SECTION <strong>75</strong> – POOLED BUDGET PARTNERSHIP AGREEMENT<br />

1 PURPOSE OF REPORT<br />

1.1 To approve the overarching <strong>Section</strong> <strong>75</strong> <strong>Pooled</strong> <strong>Budget</strong> <strong>Partnership</strong> <strong>Agreement</strong> with<br />

Berkshire East Primary Care Trust PCT (BEPCT).<br />

2 RECOMMENDATION<br />

2.1 To approve the overarching S<strong>75</strong> <strong>Pooled</strong> <strong>Budget</strong> <strong>Partnership</strong> <strong>Agreement</strong> with<br />

BEPCT. (Appendix A).<br />

3 REASONS FOR RECOMMENDATION<br />

3.1 To enable the continued and potential extension of the delivery of integrated services<br />

for the benefit of people in Bracknell Forest.<br />

4 ALTERNATIVE OPTIONS CONSIDERED<br />

4.1 None at this stage.<br />

5 SUPPORTING INFORMATION<br />

5.1 <strong>Section</strong> <strong>75</strong> of the National Health Service Act 2006 allows the pooling of funds<br />

between health bodies and health-related local authority services. It further allows for<br />

functions that can be delegated and resources and management structures to be<br />

integrated. This agreement will replace both the existing and expired <strong>Section</strong> 31<br />

agreements.<br />

5.2 <strong>Partnership</strong> arrangements support more effective commissioning of existing or new<br />

services through the identification of synergies and efficiencies. It is the intention that<br />

Bracknell Forest Council uses this approach to enter into an agreement with BEPCT<br />

to integrate and continue to deliver, in partnership, those services where<br />

improvements for the outcomes of people in the community can be identified.<br />

5.3 This report recommends the approval of an overarching <strong>Section</strong> <strong>75</strong> <strong>Agreement</strong> which<br />

commits partners to a set of principles and working arrangements that ensure<br />

effective delivery, management and governance. This will be appended with service<br />

specific schedules which will amongst other things, reflect the exact nature of the<br />

service, its deliverables, perceived impact and performance measures. The service<br />

schedule for Intermediate Care Services is attached to this report. The service<br />

schedule for the Community Team for People with a Learning Disability is in<br />

development and is subject to negotiation regarding future commissioning leads.<br />

5.4 This partnership agreement, with BEPCT, is for the 2012-13 financial year. Future<br />

agreements will be between the council and the Clinical Commissioning Group.

6 ADVICE RECEIVED FROM STATUTORY AND OTHER OFFICERS<br />

Borough Solicitor<br />

6.1 The proposed agreement has been drafted to create a framework of principles within<br />

which further service specific agreements may be developed. The PCT will be<br />

abolished by statute in April 2013, and the agreement may then be transferred to a<br />

successor body. The Council has the necessary powers to enter into the proposed<br />

agreement under <strong>Section</strong> <strong>75</strong>.<br />

Borough Treasurer<br />

6.2 The Borough Treasurer is satisfied that no significant financial implications arise<br />

directly from this report. The services covered by the <strong>Agreement</strong> will continue to be<br />

funded from within existing identified budgets.<br />
