Welcome to the 6th Annual Federation of Asian Canadian Lawyers
(“FACL”) Conference!
FACL consists of Asian Canadian lawyers united by a common interest
in promoting equity justice and opportunity for Asian Canadians
in both the legal profession and the wider community. The FACL
Conference is a testament to that mission, bringing together hundreds
of lawyers to discuss current legal issues, participate in professional
development and engage in networking. The Conference Co-
Chairs, Lai-King Hum and Carolyn Chambers, and their Committee
have truly “raised the bar” showcasing the brightest and best of the
Asian legal community.
FACL’s success over the past 6 years is a result of you. Through your support, participation and dedication,
FACL continues to be active locally, nationally and internationally. FACL sponsored The Law
Society of Upper Canada’s Asian and South Asian Heritage month events, publicly commented on the
diversity of judicial appointments, conducted enriching mentoring and career development seminars,
presented at law student conferences, assisted with the establishment of a chapter in British Columbia,
participates in The Treasurer’s Liaison Group and is an affiliate of the National Asian Pacific
American Bar Association.
Message from the Conference Chairs
Dear Colleagues and Guests:
Welcome to the Federation of Asian Canadian Lawyers
(“FACL”) 6 th Annual Conference! On behalf of the FACL
Board of Directors, we thank you for joining us and
making this Conference another success.
Six years ago, FACL was started with the vision of
bringing together legal professionals of Asian and South Asian descent to discuss issues and strategies
that interest and affect our communities. We are no strangers to planning a FACL Conference:
Lai was a co-Chair of the 2011 FACL Conference, and Carolyn was a co-Chair of the 2010 FACL
Conference. Although it takes months of dedicated planning to organize this Conference, we are
passionate about FACL’s growth and its commitment to advocacy, community involvement, legal
scholarship and professional development, and we were happy to take on a major planning role in
this year’s Conference. Of course, this Conference was made possible by our Conference Planning
Committee’s hard work, and the help of all of our volunteers who have helped make this day a success.
We cannot forget to thank all of our generous sponsors who have helped make this Conference and
the continued growth of FACL possible.
Our theme this year is “Raising the Bar”. We take this time to celebrate the achievements of Asian
lawyers who have broken barriers in the past, and also highlight the progress that still needs be
made in their quest for advancement: first Asian lawyer in Canada, the breakthrough of Asians in
politics, Asians as leaders in public service, Asians in the judiciary. The bar for success was once set at
ensuring recognition of our basic human rights and freedoms. Where to now? The time has come to
raise the bar even higher: Asian lawyers succeeding at the highest levels of law, public service, politics,
and in the business and corporate world. “Raising the bar” is also a reference to the need for good
mentorship to the next generation of Asian lawyers looking for guidance in their quest to excel - and
raise the bar yet higher!
In light of this theme, it gives us great pleasure to welcome our keynote speaker, Mr. Don Liu, Senior
Vice-President, General Counsel and Corporate Secretary at Xerox Corporation, Recipient of the 2011
Trailblazer Award from the National Asian Pacific American Bar Association (“NAPABA”), and one of
only about nine general counsel of a Fortune 500 company who is of Asian descent. We are looking
forward to Mr. Liu’s keynote speech “Confessional Ode of a Pussycat Father”.
Enjoy the 2012 FACL Conference, and thank you again for your part in making this Conference a
success.
Panel Session 1:
Session A:
BREAKING THE
BARRIERS: Pioneering
Asian-Canadians in
law
We have come a long way
from the days of the head tax,
the Chinese Immigration Act,
1923 (commonly known as the
Chinese Exclusion Act), the
internment of the Japanese,
and the fear of the yellow peril.
In order to move forwards, it
is important to remember the
past. What barriers have Asian-
Canadian lawyers broken? Who
were these pioneers? Where do
we need to go?
Moderator: Jason Tam (Crown
Session B:
The Path to a
Successful Career
on “Bay Street”:
What they don’t
teach you in law
school
The “tiger-mom” phenomenon
is all about discipline and hard
work. However, as lawyers in
private practise know, it is not
just about working hard. This
session will focus on career and
profi le management for Asian
lawyers. What does it mean
to be an Asian lawyer on Bay
Street? Are there underlying
multi-cultural issues that are
relevant to a successful career,
and does that affect possible
mentorship opportunities? Find
out what it takes to succeed –
in litigation, in real estate, in
corporate law!
Session C:
Alternatives to “Bay
Street” : success is
not measured by the
billable hour
There are many who have
turned their backs on private
practise and all that entails.
There are unique reasons for
the choice of an alternative
to the traditional model to
the private practise of law.
Work/life balance may be one
of the principle reasons, but
fi nd out from these people
with alternate career choices
what other opportunities
exist that transform our usual
thinking about the lawyer/
client relationship and fi duciary
obligations, and challenge our
understanding of law practice
arrangements.
Session A:
Asian Lawyers as
Leaders on Social
Justice and Equity
Issues
Does being a lawyer of Asian
descent contribute to a better
understanding of social justice
and equity issues? Asian
lawyers have been leaders in the
areas of human rights and social
justice. Experts will speak about
the legal issues that they have
explored, such as the Chinese
“head tax”, and the particular
management of those initiatives
and the leadership skills
required. They will also discuss
the particular perspective that
being an Asian lawyer has lent
to their work.
Setting Up Your Own
Law Firm
What does it take to go out on
your own? This session will
be of interest to lawyers at
any stage of their career who
have considered setting up
their own law fi rm, including
information related to opening
and operating a legal practice.
What does it take? What do you
need to know to manage your
own practise, particularly in the
areas of marketing, maintaining
proper books and records, and
implementing systems for
fi le organization, privacy, and
reporting obligations? What are
the typical problems that land
small fi rms into compliance
Caveat emptor:
Duties of full
disclosure, from
Facebook shares, to
false advertising,
and other “buyer
beware” tales
Facebook’s IPO met with a
frenzied fanfare, and there
were many who were ready to
jump on the bandwagon based
on the hype --- to see their
investment suddenly plunge
over the next few weeks and
months. Buyers are also often
misled by false advertising and
unfair consumer contract terms.
What kind of legal safeguards
are there for these shareholders/
buyers? what are the recourses?
How do corporations defend
themselves?
Panel Session 3:
Session A:
Urban myth? the
Competent and
Aggressive Asian
Lawyer
Do stereotypes of the Asian
lawyer persist? Passive and not
someone you want in court?
What about competence? The
case of Law Society of Upper
Canada v. Selwyn Milan
McSween, 2012 ONLSAP 3
(CanLII) raised the possibility
that minority lawyers may face
increased scrutiny from their
professional regulator, with a
misconception of incompetence.
At times, this presents a
tension between outrage and
maintaining respect for clients,
potential clients, colleagues and
legal institutions and authorities.
This panel of lawyers will speak
about their own experiences
overcoming stereotypes. How
have stereotypes and racism
been overcome? Hear how
cultural backgrounds, not just
in lawyers but in clients, affect
how assertiveness is perceived –
in client/lawyer relationships, in
relationships with colleagues or
the Bench, and in marketing.
In-House Counsel to
External Counsel:
What we need that
you don’t deliver!
It is a dance of courtship that
in-house counsel know well:
the hunt of the external counsel
for business opportunities, and
the internal counsel’s search for
competent external counsel who
deliver the services effi ciently.
What tips can in-house lawyers
give to those wanting to court
them successfully? What level
of client service is expected?
What might trigger in-house
counsel to change lawyers?
Hear from senior lawyers what
the most desired qualities
service levels are expected.
DiverseCity onBoard
DiverseCity onBoard is part of DiverseCity: The
Greater Toronto Leadership Project, a joint
initiative of Maytree and the Greater Toronto
CivicAction Alliance. It connects qualified
candidates from visible minority and underrepresented
immigrant communities to the
governance bodies of agencies, boards and
commissions and voluntary organizations in
the Greater Toronto Area (GTA). We work with
public institutions and voluntary organizations
to change the face of the region’s leadership by
promoting board recruitment and appointment
processes that reflect the GTA’s diverse
population.
We do this for reasons of inclusion. As the
demographic profile of the GTA changes, public
and voluntary institutions must reflect the
lives and experiences of this new demographic.
Diversity at the board table ensures that
institutional leadership is responsive to the
needs of newer residents. Further, diversity of
thinking and perspectives leads to innovation,
new solutions and improved organizational
performance.
Good practice in board governance includes
finding the right people to lead. In a city region
as diverse as ours, this involves embracing
the full spectrum of skills, experiences and
connections available. Capitalizing on our
immense talent pool is an imperative for today’s
nonprofit and public boards.
DiverseCity onBoard helps public institutions
embrace diversity as a core value of a shared
society while connecting them to the talent they
need for competitive growth, sustainability, and
shared prosperity. It offers a proactive matching
service that identifies, trains and facilitates
placements of highly qualified candidates in
board roles in public and nonprofit agencies,
boards and commissions.
In just six years, DiverseCity onBoard has
facilitated the appointment of over 600
individuals to a variety of public, non-profit and
other organizational boards. Additionally, over
600 organizations and over 1,500 pre-screened
qualified candidates from visible minority
and immigrant groups are registered on its
searchable database.
Ontario Justice
Education Network
Founded by Ontario’s three Chief Justices in
2002, the Ontario Justice Education Network
(OJEN) is a non-profit, charitable organization
that brings together leading institutions and
individuals from the legal and education sectors
to collaborate on initiatives designed to foster
public understanding of the justice system. With
the commitment of hundreds of volunteers,
including judges from all levels of the courts,
members of the bar, the Crown Attorney’s
office, court staff, legal aid clinics, law schools,
teachers, and community representatives, OJEN
reaches thousands of youth across the province
each year.
OJEN’s justice education outreach activity
focuses on youth programming across Ontario
in four distinct areas: newcomer, at-risk,
francophone, and aboriginal communities.
OJEN partners with several high schools and
immigrant-serving organizations in Ontario to
facilitate justice education programs that aim to
acknowledge the pressures placed on newcomer
youth who may have stronger language skills
than their parents or relatives and are expected
to translate and communicate legal information
to their families. Activities are designed to
counter negative stereotypes and focus on
accurate legal information by directing students
to local sources of reliable legal support in their
communities.
Pro Bono Law Ontario
Pro Bono Law Ontario (PBLO) is the leading
facilitator of pro bono legal services to Ontarians
of limited means. It is a charitable organization
that enhances access to justice in Ontario by
creating and promoting opportunities for private
lawyers to provide pro bono (free) legal services
to low-income individuals and families, as well
as the charitable organizations that serve them.
PBLO designs pro bono projects and coordinates
the pro bono efforts of law firms, in-house
counsel, retired lawyers, law associations and
government lawyers.
PBLO projects focus on the unmet civil, nonfamily
legal needs of Ontarians that are not
covered by Legal Aid. The organization works
with community-based partners to create
responsive litigation or corporate pro bono
projects, such as:
• Court-based services for unrepresented
litigants at Ontario’s Superior and Small
Claims courts;
• Representation for children and youth
facing school rights challenges;
• Assistance for individuals with appeals
at the Ontario Court of Appeal, the
Federal Court of Appeal or Divisional
Court;
• Corporate legal services for nonprofits
and charities.
PBLO also provides strategic guidance to help
law firms and law associations formalize their
pro bono participation through the creation of
pro bono policies and customized administrative
resources.
FACL Mentorship
Committee
One of the goals of FACL is to promote the
professional development of its members.
As such, FACL has established a Mentoring
Program, targeted towards law students
currently attending law school, those currently
in their articling year, and recent calls to the
Bar. The goal of this program is to provide
an opportunity for law students and recent calls
to talk to mentors to consider potential career
paths and to encourage lawyers and jurists to
interact with members of the legal community
by acting as mentors and role models.
Mentees can benefit from opportunities to
develop and learn about practice areas of
interest, and mentors will be able to develop
leadership and communication skills, while
participating in shared learning with their
mentee. The Mentoring Program also provides
FACL mentors with an opportunity to make a
positive impact on a new generation of lawyers
and to help their respective communities by
promoting better representation in the legal
profession.
FACL Mentorship Committee
The Mentorship Committee had a very
successful re-launch of its Program, earlier this
year in January. The Committee would like to
continue this tradition, and is looking forward to
organizing another successful mentorship event
in January, 2013.
As the FACL Mentorship Program continues
to grow, we will focus on reaching out to other
members of the legal community. Specifically,
the Committee would like to help recruit foreign
trained lawyers and provide mentoring to these
individuals. Hopefully, the FACL Mentorship
Program can assist them in their re-licensing
and accreditation process.
The formal mentoring period will run from
February to October. However, a mentoring
pair may agree to continue with their mentoring
relationship after the formal nine month period
has expired.
