Welcome to the 6th Annual Federation of <strong>Asian</strong> Canadian Lawyers<br />

(“<strong>FACL</strong>”) <strong>Conference</strong>!<br />

<strong>FACL</strong> consists of <strong>Asian</strong> Canadian lawyers united by a common interest<br />

in promoting equity justice and opportunity for <strong>Asian</strong> Canadians<br />

in both the legal profession and the wider community. The <strong>FACL</strong><br />

<strong>Conference</strong> is a testament to that mission, bringing together hundreds<br />

of lawyers to discuss current legal issues, participate in professional<br />

development and engage in networking. The <strong>Conference</strong> Co-<br />

Chairs, Lai-King Hum and Carolyn Chambers, and their Committee<br />

have truly “raised the bar” showcasing the brightest and best of the<br />

<strong>Asian</strong> legal community.<br />

<strong>FACL</strong>’s success over the past 6 years is a result of you. Through your support, participation and dedication,<br />

<strong>FACL</strong> continues to be active locally, nationally and internationally. <strong>FACL</strong> sponsored The Law<br />

Society of Upper Canada’s <strong>Asian</strong> and South <strong>Asian</strong> Heritage month events, publicly commented on the<br />

diversity of judicial appointments, conducted enriching mentoring and career development seminars,<br />

Message from the <strong>Conference</strong> Chairs<br />

Dear Colleagues and Guests:<br />

Welcome to the Federation of <strong>Asian</strong> Canadian Lawyers<br />

(“<strong>FACL</strong>”) 6 th Annual <strong>Conference</strong>! On behalf of the <strong>FACL</strong><br />

Board of Directors, we thank you for joining us and<br />

making this <strong>Conference</strong> another success.<br />

Six years ago, <strong>FACL</strong> was started with the vision of<br />

bringing together legal professionals of <strong>Asian</strong> and South <strong>Asian</strong> descent to discuss issues and strategies<br />

that interest and affect our communities. We are no strangers to planning a <strong>FACL</strong> <strong>Conference</strong>:<br />

Lai was a co-Chair of the 2011 <strong>FACL</strong> <strong>Conference</strong>, and Carolyn was a co-Chair of the 2010 <strong>FACL</strong><br />

<strong>Conference</strong>. Although it takes months of dedicated planning to organize this <strong>Conference</strong>, we are<br />

passionate about <strong>FACL</strong>’s growth and its commitment to advocacy, community involvement, legal<br />

scholarship and professional development, and we were happy to take on a major planning role in<br />

this year’s <strong>Conference</strong>. Of course, this <strong>Conference</strong> was made possible by our <strong>Conference</strong> Planning<br />

Committee’s hard work, and the help of all of our volunteers who have helped make this day a success.<br />

We cannot forget to thank all of our generous sponsors who have helped make this <strong>Conference</strong> and<br />

the continued growth of <strong>FACL</strong> possible.<br />

Our theme this year is “Raising the Bar”. We take this time to celebrate the achievements of <strong>Asian</strong><br />

lawyers who have broken barriers in the past, and also highlight the progress that still needs be<br />

made in their quest for advancement: first <strong>Asian</strong> lawyer in Canada, the breakthrough of <strong>Asian</strong>s in<br />

politics, <strong>Asian</strong>s as leaders in public service, <strong>Asian</strong>s in the judiciary. The bar for success was once set at<br />

ensuring recognition of our basic human rights and freedoms. Where to now? The time has come to<br />

raise the bar even higher: <strong>Asian</strong> lawyers succeeding at the highest levels of law, public service, politics,<br />

and in the business and corporate world. “Raising the bar” is also a reference to the need for good<br />

mentorship to the next generation of <strong>Asian</strong> lawyers looking for guidance in their quest to excel - and<br />

raise the bar yet higher!<br />

In light of this theme, it gives us great pleasure to welcome our keynote speaker, Mr. Don Liu, Senior<br />

Vice-President, General Counsel and Corporate Secretary at Xerox Corporation, Recipient of the 2011<br />

Trailblazer Award from the <strong>National</strong> <strong>Asian</strong> <strong>Pacific</strong> American Bar Association (“NAPABA”), and one of<br />

only about nine general counsel of a Fortune 500 company who is of <strong>Asian</strong> descent. We are looking<br />

forward to Mr. Liu’s keynote speech “Confessional Ode of a Pussycat Father”.<br />

DON H. LIU is Senior Vice President,<br />

General Counsel and Secretary for Xerox<br />

Corporation. In this role, reporting directly<br />

to Ursula M. Burns, Chairman and CEO,<br />

he is responsible for all of Xerox’s legal and<br />

government affairs.<br />

Prior to joining Xerox, Mr. Liu was Senior<br />

Vice President, General Counsel and Chief<br />

Compliance Officer for Toll Brothers, Inc.<br />

and previously Senior Vice President, General<br />

Counsel and Secretary of IKON Office<br />

Solutions, where he was also IKON’s Corporate<br />

Compliance Officer and Chair of IKON Diversity<br />

Council. Before joining IKON, Mr. Liu was<br />

Vice President and Deputy Chief Legal Officer<br />

of Aetna U.S. Healthcare (and its predecessor<br />

entity, U.S. Healthcare). Prior to becoming<br />

in-house counsel, he worked as an associate<br />

at two New York City law firms from 1987 to<br />

1992, specializing in securities and mergers<br />

and acquisitions – first at Simpson Thacher &<br />

Bartlett and then at Richards & O’Neil (now<br />

Breaking the Barriers<br />

Jason Tam<br />

Jason Tam is currently a Crown Counsel in the<br />

litigation group with the Ministry of Labour. He<br />

received his B.A. (Hons.) from the University<br />

of Toronto in 2003 and went on to receive his<br />

Juris Doctor degree from Capital University in<br />

Columbus, Ohio in 2006. He has been called<br />

to the State and Federal Bars in Ohio (2006<br />

and 2007) and to the Ontario Bar (2009). He<br />

has practiced in both Ohio and Ontario in a<br />

variety of areas including family, criminal,<br />

human rights, and labour law. He currently<br />

sits on the board of directors for the Metro<br />

Toronto Chinese and Southeast <strong>Asian</strong> Legal<br />

Clinic and is also the Chair of the Advocacy and<br />

Policy Committee with the Federation of <strong>Asian</strong><br />

Canadian Lawyers.<br />

DR. ALLISON<br />

KIRK-MONTGOMERY<br />

Dr. Allison Kirk-Montgomery is a historian,<br />

and the Project Manager of the Law Society of<br />

Upper Canada’s Diversifying the Bar: Lawyers<br />

Make History Project. She received her Ph.D.<br />

from the University of Toronto in 2001. She<br />

has also written on the history of legal medicine<br />

and medical technology. Dr. Kirk-Montgomery<br />

has been involved previously with a number of<br />

interview projects for the Law Society including<br />

the Senior Treasurers’ Interview Project in<br />

2004. She was also the oral historian and<br />

compiler of the “Memoir of Mary Constance<br />

Hunt McLean” in 2007-08. As the project<br />

manager of the Law Society’s Diversifying the<br />

Bar project, Dr. Kirk-Montgomery is helping to<br />

preserve, build and publicize the rich history<br />

of Ontario’s ground-breaking lawyers of<br />

diverse communities, by providing access to<br />

the transcripts of recorded interviews and to<br />

hundreds of brief biographies at http://www.<br />

JUDGE MARYKA OMATSU<br />

Before her appointment to the bench, Judge<br />

Omatsu practised law in Toronto for 16 years.<br />

She worked for all levels of Government and<br />

taught law in China, Japan and Toronto. She<br />

was Chair of the Ont. Human Rights Appeals’<br />

Tribunal and a LSUC referee. During the<br />

1980’s, Judge Omatsu was a member of the<br />

<strong>National</strong> Association of Japanese Canadians’<br />

negotiation team and helped win Redress for<br />

her community for the WWII violations. In<br />

1992, her book, Bittersweet Passage: Redress<br />

and the Japanese Canadian Experience won<br />

several prizes and was published in Japan. In<br />

February 1993, Judge Omatsu was appointed<br />

to the Ontario Court of Justice as Canada’s first<br />

East <strong>Asian</strong> woman judge. She has presided in<br />

Toronto’s criminal courts, co-chaired CAPCJ’s<br />

Equality and Diversity Committee; co-edited<br />

a Section 15 Charter manual. Judge Omatsu<br />

was an OCJ Toronto representative for two<br />

terms and helped negotiate sabbatical leaves<br />

and a better pension. She retired after over 19<br />

years on the bench. Judge Omatsu has received<br />

the Federation of <strong>Asian</strong> Canadian Lawyers’<br />

(<strong>FACL</strong>) Life Time Achievement Award; U. of<br />

Victoria Law School’s, Lansdowne Lectureship;<br />

Dartmouth College’s William Timbers<br />

Lectureship; the Queen Elizabeth’s Golden<br />

Jubilee Medal; the Delta SS Wall of Excellence<br />

plaque and various Dept. of External Affairs and<br />

Arts Council grants from the Canadian, Ont.<br />

and Toronto governments. To honour Judge<br />

Omatsu, one of <strong>FACL</strong>’s founders, in <strong>2012</strong>, the<br />

Omatsu <strong>FACL</strong> Scholarship was established.<br />

Gary yee<br />

Gary Yee’s legal career has focused on administrative<br />

law since his call to the Bar in 1985. In addition to<br />

his LL.B., he has an LL.M. in Law and Regulation.<br />

Gary’s current position is Chair of the Licence<br />

Appeal Tribunal, where he started a fi ve-year term in


August <strong>2012</strong>. Gary’s previous Chair appointments<br />

include Chair of the Social Benefi ts Tribunal in<br />

2009, Alternate Executive Chair of the Social<br />

Justice Tribunals Ontario in 2011, and Chair of<br />

the Board of Inquiry that heard public complaints<br />

regarding police misconduct (1993 to 1998). Gary<br />

was Co-Chair of the 2011 Council of Canadian<br />

Administrative Tribunals (CCAT) <strong>Conference</strong>, and<br />

he currently sits on the CCAT Board of Directors.<br />

In the 1990s, he was on the Board of the Society<br />

of Ontario Adjudicators and Regulators (SOAR),<br />

including two years as the Vice-President. Gary’s<br />

other past positions include: founding executive<br />

director of the Metro Toronto Chinese & Southeast<br />

<strong>Asian</strong> Legal Clinic (1987 to 1992), manager<br />

of legal services at the Ombudsman of Ontario<br />

(1992 to 1993) and Special Advisor to the Deputy<br />

Chairperson for the Immigration Appeal Division<br />

of the Immigration and Refugee Board (1999 to<br />

2009).<br />

Gary’s volunteer background includes his position<br />

as <strong>National</strong> President of the Chinese Canadian<br />

<strong>National</strong> Council (CCNC) from 1987 to 1991. He<br />

also served on the Equity Advisory Group of the<br />

Law Society of Upper Canada from 2000 to 2006,<br />

and on the Board of Directors of the Federation<br />

of <strong>Asian</strong> Canadian Lawyers (<strong>FACL</strong>) from 2007<br />

to 2009. In 1999, Gary received the SOAR Medal<br />

for his contribution to Ontario’s administrative<br />

justice system. His other honours include Head<br />

of the Public Service Award (Canada) in 2003,<br />

the Golden Jubilee Medal in 2002, and the 125th<br />

Anniversary Confederation Medal in 1992.<br />

Path to Successful Career on Bay Street<br />

constance L. Sugiyama<br />

Constance L. Sugiyama is the Vice Chair of<br />

Canada Health Infoway and was the first<br />

woman Chair of the Hospital for Sick Children.<br />

Recognized over her 35 year career on Bay<br />

Street as a leading Canadian corporate and<br />

mergers and acquisitions lawyer, Constance<br />

has held leadership positions in several major<br />

law firms, most recently as Deputy Chair and<br />

partner of Fraser Milner Casgrain LLP. She<br />

has also been recognized for professional<br />

excellence and leadership by Women in Capital<br />

Markets (2009), International Alliance for<br />

Raj Anand is a partner and an arbitrator and<br />

Jeffrey W. Lem, a partner in the real estate<br />

group in the Toronto/Markham offices of<br />

Miller Thomson LLP, received his B.Comm.<br />

from the University of Toronto in 1984, a J.D.<br />

from the Osgoode Hall Law School in 1987, and<br />

an LL.M. from the Osgoode Hall Law School<br />

in 2002. He was called to the Ontario Bar in<br />

1989 and admitted to the rolls as a solicitor in<br />

Abdul-Basit Khan is a graduate of McGill<br />

Victor Lee<br />

Victor Lee, B.A., B.Sc., LL.B., FLMI, ACS,<br />

AIRC is a member of the Manitoba Bar and<br />

has worked in the insurance industry for over<br />

20 years. Victor manages Compliance for the<br />

group insurance divisions of Great-West Life<br />

and Canada Life, focusing on Compliance,<br />

Legislation, Tax, Privacy, and federal Industrial<br />

Jeffrey Fung is the Founder of MyLawBid (www.<br />

IMMANUEL F. LANZADERAS<br />

IMMANUEL F. LANZADERAS was called to<br />

the bar in 2009. He is a graduate of Queen’s<br />

Faculty of Law, where he was involved with the<br />

Society of <strong>Asian</strong>s in Law, the Equity Committee,<br />

and helped to organise the Paths Less Travelled<br />

<strong>Conference</strong> for non-traditional legal careers. He<br />

is a founding member of <strong>FACL</strong>, and a former<br />

board member. Part of his work with <strong>FACL</strong><br />

involved planning major fundraising events,<br />

writing policy statements, and helping to start<br />

Nicole Suen Phillips<br />

Nicole Suen Phillips is Counsel and Project<br />

Manager – Underwriting at Stewart Title<br />

Guaranty Company in Toronto. In her role,<br />

Nicole assesses transactions exhibiting indicia<br />

of fraud, analyzes title and off-title issues<br />

for commercial and residential real estate<br />

transactions, drafts underwriting, and acts as<br />

a legal subject matter expert to other internal<br />

stakeholders. Nicole graduated with an HBA<br />

from the Richard Ivey School of Business at the<br />

University of Western Ontario and LL.B. from<br />

Osgoode Hall Law School. She was admitted<br />

Lai-King Hum<br />

Lai-King Hum is licensed to practice in both<br />

Ontario and Quebec. She holds a law degree<br />

and D.Ed from McGill University and a B.A.<br />

in liberal arts from Concordia University. Lai<br />

joined McMillan LLP in 2007 and has worked<br />

for prominent national and boutique firms<br />

in both Montreal and Toronto. Lai practices<br />

primarily in management side employment<br />

and labour law, including providing advice on<br />

employment and labour aspects of mergers<br />

and acquisitions, and other corporate reorganizations.<br />

Avvy Go<br />

Avvy Go is the Clinic Director of Metro Toronto<br />

Chinese & Southeast <strong>Asian</strong> Legal Clinic. She<br />

received her B.A. in economics and management<br />

studies from the University of Waterloo, LL.B.<br />

from the University of Toronto, and LL.M. from<br />

Osgoode Hall Law School. Since her call to the<br />

Bar in 1991, she has worked exclusively in the<br />

legal clinic system, serving the legal needs of low<br />

income individuals and families, the majority<br />

of who are non-English speaking immigrants<br />

and refugees. Between 2001 and 2003, she was<br />

Renu Mandhane<br />

Renu Mandhane, B.A. (Queen’s), JD (Toronto),<br />

LL.M. (NYU) is the Director of the International<br />

Human Rights <strong>Program</strong>, including its awardwinning<br />

legal clinic, at the University of<br />

Toronto, Faculty of Law. Renu graduated from<br />

the Faculty with a J.D., articled at Torys LLP<br />

in Toronto, and completed her LL.M. at New<br />

York University with a focus on international<br />

human rights law. In addition to publishing in<br />

the area, Renu is the co-chair of the Advocacy<br />

Committee of Human Rights Watch Canada,<br />

and has worked at a number of domestic<br />

and international organizations focused on<br />

advancing women’s human rights, including the<br />

Centre for Reproductive Rights in New York.<br />

Renu is a recognized expert on international<br />

human rights law and has trained Canadian<br />

and foreign judges through the <strong>National</strong><br />

Judicial Institute of Canada. Prior to joining the<br />

Faculty, Renu practiced criminal law from an<br />

equality rights perspective for approximately<br />

four years and routinely represented survivors<br />

of domestic and sexual violence, as well as<br />

federally-sentenced prisoners. Most recently,<br />

Renu was an Assistant Dean at the Faculty and<br />

worked extensively on the review of the first year<br />

curriculum<br />

Gerald Chan<br />

Gerald Chan practises criminal, constitutional<br />

and administrative law with a particular<br />

interest in appellate advocacy. Gerald graduated<br />

from Osgoode Hall Law School with the Gold<br />

Medal. Prior to joining Clayton Ruby’s office in<br />

2008, he clerked for the Honourable Rosalie<br />

Silberman Abella at the Supreme Court of<br />

Canada and practised commercial litigation<br />

with Goodmans LLP. He regularly defends<br />

clients charged with wrongdoing under the<br />

Criminal Code (e.g., fraud, sexual offences),<br />

Controlled Drugs and Substances Act (e.g.,<br />

trafficking), Extradition Act, and professional<br />

disciplinary and other regulatory regimes.<br />

Gerald also represents clients on judicial<br />

reviews of government decision-making and<br />

constitutional challenges to legislation. He has<br />

argued before administrative tribunals, every<br />

level of court in Ontario, and the Supreme Court<br />

of Canada. Gerald graduated from Osgoode<br />

Hall Law School with the Gold Medal. Prior to<br />

Archana SRIDHAR<br />

Archana Sridhar is Assistant Provost in the<br />

Office of the Vice-President & Provost at the<br />

University of Toronto. She received her Juris<br />

Doctor (JD) degree from Harvard Law School<br />

and received a Fulbright Scholarship to study<br />

in Guatemala. She has published several peerreviewed<br />

articles and policy reports, and is also<br />

co-founder of The South <strong>Asian</strong> Philanthropy<br />

Project, a charitable organization which fosters<br />

philanthropy among South <strong>Asian</strong>s in North<br />

Fidelia Hung<br />

Fidelia Hung is a sole practitioner practising in<br />

Amer Mushtaq is an employment and human<br />

ALICIA S. NATIVIDAD<br />

Alicia S. Natividad is the first female Filipino-<br />

Canadian lawyer to practice law in Canada. Alicia<br />

holds a B.A. from Carleton University and an<br />

of the Ontario Bar since 1983, Alicia was a partner<br />

with a national law firm in Ottawa before<br />

CATERINA GALATI<br />

Caterina Galati joined the Law Society of Upper<br />

Canada in 2000 and practised law in Toronto from<br />

1983 to 2000. She received her Honours B.A. from<br />

the University of Toronto in 1978, her LL.B. from<br />

Osgoode Hall Law School in 1981 and was called<br />

to the Bar in 1983. She is involved in a number of<br />

HENRY J. CHANG<br />

Henry J. Chang is a partner at Blaney McMurtry<br />

Jacqueline is the President of Korean Women’s<br />

ROSLYN M. TSAO<br />

Roslyn M. Tsao is a partner at Epstein Cole and<br />

Roslyn holds an LLB from the University of<br />

Jonathan Lau<br />

Jonathan Lau is currently Senior Legal Counsel at<br />

media organization for mobile, on-line and television<br />

content. He is a graduate of Osgoode Hall Law<br />

School and completed his LL.M. at Stockholm<br />

University (Sweden). Jonathan’s practice touches<br />

Jin Hwang<br />

is Staff Counsel in Morristown, New Jersey<br />

for Verizon Wireless, an American technology<br />

company serving over 95 million U.S. retail<br />

customers. Jin provides guidance to Verizon<br />

Wireless’ Northeast Area, comprised of fifteen<br />

states from Maine to North Carolina and as<br />

far west as West Virginia, and as such, is a<br />

generalist with experience and expertise in a<br />

wide array of fields. Before Verizon Wireless,<br />

Jin worked in-house at France Télécom in its<br />

Washington, D.C. office. Jin is very active in<br />

various bar associations. Jin will be completing<br />

her two-year term as one of the Northeast<br />

Regional Governors for the <strong>National</strong> <strong>Asian</strong><br />

<strong>Pacific</strong> American Bar Association (NAPABA).<br />

She has been elected as NAPABA’s Vice<br />

Julie Wong Barker<br />

Julie Wong Barker graduated with distinction<br />

from the LLB/BCL program at McGill University<br />

and was called to the Ontario bar in 2007. She<br />

earned her M.A. while on a Commonwealth<br />

Scholarship in Mysore, India, and she earned<br />

her B.A. Hon. in English Literature from the<br />

University of British Columbia. Julie summered<br />

and articled at Davis LLP in Toronto and<br />

interned at a commercial litigation boutique<br />

in Paris, France. She joined Cassels Brock &<br />

Blackwell LLP as a Financial Services associate<br />

in 2007 after which she was seconded to the<br />

Independent Electricity System Operator<br />

(IESO). In 2011, Julie became Bilingual Senior<br />

Legal Counsel with MTS Allstream, one of<br />

Canada’s leading national telecommunications<br />

providers. Julie’s in-house practice covers a<br />

broad range of areas including: corporate and<br />

commercial law, competition, employment<br />

& labour, intellectual property, disputes, real<br />

estate & municipal law, and technology. She<br />

also supports the Health & Safety Committee.<br />

She earned her M.A. while on a Commonwealth<br />

Scholarship in Mysore, India, and she earned<br />

her B.A. Hon. in English Literature from the<br />

Will w. Chang<br />

Will W. Chang has practiced commercial law<br />

for 14 years. He spent the first 6 years of his<br />

legal career at large firms – first Gowlings,<br />

then McMillan – before moving in-house. His<br />

in-house roles have included General Counsel<br />

at Thomas Cook, Head of Legal at Air Transat<br />

and, currently, VP General Counsel at Granite<br />

Global Solutions, a Canadian portfolio company<br />

for a U.S. private equity firm, having 7 lines of<br />

business in various sectors of the insurance,<br />

health and risk mitigation industries. Will uses<br />

a number of external law firms regularly, mostly<br />

for M&A but also for litigation, employment law,<br />

tax, securities and corporate maintenance. Will<br />

was named one of “Toronto’s Top Ten Heroes”<br />

by Now Magazine and one of Canada’s “Top<br />

20 Catalysts For Change In Entertainment”<br />

by The Toronto Star. At age 24, Will became<br />

the youngest ever instructor at Osgoode Hall<br />

Law School, where he is currently an Adjunct<br />

Professor. Will enjoys pro bono work, has been a<br />

leading activist for a variety of causes and sits on<br />

the Board of Directors of FoodShare.


Tips, Tricks, and Traps<br />

CAROLYN J. CHAMBERS<br />

Carolyn J. Chambers graduated from the<br />

John Molson School of Business at Concordia<br />

University in 2003 with a B.Comm. in<br />

Marketing. She received her LL.L. (Civil Law)<br />

in 2007 and her LL.B. (Common Law) in 2008<br />

from the <strong>National</strong> <strong>Program</strong> at the University<br />

of Ottawa. She also graduated from Osgoode<br />

Hall, York University in <strong>2012</strong> with an LL.M. in<br />

Family Law. She was called to the Ontario Bar in<br />

2009, and is currently practicing family law with<br />

Gelman & Associates. Working with diverse<br />

clients is one of the things Carolyn enjoys most<br />

about her work in family law. She especially<br />

enjoys helping clients with issues involving<br />

culture and diversity.<br />

Justice Mavin Wong<br />

Justice Mavin Wong graduated from Osgoode<br />

Hall Law School in 1984 and was called to the<br />

Bar in Ontario in 1986. While at law school she<br />

was President of the Legal and Literary Society<br />

and a division leader at CLASP (student run<br />

legal aid clinic). During her years as a defence<br />

lawyer, Justice Wong was particularly interested<br />

in youth justice and she addressed the topic on<br />

many panels and committees. She co-authored<br />

the book on Young Offender Law with Justice<br />

Brian Weagant, and she continues to have a<br />

particular interest in this area.<br />

In June 2000, Justice Wong was appointed to<br />

the Ontario Court of Justice. She has spoken at<br />

programs sponsored by Law Society of Upper<br />

Canada, Canadian Bar Association, Osgoode<br />

Hall Professional Development <strong>Program</strong>, and<br />

the Criminal Lawyers Association. She has also<br />

been a presenter on numerous Ontario Court<br />

of Justice education programs. Most recently,<br />

Justice Wong served as the Ontario Court of<br />

Justice represented on the Board of Directors of<br />

the Ontario Justice Education Network (OJEN)<br />

and the Chair of the Toronto OJEN Committee.<br />

Currently, Justice Wong is the <strong>Conference</strong> Chair<br />

for the Ontario <strong>Conference</strong> of Justice.<br />

For the past ten years, Justice Wong presided<br />

as a criminal court judge in Metro East Court<br />

in Toronto (Scarborough), but transferred to<br />

College Park Court in August <strong>2012</strong>.<br />

Justice Wong has been an active member of the<br />

<strong>FACL</strong> since its inception and is always happy to<br />

mentor young lawyers. In May <strong>2012</strong>, Justice<br />

Wong was honoured as a “Local Hero” during<br />

the <strong>Asian</strong> Heritage Month poster campaign.<br />

Benjamin Na<br />

Benjamin Na is a partner in Gowlings’ Toronto<br />

office, practising in the area of advocacy. His<br />

practice focuses on commercial litigation with<br />

an emphasis on directors’ and officers’ liability;<br />

brokers’ liability; shareholder, partnership<br />

and cross-border disputes; and civil fraud and<br />

banking disputes. Benjamin has appeared<br />

before all levels of the court in Ontario and has<br />

appeared as counsel before the Federal Court,<br />

the U.S. Bankruptcy Court, the U.S. District<br />

Court and various administrative tribunals.<br />

Benjamin’s practice includes commencing and<br />

responding to injunctions, oppression actions<br />

and derivative applications in connection<br />

with claims regarding negligence, breach of<br />

contract, breach of fiduciary duty and corporate<br />

governance issues. He has acted for investment<br />

advisers and brokerage firms involving the<br />

governance of the brokerage and investment<br />

industry, including licensing and investigation<br />

issues, duties and obligations of advisers and<br />

compliance officers as well as mediation,<br />

arbitration, disciplinary and compliance<br />

hearings. Benjamin also acts on behalf of<br />

financial institutions and commercial lenders<br />

pursuing various types of injunctive relief and<br />

the recovery of assets and loans related to fraud<br />

and auditors’ negligence matters.


ian Hu<br />

Ian Hu was born in Hong Kong and grew<br />

up in Toronto. After completing a Master’s<br />

degree in philosophy at the University of<br />

Toronto, Ian obtained his J.D. from Osgoode<br />

Hall Law School, where he was the Pro<br />

Bono Students Canada coordinator. As a<br />

law student he also participated at Parkdale<br />

Community Legal Services in the Worker’s<br />

Rights Group. Specializing in personal injury<br />

law, Ian only represents those who have<br />

been seriously injured. Ian is committed to<br />

advocating on behalf of the <strong>Asian</strong> Canadian<br />

community. As a Mandarin and Cantonese<br />

speaker he is proud to contribute to both his<br />

profession and his community. Ian enjoys<br />

snowboarding, sailing, and cross country<br />

skiing. He plays basketball but he can’t jump<br />

very high.<br />

Daniel Wong<br />

Daniel Wong advises employers on all<br />

aspects of employment and labour relations<br />

including employee hiring and terminations,<br />

employment standards compliance, unfair<br />

practice and human rights complaints and<br />

the development and execution of initiatives<br />

and policies. He represents employers<br />

before the courts on wrongful dismissal and<br />

provincial offence matters, and before various<br />

administrative tribunals on rights arbitration,<br />

employment standards issues, human rights<br />

complaints, occupational health and safety<br />

investigations and workers’ compensation<br />

appeals. Daniel also conducts HR and<br />

employment audits on behalf of employers<br />

to ensure compliance with applicable laws<br />

and employer best practices. Prior to joining<br />

Osler, Daniel articled and practiced at a large<br />

management-side boutique firm and was also<br />

Employment Counsel and Privacy Manager<br />

at McDonald’s Restaurants of Canada. He<br />

is a presenter at conferences and training<br />

seminars, and has also delivered guest<br />

lectures at York University in the areas of<br />

employment and labour law. Daniel is also a<br />

member of the Board of Directors for the Yee<br />

Hong Centre for Geriatric Care.<br />

Justice Net<br />

JusticeNet is a federally incorporated not-forprofit<br />

organization designed to complement<br />

the more targeted legal aid and pro bono law<br />

programs. Participating lawyers offer their<br />

services to qualifying clients based on a sliding<br />

scale that adjusts for a client’s net family income<br />

and number of dependents. The service is open<br />

to all inquirers earning a net household income<br />

of $59,000 or less. Potential clients connect with<br />

registered lawyers by searching the JusticeNet<br />

website or the call centre. Each lawyer listing<br />

includes the lawyer’s personal profile page<br />

and his or her practice specialization. The<br />

acceptance of any given reduced fee application,<br />

as well as the total number of cases, remains at<br />

the discretion of each participating lawyer. The<br />

program facilitates but does not interfere with<br />

the solicitor-client relationship. To be eligible<br />

DiverseCity onBoard<br />

DiverseCity onBoard is part of DiverseCity: The<br />

Greater Toronto Leadership Project, a joint<br />

initiative of Maytree and the Greater Toronto<br />

CivicAction Alliance. It connects qualified<br />

candidates from visible minority and underrepresented<br />

immigrant communities to the<br />

governance bodies of agencies, boards and<br />

commissions and voluntary organizations in<br />

the Greater Toronto Area (GTA). We work with<br />

public institutions and voluntary organizations<br />

to change the face of the region’s leadership by<br />

promoting board recruitment and appointment<br />

processes that reflect the GTA’s diverse<br />

population.<br />

We do this for reasons of inclusion. As the<br />

demographic profile of the GTA changes, public<br />

and voluntary institutions must reflect the<br />

lives and experiences of this new demographic.<br />

Diversity at the board table ensures that<br />

institutional leadership is responsive to the<br />

needs of newer residents. Further, diversity of<br />

thinking and perspectives leads to innovation,<br />

new solutions and improved organizational<br />

performance.<br />

Good practice in board governance includes<br />

finding the right people to lead. In a city region<br />

as diverse as ours, this involves embracing<br />

the full spectrum of skills, experiences and<br />

connections available. Capitalizing on our<br />

immense talent pool is an imperative for today’s<br />

nonprofit and public boards.<br />

DiverseCity onBoard helps public institutions<br />

embrace diversity as a core value of a shared<br />

society while connecting them to the talent they<br />

need for competitive growth, sustainability, and<br />

shared prosperity. It offers a proactive matching


service that identifies, trains and facilitates<br />

placements of highly qualified candidates in<br />

board roles in public and nonprofit agencies,<br />

boards and commissions.<br />

In just six years, DiverseCity onBoard has<br />

facilitated the appointment of over 600<br />

individuals to a variety of public, non-profit and<br />

other organizational boards. Additionally, over<br />

600 organizations and over 1,500 pre-screened<br />

qualified candidates from visible minority<br />

and immigrant groups are registered on its<br />

searchable database.<br />

NAAAP Toronto<br />

NAAAP (North American Association of<br />

<strong>Asian</strong> Professionals) Toronto is a not for<br />

profit volunteered-based association which<br />

aims to provide Pan <strong>Asian</strong> professionals with<br />

a forum to cultivate leadership, professional<br />

development and workplace diversity. As an<br />

integral Canadian Chapter in an International<br />

organization, NAAAP (<strong>National</strong> Association<br />

of <strong>Asian</strong> American Professionals) is uniquely<br />

positioned to leverage and mobilize the talents,<br />

inputs and resources of an <strong>Asian</strong> professional<br />

community that spans coast to coast,<br />

encompassing over 25 cities in Canada and the<br />

Ontario Justice<br />

Education Network<br />

Founded by Ontario’s three Chief Justices in<br />

2002, the Ontario Justice Education Network<br />

(OJEN) is a non-profit, charitable organization<br />

that brings together leading institutions and<br />

individuals from the legal and education sectors<br />

to collaborate on initiatives designed to foster<br />

public understanding of the justice system. With<br />

the commitment of hundreds of volunteers,<br />

including judges from all levels of the courts,<br />

members of the bar, the Crown Attorney’s<br />

office, court staff, legal aid clinics, law schools,<br />

teachers, and community representatives, OJEN<br />

reaches thousands of youth across the province<br />

each year.<br />

OJEN’s justice education outreach activity<br />

focuses on youth programming across Ontario<br />

in four distinct areas: newcomer, at-risk,<br />

francophone, and aboriginal communities.<br />

OJEN partners with several high schools and<br />

immigrant-serving organizations in Ontario to<br />

facilitate justice education programs that aim to<br />

acknowledge the pressures placed on newcomer<br />

youth who may have stronger language skills<br />

than their parents or relatives and are expected<br />

to translate and communicate legal information<br />

to their families. Activities are designed to<br />

counter negative stereotypes and focus on<br />

accurate legal information by directing students<br />

to local sources of reliable legal support in their<br />

communities.<br />

Pro Bono Law Ontario<br />

Pro Bono Law Ontario (PBLO) is the leading<br />

facilitator of pro bono legal services to Ontarians<br />

of limited means. It is a charitable organization<br />

that enhances access to justice in Ontario by<br />

creating and promoting opportunities for private<br />

lawyers to provide pro bono (free) legal services<br />

to low-income individuals and families, as well<br />

as the charitable organizations that serve them.<br />

PBLO designs pro bono projects and coordinates<br />

the pro bono efforts of law firms, in-house<br />

counsel, retired lawyers, law associations and<br />

government lawyers.<br />

PBLO projects focus on the unmet civil, nonfamily<br />

legal needs of Ontarians that are not<br />

covered by Legal Aid. The organization works<br />

with community-based partners to create<br />

responsive litigation or corporate pro bono<br />

projects, such as:<br />

• Court-based services for unrepresented<br />

litigants at Ontario’s Superior and Small<br />

Claims courts;<br />

• Representation for children and youth<br />

facing school rights challenges;<br />

• Assistance for individuals with appeals<br />

at the Ontario Court of Appeal, the<br />

Federal Court of Appeal or Divisional<br />

Court;<br />

• Corporate legal services for nonprofits<br />

<strong>FACL</strong> Mentorship<br />

Committee<br />

One of the goals of <strong>FACL</strong> is to promote the<br />

professional development of its members.<br />

As such, <strong>FACL</strong> has established a Mentoring<br />

<strong>Program</strong>, targeted towards law students<br />

currently attending law school, those currently<br />

in their articling year, and recent calls to the<br />

Bar. The goal of this program is to provide<br />

an opportunity for law students and recent calls<br />

to talk to mentors to consider potential career<br />

paths and to encourage lawyers and jurists to<br />

interact with members of the legal community<br />

by acting as mentors and role models.<br />

Mentees can benefit from opportunities to<br />

develop and learn about practice areas of<br />

interest, and mentors will be able to develop<br />

leadership and communication skills, while<br />

participating in shared learning with their<br />

mentee. The Mentoring <strong>Program</strong> also provides<br />

<strong>FACL</strong> mentors with an opportunity to make a<br />

positive impact on a new generation of lawyers<br />

and to help their respective communities by<br />

promoting better representation in the legal<br />

profession.<br />

<strong>FACL</strong> Mentorship Committee<br />

The Mentorship Committee had a very<br />

successful re-launch of its <strong>Program</strong>, earlier this<br />

year in January. The Committee would like to<br />

continue this tradition, and is looking forward to<br />

organizing another successful mentorship event<br />

in January, 2013.<br />

As the <strong>FACL</strong> Mentorship <strong>Program</strong> continues<br />

to grow, we will focus on reaching out to other<br />

members of the legal community. Specifically,<br />

the Committee would like to help recruit foreign<br />

trained lawyers and provide mentoring to these<br />

individuals. Hopefully, the <strong>FACL</strong> Mentorship<br />

<strong>Program</strong> can assist them in their re-licensing<br />

and accreditation process.<br />

The formal mentoring period will run from<br />

February to October. However, a mentoring<br />

pair may agree to continue with their mentoring<br />

relationship after the formal nine month period<br />

has expired.<br />
