The Respiratory Care Advisory Committee <strong>of</strong> the <strong>Board</strong> <strong>of</strong> <strong>Medical</strong> <strong>Licensure</strong> <strong>and</strong> <strong>Supervision</strong><br />

met in regular meeting on August 16, 2012, at the <strong>of</strong>fice <strong>of</strong> the <strong>Board</strong>, 101 NE 51 st Street, <strong>Oklahoma</strong><br />

City, <strong>Oklahoma</strong>. The meeting was held in accordance with the Open Meeting Act <strong>and</strong> the<br />

Administrative Procedure Act. Members present were:<br />

The meeting was called to order at 11:30 a.m. The minutes <strong>of</strong> the April 26, 2012, Committee<br />

meeting were reviewed. Ms. Nation noted one correction to the vote on the matter <strong>of</strong> Viola Renee Bliss.<br />

She <strong>and</strong> Dr. Britt had abstained from the vote. With the correction, the minutes were approved.<br />

JOANIE O’CONNOR, RCP appeared to explain negative responses on her 2007 initial<br />

licensure application <strong>and</strong> her 2009 license renewal application to questions regarding an alcohol related<br />

arrest. Dr. Britt joined the meeting. Staff reported that Ms. O’Connor had an arrest in 2006 for DUI. She<br />

reported the arrest on her 2011 license renewal. Ms. O’Connor said she was not sure how to answer the<br />

question. She said she thought she just read the question differently the last time. The Committee<br />

counseled her on the importance <strong>of</strong> being completely open <strong>and</strong> honest with the <strong>Board</strong>. Mr. Porterfield<br />

moved, based on the conversation with Ms. O’Connor <strong>and</strong> her stated underst<strong>and</strong>ing <strong>of</strong> the Committee’s<br />

concerns, to close the case with a letter being placed in her public file stating there will be no tolerance<br />

<strong>of</strong> any future failure to be honest or any future DUI related arrests. Ms. Nation seconded the motion <strong>and</strong><br />

the vote was unanimous in the affirmative.<br />

JASON JEFFERSON SCOTT appeared in support <strong>of</strong> his application for Respiratory Care<br />

Practitioner license re-entry. Mr. Scott had last practiced respiratory care in 2008. Mr. Scott said he was<br />

working as an echocardiogram/ultrasound technician but wants to return to respiratory care. He stated he<br />

has been working the last four months at Solara under temporary license. He discussed his continuing<br />

education. Dr. Britt moved to recommend approval <strong>of</strong> the application pending pro<strong>of</strong> <strong>of</strong> satisfactory<br />

completion <strong>of</strong> four months practice under direct supervision <strong>and</strong> completion <strong>of</strong> 12 hours <strong>of</strong> continuing


espiratory care education. Ms. Fisher seconded the motion <strong>and</strong> the vote was unanimous in the<br />

affirmative. The Committee determined that the letter he presented from his supervisor would suffice as<br />

pro<strong>of</strong> <strong>of</strong> the required practice under direct supervision.<br />

JENNIFER KAY WEEMS appeared in support <strong>of</strong> her application for Provisional Respiratory Care<br />

Practitioner license. Ms. Weems had been arrested for DUI in 2009. She had met with staff <strong>and</strong> no<br />

Agreement for licensure had been recommended. Ms. Weems stated she has been working at Hillcrest<br />

South <strong>and</strong> that she would be graduating in May 2013. She testified regarding the DUI, saying it was a<br />

great lesson <strong>and</strong> that she does not socialize with that group <strong>of</strong> people any more. Mr. Porterfield said<br />

there is a concern about loosing self-control due to alcohol or drugs <strong>and</strong> it is the Committee’s<br />

responsibility to ensure protection <strong>of</strong> public. He admonished Ms. Weems, stating the Committee does<br />

not want to see this happen again. Mr. Porterfield moved to recommend approval <strong>of</strong> the license with a<br />

letter placed in her public file stating there would be no tolerance <strong>of</strong> any future alcohol related events.<br />

Ms. Nation seconded the motion <strong>and</strong> the vote was unanimous in the affirmative.<br />

MELODY ANN LOVELESS appeared in support <strong>of</strong> her application for Respiratory Care<br />

Practitioner licensure re-entry. Ms. Loveless’ license had expired August 31, 2003. Ms. Loveless said<br />

she had been doing home health but would like to do respiratory care while going to nursing school. She<br />

stated that Timothy Markus, RC was willing to be her supervisor at Hillcrest. Dr. Britt moved to<br />

recommend approval <strong>of</strong> the application pending satisfactory completion <strong>of</strong> nine months practice under<br />

direct supervision, twelve hours <strong>of</strong> continuing education <strong>and</strong> satisfactory completion <strong>of</strong> the file. Dr.<br />

Pettigrew seconded the motion <strong>and</strong> the vote was unanimous in the affirmative.<br />

DIANNE SARA SCALES appeared in support <strong>of</strong> her application for Respiratory Care Practitioner<br />

license re-entry. Ms. Scales’ license had expired January 31, 2010. After review <strong>of</strong> the file, Dr. Britt<br />

moved to recommend approval <strong>of</strong> the application based on her appearance <strong>and</strong> the continuing education<br />

hours provided. Ms. Nation seconded the motion <strong>and</strong> the vote was unanimous in the affirmative.<br />

ROY H. ADAMS appeared in support <strong>of</strong> his application for Provisional Respiratory Care<br />

Practitioner license. Mr. Adams talked to the Committee about his 2010 DUI arrest. He said it was an<br />

unfortunate event but fortunately he was pulled over. He said it has changed him as a person <strong>and</strong> how he<br />

views others. He said he completed all court requirements related to the arrest. Ms. Nation moved to<br />

recommend approval <strong>of</strong> the application with a letter placed in his public file stating there will be no<br />

tolerance <strong>of</strong> any other alcohol related events. Dr. Britt seconded the motion <strong>and</strong> the vote was unanimous<br />

in the affirmative.<br />

KRISTI GRATE appeared in support <strong>of</strong> her application for Respiratory Care Practitioner<br />

license. Ms. Grate answered questions regarding her previous arrests for minor in possession, a domestic<br />

altercation that did not result in charges being filed, a returned check, which was paid, <strong>and</strong> transport <strong>of</strong><br />

an open container. Her last arrest was in 2010 for the open container. She said she was not driving nor<br />

intoxicated but she took responsibility for the container in the vehicle. Dr. Britt moved to recommend<br />

approval <strong>of</strong> the application with a letter placed in her public file stating there will be no tolerance <strong>of</strong> any<br />

future arrests. Mr. Porterfield seconded the motion <strong>and</strong> the vote was unanimous in the affirmative.<br />

Motion. Mr. Porterfield reminded Ms. Grate <strong>of</strong> what was at stake if she continued to have problems; she<br />

would be at risk <strong>of</strong> losing her license.<br />

RICHARD BRUCE ATKINS appeared in support <strong>of</strong> his application for Respiratory Care<br />

Practitioner licensure. Mr. Atkins last practiced respiratory care in 1984. Mr. Atkins said he was in home<br />

medical equipment until 2005. He stated he had some serious medical issues in 2006 <strong>and</strong> now is seeking


employment. After discussion, Ms. Fisher moved to table the application until Mr. Atkins successfully<br />

completes the entry-level certification exam. She further moved that, if passes the exam, he then could<br />

come back to the Committee for a temporary license. Dr. Britt seconded the motion <strong>and</strong> the vote was<br />

unanimous in the affirmative.<br />

ELLYSSA REAMES appeared in support <strong>of</strong> her application for Respiratory Care Practitioner<br />

licensure reinstatement. Ms. Reames’ license had expired November 30, 2011. Ms. Reames talked to the<br />

Committee about her activities for the last couple <strong>of</strong> years. She said she has completed 25 hours <strong>of</strong><br />

continuing education <strong>and</strong> has a current Texas license. Mr. Porterfield moved to recommend approval <strong>of</strong><br />

the application. Ms. Beard seconded the motion. Mr. Wersal asked about Ms. Reames’ Kansas license.<br />

Staff reported that it was inactive. The vote was called <strong>and</strong> was unanimous in the affirmative, except Dr.<br />

Britt was not present at the time <strong>of</strong> voting.<br />

CHEREE GREER TALLEY appeared in support <strong>of</strong> her application for Respiratory Care<br />

Practitioner licensure re-entry. Ms. Talley’s license had expired December 31, 2009. Ms. Talley talked<br />

about her reasons for wanting to return to respiratory care <strong>and</strong> her activities since being out <strong>of</strong> practice.<br />

Dr. Britt moved to recommend approval <strong>of</strong> the application pending satisfactory completion <strong>of</strong> two <strong>and</strong><br />

one-half months <strong>of</strong> practice under direct supervision <strong>and</strong> 12 hours <strong>of</strong> continuing education. Dr. Pettigrew<br />

seconded the motion <strong>and</strong> the vote was unanimous in the affirmative.<br />

Applications for licensure were reviewed. Dr. Britt moved to recommend approval <strong>of</strong> the<br />

following applications. Ms. Nation seconded the motion <strong>and</strong> the vote was unanimous in the affirmative.<br />

Ms. Heaton reported on a pending Complaint against Robert M. Bradbury, RC alleging<br />

substance abuse. She said Mr. Bradbury had met with staff <strong>and</strong> decided to enter into treatment. Once<br />

that is successfully completed, his case would be brought to the <strong>Board</strong> with a Voluntary Submittal to<br />

Jurisdiction that would allow the <strong>Board</strong> to monitor him.<br />

Mr. Wersal introduced Alecia George, AAG, Kim Heaton, AAG, Marissa Lane, <strong>and</strong> Melody<br />

Beard, RCP. Ms. George will be providing legal guidance to the Committee. Ms. Heaton <strong>and</strong> Ms. Lane<br />

will be prosecuting cases on behalf <strong>of</strong> the State <strong>and</strong> the <strong>Board</strong>. Ms. Beard was welcomed as the newest<br />

appointee to the Committee.<br />

There being no further business, Dr. Britt moved to adjourn the meeting. Mr. Pettigrew seconded<br />

the motion <strong>and</strong> the vote was unanimous in the affirmative. The time was 1:32 p.m.
