Minutes<br />

The Physical Therapy Committee <strong>of</strong> the <strong>Board</strong> <strong>of</strong> <strong>Medical</strong> Licensure and Supervision<br />

met on May 1, 2008. The meeting was held at the <strong>of</strong>fice <strong>of</strong> the <strong>Board</strong>, 5104 North Francis,<br />

Suite C, <strong>Oklahoma</strong> City, <strong>Oklahoma</strong> in accordance with the Open Meetings Act and the<br />

Administrative Procedures Act. Members present were:<br />

The meeting was called to order at 9:00 a.m. The minutes from the February 14,<br />

2008, Committee meetings were reviewed. Mr. Gavras moved to approve the minutes. Ms.<br />

Staley seconded the motion and the vote was unanimous in the affirmative.<br />

TRAVIS CALTON appeared in support <strong>of</strong> his application to sit for the Physical<br />

Therapist examination and for licensure pending passing the exam. Elizabeth Scott,<br />

Assistant Attorney General, briefed the Committee on Mr. Calton’s substance abuse history<br />

and presented an Agreement for licensure. She advised that the Agreement was not a<br />

disciplinary action but would allow the <strong>Board</strong> to monitor Mr. Calton. The Committee<br />

discussed requiring Mr. Calton to work under direct supervision for a time. Also discussed<br />

was his obligation to advise any Physical Therapist Assistant he may supervise that he was<br />

being monitored by the <strong>Board</strong>.<br />

Ms. Reese moved to amend the Agreement, adding a requirement that Mr. Calton<br />

work under direct supervision for the first year. Additionally, she moved to add the<br />

requirement that he disclose the Agreement to any PTA that he supervises. Ms. Staley<br />

seconded the motion and the vote was unanimous in the affirmative. Mr. Gavras moved to<br />

recommend approval <strong>of</strong> the application to sit for the exam. He further moved to<br />

recommend approval for licensure under terms <strong>of</strong> the Agreement pending passing the<br />

exam. Mr. Titony seconded the motion and the vote was unanimous in the affirmative.<br />

KYMBERLI RAE CHEEK appeared in support <strong>of</strong> her application for reinstatement<br />

<strong>of</strong> Physical Therapist Assistant licensure. Ms. Cheek had been out <strong>of</strong> practice since 1999.<br />

Ms. Cheek testified regarding her activities since leaving practice. She presented a letter <strong>of</strong><br />

support from her supervisor. Ms. Reese moved to recommend approval <strong>of</strong> the application<br />

pending satisfactory completion <strong>of</strong> one year <strong>of</strong> practice under direct supervision, passing<br />

the jurisprudence exam and completion <strong>of</strong> 80 hours <strong>of</strong> continuing education (half the hours<br />

in Category A) to be completed prior to end <strong>of</strong> the current compliance period in addition to<br />

the 30 hours required for this period. Mr. Titony seconded the motion and the vote was<br />

unanimous in the affirmative.<br />

ALYSSA NEAL appeared in support <strong>of</strong> her application to sit for the Physical<br />

Therapist Assistant examination and for licensure. Ms. Reese recused from consideration<br />

<strong>of</strong> the application. Ms. Neal had failed the PTA exam twice. Her plan <strong>of</strong> study for the<br />

exam was reviewed. Mr. Gavras moved to recommend approval to sit for the exam and<br />

recommend approval for licensure pending passing the exam. Mr. Titony seconded the<br />

motion and the vote was unanimous in the affirmative (with Ms. Reese abstaining from the<br />

vote).<br />

DARIN GOLDSMITH appeared in support <strong>of</strong> his application to sit for the Physical<br />

Therapist examination and licensure. After reviewing the application, Mr. Gavras moved<br />

to recommend approval <strong>of</strong> the application. Ms. Reese seconded the motion and the vote<br />

was unanimous in the affirmative.<br />

NICHOLAS PINGRY appeared in support <strong>of</strong> his application to sit for the Physical<br />

Therapist examination and for licensure. Mr. Pingry’s ex-girlfriend had filed an emergency<br />

protective order against him. The hearing on the emergency order was to be held May 5,<br />

2008. After discussion Ms. Reese moved to recommend approval to sit for the licensure<br />

exam. She further moved that prior to consideration <strong>of</strong> his licensure application at the<br />

August 28, 2008 meeting <strong>of</strong> the Advisory Committee, Mr. Pingry should have letters<br />

submitted from his clinical instructors and college pr<strong>of</strong>essors regarding his behavior and<br />

pr<strong>of</strong>essionalism. Mr. Pingry need not appear at the August Committee meeting unless<br />

there is significant extension <strong>of</strong> the protective order. Mr. Titony seconded the motion and<br />

the vote was unanimous in the affirmative. Mr. Gavras moved to recommend, if the<br />

protective order is dismissed at the May 5 th hearing and the requested letters <strong>of</strong> support are<br />

favorable, the application for licensure should be submitted to the full <strong>Board</strong> on May 15,<br />

2008 for approval. Ms. Reese seconded the motion and the vote was unanimous in the<br />

affirmative.<br />

RABIYYAH HAZZIEZ appeared in support <strong>of</strong> her application for Physical<br />

Therapist Assistant licensure. Dr. Hazziez had failed the PTA exam five times. Dr.<br />

Hazziez had been issued a temporary letter to practice in <strong>Oklahoma</strong> from February 2006 to


November 2006, even though she had failed the exam in Missouri three times, because she<br />

had answered “no” to the question on the application regarding exam failures. After<br />

expiration <strong>of</strong> her temporary license, Dr. Hazziez attended chiropractic school and became a<br />

licensed chiropractor in 2005. After passing the PTA exam for New York on the sixth<br />

attempt, Dr. Hazziez had sought <strong>Oklahoma</strong> licensure. The Committee was concerned that<br />

she may have trouble separating her role as a PTA from that <strong>of</strong> a chiropractor.<br />

Additionally, they were concerned about the failure to disclose the examination history.<br />

Mr. Gavras moved to enter into Executive Session. Ms. Reese seconded the motion<br />

and the vote was unanimous in the affirmative. Mr. Gavras made the motion to return to<br />

open session. Ms. Staley seconded the motion and the vote was unanimous in the<br />

affirmative. No votes were taken during Executive Session and only the application <strong>of</strong> Dr.<br />

Hazziez was discussed.<br />

Dr. Hazziez testified regarding her examination history, her practice as a<br />

chiropractor and her reasons for wanting a PTA license. She stated she answered “no” on<br />

the application question regarding exam failures because she thought it asked if she had<br />

failed any exams in <strong>Oklahoma</strong> and did not pertain to the three failures in Missouri. Ms.<br />

Reese said she would like more information regarding Dr. Hazziez’ practice as a PTA and<br />

her employer’s understanding <strong>of</strong> her role as a PTA with reassurance that her duties had<br />

never and would never cross over into chiropractic. The Committee asked for a clearer<br />

explanation <strong>of</strong> her role as a PTA and her intention to work only as a PTA. Her supervising<br />

<strong>physical</strong> therapist would need to understand clearly that Dr. Hazziez would be working<br />

under his/her plans <strong>of</strong> care as a PTA. Ms. Freudiger suggested that she bring one <strong>of</strong> her<br />

supervising PTs with her to the August meeting.<br />

Ms. Reese moved to table the application until the August Committee meeting in<br />

order to allow time for Dr. Hazziez to submit significant additional information to add<br />

some clarity to the discussion. Ms. Staley seconded the motion. The Committee discussed<br />

the temporary license and authorized its extension until the August meeting, noting to Dr.<br />

Hazziez that extension <strong>of</strong> the temporary letter did not guarantee issuance <strong>of</strong> a full license.<br />

The vote was called and was unanimous in the affirmative.<br />

The Committee discussed proposed rule changes to OAC 435:20-1-1.1. Definitions<br />

[AMENDED] and OAC 435:20-7-1. Supervision <strong>of</strong> Physical Therapist Assistants<br />

[AMENDED] relating to supervision <strong>of</strong> PTAs. The rules submitted to the legislature had<br />

been withdrawn at the request <strong>of</strong> the Legislative Rules Committee when objections to the<br />

rules were presented by a few <strong>physical</strong> therapists. Virginia Harbour, PT and Cathy Wilson,<br />

PT were present for the discussion. Staff reported that a request would be submitted for a<br />

formal opinion from the Attorney General on whether a PT can delegate to a PTA that is<br />

not under his/her supervision. The discussion was tabled until the August 28 th Committee<br />

meeting in order to wait on the Attorney General opinion.


Applications for examination, licensure and reinstatement were reviewed. Mr.<br />

Gavras moved to recommend approval <strong>of</strong> the following applications for licensure as<br />

Physical Therapists. Ms. Staley seconded the motion and the vote was unanimous in the<br />

affirmative.<br />

motion and the vote was unanimous in the affirmative.<br />

the Physical Therapist licensure exam. He further moved to recommend approval for<br />

licensure pending passing the exam. Ms. Reese seconded the motion and the vote was<br />

moved to adopt the Continuing Education Sub<strong>committee</strong>’s recommendations. Ms. Staley<br />

seconded the motion and the vote was unanimous in the affirmative. (See attachment #1)<br />

A list <strong>of</strong> licensees who will be required to obtain double continuing education hours<br />

for the next compliance period was reviewed. Staff advised that 92 individuals will be<br />

required to get double hours. (See attachment #2)<br />

Examination results for May 1, 2007 to April 30, 2008 were reviewed. No action was<br />

required. (See attachment #3)<br />

The Committee discussed the newsletter. Staff was directed to add a list <strong>of</strong> those<br />

licensees required to obtain double continuing education hours.<br />

The Committee considered selection <strong>of</strong> a delegate and alternate for the Federation <strong>of</strong><br />

State <strong>Board</strong>s <strong>of</strong> Physical Therapy Annual Meeting. Ms. Staley nominated Ms. Freudiger as<br />

delegate and Ms. Reese as the alternate. Mr. Gavras seconded the motion and the vote was<br />

unanimous in the affirmative.<br />

Staff demonstrated the on-line Travel Claim Voucher system. No further action was<br />

required.<br />
