br />

Iberibank grows<br />

some more<br />

Iberiabank Corp., which<br />

has several branches in the<br />

<strong>Key</strong>s, is adding three companies<br />

to its financial services<br />

Question: I have a small<br />

but very profitable retail<br />

operation with two locations.<br />

Although cash flow<br />

generally isn’t a problem,<br />

every once in a while we<br />

run into problems paying<br />

our bills. Our accountant<br />

gives us monthly financial<br />

statements, but I’m wondering<br />

if there isn’t something<br />

else I should be doing to<br />

monitor our cash flow.<br />

Answer: Most of my<br />

clients have found that<br />

monthly financial statements<br />

are a great help in<br />

looking at where the busi-<br />

ness has<br />

been. But to<br />

keep track<br />

of where<br />

you are and<br />

to suggest<br />

what you<br />

need to do<br />

tomorrow,<br />

most owners<br />

find that<br />

they need a<br />

little more help. For my<br />

clients, this help comes in<br />

the form of a Flash Report.<br />

Generally, the report is prepared<br />

weekly, at the end of<br />

whatever day the business<br />

considers to be the natural<br />

end of its weekly business<br />

cycle. For a retailer that is<br />

open six days a week and<br />

closed on Sunday, the end<br />

of the cycle would be<br />

Saturday. The purpose of<br />

the report is to inform the<br />

owner/manager about key<br />

aspects of the business so<br />

that adjustments to operations<br />

can be made quickly.<br />

One reason I like doing the<br />

report at the end of the<br />

week is so that the owner<br />

can be thinking about what<br />

needs to be done differently<br />

Report? The answer varies<br />

somewhat depending upon<br />

what the owner considers<br />

important to the business<br />

and how they want to measure<br />

it. For example, in a<br />

retail business, some owners<br />

consider the dollar value<br />

of their inventory to be very<br />

important. For others, the<br />

percentage of inventory<br />

compared to annualized<br />

sales is the most important<br />

number. For most professionally<br />

managed retailers,<br />

inventory turnover on an<br />

annualized basis is the most<br />

important figure.<br />

Whatever metrics you<br />

consider important to your<br />

business, most retail Flash<br />

Reports are going to have a<br />

sales comparison (this week<br />

compared to the same week<br />

a year ago), customer<br />

count, dollar amount of the<br />

average sale ticket and<br />

company recycles everything<br />

possible and uses<br />

recycled paper supplies and<br />

But the biggest impact<br />

on the accounting firm’s<br />

carbon footprint might be<br />

the move to electronic files,<br />

eliminating the mass consumption<br />

of paper that was<br />

once considered necessary<br />

in the accounting industry.<br />

saves us time and money in<br />

printing, ink and paper,”<br />

said Maria Diaz, leader of<br />

the firm’s green team.<br />

“Fewer file cabinets also<br />

means more office space.”<br />

Printed documents, most<br />

of which are confidential in<br />

nature, are shredded for<br />

recycling immediately,<br />

while electronic versions<br />

are stored online. The<br />

process of scanning nearly<br />

570 client files for electronic<br />

storage took almost a<br />

year, but Diaz says it was<br />

well worth it.<br />

The staff at Ward &<br />

Meyers have also adopted a<br />

“Go Green” policy to<br />

emphasize the importance<br />

of energy conservation and<br />

waste reduction. According<br />

to the policy, the thermostat<br />

is kept at 78 degrees during<br />

the day, and turned down to<br />

80 at night. All computers,<br />

copiers and fax machines<br />

are turned off at night, and<br />

when not in use during regular<br />

hours, offices are dark.<br />

In the kitchenette, staff has<br />

access to reusable cups,<br />

and paper cups — not<br />

Styrofoam — are provided<br />

for visitors.<br />

As an added conservation<br />

measure, Ward &<br />

Meyers plan to experiment<br />

this summer with less overhead<br />

lighting in an effort to<br />

reduce heat and overall<br />

energy consumption.<br />
