Accidents Act 1976 (as ar?rrdec^ and fcr tr - “n e fit cf the estate cf the deceased under the provisions of the Lav Reform (Miscellaneous Provisions) Act 1934. L etters of Administration vere taken out of the Liverpool D istrict Probate Registry on the 29th day - June 1989. 2. The F irst Defendant is the Chief Constable of the South Yorkshire Police. The Police O fficers h ereinafter referred to were at a ll n aterial times um bers of the said Force acting under the direction and control of the F irst Defendant in purported performance of th eir duties as police o ffice rs. 3. The Second Defendants are and were a t a ll n aterial times the owners and occupiers of the football ground premises known as The Hillsborough Stadium in Sheffield, South Yorkshire. 4. A. The F irst Defendant's police force *as at a ll n aterial times the force responsible for policing at the said stadium on the occasion of football matches, in particular the football match on the 15th April 1989 hereinafter referred to , being the Mitch between Liverpool Football Club and Nottingham Forest Football Club in the sem i-final round of the Football Association Challenge Cup (hereinafter referred to as the F.A. Cup).

Further the Plaintiff adopts and repeats against the First Defendant the allegation against him contained in paragraph 3 of the Defence of the Second Defendant herein, that is to say that the First Defendant was also an occupier of the said football ground and was in control of the said event and of all merrbers of the public admitted thereto. 5. The Third Defendants were at a ll m aterial times the local authority responsible for the issue and/or continuance of the Safety C ertificate and the conditions thereof, as issued to the Second Defendants in respect of the said stadium pursuant to the previsions of the Safety of Sports Ground Act 1975. By th e ir o fficers, th e ir servants or agents the Third Defendants cade periodic v is its to the stadium and directed and/or approved the carrying out of a ll works thereto. In the premises the Third Defendants at a ll material times owed a duty to a ll lawful v isito rs to the ground, in particu lar the Deceased, to take a ll reasonable care to ensure that the Cert lfic a :e and i t s conditions, and any works Wiich they directed and/or required and/or approved would ensure the reasonable safety of v isito rs to the stadium. 6. The Fourth Defendants were at a ll m aterial times retained by the Second Defendants to advise them on a ll matters relating to the safety of the said stadium and its ccnpliance with the Safety C ertificate referred to; Pursuant to the retainer, the Fourth Defendants by themselves their servants
