A Word from the Dean
The “tag line”
for Cumberland is “…where good
people become exceptional lawyers.”
That, in a nutshell, is our mission.
To make that concept a reality, we
have accumulated, I believe, the
finest faculty, staff and student in the
country. Everyone works hard and for
the same goal, providing quality legal
education to tomorrow’s leaders.
In The Cumberland Lawyer we
try to focus on a few of the truly
outstanding alumni who practice and
serve all across this great country of
ours. Their stories are interesting, but
their influence in their communities,
and impact on the legal system are
remarkable. I invite you to read your
alumni magazine regularly and let us
know about others we might feature.
This report is more personal. It is
about what you and hundreds of
your fellow alumni have given and
committed to this law school to
make it possible to train “exceptional
lawyers.” Note the new funds
that have been created by your
colleagues; the varieties of planned
gifts which have become realities this
year; and the consistent support our
alumni have provided that has moved
the endowment of the law school to
almost $20 million.
One of the most remarkable events
of the year was the funding of
Brewer Plaza, which is featured on
page 6. Conceived and executed by
the Law School Advisory Board, this

project raised over $650,000 in gifts and pledges in less than
six months. That kind of drive and commitment deserves
recognition. Our hats are off to Scott Powell ’78, Bob
MacKenzie ’84 and Mark White ’74 for inviting the legal
and corporate community as well as alumni and friends to
participate in this tribute to Gov. and Mrs. Brewer.
This report covers the period from June 1, 2007 through
June 30, 2008. Many important gifts have come to the law
school since July 1, 2008 and these will be reported next Fall.
Our faculty have a vital role in achieving our mission. Their
vitality in the classroom and diligence in scholarly research
are recognized with teaching and research awards. The
Harvey Jackson Award for Excellence in Teaching paid
tribute to Beth Burch and Brannon Denning at the Alumni
Weekend Gala in April. At the same event, Bill Ross, Beth
Burch and Marcia McCormack received the Lightfoot,
Franklin & White Faculty Scholarship Award. Appreciation
for the work of our faculty reach far beyond the Georgian
Colonial halls of Samford University. This past year our faculty
spoke and led conferences in Europe, Africa, Asia and South
America in addition to a variety of engagements throughout
the country. Two faculty were on leave for half a year while
serving as Fulbright Scholars in China and the Ukraine.
Sixteen Faculty members received summer research grants
which enabled them to write articles and generate new
courses which benefit the reputation of Cumberland in the
larger academic community.
Finally, the students excelled in leadership and commitment
to service. Eddie Koen served as the President of the
National Black Law Student Association and three other
Cumberland students were on the Board. Sigfredo Rubio
was recognized by the Alabama State Bar for his community
service and received the Alabama State Bar Student Pro
Bono Award. Cumberland’s Community Service Organization
was a finalist for Hands on Birmingham’s Organization
of the Year. As a finalist, this organization is a team that
has demonstrated a strong commitment to service in the
community throughout the year. During the 2007-2008
academic year, Cumberland’s Community Service Organization
served in many different projects including: Public Interest Day
as part of Orientation, Habitat for Humanity, MLK project, Puppy
Walk, Spring Festival, Wills for Heroes, Public Interest Career Fair,
and other projects as well. Thirty-six students spent their summer
working in non-profit, governmental and judicial position as a part
of the Public Interest Stipend program. Funding from alumni made
the stipends possible.
The 2007-2008 Cumberland trial and moot court
teams were the most successful in the school’s
history. From the regional to the national level,
Cumberland made its mark in the competition
arena. The trial team took first place at
the American Association of Justice (AAJ)
2008 Student Trial Advocacy Competition
(STAC) which was held April 3-6 in West
Palm Beach, Fla. Led by coach Michael V.
Rasmussen, the championship team beat
out over 200 participating teams to garner
the national title. Cumberland trial teams
also won on the regional level of the AAJ
taking both First and Second place. The
Criminal Justice Trial Advocacy Competition
also named the Cumberland team First
Place Winner and awarded a Cumberland
student Best Individual Cross Examination.
At the Lone Star Classic Mock Trial
Competition, the Cumberland team won
First Place and Overall Best Advocate. The
American Bar Association’s (ABA) National
Arbitration Competition named Cumberland
Regional Finalist and the ABA National Client
Counseling Competition named
Cumberland Regional Winner.
It was a very good year. I am proud of what
we have accomplished together and look
forward to reporting our successes again
next Fall.

Brewer Plaza Dedicated
In October 2007, the Advisory
Board approved and undertook the task of raising
funds to name the plaza in front of Robinson Hall for
Gov. and Mrs. Albert P. Brewer. The effort raised over
$650,000 in gifts and pledges to cover the cost of
additions to the plaza with the excess funds being
added to the corpus of the Albert P. and Martha F.
Brewer Scholarship in Law.
Advisory Board Chairman Scott Powell ’78, Bob
MacKenzie ’84 and J. Mark White ’74 served as
the steering group for The Committee to Honor
Gov. & Mrs. Brewer. The project concluded with
a dedication of the Martha F. and Albert P. Brewer
Plaza during the April 4, 2008 meeting of the

Samford President Andrew Westmoreland participated in the dedication ceremony. Over 120 individuals,
law firms, corporations and organizations contributed to the project.
Dean John Carroll noted “this recognition of one of the great leaders of our state and the statesman of
the legal profession is long overdue. We are honored to have this permanent reminder of the contributions
Gov. and Mrs. Brewer have made to our state, the legal community and to this law school.”
Jere Beasley Jim Folsom, Jr.
Davis Chair Filled
In 2000, Elizabeth (Betty) Davis Eshelman ‘64 created a charitable remainder unitrust which
provided income for her life and made possible the establishment of the Harwell G. Davis Chair in
Constitutional Law. The Chair became a reality after the death of Ms. Eshelman in April 2007.
On October 10, 2008, Prof. David M. Smolin became the Harwell G. Davis Professor of Constitutional Law.
Prof. Smolin was born in New York City, grew up in Cincinnati, Ohio, and graduated from New College of
the University of South Florida in 1980 with a degree in Applied Psychology. His thesis was The Stolen
Child: A Case Study of an Emotionally-Troubled Child. Graduating first in his class at the University of
Cincinnati Law School, he was a member of the Order of the Coif, co-winner of the Norbert Heinsheimer
Prize in Jurisprudence, a Fellow for the Urban Morgan Institute for Human Rights, on the editorial staff of
the Human Rights Quarterly, and a member of the University of Cincinnati Law Review. Upon graduation,
Smolin clerked for The Honorable George Edwards, Senior Judge, United States Court of Appeals for the
Sixth Circuit.
Joining the faculty of the Cumberland School of Law
of Samford University in 1987, he was promoted to
full professor in 1993. His teaching areas include:
Constitutional Law, International Human Rights, Family
& Juvenile Law, Wills & Trusts, Intellectual Property,
Bioethics, Law & Religion, and Criminal Law. He serves
as Director of the Center for Biotechnology, Law and
Ethics.
Professor Smolin has been the primary author/coauthor
of amicus curiae briefs in significant Supreme
Court cases. He has submitted written and/or
oral testimony before two Congressional
committees, and legislative committees
in five states, on the constitutional
implications of proposed
legislation.

William J. Peeler
Advanced Advocacy Award Initiated
Jeana P. Hosch ’86 initiated an endowed fund in the law school in honor and memory of her father,
William J. Peeler ’52 of Waverly, Tennessee. A strong advocate of the legal system and our system of
justice, William Peeler spanned Cumberland’s history and tradition in Lebanon and Birmingham. The fund,
which has received gifts from family and friends, recognizes the student showing outstanding ability and
interest in trial advocacy as evidenced by performance in the Advanced Advocacy course or other trial
advocacy course at Cumberland.
McCallum, Methvin and Terrill, P.C.
Scholarship Fund
Phillip McCallum ’87, Robert Methvin ’94 and the law firm of McCallum, Methvin and Terrell, P.C. have
created the first Enabling Fund at the law school. An Enabling Fund is a five year commitment of $5,000
per year which enables the law school to provide program, services or financial assistance to students
that would not otherwise be available. This fund provides assistance to students with demonstrated
financial need.

David Matthew McLain
Memorial Scholarship Established
Family and friends have established a memorial scholarship in memory of Matthew David McLain, a first
year student tragically killed in April 2008. A native of Huntsville, Matt graduated from Rhodes College
with a major in English. His winning personality, creative nature and commitment to his fellow law
students were evident in his brief tenure at the law school. The scholarship will be awarded to a rising
second year student, with demonstrated financial needs and commitment to others.
Crittenden Women In Law
Scholarship Grows
Members of The Crittenden Firm presented Judith Crittenden ’70 with an
unusual birthday present this year. They made contributions to the scholarship
established in her name. The scholarship provides financial assistance to an
outstanding second or third year female law student who is not receiving any
other scholarship assistance. Demonstrated financial need may be considered
in the decision.
Lt. Wayne Morse USMC
Book Scholarship Created
Wayne Morse ’76 has established an endowed scholarship in honor of his father, Lt. Wayne Morse,
USMC. The scholarship assists students at Cumberland who have served on active duty with the
military or are currently active in a reserve or national guard unit. In addition to the initial endowment,
Mr. Morse has included the book scholarship fund in his estate plan.
Judge T. Virgil Pittman
Scholarship Established
Judge T. Virgil Pittman has established an endowed scholarship at the law school to assist second
or third year students with demonstrated financial need. Additionally, Judge Pittman stipulated “the
recipient shall have a deep desire to be a lawyer as demonstrated by his/her self-help approach to law
school.”
Judge Pittman serves as Senior United States District Judge. He is a former Trustee of Samford
University and parent of a Cumberland alumnus, Lee Pittman ’76 of Birmingham.
Lightfoot, Franklin & White
Scholarship Renewed
Jere F. White ’80 has renewed the scholarship created in the firm’s name. Originally established in
2002, in 2006 the firm added to the corpus of the fund and requested it be converted to an award
recognizing faculty excellence in legal scholarship and writing. That fund provides cash awards to the
junior and senior members of the faculty who have made the most significant contribution to legal
research and scholarship through published books and articles.
Convinced that financial assistance to high achieving students was in the best interest of Cumberland,
Mr. White renewed his pledge to the The Lightfoot, Franklin & White Scholarship in Law as a way
to retain outstanding second and third year students. For financial reasons, some exceptional students
find it necessary to transfer to another law school. Retention scholarships such as this make it possible
for Cumberland to recognize the academic achievements of our students in a tangible way. Dean
Carroll notes “without such assistance, Cumberland could lose some of her most talented
future lawyers.”

Estate Gifts are Important

Three planned gifts matured
this year fulfilling the lifetime dreams
and intentions of the donors. In 1979 Whelan
W. and Rosalie T. Palmer created a Charitable
Remainder Unitrust which was to eventually fund
a Professorship in Tax at the law school. The Trust
provided income to the couple for both of their lives,
then became the corpus for the Whelan W. and
Rosalie T. Palmer Professorship. Prof. Joe Blackburn
was named the Palmer Professor of Tax.
Frederick Schlichter established a scholarship in the law school
which would be funded with the remainder of a trust he established
at the university many years ago. The Frederick C. Schlichter
Scholarship in Law now benefits students who have demonstrated
financial need. The endowed scholarship will help students for
generations to come.
As mentioned elsewhere in this report, Betty Eshelman ’64 made
provisions in her estate plan for a Chair in Constitutional Law to be
established in her father’s honor at her death. The chair is now a
reality and the law school and her students will always be indebted
to her for the Harwell G. Davis Chair in Constitutional Law.
Tom Jones ’66 of Huntsville, Alabama has developed an estate plan
which will provide for his wife in the event of his death and then
funds the Thomas L. and Shirley D. Jones Memorial Scholarship
for Cumberland students who have served in the military or are
active members of Reserve or National Guard components of the
Armed Forces of the United States while in law school.
Albert L. Shumaker ’65 of Centre, Alabama has created the Albert
Leo and Miariam Anne Williamson Shumaker Charitable Remainder
Unitrust which will fund the Albert L. Shumaker Scholarship.
When funded, the scholarship may be used by the Dean of the
Cumberland to grant financial assistance to any worthy student he/
she may choose to assist.
There are many ways you can create plans which will benefit you
and your spouse for your lives and then benefit Cumberland, her
faculty and students in perpetuity. If you are interested in knowing

Gift Planning.
