recommended <strong>to</strong> grant <strong>Consent</strong> <strong>to</strong> Operate.<br />

4. Application received at A.S. (Tech.) Section on 18/10/2011.<br />

5. Mem<strong>be</strong>r Secretary has ordered <strong>to</strong> call explanation on 3/02/2012 from R.O.<br />

(Pune) for wrongly processing and forwarding consent application <strong>to</strong> HQ.<br />

6. R.O. (Pune) was instructed on 29/02/2012 <strong>to</strong> submit their explanation for non<br />

taking action against Hotel authority for submitting wrong information in the<br />

Board and for wrongly processing and forwarding consent application <strong>to</strong> HQ.<br />

7. R.O. (Pune) has <strong>submitted</strong> explanation that Hotel Authority has informed vide<br />

letter dtd. 23/01/2012 that they have converted water body meant for<br />

<strong>be</strong>autification purpose in<strong>to</strong> swimming pool. Also, he has issued proposed<br />

directions on 2/03/2012 for operating hotel without obtaining <strong>Consent</strong> <strong>to</strong><br />

Operate from the Board and for submitting wrong information in the Board.<br />

8. RO, Pune has recommended <strong>to</strong> initiate stringent action against the Hotel<br />

Authority.<br />

9. Case was discussed in the CAC meeting on 20/03/2012 and it was decided<br />

<strong>to</strong> issue SCN for refusal <strong>of</strong> <strong>Consent</strong> as the Industry has not <strong>submitted</strong> B.G. <strong>of</strong><br />

Rs. 5.0 Lakhs within stipulated time and not mentioning swimming pool<br />

activity in the application for <strong>Consent</strong> <strong>to</strong> 1 st Operate.<br />

10. Show cause notice was issued on 29/03/2012 <strong>to</strong> which hotel authority has<br />

replied vide letter dtd. 11/04/2012 and <strong>submitted</strong> B.G. <strong>of</strong> Rs. 5.0 Lakhs on<br />

28/04/2012.<br />

11. <strong>Consent</strong> <strong>to</strong> 1 st Operate may <strong>be</strong> granted for the period up<strong>to</strong> 31/10/2013 after<br />

the receipt <strong>of</strong> additional payment <strong>of</strong> Rs. 4,08,320/- as per Env. Dept’s revised<br />

<strong>Consent</strong> Fee G.R. dtd. 25/08/2011.


CAC Item No. 02<br />

Name <strong>of</strong> the Industry: M/s. The Leela Kempinski Sahar,<br />

Plot No. 1407(pt), 1405(pt), 1404(pt),<br />

Sahar, Andheri(E), Mumbai.<br />

HOD Remarks:<br />

a. Applied for grant <strong>of</strong> Renewal <strong>of</strong> consent for hotel activity including 395 rooms<br />

including lodging activity.<br />

b. Application received at SRO on 21.10.2011 and at HQ on 07.01.2012.<br />

c. Previous consent was valid up<strong>to</strong> 31.08.2011.<br />

d. The case was discussed during CAC meeting held on 23.01.2012 and during<br />

the meeting, it was decided <strong>to</strong> issue SCN for refusal <strong>of</strong> consent as industry has<br />

not replied <strong>to</strong> letter issued by the SRO on 11.11.2011. SCN issued on<br />

06.02.2012 and industry has <strong>submitted</strong> the reply on 27.02.2012 & 03.04.2012,<br />

wherein mentioned that C.I. mentioned is found reduced <strong>to</strong> previous year is due<br />

<strong>to</strong> fluctuation <strong>of</strong> the foreign exchange rate <strong>of</strong> the assets purchased under foreign<br />

loans. They are ready <strong>to</strong> pay the requisite consent fees. Current year C.I. is Rs.<br />

318.34 Crs. Therefore, File was referred <strong>to</strong> CAO for verification <strong>of</strong> point no. (a)<br />

& (b) and he remarked that C.I. shown in schedule <strong>of</strong> fixed assets <strong>of</strong> balance<br />

sheet do not match with <strong>to</strong>tal gross block <strong>of</strong> fixed asset shown in CA-certificate.<br />

e. Further, it was discussed during CAC meeting held on 16.04.2012 and decided<br />

<strong>to</strong> grant consent after CI verification by CAO.<br />

f. Accordingly, file was again referred <strong>to</strong> CAO on 20.04.2012 and he asked <strong>to</strong> call<br />

Balance Sheet from industry <strong>to</strong> verify Gross Block <strong>of</strong> Fixed Assets. After<br />

verification <strong>of</strong> CA certificate <strong>of</strong> Multiple unit, it is reflect that C.I. in fixed assets in<br />

particularly building, land and furniture fixture got reduced. Gross block <strong>of</strong> fixed<br />

assets never reduce in value in normal course <strong>of</strong> business. Hence, said details<br />

were called from industry on 27.04.2012 and 03.05.2012, but they have not<br />

<strong>submitted</strong> the reply till date.<br />

g. <strong>Consent</strong> may <strong>be</strong> refused due <strong>to</strong> non-submission <strong>of</strong> Balance Sheet details.


CAC Item No. 03<br />

Name <strong>of</strong> the Industry: M/s. Wardha Power Company Ltd.,<br />

Phase II <strong>of</strong> 270 MW,<br />

MIDC Warora, Dist-Chandrapur.<br />

HOD Remarks:<br />

• Applied for renewal <strong>of</strong> consent for phase II <strong>of</strong> 270 MW capacities (i.e 2 x 135 MW)<br />

with no increase in capacity.<br />

• Gross block investment is increased from Rs 1211.15 crore <strong>to</strong> Rs 1339 crore &<br />

<strong>submitted</strong> additional consent <strong>of</strong> Rs 255700/- as consent <strong>to</strong> establish fee and renewal<br />

fees <strong>of</strong> Rs. 26,78,000/- as per new GR dated 25.8.2011 for the consent period up <strong>to</strong><br />

31.1.2013.<br />

• Domestic effluent generation is 48 m3/day. STP provided. Industrial effluent generation<br />

is 1800 m3/day. ETP consists <strong>of</strong> neutralization tank, aeration tank, RO system, guard<br />

point. This treated effluent is used for cooling makeup. RO reject taken in evaporation<br />

pond for further use in dust suppression.<br />

• Coal consumption -3600 MT/day. ESP Followed by bag house provided <strong>to</strong> boiler. Bag<br />

house provided <strong>to</strong> coal crusher and transfer point.<br />

• Regional Officer, Chandrapur has issued interim direction on dtd 25/05/2011<br />

• Analysis results <strong>of</strong> ambient air quality moni<strong>to</strong>ring and stack moni<strong>to</strong>ring are<br />

exceeding the standards.<br />

Earlier the case was discussed in CAC meeting held on 20.03.2012 and it was decided<br />

<strong>to</strong> issue Show cause notice for refusal <strong>of</strong> consent. Accordingly Board has issued SCN vide letter<br />

dated 2.4.2012. R.O. Chandrapur has <strong>submitted</strong> the compliance report vide letter dated<br />

17.04.2012.<br />

In view <strong>of</strong> the above we may grant renewal <strong>of</strong> <strong>Consent</strong> up <strong>to</strong> 31.1.2013 with condition <strong>of</strong><br />

Encashment <strong>of</strong> Bank Guarantee <strong>of</strong> Rs.10/- Lakhs against exceeding norms and fresh Bank<br />

Guarantee <strong>of</strong> Rs.20/-Lakhs <strong>to</strong> achieve the standards.


CAC Item No. 04<br />

Name <strong>of</strong> the Industry: M/s. Thyssenkrupp Engine Components India Pvt. Ltd.,<br />

G.No.392, A/p Gonde, Vill: Wadivarhe, Tal: Igatpuri,<br />

Dist: Nashik.<br />

HOD Remarks:<br />

1. Applied for 1 st consent <strong>to</strong> operate <strong>Consent</strong> <strong>to</strong> established obtained for production <strong>of</strong><br />

crank shafts – 1,00,000 Nos./Year.<br />

2. Gross block investment is increased from Rs 102.78 crores <strong>to</strong> Rs 155.52 crore. <strong>Consent</strong><br />

fee paid by the industry Rs.2,08,251 & required <strong>to</strong> submit difference in <strong>Consent</strong> fee <strong>of</strong><br />

Rs.2,02,789/- as per new GR dated 25.8.2011 for the consent period up <strong>to</strong> 31.1.2013<br />

3. SRO, Nashik reported that industry has not provided STP, ETP and coolant treatment<br />

plant and industry has started production activity since Novem<strong>be</strong>r, 2011 without valid<br />

consent <strong>to</strong> operate.<br />

4. Warning notice issued by SRO, Nashik. Show cause notice issued by R.O. Nashik vide<br />

letter dated 22.02.2012 .<br />

Earlier the case was discussed in CAC held on 20.03.2012 and it was decided <strong>to</strong> issue<br />

show cause notice for refusal <strong>of</strong> consent. Accordingly Board has issued Show Case Notice vide<br />

letter dated 02.04.2012. Industry has <strong>submitted</strong> the reply <strong>of</strong> SCN vide letter dated 10.04.2012.<br />

R.O. Nashik <strong>submitted</strong> the compliance report vide letter dated 24.04.2012.<br />

We may grant 1 st <strong>Consent</strong> <strong>to</strong> operate for the period up <strong>to</strong> 30.09.2012 with the operation<br />

Bank Guarantee <strong>of</strong> Rs.5/- Lakhs each for ETP operation and STP operation.


CAC Item No. 05<br />

Name <strong>of</strong> the Industry: M/s. Western Coalfields Ltd.,<br />

Umred Open Cast Project,<br />

Tal: Umred, Dist: Nagpur.<br />

HOD Remarks:<br />

1. Applied for plain renewal <strong>of</strong> <strong>Consent</strong>.<br />

2. Earlier consent for mining <strong>of</strong> coal 3.5 MTPA was valid up <strong>to</strong> 31.12.2011.<br />

3. Capital Investment <strong>of</strong> the Industry is Rs.168.43. The investment was in earlier consent<br />

was 201.44 cores. Justification required for decrease in capital investment. Capital<br />

investment Certificate <strong>of</strong> C.A. is not furnished.<br />

4. Industry required <strong>to</strong> submit difference in <strong>Consent</strong> Fee <strong>of</strong> Rs.8,26,266/- for the consent<br />

validity period up <strong>to</strong> 31.12.2012 as per new GR dated 25.08.2011.<br />

5. Mobile Water tanker provided for water sprinkling on road. 7 Nos. rain guns provided at<br />

CHP.<br />

6. Analysis results <strong>of</strong> AAQM are not <strong>submitted</strong>.<br />

7. Analysis results <strong>of</strong> effluent sample from ETP outlet collected on 5.10.2010 and<br />

22.2.2011 shows all the parameters are within the limit.<br />

Earlier the case was discussed in CAC meeting held on 23.01.2012 and it was decided<br />

<strong>to</strong> issue refusal order. Accordingly refusal order was issued on 08.02.2012. The unit vide letter<br />

dated 29.02.2012 has requested for revocation <strong>of</strong> refusal order. The work <strong>of</strong> STP require two<br />

years. Strengthening <strong>of</strong> water sprinkler by June, 13, 2012.<br />

In view <strong>of</strong> above work, we may consider the proposal for withdrawal <strong>of</strong> refusal order<br />

and forfeit the Bank Guarantee <strong>of</strong> Rs.10 Lakhs. Also grant conditional consent <strong>to</strong><br />

complete all the works related <strong>to</strong> pollution control within 1 year.


CAC Item No. 06<br />

Name <strong>of</strong> the Industry: M/s. WCL Mungoli Opencast Mine,<br />

Po-Sakhara(Kolgaon),Mungoli Sub Area,<br />

Dist-Yavatmal.<br />

HOD Remarks:<br />

1. Applied for renewal <strong>of</strong> consent with expansion from 1.5 Million <strong>to</strong>n per year <strong>to</strong><br />

4.0 Million <strong>to</strong>n per year.<br />

2. Obtained Environmental Clearance for coal production 2.5 MTPA <strong>to</strong> 4.0 MTPA from<br />

MoEF GOI vide letter dated 30th March 2011, copy is enclosed.<br />

3. Earlier consent was valid up <strong>to</strong> 31/12/2010, for coal production <strong>of</strong> 1.55 Million <strong>to</strong>n<br />

per year.<br />

4. Regional Office Chandrapur vide letter dated 21/01/2012 demanded additional consent<br />

fee <strong>of</strong> Rs. 34,80,938/- including delay charges and balanced consent fee. Mine authority<br />

vide their letter dated 03/02/2012 has <strong>submitted</strong> that they are in process <strong>of</strong> depositing<br />

additional fee.<br />

5. Coal Production for last three years is enclosed herewith. The Production for the year<br />

2010-11 was 3.058 Million Ton.<br />

6. The Board vide letterMPC/CRO/1366/2010 dated 05/08/2010 has issued interim<br />

directions <strong>to</strong> the mine. But said mine authority is non-complied with respect <strong>to</strong><br />

these points.<br />

a. Active O.B is about 50 meter away from notified Wardha river. The OB<br />

was slide in part and spread up <strong>to</strong> bank <strong>of</strong> river.<br />

b. Operation & maintenance <strong>of</strong> existing air pollution control system, sewage<br />

treatment plant is very poor and thus affecting surrounding environment.<br />

8. From the Ambient Air Moni<strong>to</strong>ring Results carried in Jan/March/Oct, 2011 observed<br />

that results are exceeding.<br />

9. Mine Lease boundary is adjacent <strong>to</strong> notified A-II class Wardha river ( 0.2 Km) and<br />

within two km from Notified A-II Class Penganga river. RRZ not satisfied for<br />

expansion <strong>of</strong> mine near the notified A-II class river.<br />

10. Earlier the case was discussed in CAC meeting dt 16/04/2012 decided <strong>to</strong> refuse the<br />

consent for expansion and SCN for refusal <strong>of</strong> renewal <strong>of</strong> consent <strong>of</strong> existing unit.<br />

Accordingly, Board has issued SCN for refusal on dt 23/04/2012 and refusal order for<br />

expansion is issued on 25/04/2012. Industry has <strong>submitted</strong> the reply <strong>of</strong> SCN vide letter<br />

dt 30/04/2012 received on 05/05/2012.<br />

We may grant the renewal <strong>of</strong> consent for 2.5 Million Ton/Yr capacity by forfeting<br />

the existing BG <strong>of</strong> Rs.5 Lakhs due <strong>to</strong> non compliance <strong>of</strong> consent conditions and by<br />

taking operation BG <strong>of</strong> Rs.5 Lakhs <strong>to</strong>wards pollution control system.


CAC Item No. 07<br />

Name <strong>of</strong> the Industry: Mahindra and Mahindra Ltd.,<br />

F-1 & 7, MIDC Hingna, Nagpur.<br />

HOD Remarks :<br />

• Applied for first consent <strong>to</strong> operate for expansion.<br />

• <strong>Consent</strong> <strong>to</strong> establish for expansion obtained vide letter dated 26.8.2011.<br />

• <strong>Consent</strong> <strong>of</strong> existing unit is valid up <strong>to</strong> 28.2.2014.<br />

• Total Gross block investment <strong>of</strong> the industry is Rs 274 crore (CI <strong>of</strong> existing unit is Rs.<br />

160/- crore and CI <strong>of</strong> expansion is Rs. 114/- crore). <strong>Consent</strong> fee <strong>of</strong> Rs.5, 60,000/- paid<br />

for the period up <strong>to</strong> 31.01.2014 as per new GR.<br />

• Domestic effluent generation is 4.34 m3/day. STP provided. Industrial effluent 130 CMD.<br />

Existing ETP <strong>of</strong> 300 m3 capacity will <strong>be</strong> utilized & addl. 150m3 proposed. Treated<br />

effluent will <strong>be</strong> recycled partly and remaining disposed on land for gardening.<br />

• Paint booth with water scrubbing provided.<br />

• Industry has installed plant and machinery for phosphate and spray painting and also<br />

provided air pollution control system i.e water scrubbing system with exhaust stack for<br />

the same.<br />

• Industry has provided stack for hot water genera<strong>to</strong>r and backing oven.<br />

• Industry has provided pipeline for carrying effluent from new plant <strong>to</strong> existing effluent<br />

treatment plant having capacity 300m3.<br />

• Installation <strong>of</strong> machineries in transmission line section found in progress and fac<strong>to</strong>ry<br />

representative reported that, they have completed work within the month.<br />

• Earlier the case was discussed in CAC meeting held on 20.03.2012 and it was decided<br />

<strong>to</strong> keep the case in a<strong>be</strong>yance till the completion <strong>of</strong> the work and compliance <strong>of</strong> consent<br />

conditions.<br />

• R.O. Nagpur vide letter dated 21.04.2012 has <strong>submitted</strong> the compliance report <strong>of</strong> the<br />

industry.<br />

As reported by R.O. Nagpur, now the unit has completed the remaining works <strong>of</strong><br />

pollution control system and is ready for use. In view <strong>of</strong> the above, we may grant consent <strong>to</strong><br />

operate amalgamating <strong>to</strong> the existing one for period up <strong>to</strong> 31.01.2014.


CAC Item No. 08<br />

Name <strong>of</strong> the Industry: M/s. Gupta Energy Ltd.,<br />

(Formerly known as M/s Gupta Thermal Power Plant)<br />

HOD Remarks :<br />

1. RED/LSI Unit, Applied for first consent <strong>to</strong> operate for the power plant coal based 2 x 60<br />

Difference in consent fee <strong>of</strong> Rs.3,13,740 /- for increased in capital investment <strong>of</strong><br />

Rs.156.87 crore shall <strong>be</strong> <strong>submitted</strong> by the industry.<br />

5. I/c SRO Chandrapur recommended consent <strong>to</strong> operate subject <strong>to</strong> following compliances<br />

• Industry is located in CEPI<br />

• Standard for TPM shall <strong>be</strong> 50 mg/Nm3<br />

• Bot<strong>to</strong>m ash shall <strong>be</strong> disposed as per consent condition.<br />

• Permission <strong>to</strong> carry out bot<strong>to</strong>m ash in container & dump at ash pond may<br />

<strong>be</strong> reviewed.<br />

• Industry shall achieve zero discharge<br />

• Industry shall install three CAAQMS & on line stack moni<strong>to</strong>ring system.<br />

• Industry shall provide conveyor <strong>be</strong>lts for transportation <strong>of</strong> raw material<br />

/waste so as <strong>to</strong> minimize internal truck movement<br />

• Industry shall complete all the balance environmental works <strong>be</strong>fore<br />

commission <strong>of</strong> the power plant.<br />

6. Earlier the case was discussed in CAC meeting held on 23.1.2012 & decided <strong>to</strong> issue<br />

SCN Accordingly SCN issued <strong>to</strong> industry vide letter dated 3.2.2012<br />

7. Industry has <strong>submitted</strong> the reply <strong>of</strong> SCN received on 6.2.2012 & verification report<br />

received from RO/SRO on 14.2.2012.<br />

Earlier the case was discussed in CAC held on 20.03.2012 and it was decided <strong>to</strong><br />

keep the case in a<strong>be</strong>yance. Regional Officer, Chandrapur has <strong>submitted</strong> the compliance report<br />

dated 03.05.2012 and stated that the unit has completed the work <strong>of</strong> requisite pollution control


system. In view <strong>of</strong> above, we may grant <strong>Consent</strong> up <strong>to</strong> 31.03.2013 with conditional operational<br />

Bank guarantee <strong>of</strong> Rs.5/- Lakhs.

HOD Remarks :<br />

1. Applied for renewal <strong>of</strong> consent for electricity generation (125 MW x 2 & 210 MW x 3). SRO,<br />

Nashik reported that Unit No.1 & 2 <strong>of</strong> 125 MW each are decommissioned and only unit<br />

no.3,4,5 <strong>of</strong> 210 Mw each are in operation .<br />

2. Earlier consent for electricity generation- 880 MW was valid up <strong>to</strong> 31.12.2011.<br />

3. Capital investment <strong>of</strong> the industry is increased from Rs.613.09 Crores <strong>to</strong> Rs.700.89 Crores<br />

(i.e. Rs.87.80 Crores.). Industry has paid <strong>Consent</strong> fee <strong>of</strong> Rs.28,03,575/- along with<br />

application. However, industry required <strong>to</strong> submit <strong>Consent</strong> <strong>to</strong> Establish fee <strong>of</strong><br />

Rs.1,25,000/- for increase in capital investment <strong>of</strong> Rs.87.80 crores.<br />

4. Domestic Effluent – 2500 CMD. Industry has provided STP. Industrial Effluent – 37285<br />

CMD. ETP provided. 20% effluent is used for gardening & 80% effluent is used for ash<br />

slurry.<br />

5. ESP provided <strong>to</strong> Unit no.3,4,5. The unit No.1 & 2 are closed.<br />

6. Augmentation <strong>of</strong> ESP is completed for unit no.3 and augmentation <strong>of</strong> ESTP for unit no.4 & 5<br />

is not done.<br />

7. CAAQM Station is not yet installed.<br />

8. Analysis results <strong>of</strong> Stack moni<strong>to</strong>ring are exceeding the standards.<br />

9. Regional Officer, Nashik reported that Board had issued directions vide letter No.<br />

MPCB/APAE/TB-2/B-1884 dated 29.03.2011 and directed the industry <strong>to</strong> comply with these<br />

directions in stipulated period and submit the Bank Guarantee <strong>of</strong> Rs.1.0 Crore <strong>to</strong>wards<br />

compliance <strong>of</strong> these directions (detail report is enclosed herewith). But Industry has failed <strong>to</strong><br />

submit the said Bank Guarantee. In view <strong>of</strong> above the application is <strong>submitted</strong> herewith for<br />

the consideration and further disposal, please.


10. Earlier the case was discussed in 16/04/2012 and it was decided <strong>to</strong> issue SCN for refusal<br />

<strong>of</strong> consent. Accordingly Board has issued SCN dt 23/04/2012. The industry has <strong>submitted</strong><br />

the reply <strong>of</strong> SCN vide letter dated 30/04/2012 received on 10/05/2012.<br />

The unit has not completed most <strong>of</strong> the pollution control works also CAAQMS also not yet<br />

installed.<br />

In view <strong>of</strong> above as decided in interim direction we may grant renewal for one year i.e<br />

31/12/2012 with BG <strong>of</strong> Rs.1/- Cr for compliance <strong>of</strong> above directions dated 29/03/2011.<br />

3. The Case was disused in CAC meeting for reconsideration <strong>of</strong> Refusal dated 16.04.2012<br />

4. It was decided <strong>to</strong> obtain report from RO (Thane) along with the justification <strong>to</strong> achieve Zero<br />

discharge & revert back <strong>to</strong> CAC<br />

5. As per Regional Officer, Thane report Industry has made arrangement for utilizing treated<br />

effluent (250 CMD) for <strong>to</strong>ilet flushing, humidification process and cooling <strong>to</strong>wer, which will<br />

resulting Zero discharge.<br />

6. MIDC has not provided any connection <strong>to</strong> the industry for any kind <strong>of</strong> disposal drainage<br />

system.<br />

7. Industry is still engaged in weaving process without Boards permission.

e. The production in C <strong>to</strong> E was equal <strong>to</strong> C <strong>to</strong> O valid consent (i.e. doubled)<br />

f. H.W. quantities are increased<br />

g. Air Pollution / Emission also increased.<br />

6. Grant C <strong>to</strong> O with amalgamation and obtain B.G. <strong>of</strong> Rs. 10 lakh for Nill effluent generation.<br />

Also we may obtain assurance / put condition in C <strong>to</strong> O that there should not <strong>be</strong> increase in<br />

effluent quantity from expansion.<br />

aeration tank drain valve failed and hence the effluent went out side the fac<strong>to</strong>ry<br />

premises, S<strong>to</strong>pped the discharge <strong>of</strong> the effluent immediately and replaced the drain<br />

valve, Industry has s<strong>to</strong>pped the production on 04.04.2012, The proposal <strong>of</strong> the up<br />

gradation <strong>of</strong> ETP is received from Vasantdada Sugar Institute, Upgradation <strong>of</strong> the ETP<br />

will <strong>be</strong> done in this <strong>of</strong>f-season.<br />

• Closure was issued on 26.03.2012 and Industry has s<strong>to</strong>pped production on 04.04.2012.<br />

• Sugar ETP was <strong>to</strong>o old and valve was failed and untreated effluent went outside the<br />

premises.<br />

• Industry is regular defaulter.<br />

• We may refuse the <strong>Consent</strong>.


CAC Item No. 23<br />

Name <strong>of</strong> the industry : M/s. B.S. ISPAT LTD.,(sponge Iron Plant)<br />

Vill-Salori Yensa,Tal-Warora, Dist.- Chandrapur.<br />

HOD Remarks :<br />

1. M/s B.S.Ispat Ltd,Salori Yensa, Ta warora, dist Chandrapur, is engaged in<br />

manufacturing <strong>of</strong> sponge iron.<br />

2. Earlier application for first consent <strong>to</strong> operate was refused by the Head<br />

<strong>of</strong>fice vide letter dated 01/02/2012 due <strong>to</strong> non compliance <strong>of</strong> consent <strong>to</strong><br />

establish conditions and accordingly Regional Office vide letter dated<br />

29/02/2012 has issued directions not <strong>to</strong> operate industry unless obtaining<br />

valid consent <strong>to</strong> operate from the Board.<br />

3. Now, the said industry has made fresh application for first consent <strong>to</strong><br />

operate for sponge iron plant for production <strong>of</strong> 60,000 TPA (Phase-I).<br />

4. Capital Investment <strong>of</strong> the Sponge iron plant is Rs. 65.24 crore. Total Capital<br />

Investment <strong>of</strong> integrated project including sponge iron plant as per the<br />

consent <strong>to</strong> establish granted earlier is Rs.158.5/- crore.<br />

5. <strong>Consent</strong> Fees <strong>of</strong> Rs.2,00,000/- had <strong>be</strong>en <strong>submitted</strong> with earlier consent<br />

application which was refused. Hence we may forfeit one term consent fees<br />

<strong>of</strong> Rs.1,00,000/- and consider Rs.1,00,000/- for this consent <strong>to</strong> operate.<br />

6. Obtained Environmental Clearance from the MoEF, GOI, vide letter dated 5th<br />

May 2009 for sponge iron unit with captive power plant , for sponge iron <strong>of</strong><br />

production <strong>of</strong> 64000 TPA & further obtained EC vide letter dated 23 rd<br />

Novem<strong>be</strong>r 2010 for production <strong>of</strong> sponge iron <strong>of</strong> 64000 TPA <strong>to</strong> 184000 TPA,<br />

copy is enclosed.<br />

Now unit has installed necessary pollution control system including<br />

installation <strong>of</strong> CAAQMS & Opacity meter. The compliance is <strong>submitted</strong> by RO<br />

/SRO. We may grant consent <strong>to</strong> operate up <strong>to</strong> 30.4.2013 with operational bank<br />

guarantee <strong>of</strong> Rs.5/- Lakhs <strong>to</strong>wards pollution control system.


CAC Item No. 24<br />

Name <strong>of</strong> the Industry: M/s. Wokhardt Hospitals Pvt. Ltd.,<br />

HOD Remarks:<br />

a. Applied for grant <strong>of</strong> consent <strong>to</strong> Establish for construction <strong>of</strong> Hospital (320 No.<br />

<strong>of</strong> Beds and Cafeteria/canteen).<br />

b. Application received at SRO on 3.11.2011 and at HQ on 17.03.2012.<br />

c. The <strong>to</strong>tal built-up area 25,015.26 sq.m. and <strong>to</strong>tal plot area is 3586.98 sq.m.<br />

d. Applicant requires <strong>to</strong> obtain Environmental Clearance as per EIA Notification,<br />

2006 and obtained the same.<br />

e. Applicant have started construction activity without obtaining consent as<br />

previously they had approved plan for 7,868.06 sq.m. BUA and said does not<br />

require Environmental Clearance. SRO reported that they have completed 21<br />

s<strong>to</strong>rey building <strong>of</strong> hospital with partly plumbing/ flooring. And SRO recommended<br />

<strong>to</strong> issue SCN for the same.<br />

f. The effluent generated from the said activity will <strong>be</strong> sewage – 242 CMD and<br />

proposed <strong>to</strong> provide STP (capacity-325 CMD) and treated effluent will <strong>be</strong> reused<br />

for flushing, cooling purpose and remaining treated effluent is disposed <strong>of</strong>f in<strong>to</strong><br />

the sewer line.<br />

g. The bio-degradable waste generated will <strong>be</strong> segregated and disposed <strong>to</strong> MCGM.<br />

And non-biodegradable waste will <strong>be</strong> send <strong>to</strong> authorized vendor. They have<br />

proposed <strong>to</strong> provide vermin-composting pits for biodegradable waste.<br />

h. RO reported that applicant have proposed rain water harvesting.<br />

i. The C.I. <strong>of</strong> project mentioned in EC is Rs. 100 Crs. and in the application it is<br />

mentioned as Rs. 208 Crs. Applicant have <strong>submitted</strong> the clarification as earlier<br />

medical equipment cost did not included in C.I. and escalation in project cost is<br />

due <strong>to</strong> the time lapsed <strong>be</strong>tween 2008 and now and paid consent fees<br />

accordingly.<br />

j. As this is the construction <strong>of</strong> Hospital with canteen, category <strong>of</strong> consent and<br />

consent granting authority needs <strong>to</strong> <strong>be</strong> defined. As per CPCB revised product<br />

category, Hospital comes under RED category. There are similar activities in<br />

Hospital & Hotel such as laundry activity, canteen, sewage waste, biodegradable<br />

waste. So, we may consider hospital in Red category and Hotel.<br />

k. The case was discussed in CAC dtd. 16.04.2012 and it was decided <strong>to</strong> keep the<br />

case in a<strong>be</strong>yance. It was decided <strong>to</strong> cover the Hospital activity under purview <strong>of</strong>


Water Act, Air Act, etc. <strong>to</strong> grant consent, a separate note shall <strong>be</strong> moved for<br />

discussion in CAC and then a decision <strong>be</strong> taken in this case.<br />

l. <strong>Consent</strong> may <strong>be</strong> granted up<strong>to</strong> commissioning <strong>of</strong> the unit.

d. RO/SRO reported that industry has provided ozonation treatment <strong>to</strong> one <strong>of</strong> the<br />

swimming pool and remaining work <strong>of</strong> the same is in progress, which need<br />

further period <strong>of</strong> three months for completion.<br />

e. The bio-degradable waste generated is <strong>be</strong>ing sent <strong>to</strong> PMC site for treatment and<br />

disposal.<br />

f. RO-Pune recommended the case for grant <strong>of</strong> consent up<strong>to</strong> 31.03.2017 with the<br />

condition <strong>of</strong> obtaining BG <strong>to</strong>wards the installation <strong>of</strong> ozonation treatment within<br />

next three month period.<br />

g. <strong>Consent</strong> may <strong>be</strong> granted with the condition <strong>of</strong> obtaining BG for providing<br />

ozonation treatment within three months period.

Establish fee for increase in production <strong>of</strong> mineral 1.3 MTPA Rs. 5,2,000/- as per new GR<br />

dated 25.08.2011.<br />

6. Domestic Effluent-489.67 CMD. STP proposed <strong>to</strong> <strong>be</strong> provided. Treated effluent will <strong>be</strong><br />

disposed in river. Industrial Effluent-17186 CMD. Mine water will <strong>be</strong> discharged in <strong>to</strong> river.<br />

HOD Remarks:<br />

1. Industry is having two consent in the same premises. First is for 4 x 100 TPD Kiln which is<br />

valid up <strong>to</strong> 18.10.2011. Second one is for 500 TPD Kiln, Coal Washery and 25 MW Power<br />

generation which is valid u <strong>to</strong> 28.2.2012. Plain renewal with amalgamation <strong>of</strong> both consents.<br />

2. Total Capital investment <strong>of</strong> the industry is Rs.498.55 Crores. <strong>Consent</strong> fee <strong>of</strong> Rs.9,97,109/is<br />

paid for one year period as per new G.R. dated 25.08.2011.<br />

3. Regional Officer, Chandrapur reported that the industry has complied majority <strong>of</strong> directions<br />

except point no.4 & 7 i.e. installation <strong>of</strong> Ash Silo and disposal <strong>of</strong> solid waste. Hence, R.O.<br />

has forfeited the bank guarantee <strong>of</strong> Rs.5.0 Lakhs in the month <strong>of</strong> Decem<strong>be</strong>r, 2011.<br />

4. Regional Officer, Chandrapur reported that;<br />

i) Industry has installation one CAAQM station within premises in January, 2008.<br />

ii) Continuous Moni<strong>to</strong>ring Station (CMS) is also provided Sponge Iron stack and 25 MW<br />

Power Plant.<br />

iii) Construction <strong>of</strong> new ash silo is expected <strong>to</strong> complete by March, 2012.<br />

iv) Industry has improved housekeeping since previous visit.<br />

v) Industry has paid Cess payment <strong>of</strong> Rs.22,856/- on 17.1.2012 and Cess Return filed up<br />

<strong>to</strong> 31.1.2012.<br />

vi) Online environment statement for the year 2010-11 <strong>submitted</strong> by the industry.<br />

vii) From the analysis reports stack emission and ambient air quality levels are fluctuating<br />

and some time on higher side and hence industry shall improve operation and<br />

maintenance <strong>of</strong> pollution control system.<br />

viii) Char <strong>be</strong>neficiation plant is commissioned on January, 2011 and it is used as<br />

secondary fuel in AFBC boiler and hence conditions regarding use <strong>of</strong> char as fule may<br />

<strong>be</strong> incorporated.<br />

ix) Industry shall submit proposal for one additional CAAQMS as per consent condition.<br />

5. Legal Action: Writ Petition No.3501/2006 in Mumbai High Court, Nagpur Bench. The writ<br />

petition is pending for hearing.<br />

9. Industry has represented against that and mentioned that, this 5 yrs conditions<br />

has not <strong>be</strong>en mentioned in C To E or amendment granted <strong>to</strong> them.<br />

10. Now industry has <strong>submitted</strong> a fresh application for C <strong>to</strong> E & also requested <strong>to</strong><br />

withdrawal and return <strong>of</strong> fees.<br />

11. SRO has reported only leveling and compound wall work is in progress.<br />

12. SRO has remarked that suitable decision may <strong>be</strong> taken at HQ.<br />

This may <strong>be</strong> placed <strong>be</strong>fore CAC for policy decision regarding refund <strong>of</strong> consent<br />

• The industry location is in RRZ restricted area (Nira river A-IV Zone)<br />

• In the same premises industry has holding 5 consents for various products Existing I.E.<br />

– 1804 CMD, proposed IE-163. Total I.E. 1967 CMD.<br />

• Earlier board has granted consent <strong>to</strong> establish in 22/08/2008 and accordingly industry<br />

has obtained EC from MoEF. Now Industry has applied Phase-wise consent <strong>to</strong> 1 st<br />

Operate only for the mfg <strong>of</strong> acetic anhydride 125 MT/Day with IE 163 CMD.<br />

• RO Pune has reported compliance <strong>of</strong> existing industries and recommended for 1 st<br />

Operate with amalgamation <strong>of</strong> existing consent.<br />

• Board has already granted C <strong>to</strong> E and now the application is for consent <strong>to</strong> 1 st operate.<br />

• Case was discussed in CAC meeting held on 16/04/2012 and it was decided <strong>to</strong> verify the<br />

pollution load, applicability <strong>of</strong> RRZ policy reverts back <strong>to</strong> CAC.<br />

• Accordingly, industry has <strong>submitted</strong> details about effluent treatment and its disposal<br />

method for achieving ZERO discharge for proposed products, which seems <strong>to</strong> <strong>be</strong> in<br />

order.<br />

We may consider the case for short period for verification <strong>of</strong> industry say about<br />

achieving ZERO discharge with amalgamation <strong>of</strong> existing consent issued for chemical<br />

plant.
