The day before President Obama’s fifth State of<br />

the Union Address, Valerie Jarrett, assistant to<br />

the president, bluntly told this writer in an exclusive<br />

interview that Obama would not hesitate to<br />

use the power of his pen to get action on vital<br />

initiatives that he feels should be passed. At the<br />

same moment that Jarrett declared Obama would<br />

take action to attempt to break the GOP’s torpedo<br />

of vital legislation backed by the White House,<br />

House Speaker John Boehner was equally blunt<br />

and saber rattled Obama that he’d better not think<br />

of taking unilateral action on legislation or else.<br />

Boehner didn’t spell out what the “or else” would<br />

be. There was really no need, because Boehner<br />

– as a troupe of GOP Obama bashers before him<br />

– is again cynically spinning the bogus line that<br />

Obama is recklessly usurping the Constitution by<br />

skirting Congress and going it alone on passing<br />

Super Bowl fever hit the New York City area<br />

this week, and it afflicted one middle school<br />

in Washington Heights particularly hard.<br />

Middle School 328 on 164th Street in Manhattan,<br />

which is about 90 percent Latino, was<br />

selected by the NFL to have its students participate<br />

in the Play 60 Character Camp and<br />

Healthy Cooking Demo held Tuesday evening<br />

in a large tent erected along the Hudson<br />

River.<br />

On a small football field, coaches taught 6th,<br />

7th and 8th graders American football fundamentals,<br />

with Hall of Fame lineman Anthony<br />

Muñoz on hand to talk to them about the importance<br />

of hard work and exercise – and to<br />

squat down to demonstrate proper blocking<br />

technique, too.<br />

“This is so much fun,” Muñoz, 55, told Fox<br />

News Latino. “It’s important that kids stay active,<br />

and football –the best team sport in the<br />

legislation.<br />

Obama is near the bottom on the list of presidents<br />

in the number of executive orders issued. The last<br />

president that issued orders at a lower rate than<br />

Obama was Grover Cleveland. GOP Presidents<br />

Reagan and George W. Bush issued far more executive<br />

orders per day in office than Obama. It’s<br />

not really the number or rate of executive orders,<br />

however, that Obama has issued that’s raised the<br />

hackles of the GOP. It’s the executive orders that<br />

he has issued that have given the GOP ammunition<br />

to attempt to intimidate and politically bash<br />

Obama.<br />

The GOP saw an opening to raise the canard of<br />

Obama as the alleged Constitutional and congressional<br />

usurper when he signed a series of orders<br />

on gun control nearly a year ago. Obama took the<br />

action precisely because he knew that gun control<br />

world – is a great way to do it.”<br />

As a Latino pioneer in the game, Muñoz is<br />

gratified to see more and more Hispanics<br />

in the pro football ranks. “I’ve always been<br />

proud of my heritage, and it’s great to see<br />

more and more Latino names on the back of<br />

the jerseys. And they aren’t all kickers, they’re<br />

linemen like the Broncos’ Louis Vasquez and<br />

Manny Ramirez.”<br />

Muñoz, a 6-foot-6 man with a ridiculously<br />

bright smile, shows no sign of cognitive trouble,<br />

but does he worry about the problems<br />

other NFL linemen have had as a result of<br />

concussions?<br />

“I’m always concerned,” he said. “I strapped<br />

on the pads every day for 20-plus years. But<br />

the rule changes the NFL enacted are helping.<br />

I think so.”<br />

Film and art lovers will fall in love with the<br />

colorful and animated poster that artist<br />

Jaime Carbo from Baja California has created<br />

to represent the 21st annual San Diego<br />

Latino Film Festival, set to take place<br />

from March 13-23.<br />

This year’s poster competition received<br />

more than 50 entries from around the<br />

world, including Italy, France, South Korea<br />

and Mexico, making the selection committee’s<br />

choice a difficult one but ultimately<br />

went with Carbo’s entry.<br />

“His vibrant use of colors and collage of<br />

musicians, artists, filmmakers, dancers<br />

and more is a great representation of our<br />

annual film festival,” said Ethan van Thillo,<br />

Executive Director at the Media Arts Center<br />

San Diego, the organization that produces<br />

the festival.<br />

“Plus the poster represents this years’ very<br />

entertaining 21st annual San Diego Latino<br />

Film Festival. Twenty-one years is a time<br />

to celebrate and the poster represents that<br />

fun and colorful feeling that we hope to<br />

bring this year’s event,” Van Thillo added.<br />

Carbo, who resides in Rosarito, Baja California,<br />

is also a digital media artist and a<br />

scenic sculptor for films. He said his art<br />

influences are Aztec, Olmeca, Tolteca and<br />

Mayan with a little bit of modern art like<br />

Pop, Fauvism and Post Impressionism.<br />

Regarding his use of lively color and simplicity<br />

comes from his believe that “art<br />

should evoke inner peace and happiness.”<br />

As far as having one of his pieces representing<br />

the festival Carbo said, “I have always<br />

been a fan of film and some of my<br />

work has been inspired by movie characters,<br />

so I am truly honored that my work<br />

was chosen.”<br />

Carbo’s poster will be used in promotional<br />

literature, invitations, banners, programs<br />

and t-shirts for the festival and he will receive<br />

Immigration Reform Could Hinge On<br />

Quiet Handful Of Tea Party Conservatives<br />

They’re not the conservative<br />

faction that has been front<br />

and center in the opposition<br />

to giving undocumented immigrants<br />

a chance to legalize<br />

their status and stay and<br />

work in the United States.<br />

The toughest stumbling block<br />

to a comprehensive immigration<br />

reform agreement in the<br />

House of Representatives,<br />

The Hill reports, may well be<br />

a quiet group – a handful of<br />

Tea Party conservatives who<br />

aren’t the kind of fixtures in<br />

front of the camera that other<br />

immigration hardliners, such<br />

as Rep. Steve King of Iowa<br />

and Rep. Louie Gomert of Texas, have been<br />

on the emotionally-charged issue.<br />

Those quiet critical few, The Hill said, include<br />

Reps. Jason Chaffetz (Utah), Trey<br />

Gowdy (S.C.), Justin Amash (Mich.), Renee<br />

Ellmers (N.C.) and Steve Scalise (La.).<br />

These lawmakers are likely to look to conservative<br />

peers – not lobby groups or the<br />

GOP establishment – for cues<br />

on how to move on the immigration<br />

issue, the publication<br />

said.<br />

House Speaker John Boehner,<br />

an Ohio Republican, has<br />

said he will push a measure if<br />

it gets a majority – or 117 – of<br />

the 233 members of the Republican<br />

conference.<br />

“American Principles [Project,<br />

dedicated to promoting conservative<br />

policies] is going<br />

after Tea Party conservatives<br />

who are influencers. Their<br />

votes will influence other Tea<br />

Party members and at the end<br />

of the day that will make the<br />

difference with House Republicans,”<br />

said Alfonso Aguilar,<br />

executive director of Latino Partnership for<br />

Conservative Principles, to The Hill.<br />

Immigration reform seemed on a roll last<br />

year as a bipartisan group in the Senate<br />

worked very publicly on a comprehensive<br />

measure that ultimately called for beefing up<br />

border security, expanding foreign work visa<br />

programs, and providing a path to legal status<br />

for certain undocumented immigrants.<br />

The Senate passed the bipartisan measure<br />

in June.<br />

But almost immediately conservatives in the<br />

House, where Republicans have a majority,<br />

vowed not to rubber-stamp the Senate<br />

measure.<br />

They said they would act on immigration in a<br />

piecemeal way. And some of the most conservative<br />

Republicans said they would not<br />

approve any measure that called for giving<br />

a break to people who had broken immigration<br />

laws.<br />

And so, efforts to pass an immigration measure<br />

in the House came to a halt.<br />

“Libertarians are more inclined to an open<br />

borders strategy,” said a GOP aide, who<br />

was not named in The Hill story.<br />

legislation was a virtual dead letter in<br />

Congress at the time and that there<br />

was almost no chance that things<br />

would change given the iron grip that<br />

the NRA has on Congress. Obama<br />

would have had to spend precious<br />

time, energy, and resources jawboning<br />

anti-gun control congressional<br />

Democrats, wage an all-out battle<br />

with the gun lobby, and the NRA,<br />

and risk losing the political momentum<br />

that he needed to do battle with<br />

GOP congressional obstructionists<br />

in the battles over the debt ceiling,<br />

spending cuts, and deficit reduction.<br />

The executive orders on gun checks<br />

were, as executive orders go, a last<br />

resort and piecemeal attempt to at<br />

least get something on the books on<br />

guns. Obama was under no illusion<br />

that the executive orders on guns<br />

could in any way take the place of<br />

comprehensive gun control legislation.<br />

Only Congress can pass a gun<br />

control law that would have the full<br />

force of law behind it.<br />

Obama, as most presidents, knows<br />

that the whimsical or cavalier use<br />

of executive orders to bypass Congress<br />

or to legislate from the Oval<br />

Office not only will trigger a powerful<br />

public backlash, and reinforce<br />

the opposition’s usual charge of<br />

dictatorial abuse, but can and often<br />

have been overturned by Congress,<br />

which has the power to change (in<br />

this case scrap) an executive order.<br />

The courts also have the same pow-<br />

er. And there have been times when<br />

the courts have declared an executive<br />

order unconstitutional or simply<br />

vacated the orders.<br />

That’s not all. An executive order issued<br />

by one president is not even<br />

safe from another president. The<br />

textbook example of the transitory<br />

nature of an executive order is the<br />

so-called Mexico City Policy that required<br />

all non-governmental organizations<br />

that receive federal funding to<br />

refrain from performing or promoting<br />

abortion services as a form of family<br />

planning in other countries. Reagan<br />

issued the executive order in 1984.<br />

Clinton overturned it in 1993. Bush<br />

reinstated it and Obama rescinded it<br />

as one of his first acts when he took<br />

office in January 2009.<br />

The ultimate proof of the severe limits<br />

of what an executive order can actually<br />

accomplish is the executive order<br />

that Obama said he’d issue and<br />

the GOP’s cynical and contradictory<br />

response to it. The GOP adamantly<br />

opposes Obama’s proposal to hike<br />

the minimum wage. The executive<br />

order he’ll issue boosting the minimum<br />

wage extends only to new federal<br />

contracts issued and then only<br />

if other terms of a contractual agreement<br />

change. Boehner apparently<br />

suffered momentary amnesia from<br />

his full throated rip of Obama as a<br />

tyrant in the use of executive orders<br />

when he quipped that this executive<br />

order would have near zero effect.<br />
