Rate hikes of up to 25 percent
and tighter eligibility for
Citizens Property Insurance
Corp. policyholders are
among the raft of property
insurance overhaul proposals
floating through the Florida
Legislature this session.
One measure,
Republican Sen. Alan Hays’
SB 1714, would allow the
state-backed Citizens to
increase policyholders’ rates
by up to 25 percent — the
current cap is 10 percent —
and bar coverage for
Floridians who can find
policies for up to 25 percent
more on the private market.
(The current threshold is
only 15 percent.)
Hays’ measure would
also set staggered deadlines
for Citizens to drop policies
covering homes that would
cost $500,000 and up to
replace and bar Citizens policyholders
from hiring a
public insurance adjuster to
represent them in claims
disputes.
An identical bill will be
making its way through the
House.
While SB 1714 calls for
the gradual elimination of
Citizens’ coverage on
homes with an insured value
of more than $500,000,
Citizens says that would
affect only 4,957 policies in
the state — at least as currently
written.
“The key to the language
in the bill is that it designates
the reduction to ‘a structure
insured in the personal lines
account,’” explained
Christine Ashburn, Citizens’
director of legislative and
external affairs.
“We have statutory
INSURANCE
Insurance overhaul
likely this session
State lawmakers targeting rates, coverage
accounts that are treated
separately because we were
created by the merger of two
predecessor entities. The
High Risk Account is the
old Florida Windstorm
Underwriting Association
... and the Personal Lines
Account and Commercial
Lines Account are the old
Florida Residential Property
and Casualty Joint
Underwriting Association
that wrote residential coverage
statewide.”
Hays’ bill is just the latest
in a series of proposals
aimed at revamping public
and private insurance coverage
during the session that
started March 1.
Republican Gov. Rick
Scott and many GOP lawmakers
have expressed support
for sweeping changes,
making some kind of overhaul
likely to succeed.
The state-backed
Citizens, which has swelled
to nearly 1.3 million policies
since the destructive 2004
and 2005 hurricane seasons,
contends its rates are too
low to cover potential losses
from future storms. It just
came off a three-year rate
freeze with the legislative
go-ahead to raise rates up to
10 percent a year.
While Citizens is meant
to be an insurer of last
resort, it’s pretty much the
only insurer willing to write
windstorm policies for
homes and businesses in the
Florida Keys. Ashburn
noted that the Florida
Windstorm Underwriting
Association got its start in
Monroe County in 1970 for
precisely that reason.
Citizens had 24,166 personal
residential policies in
Monroe County as of Feb.
28. The vast majority of
those — 21,773 — are
wind-only policies; another
2,393 homeowners have
what’s known as multiperil
coverage, which combines
windstorm with fire and
theft coverage at a discount.
Consumer stand
Florida Keys policyholders,
who pay among the
highest rates in the state,
have been fighting for years
for what they call parity
with the mainland.
Grassroots group Fair
Insurance Rates in Monroe
has argued, with mixed success,
that Keys windstorm
rates in particular are out of
whack with the actual risk.
FIRM representatives
have already made two trips
to Tallahassee to address
legislative committees on
behalf of consumers, and
Executive Director Annalise
Mannix says they’ll keep up
the drumbeat throughout the
session.
“We’re going to address
every single bill and make
suggestions to the committees,
our representatives and
anyone else who will listen,”
Mannix said.
While FIRM’s long-term
goal is an overhaul of the
computer models that are
used to determine risk and
rates, the group’s short-term
goal is to keep a reasonable
cap on rate increases and
defend consumer interests
on other policy fronts.
“Ten percent is a huge
number for people in
Monroe County,” Mannix
said. “Most people in
Florida aren’t paying what
we’re paying here… It’s a
real hardship. And if they
increase it to what Citizens
wants to, it would be disastrous.”
Mannix is referring to
what Citizens calls its actuarially
sound rate structure.
In a quirk of state law, the
company each year is
required to file what it
would charge if there wasn’t
a cap in place, as well as
what it will charge under
the cap. In Monroe County,
those increases would top
50 percent for many Keys
wind-only policyholders.
Mannix said FIRM is
First State Bank’s Bette
Brown says the Florida
Bankers Association will be
urging lawmakers to tread
carefully for fear of upsetting
a slowly recovering
Florida economy — of
which real estate is a key
component.
Steep insurance hikes
could scare away some buyers.
That’s particularly true
in the Keys, where it’s not
unusual to see principal and
interest payments eclipsed
by insurance premiums.
“We don’t want to cause
a problem with a market
that’s just starting to move,”
Brown said.
Too exposed
Hays said Citizens has
$400 billion in exposure in
coastal regions of the state
but only $4.5 billion in
reserves. One big storm —
or a series of smaller ones
— could create a deficit in
the millions, he said.
Citizens would cover
any deficit by tacking an
assessment on to all of
Florida’s property and vehicle
insurance policies, a
scenario that Hays calls
“dead wrong.”
Hays doesn’t mince
words about his ultimate
aim, which is to get the state
out of the insurance business
and restore what he
calls a competitive private
Keys Sunday
INSURANCE
market.
“My goal is to depopulate
Citizens, to make it as
small as we can make it, as
rapidly as we can,” Hays
said.
In the meantime, he said,
steeper rate increases will
help fill Citizens’ coffers
quicker, bulking up its
reserves.
“This is not a linear
equation that has to be
solved. It’s a multifaceted
problem,” Hays said. “We
have to get sufficient
reserves to pay the claims
that will be coming.”
‘Consumer choice’
Hays places the blame
for Keys’ policyholders lack
of insurance options at the
feet of state insurance regulators,
who have been
unwilling to allow private
insurers to charge the rates
they want to in this or any
other market in the state.
That’s why he introduced
another piece of legislation,
SB 1330, which he
calls “the consumer choice
bill.” It would allow private
insurers to raise individual
rates annually by up to 30
percent — and the
statewide average premium
by 15 percent — without
state approval.
The Senate Banking and
Insurance Committee
passed the measure
Wednesday. There’s a similar
bill in the House that has
yet to receive a hearing.
“This is a complete
deregulation bill,” said
Gary Farmer, a lobbyist for
the Florida Justice
Association, which opposes
the idea. “[The Office of
Insurance Regulation]
would lose the ability to
www.KeysNet.com
Lawmaker pushing several measures to slim Citizens’ ranks, ratchet up its rates
INSURANCE / From 3
reject a rate as being excessive.”
While Hays sees the
measure as a way to entice
private insurers back into
the market, opponents of
the measure said deregulating
rates is an untested
attempt to strengthen a market
that has already jettisoned
its riskiest policies to
Citizens, which they contend
will grow if the bill is
ultimately approved.
“I would like to see a
free market system on
everything we do,” said
Sen. Eleanor Sobel, D-
Hollywood. “But this is a
statewide experiment. I
think there will be a lot of
disgruntled people across
the state of Florida.”
this report.

Merger ahead
for TIB Bank
TIB Bank, a staple in the
Florida Keys for more than
three decades, will be operating
under a new name by the
end of the year.
North American Financial
Holdings Inc., the majority
stakeholder in TIB Financial
Corp., plans to merge three
banks and operate under a
common charter and a common
name — Capital Bank.
NAFH has applied to federal
regulators to merge the
banks. If the move gets federal
OK, the merger should be
complete sometime next
quarter, with the name
change coming in the third,
said market President Thomas
Longe.
Adopted from another
recent acquisition, Longe said
the Capital Bank name made
more sense for the growing
regional company.
Once the merger is complete,
Capital Bank will have 83
branches and $5 billion in
assets, Longe said. He said the
bank would be based in Miami,
with branches in South Florida
and North and South Carolina.
TIB Financial employs
about 400 people, and Longe
said that during the merger
and beyond, TIB customers
can bank on seeing “the same
friendly faces.”
The end result will be a
streamlined and financially
strong operation, Longe said.
Customers will benefit from a
“more robust” online banking
system, he said.
Longe said NAFH will continue
to look for opportunities
to grow. There will be a huge
geographic gap between the
bank’s Florida and Carolina
footprints, with ample room
to expand in South Florida
and the rest of the state.
Question: I have a small
but very profitable retail
operation with two locations.
Although cash flow
generally isn’t a problem,
every once in a while we
run into problems paying
our bills. Our accountant
gives us monthly financial
statements, but I’m wondering
if there isn’t something
else I should be doing to
monitor our cash flow.
Answer: Most of my
clients have found that
monthly financial statements
are a great help in
looking at where the busi-
ness has
been. But to
keep track
of where
you are and
to suggest
what you
need to do
tomorrow,
most owners
find that
they need a
little more help. For my
clients, this help comes in
the form of a Flash Report.
Generally, the report is prepared
weekly, at the end of
whatever day the business
considers to be the natural
end of its weekly business
cycle. For a retailer that is
open six days a week and
closed on Sunday, the end
of the cycle would be
Saturday. The purpose of
the report is to inform the
owner/manager about key
aspects of the business so
that adjustments to operations
can be made quickly.
One reason I like doing the
report at the end of the
week is so that the owner
can be thinking about what
needs to be done differently
when the doors open
What goes in a Flash
Report? The answer varies
somewhat depending upon
what the owner considers
important to the business
and how they want to measure
it. For example, in a
retail business, some owners
consider the dollar value
of their inventory to be very
important. For others, the
percentage of inventory
compared to annualized
sales is the most important
number. For most professionally
managed retailers,
inventory turnover on an
annualized basis is the most
important figure.
Whatever metrics you
It’s a small accounting
office with only eight
employees, but the
opportunities for greening
operations continue to be
explored at Ward &
Meyers, the most recent
business to meet the standards
of the Green
Business Certification
Program offered by Florida
Keys Green Living &
Energy Education.
Located at 3201 Flagler
Ave., Suite 506, Ward &
Meyers uses only energyefficient
fluorescent lighting
throughout its 760square-foot
office. The
company recycles everything
possible and uses
recycled paper supplies and
eco-friendly cleaning products.
But the biggest impact
on the accounting firm’s
carbon footprint might be
the move to electronic files,
eliminating the mass consumption
of paper that was
once considered necessary
in the accounting industry.
“Using electronic files
Keys Sunday
saves us time and money in
printing, ink and paper,”
said Maria Diaz, leader of
the firm’s green team.
“Fewer file cabinets also
means more office space.”
Printed documents, most
of which are confidential in
nature, are shredded for
recycling immediately,
while electronic versions
are stored online. The
process of scanning nearly
570 client files for electronic
storage took almost a
year, but Diaz says it was
well worth it.
The staff at Ward &
Meyers have also adopted a
“Go Green” policy to
emphasize the importance
of energy conservation and
waste reduction. According
to the policy, the thermostat
is kept at 78 degrees during
the day, and turned down to
80 at night. All computers,
copiers and fax machines
are turned off at night, and
when not in use during regular
hours, offices are dark.
In the kitchenette, staff has
access to reusable cups,
and paper cups — not
Styrofoam — are provided
for visitors.
As an added conservation
measure, Ward &
Meyers plan to experiment
this summer with less overhead
lighting in an effort to
reduce heat and overall
energy consumption.
