SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant: SFF for almost all the Iron salts <strong>and</strong><br />

Slags<br />

Dr. Motz is dealing with the consortium for slags. It will be based on a contract which will be<br />

drafted by an experienced lawyer. The pre-contract has already been signed by several future<br />

members. The European consortium agreement will probably be ready by the end of December<br />

2008 (<strong>and</strong> available in English) <strong>and</strong> will be opened for all steel producers in Europe.<br />

The data gap analysis has started in August <strong>and</strong> will be finalised in December 2008. The FehS-<br />

Institue has given this work to a consultant coming from the chemical industry (Bayer Business<br />

Service, Leverkusen, Germany). At that stage, more will be known about the costs for the<br />

registration dossier. The idea is to combine as much as possible the different dossiers in order to<br />

reduce the amount of SIEFs <strong>and</strong> as such registration costs. So far, there are 4 pre-SIEF's for slags<br />

under the slag consortium.<br />

The first meeting of the European "Consortium Slags" will be held on 5 th February 2009 in<br />

Düsseldorf . An invitation to this consortium will be forwarded through the <strong>REACH</strong>-IT-Sysetm<br />

to all potential registrants by the SIEF-facilitator. The <strong>Eurofer</strong> secretariat will additionally<br />

forward the necessary on this to all its Clusters.<br />

Coke oven by-products<br />

Some coke oven by-products are being h<strong>and</strong>led by the Coal Chemicals Sector group (falling<br />

under CEFIC) <strong>and</strong> more specifically the <strong>REACH</strong> for Coal Chemicals (R4CC) <strong>and</strong> some others<br />

by a second consortium established by a polish company.<br />

Regarding R4CC: The <strong>REACH</strong> dossier preparation for more than 200 coal derived <strong>substance</strong>s,<br />

1955 companies <strong>and</strong> more than 8000 pre-registrations is organised by <strong>REACH</strong> for Coal<br />

Chemicals (R4CC). Contact person is Dr. Winfried Boenigk from Rütgers Chemicals GmbH. A<br />

consortium agreement was already established. R4CC has already opened the preSIEF discussion<br />

<strong>and</strong> they have sent an e-mail with an invitation for joining the preSIEF. It is foreseen that the<br />

lead registrant of each <strong>substance</strong> consortium will be member of the executive committee, dealing<br />

with R4CC. The <strong>substance</strong> concentrated ammonia liquor is not covered by the R4CC <strong>consortia</strong>.<br />

Annex<br />

Aluminium<br />

<strong>31</strong>/03/2009<br />

The Aluminium Industry was the first of the metals sectors to form a Consortium. The European<br />

Aluminium Association (EAA), in cooperation with the International Aluminium Institute (IAI),<br />

is leading the discussion on the issue <strong>and</strong> is preparing the industry for the upcoming<br />

implementation of <strong>REACH</strong>.<br />

Concerning the fees, this is based on yearly budgets <strong>and</strong> an equal share per member, without any<br />

commitment to this figure, <strong>and</strong> the estimated total cost per member over the budget period will<br />

be about 80 000 USD. In addition non members of EAA/IAI are charged a yearly additional fee<br />

of 18 000 USD. All members required to sign ”Consortium cost sharing agreement” <strong>and</strong> ”Nondisclosure<br />

agreement”. Fees for legal advice, consultants’ fees <strong>and</strong> administrative expenses<br />

connected with operating the Consortium will be charged to the Consortium <strong>and</strong> included in its<br />

annual budget.<br />

SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant: RiotintoAlcan with assitance from<br />

the Aluminium <strong>REACH</strong> Consortium<br />

Antimony<br />

IAOIA (International Antimony Oxide Industry Association) has been exp<strong>and</strong>ed <strong>and</strong> given legal<br />

entity <strong>and</strong> it has now become i2a (International antimony association). i2a started in January<br />

2008. Full Membership is open to legal entities who are producers or importers of antimony<br />

compounds. Associate Membership is open to legal entities that do not produce antimony<br />

compounds, but are stakeholders who have a commercial interest in antimony compounds, such<br />

as distributors or customers of the Full Members. OR’s are NOT member of i2a, their client is.<br />

ORs can participate to meetings. Deadline for joining without a small extra late entrance fee was<br />

July 14 th . New members are still welcome. The late entrance fee goes up continuously, so the<br />

sooner a company joins, the less the one-time entrance fee will be. For becoming member of i2a,<br />

it is necessary to fill in <strong>and</strong> sign a request for admission <strong>and</strong> return it to Karine Van de Velde<br />

(kvdv@iaoia.be). A questionnaire will need to be filled in as well. If you wish to get the request<br />

for admission <strong>and</strong> the questionnaire please contact the <strong>Eurofer</strong> Secretariat or Karine Van de<br />

Velde directly.<br />

For antimony there is no separate <strong>REACH</strong> consortium. A company can join i2a <strong>and</strong> i2a look<br />

after EHS issues, including getting the <strong>REACH</strong> registration dossiers ready in time for their<br />

members. There is one budget for i2a. Members pay a fixed administrative cost of 5000 euro + a<br />

tonnage based fee + cost to cover the risk assessment costs.<br />

So in order to calculate the potential membership fee for a company, it is necessary to know in<br />

which tonnage b<strong>and</strong> the company would fall for i2a.<br />

The following 13 Sb compounds are housed in i2a : antimony metal, diantimony trioxide,<br />

antimony trichloride, diantimony pentoxide, antimony triacetate, sodium antimonate, sodium<br />

hexahydroxoantimonate, diantimony tris(ethylene glycolate), antimony trisulfide, antimony<br />

pentachloride, antimony potassium tartrate, triphenyl antimony <strong>and</strong> antimony telluride. If a<br />

company is interested in more than one Sb compound or if it has different affiliates, it is<br />

necessary to add up all tonnages for all affiliates (per company) <strong>and</strong> that defines the annual<br />

tonnage <strong>and</strong> the class (per company).<br />

i2a currently has 32 full members worldwide <strong>and</strong> 2 associated members.<br />

Bylaws <strong>and</strong> an internal Agreement can be forwarded by Karine Van de Velde.<br />

SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant: Campine NV is the SIEF facilitator<br />

<strong>and</strong> lead registrant for Sb metal. I2a has officially taken over (at the request of Campine) the<br />

tasks of the Sief facilitator from Campine. I2a is as well preparing the <strong>REACH</strong> dossier for the<br />

2010 deadline <strong>and</strong> I2a will h<strong>and</strong> it over to Campine for submission to ECHA on time.<br />

Bismuth<br />

<strong>31</strong>/03/2009<br />

Eurometaux hosted a meeting in October 2008 to determine what action is being taken on<br />

Bismuth. It emerged that the Minor Metals Trade Association is not actively developing a<br />

consortium. Instead, 7 companies have expressed an interest in working together on Bismuth <strong>and</strong><br />

this consortium will be lead by Sidech (Belgium). A meeting report is awaited from<br />

Eurometaux.<br />

Boron<br />

Rio Tinto Minerals (RTM) is a manufacturer <strong>and</strong> importer of borates such as boric acid <strong>and</strong><br />

disodium tetraborates. Boron, the element, does not exist by itself in nature but associates with<br />

oxygen, <strong>and</strong> therefore, a <strong>REACH</strong> registration dossier shall not be submitted for 'boron'. However<br />

RTM shall be required to submit dossiers for its borate <strong>substance</strong>s in order to comply with<br />

<strong>REACH</strong>.<br />

Rio Tinto Minerals is a member of IMA-Europe (Industrial Minerals Association) <strong>and</strong> their subgroup<br />

called the European Borates Association (EBA). EBA members have formed a <strong>consortia</strong><br />

to submit dossiers for <strong>REACH</strong> for the main borate <strong>substance</strong>s:<br />

• 233-139-2 (boric acid)<br />

• 215-125-8 (diboron trioxide)<br />

• 234-541-0 (disodium octaborate tetrahydrate)<br />

• 215-540-4 (disodium tetraborate)<br />

Cadmium<br />

Cadmium Consortium is in parallel with the Zinc Consortium (www.reach-cadmium.eu). The<br />

registration of Cd <strong>and</strong> Cd compounds is lead by IZA-Europe, taking care of the organization <strong>and</strong><br />

Secretariat function of both the Zn <strong>and</strong> the Cd Consortia. The Cd Consortium was launched on<br />

1 st July 2007. The first General Assembly of the Cd Consortium was scheduled back to back with<br />

the Zn Consortium General Assembly for 4 September 2007.<br />

Scope (e.g. <strong>substance</strong>s): Pre-registration support, classification <strong>and</strong> registration dossier<br />

(evaluation of <strong>substance</strong> <strong>and</strong> authorisation currently out of the scope).<br />

• Metal subgroup: Cadmium metal (2<strong>31</strong>-152-8) <strong>and</strong> alloys<br />

• Compounds subgroup: Cd-oxyde (215-146-2), Cd-Hydoxyde (244-168-5), Cd-Nitrate (233-<br />

710-6), Cd-Carbonate (298-586-8), Cd-Sulphide (215-147-8), Cd-sulpho-selenide (261-218-1),<br />

Cd-Zn-Sulphide (232-466-8), Cd-Telluride (215-149-9)<br />

• “Isolated Intermediates” subgroup: Cd-sulphate (233-3<strong>31</strong>-6)<br />

Cerium<br />

Treibacher Industrie AG has volunteered for the SIEF Formation Facilitator (SFF) role <strong>and</strong> has<br />

communicated ECHA its intentions to be Lead Registrant for Cerium (EINECS-No. 2<strong>31</strong>-154-9).<br />

The questionnaire to facilitate the information exchange within the SIEF <strong>and</strong> to support with the<br />

compilation of the joint submission registration dossier has already been sent. Members of the<br />

consortium do not need to send any feedback.<br />

Chromium<br />

Chromium Consortia is divided in 3 families of products:<br />

Chrome Metal<br />

Some operators (LSM <strong>and</strong> Delachaux) took the lead in initiating a collaboration <strong>and</strong> have<br />

finalized a draft agreement to form a Chrome Metal consortium. A preliminary Meeting with<br />

potential Members of this consortium will be held on 17th February 2009 in Brussels. The<br />

SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant:<br />

The SIEF Formation Facilitator for<br />

Chromium metal (EC 2<strong>31</strong>-157-5) is London & Sc<strong>and</strong>inavian Metallurgical Co Limited (LSM)<br />

<strong>and</strong> the contact person is Martin Andrade. However, LSM is a founding member of the Cr Metal<br />

Consortium, <strong>and</strong> they are being assisted by the Cr Metal Consortium. Therefore, it is advisable to<br />

send any communication directly to Cyril Jacquet <strong>and</strong> cc. Martin Andrade <strong>and</strong> Jean-François<br />

Chamaly, the consortium chairman.<br />

Cobalt<br />

SIEF Formation Facilitator:<br />

OMG Kokkola Chemicals Oy (FI)<br />

Copper<br />

Introduction: a voluntary risk assessment for copper was presented to the European authorities<br />

by the copper industry under the leadership of the European Copper Institute in May 2005. It is<br />

expected that Member State approval of the final parts of this comprehensive dossier will take<br />

place in April 2008. Over 90% of the information necessary to complete the Chemical Safety<br />

Report <strong>and</strong> Hazard Classification requirements for copper under <strong>REACH</strong> will be covered by this<br />

dossier.<br />

ECI member companies have also been working, since 2006, on identifying an inventory of<br />

intermediates, linked to the production of copper, which also require registration.<br />

<strong>31</strong>/03/2009<br />

ECI is acting as the secretariat for the <strong>REACH</strong> Consortium for Copper metal <strong>and</strong> the various<br />

"intermediates" that come out of the copper smelting <strong>and</strong> refining processes. At ECI, Katia<br />

Lacasse (kla@eurocopper.org) is the coordinator of the activities <strong>related</strong> to <strong>REACH</strong> <strong>and</strong> the<br />

Consortium.<br />

Agreement <strong>and</strong> fee calculations (see also in the next page of this document):<br />

Consortium is given in Appendix 2 of the Consortium Agreement. Generally speaking, the<br />

The Lead Development Association International (LDAI) is the leading organization in the lead<br />

industry dealing with the registration of lead <strong>and</strong> lead compounds. Further information can be<br />

found on the LDAI web pages. The relevant contact point within the lead industry is Dr Andy<br />

Bush (bush@ldaint.org).<br />

Fees: Consortium Members of the Lead <strong>REACH</strong> Consortium will make annual contributions<br />

comprising a fixed fee <strong>and</strong> a tonnage-based levy fee for each of the years 2008 – 2010 <strong>and</strong> in<br />

subsequent years such fee as shall be agreed to by two thirds of the General Assembly.<br />

The fixed fees levy fees <strong>and</strong> VRAL fees shall represent a Consortium Member’s Pro Rata Share<br />

requirement (other than any additional fees which may be set in accordance with this<br />

Agreement). The fixed fee levy fees <strong>and</strong> VRAL fees are given in part 2 of this Schedule. The<br />

levy rates shall be variable being prepared by the Steering Committee (to meet the requirements<br />

of the Budget) <strong>and</strong> approved by a two thirds majority of the General Assembly. The estimated<br />

levy rates are as set out in part 2 of this Schedule.<br />

The levy element of the annual contribution will be based on the tonnage of lead metal or the<br />

lead content of lead compounds, manufactured within or imported into the Community, during<br />

the previous calendar year. For the avoidance of doubt any reference above to lead content shall<br />

be deemed to include lead content of transported isolated intermediates but excepting lead<br />

content of lead compounds which are transported to sites within any Group of Companies in<br />

which circumstance such a levy shall be paid only once by the entity originally possessing such<br />

lead compound. For the purpose of calculating the levy element of a Member’s Pro Rata Share<br />

each Consortium Member must declare its previous year’s manufacture/import tonnages in<br />

relation to each Group Substance no later than <strong>31</strong> March each year.<br />

<strong>31</strong>/03/2009<br />

The Consortium reserves the right to have an independent audit conducted of the tonnages<br />

declared by any legal entity <strong>and</strong> such legal entity shall provide all reasonable assistance to allow<br />

such audit to be conducted expeditiously <strong>and</strong> any Consortium Member who is found to have<br />

deliberately under-reported their tonnage shall be deemed to be in material breach for the<br />

purpose of clause 8 of this Agreement.<br />

The fixed fee element of a Consortium Member’s annual contribution to the Consortium<br />

becomes due on 1 January each year. The levy element becomes due on 1 April each year. If any<br />

payments are not received within 30 days from the date of an invoice then the Consortium<br />

Member shall be deemed in breach of this Agreement <strong>and</strong> shall be liable to pay interest on any<br />

outst<strong>and</strong>ing sum at the rate stated in clause 8.2.2 of this Agreement.<br />

In addition to the annual fixed fee <strong>and</strong> levy fee, Consortium Members who did not contribute to<br />

the costs incurred in preparing the VRAL Report or did contribute to such costs but such<br />

contribution is an amount less than the VRAL Fee payable by the Consortium Member as stated<br />

in part 2 of this Schedule 8 then the Consortium Member shall pay the VRAL Fee after<br />

deducting any VRAL Fee contribution previously made by that Consortium Member in order to<br />

secure access to the <strong>REACH</strong> registration data which is based on the VRAL Report (“VRAL<br />

Fee”). This fee, which will be equivalent to 50% of the rate paid by the original VRAL<br />

funders/owners in acknowledgement of the tenet that only about half of the VRAL is of direct<br />

relevance to the <strong>REACH</strong> registration, will be redistributed among the original VRAL funders.<br />

The VRAL fee will be payable in three installments on 1 January 2008, 1 January 2009 <strong>and</strong> 1<br />

January 2010. It will be based on the average tonnage of lead or lead content of compounds<br />

manufactured or imported into the Community over the period 2004 – 2006. The contribution<br />

rates are given in Part 2 of this Schedule below. The VRAL Fees paid by any Party for the use of<br />

the VRAL Report shall be remitted to the VRAL Funders at the direction of the LDAI.<br />

Part 2<br />

Contribution rates for 2008 – 2010<br />

FIXED FEES<br />

Annual fixed fee (lead metal manufacturers or importers) €10,000<br />

Annual fixed fee (lead compound manufacturers or importers) €7,500<br />

For the avoidance of doubt any Member who is a producer or importer of lead metal <strong>and</strong> lead<br />

compound shall be required to pay the higher lead metal levy of €10,000<br />

LEVY FEES<br />

The Budget for the work of the Consortium is anticipated to be approximately €2,000,000 spread<br />

over three years. Assuming that 50 persons join the consortium, the levy rate would be €0.13 per<br />

tonne per year.<br />

VRAL FEES<br />

For lead metal manufacturers <strong>and</strong> importers an entry fee of €1.20 per tonne of lead<br />

manufactured or imported into the Community, calculated as the average tonnage manufactured<br />

or imported over the period 2004 – 2006. This will be charged as follows:<br />

€0.40 per tonne, due on 1 January 2008<br />

€0.40 per tonne, due on 1 January 2009<br />

€0.40** per tonne, due on 1 January 2010<br />

For lead oxide manufacturers <strong>and</strong> importers an entry fee of the higher of €5,000 or €0.679 per<br />

tonne of lead content of compounds manufactured or imported into the Community, calculated as<br />

the average tonnage manufactured or imported over the period 2004 – 2006. This will be charged<br />

as follows:<br />

€0.226 per tonne, due on 1 January 2008<br />

€0.226 per tonne, due on 1 January 2009<br />

€0.226** per tonne, due on 1 January 2010<br />

For lead stabiliser producers <strong>and</strong> importers an entry fee of the higher of €5,000 or €3.14 per<br />

tonne of lead content of compounds produced or imported into the Community, calculated as the<br />

average tonnage produced or imported over the period 2004 – 2006. This will be charged as<br />

follows:<br />

€1.05 per tonne, due on 1 January 2008<br />

€1.05 per tonne, due on 1 January 2009<br />

€1.05 per tonne, due on 1 January 2010<br />

**Since entry fees will be redistributed amongst the original VRAL funders, this final<br />

installment of the entry fee will be adjusted downwards to ensure that the total entry fee<br />

comprises exactly 50% of the adjusted contribution rate of original VRAL funders.<br />

***The cost structure is <strong>related</strong> to full membership <strong>and</strong> apply to companies with <strong>REACH</strong><br />

obligations as a manufacturer or importer. Some downstream users <strong>and</strong> user associations have<br />

expressed an interest in joining the Consortium as Associate Members. Membership terms <strong>and</strong><br />

fees for Associate Members are agreed on a case by case basis.<br />

SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant: The SIEF Formation Facilitator for<br />

lead metal is Berzelius Metall, Germany. However, the International Lead Association is<br />

currently coordinating the lead SIEF activities on their behalf.<br />

Magnesium<br />

In summer 2007, a small group of companies established a Consortium for the registration of<br />

Magnesium (name of the Consortium: "MaREC").<br />

If a company wish to join the Consortium, there is a minimum fee (US$ 15,000) that has to be<br />

paid as soon as possible, <strong>and</strong> a pdf of the signing sheets of the Consortium Agreement has to be<br />

sent. Afterwards, the signed originals have to be sent by post to IMOA, Rue Pere Eudore<br />

With regard to the annual fees payable by members:<br />

- Membership is a four year financial commitment: 2007 - 2010 inclusive<br />

- The initial joining fee (that is the minimum annual fee) is now US15,000 (down from<br />

US$25,000). Note that this minimum fee will not increase.<br />

-The fee basis each year is determined by calculating the volume of each Members imports to<br />

the EU (lbs Mo-contained that they declared to MoCon for 2006) as a proportion of the total<br />

volume of Members 2006 imports to EU declared to MoCon, <strong>and</strong> applying that percentage to the<br />

annual budget approved for that year. So the annual fee payable will vary dependent on the total<br />

volume declared by Members <strong>and</strong> variations in the annual volumes of each member.<br />

- Your calculation of Mo imports into the EU is Lbs Mo-Contained (i.e. not product weight).<br />

- A volume of 1000 MT Mo-contained works out as a MoCon fee of US$35,500 (rounded to the<br />

nearest US$500). This is based on the 2007 membership fees where the levy was 1.61 USc/lb<br />

Mo-contained.<br />

SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant: The SIEF Lead Registrant for moly<br />

metal that will be shortly proposed is Plansee SE, Austria. For SIEF purposes the Moly<br />

Consortium Secretariat will act on their behalf within the SIEF. It has already been known at the<br />

Pre-SIEF stage that Plansee is willing to be Lead Registrant, but SIEF participants need to<br />

endorse that, which is expected to happen in early April. SFF is the Moly Consortium secretariat.<br />

Nickel<br />

The Nickel Consortium was officially launched in February 2007 <strong>and</strong> its activities are lead by<br />

the Nickel Institute <strong>and</strong> ENIA (European Nickel Industry Assosication).<br />

There are 3 Consortia following the <strong>substance</strong>s involved:<br />

• Nickel Consortium RA <strong>substance</strong>s covers Ni metal <strong>and</strong> the main Ni compounds such us<br />

Ni chloride, Ni nitrate, Ni sulphate (closed list)<br />

• Nickel Consortium Nickel inorganic compounds covers some non-RA <strong>substance</strong>s: Ni<br />

acetate, Ni carbonate, Ni sulphamate, Ni fluoride, Ni oxide…(open list)<br />

• Nickel Consortium “Complex materials” covers Ferronickel as a special preparation <strong>and</strong><br />

some intermediates, e.g.: Ni matte (open list)<br />

Additional <strong>substance</strong>s may be included in the second <strong>and</strong> third group of <strong>substance</strong>s upon request,<br />

evaluation <strong>and</strong> decision by the Steering Committee. It is not planned to cover Nickel organic<br />

compounds.<br />

Membership: Importers <strong>and</strong> EU or non-EU Manufacturers (as defined in <strong>REACH</strong>) can join the<br />

Consortium as Regular Members. The non-EU manufacturers can delegate their OR by signing a<br />

power of attorney. Downstream Users can be represented by their European Association<br />

(Associate Membership) to ensure a good communication for the preparation of the Registration<br />

dossier. Up to now there are 30 Regular members in total – pending <strong>contacts</strong> with 50 companies.<br />

Fee: As for the costs of membership, it is not feasible to give an off-the-shelf estimation, due to<br />

the quantity of cost drivers. Main cost drivers are the volume of Ni-content <strong>and</strong> the number of<br />

Members in the Consortium. Potential members are invited to contact the Secretariat, so that a<br />

detailed cost estimation can be made following the specific situation of the company.<br />

Pre-existence of RA: Yes for the following <strong>substance</strong>s: nickel metal, nickel chloride,<br />

nickel sulphate, nickel dinitrate, nickel (hydroxy)carbonate.<br />

the <strong>REACH</strong> consortium, also per company.<br />

The entrance fee (2008) amounts to 14000<br />

Euro. This fixed fee will decrease to 5500 -<br />

7000 Euro the next years (only the<br />

administrative need then to be covered),the<br />

definite amount depending upon the number<br />

of participants. The yearly budget for<br />

administrative costs is around 300 000 Euro.<br />

The variable fee is <strong>related</strong> to the product (data/<br />

assessment/testing) <strong>and</strong> depends upon the<br />

volume of the <strong>substance</strong> put on the market,<br />

<strong>and</strong> more precisely on the tonnage b<strong>and</strong> (6<br />

b<strong>and</strong>s defined above 1000 T). The budget for<br />

Silicon/Silica Fume <strong>and</strong> FeSi, for the scientific<br />

part is respectively around 980 000 Euro <strong>and</strong><br />

around 680 000 Euro to achieve the<br />

registration requirements. Those figures are<br />

most presumably conservative. It is based on<br />

the current knowledge of risk assessment costs<br />

given by other metals (which have been<br />

classified).<br />

2.3. Fees for late entrants<br />

The Consortium Agreement determines in the<br />

attached Consortium Agreement [Chapter XI.3<br />

" Membership "] that<br />

The objective of the Consortium is to help the<br />

members prepare the Registration dossier by<br />

sharing data <strong>and</strong> sharing the cost of acquiring the<br />

necessary new data in the most cost-effective<br />

way. The Consortium Agreement establishes the<br />

conditions under which these data can be shared.<br />

2.2. Overall costs<br />

The costs <strong>related</strong> to the consortium are split into a<br />

fixed fee <strong>and</strong> a variable fee. The first year<br />

(2008), the entrance fee covers the fixed fee<br />

<strong>related</strong> to the administrative expenses of the<br />

consortium per company <strong>and</strong> the past expenses<br />

incurred by the CaSi Institute <strong>related</strong> to the<br />

<strong>REACH</strong> consortium, also per company.<br />

The companies will share the management<br />

costs <strong>and</strong> 50% of the data gathering costs<br />

equally (fixed fee), whilst the other 50%<br />

of the data gathering costs will be shared<br />

on the basis of the tonnages manufactured<br />

or imported in the EEA (variable fee). The<br />

draft 2008 - 2010 budget agreed by the<br />

Assembly establishes that this fixed fee<br />

per company will be 34.953 EUR in 2008<br />

<strong>and</strong> will grow to 35.833 EUR in 2010, this<br />

on the basis of the current membership.<br />

The variable fee, based on the tonnages,<br />

will share an assessment cost of 60.000<br />

EUR in 2008 (i.e. 50% of the 2008<br />

assessment costs). This amount will grow<br />

to 150.000 EUR the following two years.<br />

in accordance with the tonnages indicated to<br />

the Trustee.<br />

3. What is the registration process for new<br />

applicants to the “Si” Consortium?<br />

According to the provisions of the consortium<br />

agreement, any new application is subject to<br />

the approval of the Steering Committee. A<br />

short procedure will be provided for those<br />

ready to join.<br />

From an administrative point of view, an<br />

annex indicating the contact details of the<br />

company, of its representative <strong>and</strong> its<br />

signatories <strong>and</strong> the products concerned (1, 2 or<br />

the 3) has to be filled in, signed <strong>and</strong> send back<br />

to Euroalliages. The other annex, <strong>related</strong> to<br />

tonnages declaration is to be filled in <strong>and</strong> send<br />

at a later stage, once the instruction will be<br />

unanimous decision of the Assembly.<br />

indicating the contact details of the company, of<br />

consortium from the start is set at 30 of November 2007 <strong>and</strong> further information on how<br />

interested companies can join the Tungsten Consortium can be found at the ITIA website.<br />

SIEF Formation Facilitator <strong>and</strong> SIEF Lead Registrant: At the General Assembly meeting of<br />

the Vanadium Consortium in January 2009, the ‘not-yet VC member’ Duferco was selected as<br />

c<strong>and</strong>idate lead registrant with Exstrata being the back-up in case Duferco will not join the VC.<br />

It was agreed to promote the lead registrants within the SIEF to become official lead registrants.<br />

It was furthermore agreed that the VC will coordinate the SIEF facilitation for the <strong>substance</strong>s<br />

that are strictly due for registration in 2010 considered by the VC, including V. As Duferco has<br />

not joined the VC yet, it will most likely be the case that the VC will promote Exstrata as lead<br />

registrant. This is up for decision making at the next conference call of the VC on April 2nd ,<br />

2009.<br />

The VC is currently in the process of modifying the IT tool that MoCon developed to be used<br />

for communication with the pre-SIEFers for the <strong>substance</strong>s that are strictly due for registration in<br />

2010 considered by the VC, including V, <strong>and</strong> the VC will contact the pre-SIEFers shortly.<br />
