Addressed to the UN Inter-Agency Meeting <strong>on</strong> the <strong>Safety</strong> <strong>of</strong> <strong>Journalists</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the Issue <strong>of</strong><br />

Impunity in Vienna <strong>on</strong> 22-23 November 2012, organized by UNESCO.<br />

We, members <strong>of</strong> the Nati<strong>on</strong>al C<strong>on</strong>sultative Meeting in <str<strong>on</strong>g>Islamabad</str<strong>on</strong>g> <strong>on</strong> 05 November 2012:<br />

1. C<strong>on</strong>demn all cases <strong>of</strong> killings <str<strong>on</strong>g>and</str<strong>on</strong>g> other physical attacks, intimidati<strong>on</strong>, harassment,<br />

threats, abducti<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> wr<strong>on</strong>gful impris<strong>on</strong>ment as well as other forms <strong>of</strong> oppressi<strong>on</strong> <strong>of</strong><br />

journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> other media workers;<br />

2. Express our c<strong>on</strong>cern over insufficient coordinated efforts to end impunity for the killers<br />

<strong>of</strong> journalists;<br />

3. Urge all parties including n<strong>on</strong>-state actors to respect the pr<strong>of</strong>essi<strong>on</strong>al independence <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

rights <strong>of</strong> journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> media workers;<br />

4. Reaffirm the right <strong>of</strong> journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> media workers to work free from harm, harassment<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> abuse, which is fundamental to freedom <strong>of</strong> expressi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> therefore a matter <strong>of</strong><br />

urgent <str<strong>on</strong>g>and</str<strong>on</strong>g> legitimate c<strong>on</strong>cern for Government <strong>of</strong> Pakistan as well as for the news<br />

media themselves;<br />

5. Seek firmer commitment from Government <strong>of</strong> Pakistan towards the issue <strong>of</strong> impunity<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> security <strong>of</strong> journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> urge for c<strong>on</strong>crete <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>tinuous acti<strong>on</strong>s towards<br />

developing enabling legal frameworks, reviewing <str<strong>on</strong>g>and</str<strong>on</strong>g> implementing existing laws,<br />

building more robust prosecuting mechanisms, <str<strong>on</strong>g>and</str<strong>on</strong>g> strengthening relevant nati<strong>on</strong>al<br />

policies;


6. Seek justice from c<strong>on</strong>cerned authorities <str<strong>on</strong>g>and</str<strong>on</strong>g> duty bearers for the families <strong>of</strong> the victim<br />

journalists through c<strong>on</strong>clusive legal investigati<strong>on</strong>s into the killings <strong>of</strong> journalists;<br />

7. Encourage the Government, media organizati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> the civil society, in cooperati<strong>on</strong><br />

with the internati<strong>on</strong>al community, to develop a mechanism <str<strong>on</strong>g>and</str<strong>on</strong>g> ensure necessary<br />

resources to protect media pers<strong>on</strong>nel from security threats <str<strong>on</strong>g>and</str<strong>on</strong>g> support the families <strong>of</strong><br />

the victims;<br />

8. Encourage media organizati<strong>on</strong>s including owners, editors, managers <str<strong>on</strong>g>and</str<strong>on</strong>g> journalist<br />

uni<strong>on</strong>s to adopt a comm<strong>on</strong> code <strong>of</strong> c<strong>on</strong>duct, establish proper legal status <strong>of</strong> employees,<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> have str<strong>on</strong>g security policies <str<strong>on</strong>g>and</str<strong>on</strong>g> capacity building measures to ensure safe<br />

working c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> all working media pers<strong>on</strong>nel, especially those in c<strong>on</strong>flict areas;<br />

9. Call for more effective, inclusive <str<strong>on</strong>g>and</str<strong>on</strong>g> coordinated initiatives by the United Nati<strong>on</strong>s<br />

System, including c<strong>on</strong>tinuous m<strong>on</strong>itoring <str<strong>on</strong>g>and</str<strong>on</strong>g> reporting <strong>of</strong> the implementati<strong>on</strong> <strong>of</strong> the<br />

UN Security Council Resoluti<strong>on</strong> 1738 <strong>on</strong> the safety <strong>of</strong> journalists in c<strong>on</strong>flict <str<strong>on</strong>g>and</str<strong>on</strong>g> an end<br />

to impunity;<br />

10. Urge One UN in Pakistan under the leadership <strong>of</strong> Resident Coordinator to mainstream<br />

this issue into its developmental <str<strong>on</strong>g>and</str<strong>on</strong>g> humanitarian activities in 2013 to 2017;<br />

11. Welcome the initiative towards the implementati<strong>on</strong> strategy <strong>of</strong> UN Plan <strong>of</strong> Acti<strong>on</strong> <strong>on</strong><br />

the <strong>Safety</strong> <strong>of</strong> <strong>Journalists</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the Issue <strong>of</strong> Impunity <str<strong>on</strong>g>and</str<strong>on</strong>g> declare that this historic<br />

commitment should fulfill the high expectati<strong>on</strong>s to which it gives rise;<br />

12. Propose that the acute c<strong>on</strong>cerns <strong>of</strong> the media for meaningful <str<strong>on</strong>g>and</str<strong>on</strong>g> practical acti<strong>on</strong>s are<br />

fully <str<strong>on</strong>g>and</str<strong>on</strong>g> seriously taken into account at the UN Inter-Agency Meeting being held in<br />

Vienna in November <str<strong>on</strong>g>and</str<strong>on</strong>g> thereafter in the effective implementati<strong>on</strong> <strong>of</strong> the UN Plan <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

its stakeholders at all levels.


PAKISTAN SPECIFIC INPUTS TO THE IMPLEMENTATION STARTEGY OF THE<br />

UNITED NATIONS’ PLAN OF ACTION ON THE SAFETY OF JOURNALISTS AND<br />

THE ISSUE OF IMPUNITY- 2012<br />

I. INTRODUCTION<br />

1. The safety <strong>of</strong> journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> media workers in Pakistan remains a major c<strong>on</strong>cern in the<br />

light <strong>of</strong> high levels <strong>of</strong> violence, including threats, intimidati<strong>on</strong>, assaults, kidnappings <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

killings targeting print, broadcast <str<strong>on</strong>g>and</str<strong>on</strong>g> <strong>on</strong>line media workers in the country. This calls for<br />

the acti<strong>on</strong> <strong>of</strong> Government, Civil Society <str<strong>on</strong>g>and</str<strong>on</strong>g> the <strong>Journalists</strong> themselves to increase their<br />

commitment towards safety <strong>of</strong> <strong>Journalists</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> end impunity for the killers <strong>of</strong> journalists.<br />

2. There is a general c<strong>on</strong>sensus that the single biggest challenge to the establishment <strong>of</strong> a safe<br />

journalism is the prevailing culture <strong>of</strong> impunity for those who commit violence against<br />

media. The fight against impunity must therefore be at the heart <strong>of</strong> plan <strong>of</strong> acti<strong>on</strong> to inspire<br />

strategies for raising awareness about this issue <str<strong>on</strong>g>and</str<strong>on</strong>g> establishing effective partnerships<br />

am<strong>on</strong>g all stakeholders to tackle it together.<br />

3. The Freedom <strong>of</strong> Expressi<strong>on</strong> is inherent <strong>of</strong> Article 19-A <strong>of</strong> 1973 C<strong>on</strong>stituti<strong>on</strong> which states:<br />

“Every citizen shall have the right to have Access to informati<strong>on</strong> in all matters <strong>of</strong> public<br />

importance subject to regulati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> reas<strong>on</strong>able restricti<strong>on</strong>s imposed by law." Which calls<br />

for the greater acti<strong>on</strong> for effective legislati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> policy to safe guard right to Freedom <strong>of</strong><br />

Informati<strong>on</strong> Act, <str<strong>on</strong>g>and</str<strong>on</strong>g> related obligati<strong>on</strong>s under internati<strong>on</strong>al law instruments.<br />

4. In this regard, journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> their organizati<strong>on</strong>s need to develop effective mechanisms to<br />

m<strong>on</strong>itor <str<strong>on</strong>g>and</str<strong>on</strong>g> gather informati<strong>on</strong> about press violati<strong>on</strong>s as well as to identify pro-active <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

result-oriented initiatives to ensure such informati<strong>on</strong> is shared with the authorities <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

other partners at the local, nati<strong>on</strong>al, regi<strong>on</strong>al <str<strong>on</strong>g>and</str<strong>on</strong>g> internati<strong>on</strong>al levels. This approach would<br />

increase the pressure <strong>on</strong> the authorities to take acti<strong>on</strong> against those resp<strong>on</strong>sible <str<strong>on</strong>g>and</str<strong>on</strong>g> over<br />

the l<strong>on</strong>g the term through c<strong>on</strong>sistent practice, provides deterrence against future attacks <strong>on</strong><br />

journalists.


kidnap, arrest, etc. In time <strong>of</strong> crisis, media organizati<strong>on</strong>s should devise mechanisms to<br />

report <str<strong>on</strong>g>and</str<strong>on</strong>g> alert the legal instruments to provide safety to journalists in challenging<br />

situati<strong>on</strong>. Due regard should be given to working c<strong>on</strong>diti<strong>on</strong>s <strong>of</strong> freelance journalists who<br />

lack employers’ backing.<br />

Civil Society <str<strong>on</strong>g>and</str<strong>on</strong>g> Human Right’s Activists<br />

• Develop Advocacy Skills: Effective media advocacy requires skills to ensure that the issues<br />

<strong>of</strong> c<strong>on</strong>cern to journalists get a fair chance to be debated at nati<strong>on</strong>al, regi<strong>on</strong>al <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

internati<strong>on</strong>al levels which media representatives can’t access. These skills range from the<br />

preparati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> presentati<strong>on</strong> <strong>of</strong> the informati<strong>on</strong> to preparing <str<strong>on</strong>g>and</str<strong>on</strong>g> presenting informati<strong>on</strong> to<br />

the timing <strong>of</strong> submissi<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> targeting <strong>of</strong> potential sp<strong>on</strong>sors.<br />

• Maintain str<strong>on</strong>g networks <str<strong>on</strong>g>and</str<strong>on</strong>g> Encouraging collective acti<strong>on</strong>: Solidarity should be the<br />

cornerst<strong>on</strong>e <strong>of</strong> the campaign for the safety <strong>of</strong> journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> the fight against impunity.<br />

<strong>Journalists</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> their organizati<strong>on</strong>s should c<strong>on</strong>demn every incident <strong>of</strong> violence across the<br />

country. The more united fr<strong>on</strong>t they present, the less likely their call will be ignored. In<br />

particular, Press Clubs should priorities organizing its affiliated organizati<strong>on</strong>s to strengthen<br />

their capacity to act in defense <strong>of</strong> independent reporting.<br />

• Develop mechanism <strong>of</strong> prosecuti<strong>on</strong>: Civil society <str<strong>on</strong>g>and</str<strong>on</strong>g> human rights commissi<strong>on</strong> should put<br />

in place a mechanism, which provides a platform to seek justice from c<strong>on</strong>cerned authorities<br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> duty bearers by efforts towards c<strong>on</strong>clusive investigati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> prosecuti<strong>on</strong> for the<br />

families <strong>of</strong> the victim journalists through c<strong>on</strong>clusive legal investigati<strong>on</strong>s into the killings <strong>of</strong><br />

journalists;<br />

Press Clubs, Media workers <str<strong>on</strong>g>and</str<strong>on</strong>g> Organizati<strong>on</strong>s<br />

• <strong>Safety</strong> training: Every journalist needs to have basic training in life saving techniques for<br />

hostile envir<strong>on</strong>ments. Such training should involve trauma counseling, including a genderbased<br />

approach, <str<strong>on</strong>g>and</str<strong>on</strong>g> the use <strong>of</strong> social media to share crucial informati<strong>on</strong> in time <strong>of</strong> crisis in<br />

a secure manner. One UN Pakistan together with stakeholders shall take lead role in this<br />

regard.


• Accountability through Media Credibility Index based <strong>on</strong> MDIs: A separate mechanism <strong>of</strong><br />

evaluating, media organizati<strong>on</strong>s through media Credibility Index based <strong>on</strong> Media<br />

Development Indicators, to alert <str<strong>on</strong>g>and</str<strong>on</strong>g> highlight issue <strong>of</strong> unethical, biased, self censored<br />

policies, to invoke free <str<strong>on</strong>g>and</str<strong>on</strong>g> ethical media practices am<strong>on</strong>g journalists. Based <strong>on</strong> MCI,<br />

journalists should receive training <strong>on</strong> recording evidence about an incident <str<strong>on</strong>g>and</str<strong>on</strong>g> feed that<br />

informati<strong>on</strong> back to their organizati<strong>on</strong>. To this end, there is also need to create the post <strong>of</strong> a<br />

safety <strong>of</strong>ficer in every Press Club whose resp<strong>on</strong>sibility should focus <strong>on</strong> m<strong>on</strong>itoring attacks<br />

<strong>on</strong> media <str<strong>on</strong>g>and</str<strong>on</strong>g> issue alerts to partners.<br />

• Commitment to <str<strong>on</strong>g>Islamabad</str<strong>on</strong>g> <str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>Safety</strong> <strong>of</strong> <strong>Journalists</strong>: Commitment to <str<strong>on</strong>g>Islamabad</str<strong>on</strong>g><br />

<str<strong>on</strong>g>Declarati<strong>on</strong></str<strong>on</strong>g> <strong>on</strong> <strong>Safety</strong> <strong>of</strong> <strong>Journalists</strong>: Media workers <str<strong>on</strong>g>and</str<strong>on</strong>g> their organizati<strong>on</strong>s should<br />

spearhead the campaign to urge all stakeholders to sign, ratify <str<strong>on</strong>g>and</str<strong>on</strong>g> domesticate instruments,<br />

regi<strong>on</strong>al <str<strong>on</strong>g>and</str<strong>on</strong>g> internati<strong>on</strong>al, related to the protecti<strong>on</strong> <strong>of</strong> human rights. A close collaborati<strong>on</strong><br />

with lawyers’ organizati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> human rights organizati<strong>on</strong> should be c<strong>on</strong>sidered. Member<br />

States who are parties to existing instruments must undertake to comply with obligati<strong>on</strong><br />

there<strong>of</strong>.<br />

• Work towards the implementati<strong>on</strong> <strong>of</strong> the UN Plan <strong>of</strong> Acti<strong>on</strong> <strong>on</strong> The <strong>Safety</strong> <strong>of</strong> <strong>Journalists</strong>:<br />

<strong>Safety</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> the Issue <strong>of</strong> Impunity in cooperati<strong>on</strong> with all actors involved such as<br />

internati<strong>on</strong>al <str<strong>on</strong>g>and</str<strong>on</strong>g> regi<strong>on</strong>al organizati<strong>on</strong>s, neighboring countries, pr<strong>of</strong>essi<strong>on</strong>al associati<strong>on</strong>s,<br />

PROCEEDINGS OF THE GROUP WORK<br />

Group 1: Legal <str<strong>on</strong>g>and</str<strong>on</strong>g> Policy Framework<br />

The group participant suggested following interventi<strong>on</strong>s to be addressed <strong>on</strong> the<br />

issue <strong>of</strong> impunity regarding policy <str<strong>on</strong>g>and</str<strong>on</strong>g> legal Frameworks:<br />

i. Compliance <strong>of</strong> industrial relati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> laws such as Industrial Relati<strong>on</strong> Act, Workmen<br />

Compensati<strong>on</strong> Law, insurance related obligati<strong>on</strong>s, etc. by the media industry owners<br />

should be introduced <str<strong>on</strong>g>and</str<strong>on</strong>g> implemented.<br />

ii. Media industry owners should be demarcated from working journalists.<br />

iii. Reviewing <str<strong>on</strong>g>and</str<strong>on</strong>g> reforming procedural <str<strong>on</strong>g>and</str<strong>on</strong>g> legal frameworks governing media industry<br />

in particular. Linkages may be developed between existing legal structures, such<br />

Nati<strong>on</strong>al Human Rights Commissi<strong>on</strong>, governing human rights <str<strong>on</strong>g>and</str<strong>on</strong>g> journalists’ rights.<br />

iv. Independence <str<strong>on</strong>g>and</str<strong>on</strong>g> aut<strong>on</strong>omy <strong>of</strong> the media regulators must be ensured.<br />

v. Groups/associati<strong>on</strong> <strong>of</strong> media friendly lawyers may be organized. A media legal fund<br />

may be created to support journalists with limited resources to hire expert lawyers for<br />

their cases in the courts.<br />

vi. Parliament should enact an enabling law <strong>on</strong> right to informati<strong>on</strong>, which should cover<br />

journalists’ right to access to informati<strong>on</strong>.<br />

Group 2: Capacity Building Towards <strong>Safety</strong><br />

The group participant had internal discussi<strong>on</strong> by raising first some questi<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

then tried to find answers as suggested recommendati<strong>on</strong>s to be addressed <strong>on</strong> the<br />

issue <strong>of</strong> capacity building <strong>of</strong> media towards safety:<br />

1. What are the present challenges in different areas?<br />

i. Inattenti<strong>on</strong> to/n<strong>on</strong>-prioritizati<strong>on</strong> <strong>of</strong> pr<strong>of</strong>essi<strong>on</strong>al ethics (fairness, balance, verificati<strong>on</strong> in<br />

reporting/writing) by media <str<strong>on</strong>g>and</str<strong>on</strong>g> journalists<br />

ii. Reporting <strong>of</strong>/coverage <strong>on</strong> violence (militant, sectarian, ethnic, faith-based, terrorism, etc) is<br />

d<strong>on</strong>e without acquiring skills <strong>of</strong> C<strong>on</strong>flict Sensitive Journalism (CSJ). No training institutes that


teach CSJ, no courses at universities teaching journalism <str<strong>on</strong>g>and</str<strong>on</strong>g> no interest by media houses to<br />

train their staff in CSJ.<br />

iii. Absence <strong>of</strong> st<str<strong>on</strong>g>and</str<strong>on</strong>g>ard set <strong>of</strong> security protocols - drafted <str<strong>on</strong>g>and</str<strong>on</strong>g> approved by media houses,<br />

endorsed by media associati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> adopted by media operators.<br />

iv. Absence <strong>of</strong> a centralized complaints reporting/documentati<strong>on</strong> <strong>of</strong> security-related issues<br />

facing journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> redressal mechanisms<br />

v. Absence <strong>of</strong> an "Alliance <strong>of</strong> Media <strong>on</strong> Security" that brings together all key media houses,<br />

media associati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> other allied media stakeholders that acknowledge, support <str<strong>on</strong>g>and</str<strong>on</strong>g> help<br />

implement policies to reduce risks <str<strong>on</strong>g>and</str<strong>on</strong>g> enhance safety for journalists<br />

vi. Lack <strong>of</strong> an enforceable accountability <strong>of</strong> media houses that may or may not hire journalists<br />

as full, formal employees, or c<strong>on</strong>tracts staff but who get hurt while working for the media<br />

houses.<br />

2. How far do media organizati<strong>on</strong>s <str<strong>on</strong>g>and</str<strong>on</strong>g> journalists' associati<strong>on</strong>s provide support?<br />

i. There should be a Media Threat Index identifying the types <strong>of</strong> risks that journalists face in<br />

various regi<strong>on</strong>s <strong>of</strong> Pakistan as well as outlining relevant risk mitigati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> risk resp<strong>on</strong>se<br />

mechanisms/processes, to generate st<str<strong>on</strong>g>and</str<strong>on</strong>g>ard minimum resp<strong>on</strong>ses when attacks occur.<br />

ii. There should be clear, written lines relating to security in c<strong>on</strong>tract letters so that journalists<br />

are discouraged from unnecessary risk taking that are likely to result in attacks.<br />

iii. There should be an instituti<strong>on</strong>alized interface between editors/Desk <str<strong>on</strong>g>and</str<strong>on</strong>g> reporters/Field in<br />

all media houses to remove misunderst<str<strong>on</strong>g>and</str<strong>on</strong>g>ings <str<strong>on</strong>g>and</str<strong>on</strong>g> mispercepti<strong>on</strong>s as well as orientati<strong>on</strong> <strong>on</strong> the<br />

sensitivities <strong>of</strong> reporting from the c<strong>on</strong>flict z<strong>on</strong>es to protect reporters from harm.<br />

iv. Media houses, press clubs <str<strong>on</strong>g>and</str<strong>on</strong>g> journalists uni<strong>on</strong>s should make it m<str<strong>on</strong>g>and</str<strong>on</strong>g>atory <strong>on</strong> their<br />

members <str<strong>on</strong>g>and</str<strong>on</strong>g> staffers to undergo orientati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> training <strong>on</strong> risks <str<strong>on</strong>g>and</str<strong>on</strong>g> mitigati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> harm<br />

preventi<strong>on</strong> strategies.


3. What informati<strong>on</strong>, knowledge, skills acquired by journalists to deal with hostile<br />

situati<strong>on</strong>s, <str<strong>on</strong>g>and</str<strong>on</strong>g> law-enforcement bodies to deal with impunity?<br />

i. Absence <strong>of</strong> C<strong>on</strong>flict Sensitive Journalism (CSJ) knowledge, skills, capacity <str<strong>on</strong>g>and</str<strong>on</strong>g> orientati<strong>on</strong><br />

<str<strong>on</strong>g>and</str<strong>on</strong>g> lack <strong>of</strong> trainings for adequate numbers <strong>of</strong> journalists in Pakistan.<br />

ii. Absence <strong>of</strong> an instituti<strong>on</strong>alized interface between the media community <str<strong>on</strong>g>and</str<strong>on</strong>g> legal fraternity<br />

to serve as a legal aid mechanism for journalists in distress.<br />

iii. Absence <strong>of</strong> a Fund to provide resources to finance legal aid for journalists seeking justice<br />

against attacks <str<strong>on</strong>g>and</str<strong>on</strong>g> harm.<br />

iv. Absence <strong>of</strong> verified, periodic data <strong>on</strong> violati<strong>on</strong>s against media in Pakistan that can serve as<br />

a guide <strong>on</strong> resp<strong>on</strong>se mechanisms to help journalists under attack<br />

Group 3: Role <strong>of</strong> civil society <strong>of</strong> Civil Society <str<strong>on</strong>g>and</str<strong>on</strong>g> Human Rights<br />

Activists as watchdogs<br />

The role <strong>of</strong> civil society <str<strong>on</strong>g>and</str<strong>on</strong>g> human rights activists as suggested in UNESCO’s proposed<br />

plan <strong>of</strong> acti<strong>on</strong> <strong>on</strong> the safety <strong>of</strong> journalists <str<strong>on</strong>g>and</str<strong>on</strong>g> the issue <strong>of</strong> impunity st<str<strong>on</strong>g>and</str<strong>on</strong>g>s endorsed by the<br />

c<strong>on</strong>sultati<strong>on</strong> participants.<br />

The measures suggested by UNESCO include<br />

• Develop Advocacy Skills<br />

• Maintain str<strong>on</strong>g networks <str<strong>on</strong>g>and</str<strong>on</strong>g> encourage collective acti<strong>on</strong><br />

i. A number <strong>of</strong> CSOs issue statements c<strong>on</strong>demning the killing <strong>of</strong> journalists; however<br />

these individual statements do not make a lot <strong>of</strong> impact. To ensure that CSOs can raise<br />

the voices effectively, the formati<strong>on</strong> <strong>of</strong> a coaliti<strong>on</strong> <strong>of</strong> NGO’s <str<strong>on</strong>g>and</str<strong>on</strong>g> CSOs is<br />

recommended, in order to serve as a neutral platform that can take a collective st<str<strong>on</strong>g>and</str<strong>on</strong>g><br />

against impunity <str<strong>on</strong>g>and</str<strong>on</strong>g> increasing threats to journalists. This coaliti<strong>on</strong> can release


collective c<strong>on</strong>demnati<strong>on</strong>s, statements <strong>of</strong> c<strong>on</strong>cern etc. <strong>on</strong> all cases <strong>of</strong> journalist killings,<br />

assaults <str<strong>on</strong>g>and</str<strong>on</strong>g> threats.<br />

ii. Creati<strong>on</strong> <strong>of</strong> a c<strong>on</strong>sensus credibility index, that can help differentiate good journalism<br />

from bad <str<strong>on</strong>g>and</str<strong>on</strong>g> discourage unethical practices <strong>of</strong> journalism. CSOs should also ensure<br />

that all such data is made public.<br />

iii. Regular m<strong>on</strong>itoring <str<strong>on</strong>g>and</str<strong>on</strong>g> evaluati<strong>on</strong> <strong>of</strong> media news c<strong>on</strong>tent. The m<strong>on</strong>itoring <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

evaluati<strong>on</strong> should include, M<strong>on</strong>itoring <str<strong>on</strong>g>and</str<strong>on</strong>g> evaluati<strong>on</strong> <strong>of</strong> news c<strong>on</strong>tent for journalism<br />

quality; specifically indicating any biases that are likely to put reporters <str<strong>on</strong>g>and</str<strong>on</strong>g> news teams<br />

in danger, M<strong>on</strong>itoring <strong>of</strong> news c<strong>on</strong>tent that can put journalists directly in the way <strong>of</strong><br />

danger for example live coverage from z<strong>on</strong>es where armed operati<strong>on</strong>s being c<strong>on</strong>ducted.<br />

iv. Formati<strong>on</strong> <strong>of</strong> a grievance mechanism, where media c<strong>on</strong>sumers can lodge complains<br />

about media c<strong>on</strong>tent being aired. The grievance mechanism should be able to follow up<br />

<strong>on</strong> the acti<strong>on</strong>s <strong>of</strong> media regulatory bodies as well as the media outlets <strong>on</strong>ce the<br />

complaints have been lodged. All informati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> data generated during this process<br />

should be public.<br />

v. CSOs should work with academia to c<strong>on</strong>duct a review <str<strong>on</strong>g>and</str<strong>on</strong>g> revisi<strong>on</strong> <strong>of</strong> mass<br />

communicati<strong>on</strong> courses. Comparis<strong>on</strong>s with reputed internati<strong>on</strong>al university courses<br />

should be carried out <str<strong>on</strong>g>and</str<strong>on</strong>g> c<strong>on</strong>textualized accordingly.<br />

vi. CSOs should work with universities to develop a module to teach journalism students<br />

basic safety <str<strong>on</strong>g>and</str<strong>on</strong>g> security in the field including but not limited to key ethical<br />

c<strong>on</strong>siderati<strong>on</strong>s, the lack <strong>of</strong> which could put journalists at risk.<br />

vii. CSOs should work with universities <str<strong>on</strong>g>and</str<strong>on</strong>g> mass communicati<strong>on</strong> departments to facilitate<br />

in depth empirical, quantitative <str<strong>on</strong>g>and</str<strong>on</strong>g> qualitative research <strong>on</strong> media c<strong>on</strong>tent <str<strong>on</strong>g>and</str<strong>on</strong>g> practices.<br />

viii. One <strong>of</strong> the reas<strong>on</strong>s for prevailing impunity in journalist killing cases is the lack <strong>of</strong> a<br />

proper pressure group that can c<strong>on</strong>tinuously lobby <str<strong>on</strong>g>and</str<strong>on</strong>g> advocate for increasing safety<br />

measures <str<strong>on</strong>g>and</str<strong>on</strong>g> ending impunity for killers <strong>of</strong> journalists. The CSOs should play a pivotal


ole in the formati<strong>on</strong> <strong>of</strong> such a pressure group <str<strong>on</strong>g>and</str<strong>on</strong>g> lobby together to for measures that<br />

ensure safe working envir<strong>on</strong>ment for journalists. The pressure group should target;<br />

Government / State Agencies that have to undertake investigati<strong>on</strong>s into journalist<br />

killings <str<strong>on</strong>g>and</str<strong>on</strong>g> are resp<strong>on</strong>sible for providing justice. Media owners who have to place<br />

internal safety protocols in place <str<strong>on</strong>g>and</str<strong>on</strong>g> provide safety equipment, medical <str<strong>on</strong>g>and</str<strong>on</strong>g> life<br />

insurance to employees.<br />

ix. The rat race for breaking news has been identified as <strong>on</strong>e <strong>of</strong> the key reas<strong>on</strong>s which<br />

compel journalists to work in risky situati<strong>on</strong>s. The CSOs can act as a pressure group to<br />

discourage this type <strong>of</strong> competiti<strong>on</strong> am<strong>on</strong>g news organizati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> suggest alternative<br />

news [<str<strong>on</strong>g>and</str<strong>on</strong>g> competiti<strong>on</strong>] models that keep journalist safety in mind.<br />

x. A majority <strong>of</strong> journalists killed in the last 10 years (2002-2012) were working for<br />

electr<strong>on</strong>ic media. The electr<strong>on</strong>ic media in the private sector is regulated by the Pakistan<br />

Electr<strong>on</strong>ic Media Regulatory Authority (PEMRA), whose board is governed almost<br />

entirely by government-service pers<strong>on</strong>s, with virtually no representati<strong>on</strong> from the civil<br />

society. At least <strong>on</strong>e-third representati<strong>on</strong> <strong>on</strong> the PEMRA board should be from the civil<br />

society so that they can check the unannounced media policies that lead to unnecessary<br />

risk taking by journalists.<br />

xi. The biggest televisi<strong>on</strong> (Pakistan Televisi<strong>on</strong>) <str<strong>on</strong>g>and</str<strong>on</strong>g> radio (Pakistan Broadcasting<br />

Corporati<strong>on</strong>) operati<strong>on</strong>s in Pakistan are run <str<strong>on</strong>g>and</str<strong>on</strong>g> managed by the state. These mostly<br />

serve government interests, not public interest. being outside the regulatory jurisdicti<strong>on</strong><br />

<strong>of</strong> PEMRA, they indirectly force private sector broadcasters to indulge in the breaking<br />

news culture in an envir<strong>on</strong>ment <strong>of</strong> c<strong>on</strong>flict, which hurts journalists. Both the TV <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

radio operati<strong>on</strong>s in state h<str<strong>on</strong>g>and</str<strong>on</strong>g>s should be c<strong>on</strong>verted into public service broadcasting<br />

through setting up boards <strong>of</strong> governors, which should have a majority <strong>of</strong> members<br />

drawn from civil society who, in public interest, can effectively discourage unnecessary<br />

risk taking.<br />

xii. CSOs should put up a united fr<strong>on</strong>t to start litigati<strong>on</strong> <str<strong>on</strong>g>and</str<strong>on</strong>g> pursue legal against the killers<br />

<strong>of</strong> journalists. Am<strong>on</strong>g the 86 journalist killings in Pakistan <strong>on</strong>ly <strong>on</strong>e has been solved so<br />

far, the killing <strong>of</strong> Daniel Pearl. In most cases, the families <strong>of</strong> the Pakistani journalists


eing killed do not have the capacity to pursue legal acti<strong>on</strong>. A lot <strong>of</strong> them are<br />

threatened themselves <str<strong>on</strong>g>and</str<strong>on</strong>g> are forced to withdraw cases. The Civil Society can be<br />

effective in perusing justice for the slain journalists if they get together to file cases <str<strong>on</strong>g>and</str<strong>on</strong>g><br />

act as a pressure group.
