Re: - Application for a Premises Licence – <strong>Ship</strong> <strong>and</strong> <strong>Shovel</strong>, Ripple Road,<br />

<strong>Barking</strong>, Essex, IG11 0SN<br />

Dear Sir/Madam,<br />

The police wish to make the following representations with regard to the application made<br />

for the premises above.<br />

The police are opposed to the granting <strong>of</strong> this application on the grounds that it will present<br />

a significant risk to the Licensing Objectives, specifically the Prevention <strong>of</strong> Crime <strong>and</strong><br />

Disorder <strong>and</strong> the Prevention <strong>of</strong> Public Nuisance <strong>and</strong> Public Safety<br />

We believe the Prevention <strong>of</strong> Crime <strong>and</strong> Disorder Licensing Objective will be impacted<br />

because in our experience the nature <strong>of</strong> all very late night venues carry added risk, due to<br />

alcohol being available for extended periods, the people attracted to such venues <strong>and</strong> the<br />

music played can vary attendances drastically. None <strong>of</strong> these issues are covered in the<br />

application.<br />

The venue itself is located directly on the A13, a fast arterial road that links the South East<br />

to <strong>London</strong>, there is heavy traffic present on an almost 24hr basis. There is nothing in the<br />

application that deals with crowd management, being so close to such a dangerous road<br />

surely warrants some consideration.<br />

Very serious thought needs to be given on how to minimise this impact. In the first instance<br />

it is the duty <strong>of</strong> the applicant to show how they have considered this <strong>and</strong> then show in a<br />

detailed operating schedule how these risks would be minimised. It is not for the police to so<br />

drastically alter or amend an application so that it becomes fit for purpose.

Appendix 1<br />

The proposal by the applicants is to convert the Premises Licence to a 24hr, 365 day a year<br />

operation. This is so radically different from the way the venue currently operates that one<br />

might expect a root <strong>and</strong> branch examination <strong>of</strong> the operating schedule <strong>and</strong> conditions<br />

attached to the Premises Licence by the applicants. However, no such examination can be<br />

evidenced from the application.<br />

We do not believe that the addition <strong>of</strong> conditions however stringent can make this<br />

application effective. As it is so vague that the police have no underst<strong>and</strong>ing <strong>of</strong> how the<br />

premises are intended to be run.<br />

A supplementary document to the application has been submitted. This document outlines<br />

the steps to be taken in support <strong>of</strong> the Licensing Objectives. In each case the aims seems so<br />

vague <strong>and</strong> generic that they can not be considered as effective, as an example in part E -<br />

Protection <strong>of</strong> Children - an undertaking is given that ‘All children will have to be accompanied<br />

by a reasonable adult, they will only be permitted till 6pm.’ This is meaningless <strong>and</strong> therefore<br />

unenforceable.<br />

The environmental protection issue raised by this application is noise.<br />

Appendix 1<br />

I am concerned to ensure that the playing <strong>of</strong> live <strong>and</strong> recorded music inside the premises without time restriction does<br />

not cause public nuisance. I note from part P <strong>of</strong> the application form dated 2 nd November 2011 that no additional<br />

steps are proposed to promote the licensing objective <strong>of</strong> preventing public nuisance.<br />

Whilst I have no record <strong>of</strong> complaint associated with the current use <strong>of</strong> the premises, which I underst<strong>and</strong> includes the<br />

playing <strong>of</strong> live music, my indicative calculations (attached) suggest that if windows doors <strong>and</strong> windows are opened to<br />

provide additional ventilation, for example during hot summer periods, moderate (<strong>and</strong> potentially serious) noise<br />

annoyance is likely to be caused to residents <strong>of</strong> the closest residential accommodation at Dunmow House,<br />

Goresbrook Road during the night. I do not believe this will be the case if windows are kept shut <strong>and</strong> doors are<br />

provided with lobbies <strong>and</strong> are only opened to permit access to <strong>and</strong> egress from the premises.<br />

To safeguard the situation I request that any licence variation that might be granted be subject to the following<br />

conditions.<br />

All external doors <strong>and</strong> windows to be kept shut, other than for access <strong>and</strong><br />

egress in all rooms when events involving amplified music, speech, or other<br />

entertainment likely to give rise to noise.<br />

The entrances are to be provided with lobbies with automatic door-closers.<br />

The lobbies are in use throughout the time <strong>of</strong> entertainment.<br />

The emergency exits are well fitted <strong>and</strong> are kept shut during opening hours.<br />
