A Word from the Dean<br />
The “tag line”<br />
for <strong>Cumberland</strong> is “…where good<br />
people become exceptional lawyers.”<br />
That, in a nutshell, is our mission.<br />
To make that concept a reality, we<br />
have accumulated, I believe, the<br />
finest faculty, staff and student in the<br />
country. Everyone works hard and for<br />
the same goal, providing quality legal<br />
education to tomorrow’s leaders.<br />
In The <strong>Cumberland</strong> <strong>Law</strong>yer we<br />
try to focus on a few <strong>of</strong> the truly<br />
outstanding alumni who practice and<br />
serve all across this great country <strong>of</strong><br />
ours. Their stories are interesting, but<br />
their influence in their communities,<br />
and impact on the legal system are<br />
remarkable. I invite you to read your<br />
alumni magazine regularly and let us<br />
know about others we might feature.<br />
This report is more personal. It is<br />
about what you and hundreds <strong>of</strong><br />
your fellow alumni have given and<br />
committed to this law school to<br />
make it possible to train “exceptional<br />
lawyers.” Note the new funds<br />
that have been created by your<br />
colleagues; the varieties <strong>of</strong> planned<br />
gifts which have become realities this<br />
year; and the consistent support our<br />
alumni have provided that has moved<br />
the endowment <strong>of</strong> the law school to<br />
almost $20 million.<br />
One <strong>of</strong> the most remarkable events<br />
<strong>of</strong> the year was the funding <strong>of</strong><br />
Brewer Plaza, which is featured on<br />
page 6. Conceived and executed by<br />
the <strong>Law</strong> <strong>School</strong> Advisory Board, this<br />

project raised over $650,000 in gifts and pledges in less than<br />
six months. That kind <strong>of</strong> drive and commitment deserves<br />
recognition. Our hats are <strong>of</strong>f to Scott Powell ’78, Bob<br />
MacKenzie ’84 and Mark White ’74 for inviting the legal<br />
and corporate community as well as alumni and friends to<br />
participate in this tribute to Gov. and Mrs. Brewer.<br />
This report covers the period from June 1, <strong>2007</strong> through<br />
June 30, <strong>2008</strong>. Many important gifts have come to the law<br />
school since July 1, <strong>2008</strong> and these will be reported next Fall.<br />
Our faculty have a vital role in achieving our mission. Their<br />
vitality in the classroom and diligence in scholarly research<br />
are recognized with teaching and research awards. The<br />
Harvey Jackson Award for Excellence in Teaching paid<br />
tribute to Beth Burch and Brannon Denning at the Alumni<br />
Weekend Gala in April. At the same event, Bill Ross, Beth<br />
Burch and Marcia McCormack received the Lightfoot,<br />
Franklin & White Faculty Scholarship Award. Appreciation<br />
for the work <strong>of</strong> our faculty reach far beyond the Georgian<br />
Colonial halls <strong>of</strong> <strong>Samford</strong> University. This past year our faculty<br />
spoke and led conferences in Europe, Africa, Asia and South<br />
America in addition to a variety <strong>of</strong> engagements throughout<br />
the country. Two faculty were on leave for half a year while<br />
serving as Fulbright Scholars in China and the Ukraine.<br />
Sixteen Faculty members received summer research grants<br />
which enabled them to write articles and generate new<br />
courses which benefit the reputation <strong>of</strong> <strong>Cumberland</strong> in the<br />
larger academic community.<br />
Finally, the students excelled in leadership and commitment<br />
to service. Eddie Koen served as the President <strong>of</strong> the<br />
National Black <strong>Law</strong> Student Association and three other<br />
<strong>Cumberland</strong> students were on the Board. Sigfredo Rubio<br />
was recognized by the Alabama State Bar for his community<br />
service and received the Alabama State Bar Student Pro<br />
Bono Award. <strong>Cumberland</strong>’s Community Service Organization<br />
was a finalist for Hands on Birmingham’s Organization<br />
<strong>of</strong> the Year. As a finalist, this organization is a team that<br />
has demonstrated a strong commitment to service in the<br />
community throughout the year. During the <strong>2007</strong>-<strong>2008</strong><br />
academic year, <strong>Cumberland</strong>’s Community Service Organization<br />
served in many different projects including: Public Interest Day<br />
as part <strong>of</strong> Orientation, Habitat for Humanity, MLK project, Puppy<br />
Walk, Spring Festival, Wills for Heroes, Public Interest Career Fair,<br />
and other projects as well. Thirty-six students spent their summer<br />
working in non-pr<strong>of</strong>it, governmental and judicial position as a part<br />
<strong>of</strong> the Public Interest Stipend program. Funding from alumni made<br />
the stipends possible.<br />
The <strong>2007</strong>-<strong>2008</strong> <strong>Cumberland</strong> trial and moot court<br />
teams were the most successful in the school’s<br />
history. From the regional to the national level,<br />
<strong>Cumberland</strong> made its mark in the competition<br />
arena. The trial team took first place at<br />
the American Association <strong>of</strong> Justice (AAJ)<br />
<strong>2008</strong> Student Trial Advocacy Competition<br />
(STAC) which was held April 3-6 in West<br />
Palm Beach, Fla. Led by coach Michael V.<br />
Rasmussen, the championship team beat<br />
out over 200 participating teams to garner<br />
the national title. <strong>Cumberland</strong> trial teams<br />
also won on the regional level <strong>of</strong> the AAJ<br />
taking both First and Second place. The<br />
Criminal Justice Trial Advocacy Competition<br />
also named the <strong>Cumberland</strong> team First<br />
Place Winner and awarded a <strong>Cumberland</strong><br />
student Best Individual Cross Examination.<br />
At the Lone Star Classic Mock Trial<br />
Competition, the <strong>Cumberland</strong> team won<br />
First Place and Overall Best Advocate. The<br />
American Bar Association’s (ABA) National<br />
Arbitration Competition named <strong>Cumberland</strong><br />
Regional Finalist and the ABA National Client<br />
Counseling Competition named<br />
<strong>Cumberland</strong> Regional Winner.<br />
It was a very good year. I am proud <strong>of</strong> what<br />
we have accomplished together and look<br />
forward to reporting our successes again<br />
next Fall.<br />

Brewer Plaza Dedicated<br />
In October <strong>2007</strong>, the Advisory<br />
Board approved and undertook the task <strong>of</strong> raising<br />
funds to name the plaza in front <strong>of</strong> Robinson Hall for<br />
Gov. and Mrs. Albert P. Brewer. The effort raised over<br />
$650,000 in gifts and pledges to cover the cost <strong>of</strong><br />
additions to the plaza with the excess funds being<br />
added to the corpus <strong>of</strong> the Albert P. and Martha F.<br />
Brewer Scholarship in <strong>Law</strong>.<br />

the steering group for The Committee to Honor<br />
Gov. & Mrs. Brewer. The project concluded with<br />

<strong>Samford</strong> President Andrew Westmoreland participated in the dedication ceremony. Over 120 individuals,<br />
law firms, corporations and organizations contributed to the project.<br />
Dean John Carroll noted “this recognition <strong>of</strong> one <strong>of</strong> the great leaders <strong>of</strong> our state and the statesman <strong>of</strong><br />
the legal pr<strong>of</strong>ession is long overdue. We are honored to have this permanent reminder <strong>of</strong> the contributions<br />
Gov. and Mrs. Brewer have made to our state, the legal community and to this law school.”<br />

Davis Chair Filled<br />
In 2000, Elizabeth (Betty) Davis Eshelman ‘64 created a charitable remainder unitrust which<br />
provided income for her life and made possible the establishment <strong>of</strong> the Harwell G. Davis Chair in<br />
Constitutional <strong>Law</strong>. The Chair became a reality after the death <strong>of</strong> Ms. Eshelman in April <strong>2007</strong>.<br />
On October 10, <strong>2008</strong>, Pr<strong>of</strong>. David M. Smolin became the Harwell G. Davis Pr<strong>of</strong>essor <strong>of</strong> Constitutional <strong>Law</strong>.<br />
Pr<strong>of</strong>. Smolin was born in New York City, grew up in Cincinnati, Ohio, and graduated from New College <strong>of</strong><br />
the University <strong>of</strong> South Florida in 1980 with a degree in Applied Psychology. His thesis was The Stolen<br />
Child: A Case Study <strong>of</strong> an Emotionally-Troubled Child. Graduating first in his class at the University <strong>of</strong><br />
Cincinnati <strong>Law</strong> <strong>School</strong>, he was a member <strong>of</strong> the Order <strong>of</strong> the Coif, co-winner <strong>of</strong> the Norbert Heinsheimer<br />
Prize in Jurisprudence, a Fellow for the Urban Morgan Institute for Human Rights, on the editorial staff <strong>of</strong><br />
the Human Rights Quarterly, and a member <strong>of</strong> the University <strong>of</strong> Cincinnati <strong>Law</strong> Review. Upon graduation,<br />
Smolin clerked for The Honorable George Edwards, Senior Judge, United States Court <strong>of</strong> Appeals for the<br />
Sixth Circuit.<br />
Joining the faculty <strong>of</strong> the <strong>Cumberland</strong> <strong>School</strong> <strong>of</strong> <strong>Law</strong><br />
<strong>of</strong> <strong>Samford</strong> University in 1987, he was promoted to<br />
full pr<strong>of</strong>essor in 1993. His teaching areas include:<br />
Constitutional <strong>Law</strong>, International Human Rights, Family<br />
& Juvenile <strong>Law</strong>, Wills & Trusts, Intellectual Property,<br />
Bioethics, <strong>Law</strong> & Religion, and Criminal <strong>Law</strong>. He serves<br />
as Director <strong>of</strong> the Center for Biotechnology, <strong>Law</strong> and<br />
Ethics.<br />
Pr<strong>of</strong>essor Smolin has been the primary author/coauthor<br />
<strong>of</strong> amicus curiae briefs in significant Supreme<br />
Court cases. He has submitted written and/or<br />
oral testimony before two Congressional<br />
committees, and legislative committees<br />
in five states, on the constitutional<br />
implications <strong>of</strong> proposed<br />
legislation.<br />

William J. Peeler<br />
Advanced Advocacy Award Initiated<br />
Jeana P. Hosch ’86 initiated an endowed fund in the law school in honor and memory <strong>of</strong> her father,<br />
William J. Peeler ’52 <strong>of</strong> Waverly, Tennessee. A strong advocate <strong>of</strong> the legal system and our system <strong>of</strong><br />
justice, William Peeler spanned <strong>Cumberland</strong>’s history and tradition in Lebanon and Birmingham. The fund,<br />
which has received gifts from family and friends, recognizes the student showing outstanding ability and<br />
interest in trial advocacy as evidenced by performance in the Advanced Advocacy course or other trial<br />
advocacy course at <strong>Cumberland</strong>.<br />
McCallum, Methvin and Terrill, P.C.<br />
Scholarship Fund<br />
Phillip McCallum ’87, Robert Methvin ’94 and the law firm <strong>of</strong> McCallum, Methvin and Terrell, P.C. have<br />
created the first Enabling Fund at the law school. An Enabling Fund is a five year commitment <strong>of</strong> $5,000<br />
per year which enables the law school to provide program, services or financial assistance to students<br />
that would not otherwise be available. This fund provides assistance to students with demonstrated<br />
financial need.<br />

David Matthew McLain<br />
Memorial Scholarship Established<br />
Family and friends have established a memorial scholarship in memory <strong>of</strong> Matthew David McLain, a first<br />
year student tragically killed in April <strong>2008</strong>. A native <strong>of</strong> Huntsville, Matt graduated from Rhodes College<br />
with a major in English. His winning personality, creative nature and commitment to his fellow law<br />
students were evident in his brief tenure at the law school. The scholarship will be awarded to a rising<br />
second year student, with demonstrated financial needs and commitment to others.<br />
Crittenden Women In <strong>Law</strong><br />
Scholarship Grows<br />
Members <strong>of</strong> The Crittenden Firm presented Judith Crittenden ’70 with an<br />
unusual birthday present this year. They made contributions to the scholarship<br />
established in her name. The scholarship provides financial assistance to an<br />
outstanding second or third year female law student who is not receiving any<br />
other scholarship assistance. Demonstrated financial need may be considered<br />
in the decision.<br />
Lt. Wayne Morse USMC<br />
Book Scholarship Created<br />
Wayne Morse ’76 has established an endowed scholarship in honor <strong>of</strong> his father, Lt. Wayne Morse,<br />
USMC. The scholarship assists students at <strong>Cumberland</strong> who have served on active duty with the<br />
military or are currently active in a reserve or national guard unit. In addition to the initial endowment,<br />
Mr. Morse has included the book scholarship fund in his estate plan.<br />
Judge T. Virgil Pittman<br />
Scholarship Established<br />
Judge T. Virgil Pittman has established an endowed scholarship at the law school to assist second<br />
or third year students with demonstrated financial need. Additionally, Judge Pittman stipulated “the<br />
recipient shall have a deep desire to be a lawyer as demonstrated by his/her self-help approach to law<br />
school.”<br />
Judge Pittman serves as Senior United States District Judge. He is a former Trustee <strong>of</strong> <strong>Samford</strong><br />
University and parent <strong>of</strong> a <strong>Cumberland</strong> alumnus, Lee Pittman ’76 <strong>of</strong> Birmingham.<br />
Lightfoot, Franklin & White<br />
Scholarship Renewed<br />
Jere F. White ’80 has renewed the scholarship created in the firm’s name. Originally established in<br />
2002, in 2006 the firm added to the corpus <strong>of</strong> the fund and requested it be converted to an award<br />
recognizing faculty excellence in legal scholarship and writing. That fund provides cash awards to the<br />
junior and senior members <strong>of</strong> the faculty who have made the most significant contribution to legal<br />
research and scholarship through published books and articles.<br />
Convinced that financial assistance to high achieving students was in the best interest <strong>of</strong> <strong>Cumberland</strong>,<br />
Mr. White renewed his pledge to the The Lightfoot, Franklin & White Scholarship in <strong>Law</strong> as a way<br />
to retain outstanding second and third year students. For financial reasons, some exceptional students<br />
find it necessary to transfer to another law school. Retention scholarships such as this make it possible<br />
for <strong>Cumberland</strong> to recognize the academic achievements <strong>of</strong> our students in a tangible way. Dean<br />
Carroll notes “without such assistance, <strong>Cumberland</strong> could lose some <strong>of</strong> her most talented<br />
future lawyers.”<br />

Estate Gifts are Important<br />

Three planned gifts matured<br />
this year fulfilling the lifetime dreams<br />
and intentions <strong>of</strong> the donors. In 1979 Whelan<br />
W. and Rosalie T. Palmer created a Charitable<br />
Remainder Unitrust which was to eventually fund<br />
a Pr<strong>of</strong>essorship in Tax at the law school. The Trust<br />
provided income to the couple for both <strong>of</strong> their lives,<br />
then became the corpus for the Whelan W. and<br />
Rosalie T. Palmer Pr<strong>of</strong>essorship. Pr<strong>of</strong>. Joe Blackburn<br />
was named the Palmer Pr<strong>of</strong>essor <strong>of</strong> Tax.<br />
Frederick Schlichter established a scholarship in the law school<br />
which would be funded with the remainder <strong>of</strong> a trust he established<br />
at the university many years ago. The Frederick C. Schlichter<br />
Scholarship in <strong>Law</strong> now benefits students who have demonstrated<br />
financial need. The endowed scholarship will help students for<br />
generations to come.<br />
As mentioned elsewhere in this report, Betty Eshelman ’64 made<br />
provisions in her estate plan for a Chair in Constitutional <strong>Law</strong> to be<br />
established in her father’s honor at her death. The chair is now a<br />
reality and the law school and her students will always be indebted<br />
to her for the Harwell G. Davis Chair in Constitutional <strong>Law</strong>.<br />
Tom Jones ’66 <strong>of</strong> Huntsville, Alabama has developed an estate plan<br />
which will provide for his wife in the event <strong>of</strong> his death and then<br />
funds the Thomas L. and Shirley D. Jones Memorial Scholarship<br />
for <strong>Cumberland</strong> students who have served in the military or are<br />
active members <strong>of</strong> Reserve or National Guard components <strong>of</strong> the<br />
Armed Forces <strong>of</strong> the United States while in law school.<br />
Albert L. Shumaker ’65 <strong>of</strong> Centre, Alabama has created the Albert<br />
Leo and Miariam Anne Williamson Shumaker Charitable Remainder<br />
Unitrust which will fund the Albert L. Shumaker Scholarship.<br />
When funded, the scholarship may be used by the Dean <strong>of</strong> the<br />
<strong>Cumberland</strong> to grant financial assistance to any worthy student he/<br />
she may choose to assist.<br />
There are many ways you can create plans which will benefit you<br />
and your spouse for your lives and then benefit <strong>Cumberland</strong>, her<br />
faculty and students in perpetuity. If you are interested in knowing<br />
