Court Competition<br />

<strong>The</strong> <strong>Jessup</strong> Competition is a legal advocacy contest<br />

in which teams of students write briefs and present oral<br />

arguments be<strong>for</strong>e a simulated <strong>International</strong> Court of<br />

Justice (ICJ), <strong>the</strong> principal judicial organ of <strong>the</strong> United<br />

Nations. <strong>The</strong> Competition was created in 1959 when a<br />

dedicated group of students and professors at Harvard<br />

<strong>Law</strong> School organized <strong>the</strong> first “<strong>International</strong> <strong>Law</strong><br />

Moot,” which later was named after <strong>the</strong> eminent scholar<br />

and jurist <strong>Philip</strong> C. <strong>Jessup</strong>, who served on <strong>the</strong> ICJ from<br />

1961 to 1970.<br />

Today, <strong>the</strong> <strong>Jessup</strong> Competition is <strong>the</strong> world’s largest<br />

moot court competition, with participants from over 550<br />

law schools in more than 80 countries. <strong>The</strong> Competition<br />

begins in September with <strong>the</strong> release of <strong>the</strong> Compromis,<br />

a fact pattern describing a fictional legal dispute between<br />

two countries. Teams of students work toge<strong>the</strong>r<br />

to research <strong>the</strong> legal issues raised in <strong>the</strong> Compromis,<br />

and <strong>the</strong>n write legal briefs and prepare oral arguments<br />

on behalf of each party to <strong>the</strong> case.<br />

More than a competition, <strong>the</strong> <strong>Jessup</strong> is a professional<br />

training experience which teaches practical skills in<br />

research, writing, advocacy, and teamwork. <strong>The</strong> <strong>Jessup</strong><br />

has also served as a source of inspiration to many<br />

generations of students in promoting <strong>the</strong> rule of law and<br />

<strong>the</strong> peaceful resolution of disputes. Several countries<br />

have fielded successful <strong>Jessup</strong> teams even while <strong>the</strong>ir<br />

countries were in <strong>the</strong> midst of violent conflict or internal<br />

political strife.<br />

One of <strong>the</strong> most unique features of <strong>the</strong> <strong>Jessup</strong> Competition<br />

is its cultivation of a global community of legal<br />

professionals who have shared and continue to share an<br />

invaluable cultural and academic exchange. Former<br />

<strong>Jessup</strong> participants can be found in <strong>the</strong> world’s finest<br />

law firms, universities, governments, and international<br />

organizations. <strong>The</strong>y are today’s leaders in international<br />

law, and <strong>the</strong>y continue to support <strong>the</strong> <strong>Jessup</strong> as administrators,<br />

volunteer judges, and team coaches.<br />

Structure of <strong>the</strong> <strong>Jessup</strong> Competition<br />

<strong>The</strong> <strong>Jessup</strong> Competition is divided into two levels:<br />

qualifying tournaments and <strong>the</strong> international rounds.<br />

At both levels, teams compete in head-to-head matches<br />

be<strong>for</strong>e a panel of judges and advance based on <strong>the</strong><br />

quality of <strong>the</strong>ir oral arguments and written pleadings.<br />

A national qualifying tournament must be held if two<br />

or more schools in <strong>the</strong> same country register <strong>for</strong> <strong>the</strong><br />

<strong>Jessup</strong> Competition. <strong>The</strong> winners of qualifying tournaments<br />

earn <strong>the</strong> right to advance to <strong>the</strong> international<br />

level of <strong>the</strong> Competition, called <strong>the</strong> White & Case<br />

<strong>International</strong> Rounds.<br />

National and Regional Rounds. As <strong>the</strong> number<br />

of participating schools continues to rise, so does<br />

<strong>the</strong> size and impact of qualifying tournaments called<br />

National and Regional Rounds. Each competition has<br />

its own unique structure and rules, depending on <strong>the</strong><br />

size of <strong>the</strong> Competition, <strong>the</strong> academic calendar, <strong>the</strong><br />

local mooting culture, and o<strong>the</strong>r local factors. In some<br />

countries, such as <strong>the</strong> U.S. and India, <strong>the</strong> number of<br />

teams participating is so large that <strong>the</strong> qualifying level<br />

of <strong>the</strong> Competition is broken up into multiple regional<br />

rounds instead of a single national tournament.<br />

White & Case <strong>International</strong> Rounds. <strong>Sponsor</strong>ed by<br />

<strong>the</strong> global law firm of White & Case, <strong>the</strong> international<br />

rounds are a week-long cultural and educational event<br />

held every spring in Washington, D.C. in conjunction<br />

with <strong>the</strong> annual meeting of ILSA’s sister organization,<br />

<strong>the</strong> American Society of <strong>International</strong> <strong>Law</strong>. Participating<br />

teams argue <strong>the</strong>ir case be<strong>for</strong>e leading practitioners<br />

and scholars of international law, vying <strong>for</strong> <strong>the</strong><br />

coveted White & Case <strong>Jessup</strong> Cup and <strong>the</strong> title of<br />

<strong>Jessup</strong> World Champion. <strong>The</strong> final round bench has<br />

consistently included <strong>the</strong> most prestigious names in<br />

international law, most notable among <strong>the</strong>m <strong>for</strong>mer<br />

and current ICJ Presidents such as Judges Schwebel,<br />

Owada, and Higgins.<br />

An essential quality of any good lawyer is <strong>the</strong> ability<br />

to prepare and present <strong>the</strong> best legal case available to<br />

<strong>the</strong>ir client. Mooting is an excellent way of developing<br />

that ability and <strong>the</strong> <strong>Jessup</strong> has <strong>the</strong> extra-values of<br />

emphasizing <strong>the</strong> wider world in which all lawyers<br />

operate (or should) and of providing great opportunities<br />

<strong>for</strong> meeting law students from o<strong>the</strong>r cultures.<br />

<strong>Jessup</strong> Participants and Alumni<br />

Each year, students from more than 550 law schools in over 80 countries participate in <strong>the</strong> <strong>Jessup</strong> Competition. From Afghanistan to Zimbabwe,<br />

<strong>the</strong>se students are <strong>the</strong> best and brightest young legal minds from <strong>the</strong>ir law schools and countries. <strong>The</strong> <strong>Jessup</strong> experience instills students<br />

with a valuable advantage in <strong>the</strong> global marketplace by exposing <strong>the</strong>m to complex, timely issues of international concern. Moreover, students<br />

develop strong teamwork, legal research, and oral and written advocacy skills by representing both sides of <strong>the</strong> case from start to finish in a<br />

rigorous and competitive environment. <strong>Jessup</strong> alumni commonly refer to <strong>the</strong> Competition as <strong>the</strong>ir most challenging and rewarding law school<br />

experience, and often point to <strong>the</strong> <strong>Jessup</strong> as <strong>the</strong> academic exercise that best prepared <strong>the</strong>m to work in <strong>the</strong> international legal arena. It is no<br />

surprise <strong>the</strong>n that many <strong>for</strong>mer <strong>Jessup</strong> competitors are now leaders in law, business, and goverment in instituions around <strong>the</strong> world.<br />

Each of <strong>the</strong> 550 <strong>Jessup</strong> teams that compete each year are composed of two to five students from <strong>the</strong> same academic institution. More than 125<br />

of <strong>the</strong>se teams advance from <strong>the</strong> National and Regional Rounds of <strong>the</strong> Competition to <strong>the</strong> <strong>International</strong> Rounds held in Washington, D.C. As <strong>the</strong><br />

world’s largest and most expansive ga<strong>the</strong>ring of law students, <strong>the</strong> <strong>Jessup</strong> <strong>International</strong> Rounds give many participants <strong>the</strong>ir first exposure to<br />

student and attorney counterparts from o<strong>the</strong>r countries. Through spirited debate and socializing, <strong>Jessup</strong> competitors come to view <strong>the</strong>ir peers<br />

from around <strong>the</strong> world as allies, partners, and friends. Relationships between competitors remian strong even after <strong>the</strong> Competition has ended,<br />

and <strong>the</strong> “Friends of <strong>the</strong> <strong>Jessup</strong>” network of <strong>for</strong>mer competitors--thousands of individuals from around world--continue to support <strong>the</strong> <strong>Jessup</strong><br />

year after year as volunteer coaches, judges and mentors to <strong>the</strong> next generation of international lawyers.<br />

in <strong>the</strong> <strong>Jessup</strong> during at least one of <strong>the</strong> last three years, 2008-2010. Note that approximately 550 student teams are <strong>for</strong>med each year,<br />

<strong>The</strong> <strong>Jessup</strong> Competition in <strong>the</strong> News<br />

Because <strong>the</strong> Competition is among <strong>the</strong> largest, oldest and most rigorous international contests, achievement among a field of over 80 nations<br />

yields substantial news coverage and a sense of national pride. Each year, national television stations attend <strong>the</strong> <strong>International</strong> Rounds of <strong>the</strong><br />

Competition to film <strong>the</strong> team(s) from <strong>the</strong>ir country arguing in <strong>the</strong> World Championship Rounds, and broadcast <strong>the</strong> footage back home. Numerous<br />

local news agencies also cover <strong>the</strong> National and Regional competitions held around <strong>the</strong> world.<br />

<strong>The</strong> magazine articles reprinted on <strong>the</strong> following pages represent just a fraction of <strong>the</strong> overall news-media coverage <strong>the</strong> <strong>Jessup</strong> Competition<br />

and its competitors receive each year. <strong>The</strong>y are stories of successful <strong>Jessup</strong> teams who return home after <strong>the</strong> <strong>International</strong> Rounds to great fanfare,<br />

meeting with high-ranking court and government officials, even heads of state, and stories of how <strong>the</strong> <strong>Jessup</strong> Competition brings toge<strong>the</strong>r<br />

students in all parts of <strong>the</strong> world, with <strong>the</strong> end goal of uniting <strong>the</strong>m as champions of <strong>the</strong> rule of law.<br />

<strong>The</strong> <strong>Jessup</strong> Competition remains <strong>the</strong> preeminent, worldwide<br />

moot court competition, which has proved its worth<br />

as a teaching tool of remarkable utility. It not only teaches<br />

<strong>the</strong> substance and procedures of international law. It<br />

teaches that <strong>the</strong>re is more than one way of looking at<br />

issues of international law. And in <strong>the</strong> process, it not only<br />

hones <strong>the</strong> <strong>for</strong>ensic skills of its participants, it contributes<br />

to <strong>the</strong> international understanding and fellowship in<br />

significant measure.<br />

<strong>The</strong> <strong>Jessup</strong> Competition is one place where <strong>the</strong> rubber<br />

hits <strong>the</strong> road—that is, where law students finally get to<br />

see whe<strong>the</strong>r <strong>the</strong>y can apply law to fact and emerge with<br />

a coherent (though not always winning) argument.<br />

<strong>The</strong> competition also makes international law—which<br />

tends to be viewed in <strong>the</strong> abstract—a bit more real.<br />

For <strong>the</strong>se reasons, those students lucky enough to<br />

participate in <strong>the</strong> <strong>Jessup</strong> are likely to be better lawyers,<br />

and not only just better international lawyers.<br />
