(Suspension)<br />
On March 22, <strong>2012</strong>, the <strong>Idaho</strong> Supreme<br />
Court issued a Disciplinary Order<br />
suspending former Coeur d’Alene attorney,<br />
Shawn C. Nunley, from the practice<br />
of law for a period of three years.<br />
<strong>The</strong> <strong>Idaho</strong> Supreme Court found<br />
that Mr. Nunley violated I.R.P.C. 3.4(c)<br />
[Knowingly disobeying rules of a tribunal],<br />
8.4(b) [Commission of a criminal<br />
act that reflects adversely on the lawyer’s<br />
honesty, trustworthiness or fitness as a<br />
lawyer], 8.4(d) [Conduct prejudicial to<br />
the administration of justice] and I.B.C.R.<br />
505(b) [Conviction of a serious crime].<br />
<strong>The</strong> <strong>Idaho</strong> Supreme Court’s Disciplinary<br />
Order followed a stipulated resolution<br />
of an <strong>Idaho</strong> <strong>State</strong> <strong>Bar</strong> disciplinary<br />
proceeding in which Mr. Nunley admitted<br />
that he violated the <strong>Idaho</strong> Rules of Professional<br />
Conduct set forth in the preceding<br />
paragraph.<br />
<strong>The</strong> Complaint filed in this proceeding<br />
related to Mr. Nunley’s violation of<br />
the terms of his criminal probation. In<br />
Order to cancel license to practice law for<br />
non-payment of <strong>2012</strong> license fees<br />
<strong>The</strong> Commissioners of the <strong>Idaho</strong> <strong>State</strong> <strong>Bar</strong> by and through<br />
their Executive Director have filed with the Clerk of this Court<br />
evidence that the following named attorneys have not paid the<br />
<strong>2012</strong> <strong>Idaho</strong> <strong>State</strong> <strong>Bar</strong> license fees required by Section 3-409,<br />
<strong>Idaho</strong> Code, and have not given notice of withdrawal from the<br />
practice of law to the <strong>Idaho</strong> <strong>State</strong> <strong>Bar</strong> and this Court;<br />
NOW, THEREFORE, IT HEREBY IS ORDERED that the<br />
LICENSE TO PRACTICE LAW IN THE STATE OF IDAHO of<br />
the following named persons be, and hereby is, CANCELLED,<br />
and said persons are placed on INACTIVE STATUS FOR FAIL-<br />
URE TO PAY THE <strong>2012</strong> IDAHO STATE BAR LICENSE<br />

DISCIPLINE<br />
October 2010, Mr. Nunley was convicted<br />
of felony possession of a controlled substance.<br />
Following a period of retained<br />
jurisdiction, he was placed on supervised<br />
probation for four years. Mr. Nunley’s<br />
felony conviction resulted in a disciplinary<br />
action and the suspension of his license to<br />
practice law for a period of three years,<br />
with two years withheld, followed by<br />
four-year probation upon reinstatement.<br />
Mr. Nunley did not seek reinstatement<br />
and remains suspended. In <strong>May</strong> 2011,<br />
Mr. Nunley violated his criminal probation<br />
by consuming alcoholic beverages<br />
and leaving <strong>Idaho</strong> without written permission<br />
from his probation officer. In August<br />
2011, his criminal sentence was imposed.<br />
<strong>The</strong> three-year suspension imposed in this<br />
matter is in addition to Mr. Nunley’s previous<br />
suspension and requires that he serve<br />
a four-year probation upon reinstatement,<br />
