• “In the circumstances circumstances, the issue for determ<strong>in</strong>ation is<br />
whether the breach of contract alleged to have resulted<br />
from the nullification of clause twelfth of the contract was an<br />
ord<strong>in</strong>ary one <strong>in</strong>volv<strong>in</strong>g no <strong>in</strong>ternational responsibility or<br />
whether said breach was effected arbitrarily by means of a<br />
governmental power illegal under <strong>in</strong>ternational law [...] the<br />
1931 decree of the same Legislature Legislature, [ [...] ] was clearly not<br />
an ord<strong>in</strong>ary breach of contract. Here the Government of<br />
Veracruz stepped out of the role of contract<strong>in</strong>g party and<br />
sought to escape vital obligations under its contract by<br />
exercis<strong>in</strong>g its superior governmental power. Such action<br />
under <strong>in</strong>ternational law has been held to be a confiscatory<br />
