affecting <strong>the</strong> natural environment. They also seized upon incidental statu<strong>to</strong>ry<br />

preamble language <strong>of</strong> <strong>the</strong> Clean Air Act <strong>to</strong> justify a comprehensive program for<br />

<strong>the</strong> prevention <strong>of</strong> significant deterioration <strong>of</strong> air quality. The courts likewise read<br />

long overlooked statu<strong>to</strong>ry terms in <strong>the</strong> Forest Service Organic Act <strong>of</strong> 1897 <strong>to</strong><br />

conclude that most clearcutting <strong>of</strong> national forests was unlawful, <strong>the</strong>reby prodding<br />

Congress <strong>to</strong> enact comprehensive and far more environmentally favorable<br />

national forest management legislation. These judicial rulings also had <strong>the</strong> practical<br />

effect <strong>of</strong> providing <strong>the</strong> environmental community with political leverage,<br />

argues Lazarus. 40<br />

However, many environmentally minded groups were frustrated because<br />

<strong>the</strong>y were “unable <strong>to</strong> move <strong>the</strong> system, <strong>to</strong> make it respond, <strong>to</strong> force environmental<br />

protection,” as co-founder <strong>of</strong> <strong>the</strong> Environmental Defense Fund (EDF) Charles<br />

Wurster pointed out. 41 A groundswell was building in response <strong>to</strong> Rachel Carson’s<br />

writing, augmented by public revulsion at <strong>the</strong> calamities <strong>of</strong> <strong>the</strong> 1960s. Thus, it<br />

was natural that, in 1967, three scientists living on Long Island and a fourth in<br />

Michigan, who were as alarmed as Carson had been by <strong>the</strong> effects <strong>of</strong> DDT on<br />

wildlife, conceived <strong>of</strong> a new way <strong>to</strong> put <strong>the</strong>se concerns in<strong>to</strong> motion. They formed<br />

EDF, joined with an at<strong>to</strong>rney, and became <strong>the</strong> first group <strong>to</strong> take scientific evidence<br />

in<strong>to</strong> <strong>the</strong> courts <strong>to</strong> achieve environmental goals. With support from <strong>the</strong> Ford<br />

Foundation through National Audubon’s Rachel Carson Memorial Fund, EDF’s<br />

founders brought case after case seeking <strong>to</strong> replace DDT with pest control methods<br />

less dangerous <strong>to</strong> wildlife. Before <strong>the</strong>y were through, <strong>the</strong>ir efforts would lead<br />

<strong>to</strong> <strong>the</strong> nationwide banning <strong>of</strong> DDT and <strong>to</strong> <strong>the</strong> first established precedents <strong>of</strong><br />

environmental law. 42<br />

In addition, <strong>the</strong>re were early inroads for <strong>the</strong> federal framework. They included<br />

laws governing transportation and his<strong>to</strong>rical preservation. Section 4(f) <strong>of</strong><br />

<strong>the</strong> 1966 Department <strong>of</strong> Transportation Act declared a national policy that special<br />

effort should be made <strong>to</strong> preserve <strong>the</strong> environment. Section 4(f) covered land<br />

consisting in part, <strong>of</strong> publicly owned parks, recreational areas, wildlife and waterfowl<br />

refuges, and all his<strong>to</strong>ric sites:<br />

It is hereby declared <strong>to</strong> be <strong>the</strong> national policy that special effort should be<br />

made <strong>to</strong> preserve <strong>the</strong> natural beauty <strong>of</strong> <strong>the</strong> countryside and public parks and<br />

recreation lands, wildlife and waterfowl refuges, and his<strong>to</strong>ric sites. The<br />

Secretary <strong>of</strong> Transportation shall cooperate and consult with <strong>the</strong> Secretar-<br />
