This has reference to your letter under reference and other letters<br />

requesting for disposal of hazardous wastes generated by industries in Goa at<br />

CHW TSDF, Taloja in <strong>Maharashtra</strong>. The matter was discussed in a meeting<br />

between Principal Secretary and Chairperson, <strong>Maharashtra</strong> <strong>Pollution</strong> <strong>Control</strong><br />

<strong>Board</strong>, Member Secretary, MPCB and Secretary (Environment), Government<br />

of Goa and a decision has been taken to permit disposal of only incinerable<br />

hazardous wastes at CHW TSDF, Taloja.<br />

It has also been decided that Goa state shall identify a suitable land for<br />

developing its own secured landfill (SLF) site for the treatment and disposal of<br />

the other hazardous wastes.<br />

MPCB has examined the disposal cost issues related to the tariff, in<br />

consultation with M/s. CRISIL Advisory Services. Accordingly the cost<br />

sharing and compensation mechanism to be adopted for permitting the<br />

disposal of incinerable hazardous wastes in <strong>Maharashtra</strong> has been decided.<br />

In view of the above, permission is hereby granted to Goa State<br />

<strong>Pollution</strong> <strong>Control</strong> <strong>Board</strong> to authorize industries in Goa to dispose incinerable<br />

hazardous wastes at CHW TSDF, Taloja as per the terms and conditions<br />

given below:

1) This permission is granted only for the disposal of incinerable hazardous<br />

wastes at CHW TSDF at Taloja.<br />

2) The CHW TSDF in <strong>Maharashtra</strong> operated by M/s. MWML at Taloja, Dist.<br />

Raigad, shall not accept any other hazardous wastes from industries in the<br />

state of Goa.<br />

3) The total incinerable waste permissible to be brought in <strong>Maharashtra</strong> shall<br />

not exceed 20,000 MT in the year 2006-07, in subsequent years it shall<br />

not exceed 10,000 MT/year.<br />

4) User industry shall pay Rs.1000/- (Rupees one thousand only) per tonne<br />

of incinerable waste to MPCB as the commercial compensation for using<br />

the incineration facilities at CHW TSDF, Taloja. This commercial<br />

compensation shall be recovered by MPCB, since it has to authorize the<br />

cross boundary movement of the incinerable waste under the Hazardous<br />

Wastes (Management & Handling) Rules, 1989, as amended.<br />

5) The treatment and disposal costs shall be paid, in advance, to CHW TSDF<br />

and to MPCB. CHW TSDF shall not accept the wastes unless advance<br />

payment is received by MPCB from the user industry. In case of default,<br />

the Goa State <strong>Board</strong> shall forthwith withdraw/revoke the Authorization<br />

granted under the HW(M&H) Rules and initiate further legal action.<br />

6) The cost mentioned in 4 above is exclusive of the cost of treatment of the<br />

incinerable waste that shall be separately charged and recovered by the<br />

CHW TSDF facility operator as per tariff approved by MIDC (copy<br />

attached).<br />

7) The collection, transport, handling, treatment and disposal of the<br />

incineration ash shall be strictly in accordance with the Hazardous Wastes<br />

(Management and Handling) Rules, 1989, as amended from time to time<br />

and the directions of Supreme Court of India in the matter of WP(Civil)<br />

No.657 of 1995 and also orders of the Supreme Court Monitoring<br />

Committee appointed by Ministry of Environment & Forests, Government<br />

of India.<br />

8) In addition, the agency responsible for the transportation of the incinerable<br />

wastes shall be required to take authorization from Goa SPCB and MPCB,<br />

separately and also provide insurance cover to for any accidental leakage<br />

or spillage of the hazardous wastes during the transportation. MPCB shall<br />

be made beneficiary of such insurance cover so that it can undertake the<br />

relief work, as the case may be.<br />

9) This permission is subject to satisfactory compliance of the above terms<br />

and conditions. Any default on compliance of the above conditions may<br />

result into cancellation of this permission.<br />

WHEREAS, you are operating your industrial plant subject to certain terms and<br />

conditions more precisely set out in the consent and authorization issued by the <strong>Board</strong>.<br />

AND WHEREAS, you have also been given a certificate of registration under Rule 19 (3)<br />

of the Hazardous Wastes (M&H) Rules, 1989 (as amended) by the Central <strong>Pollution</strong><br />

<strong>Control</strong> <strong>Board</strong>. AND WHEREAS, you were responsible for proper collection, reception,<br />

treatment, disposal of hazardous wastes generated during the manufacturing/<br />

processing activities.<br />

AND WHEREAS, you were also responsible for taking steps for proper and<br />

scientific handling of hazardous waste including its disposal at the CHWTSDF without<br />

any adverse impact on the environment.


AND WHEREAS, Hon’ble Supreme Court of India has passed a comprehensive<br />

order dt:14.10.2003 in Writ Petition No. 657/ 1995 regarding management and handling<br />

of hazardous waste in an environmental friendly manner and the actions required to be<br />

taken by all concern.<br />

AND WHEREAS, it has been reported that you have not been disposing<br />

hazardous waste in accordance with the provisions contained in the said rules & have<br />

not maintained proper records regarding generation of hazardous waste & its disposal.<br />

We have reason to believe that you have been disposing the hazardous waste in an<br />

illegal & unauthorized manner.<br />

AND WHEREAS, it has been reported that you have not submitted the annual<br />

returns as prescribed in Form-4 & Form-12 of Hazardous Waste (M&H) 1989<br />

(as amended).<br />

AND WHEREAS you have failed to submit the details of Hazardous Waste<br />

generation & it’s disposal called vide this office letter No: MPCB/RO(HQ)/HW-<br />

Oil/PA/TB/B-1794, dt: 21/04/2006.<br />

NOW THEREFORE, in exercise of the powers conferred on the undersigned by<br />

the <strong>Board</strong> under section 33 A of Water (Prevention & <strong>Control</strong> of <strong>Pollution</strong>) Act, 1974,<br />

section 31 A of Air (Prevention & <strong>Control</strong> of <strong>Pollution</strong>) Act, 1981 and the directions<br />

issued by the Hon’ble Supreme Court6 of India in Writ petition No. 657/1995, you are<br />

hereby directed to stop your manufacturing/processing activities forthwith till you provide<br />

details of generation & disposal of hazardous waste since your establishment.<br />

In case of your failure to comply with the above directions, the <strong>Board</strong> will have no<br />

option but to initiate appropriate legal action against you under the provisions of<br />

Environment (Protection) Act 1986 & rules made there under, which please note.<br />
