ground <strong>of</strong> expediency or alleged fraud. Answering a question by Court he said that the expulsion does not require<br />
ratification and hence R5 was unnecessary.<br />
Mr. Choksy points to the fact that under Standing Order 13 the NEC comprises an unwieldly number <strong>of</strong><br />
representatives drawn from a wide circle and includes ex-members <strong>of</strong> Parliament and Chairman <strong>of</strong> Local Authorities<br />
who are members <strong>of</strong> the Party and representatives <strong>of</strong> Trade Unions etc., and it is inconvenient and impracticable for<br />
the NEC to directly exercise disciplinary powers. It consists <strong>of</strong> 2500 members who cannot be called upon to exercise<br />
their judgment collectively or otherwise.<br />
Rule 8 (3) (m) requires the Leader <strong>of</strong> the Party to appoint the Working Committee from the NEC the composition <strong>of</strong><br />
which is fixed as follows<br />
1. Leader <strong>of</strong> the Party<br />
2. Deputy Leader<br />
3. All other <strong>of</strong>fice bearers <strong>of</strong> the NEC.,<br />
and other members, not exceeding fifty. It is to be noted therefore that the executive component <strong>of</strong> the NEC is<br />
included in the composition <strong>of</strong> the Working Committee ; and the Committee itself is a microcosm " <strong>of</strong> the NEC to<br />
whom power may be delegated even in the absence <strong>of</strong> express provision. See the dicta <strong>of</strong> Viscount Kilmuir LC in<br />
Vine's case. Under the UNP Constitution the Working Committee exercises not only the powers delegated to it by the<br />
NEC, but also a variety <strong>of</strong> other powers such as -<br />
1. to dissolve District Balamandalayas, Polling Division Organizations or main Associations ; Rule 2A(4)<br />
2. to approve the political rules <strong>of</strong> affiliated member Organizations ; Rule 3 (e)<br />
3. summoning <strong>of</strong> the Party Convention ; Rule 5 (a)<br />
4. appointment <strong>of</strong> Nomination Bords for elections ; Rule 9 (b)<br />
5. selection <strong>of</strong> a candidate for any Presidential Election ; Rule 9 (a)<br />
6. determination <strong>of</strong> the number <strong>of</strong> persons to be represented in the NEC among certain categories <strong>of</strong> representatives<br />
; Standing Order 13<br />
7. certain powers in respect <strong>of</strong> the UNP Youth League and UNP Women's Union ; Standing Orders 15 and 16<br />
8. acquisition <strong>of</strong> property and utilization <strong>of</strong> Party funds ; Standing Order 18<br />
9. giving directions in the interpretation <strong>of</strong> the Constitution ; Standing Order 21.<br />
All this shows that the Working Committee constitutes the core <strong>of</strong> the NEC and functions as a body that is<br />
singularly suited to be charged with the most vital powers and functions <strong>of</strong> the NEC including the exercise <strong>of</strong><br />
disciplinary power but with its roots in the larger body the members <strong>of</strong> which are spread out country -wide.<br />
CONCLUSION<br />
Upon a consideration <strong>of</strong> the relevant authorities the submissions <strong>of</strong> Counsel and all other matters, I am <strong>of</strong> the<br />
view that the Working Committee has been lawfully empowered by R2 to exercise disciplinary powers over members<br />
<strong>of</strong> the party and that there is no merit in the objection to its jurisdiction ; I accept Mr. Choksy's submissions and hold<br />
that the Committee has jurisdiction to take disciplinary action against the petitioners.<br />
INCONSISTENCY WITH THE PROVISIONS OF THE CONSTITUTION OF SRI LANKA AND STATUTE LAW<br />
This ground <strong>of</strong> challenge relates to the lawfulness <strong>of</strong> the grounds <strong>of</strong> expulsion set out in P1 A which I have<br />
summarised earlier in this judgment. The broad grounds <strong>of</strong> expulsion are linked with two events namely, the signing<br />
<strong>of</strong> the resolution P3B and the public campaign<br />
