<strong>the</strong> instructions transmitted by <strong>the</strong> JAG, and effect clemency action decided by<br />

<strong>the</strong> Naval Clemency and Parole Board. See section 0159 concerning <strong>the</strong> clemency<br />

powers <strong>of</strong> <strong>the</strong> CO, <strong>Navy</strong>-Marine Corps Appellate Leave Activity, and <strong>the</strong> CO,<br />

Marine Detachment, U.S. Disciplinary Barracks, Fort Leavenworth, KS.<br />

(4) Any <strong>of</strong>ficer whose nomination for promotion to flag or general<br />

<strong>of</strong>ficer rank has been confirmed by <strong>the</strong> Senate and who is serving in a flag or<br />

general <strong>of</strong>ficer billet and in command <strong>of</strong> a Naval service unit or activity, or<br />

is <strong>the</strong> immediate temporary successor in command <strong>of</strong> such an <strong>of</strong>ficer.<br />

b. Special courts-martial. Those <strong>of</strong>ficers who are empowered to convene<br />

general courts-martial may convene special courts-martial. In addition, <strong>the</strong><br />

Secretary <strong>of</strong> <strong>the</strong> <strong>Navy</strong>, acting under Article 23(a)(7), UCMJ, has empowered <strong>the</strong><br />

following <strong>of</strong>ficers, when in an active duty or inactive duty training status,<br />

to convene special courts-martial. This list is in addition to those <strong>of</strong>ficers<br />

authorized to convene special courts-martial by Article 23(a)(5) and (6),<br />

UCMJ:<br />

(1) COs <strong>of</strong> all battalions and squadrons, including both Regular and<br />

Reserve Marine Corps commands.<br />

(2) Any commander whose subordinates in <strong>the</strong> operational or<br />

administrative chain-<strong>of</strong>-command have authority to convene special courtsmartial.<br />

(3) All commanders and COs <strong>of</strong> units and activities <strong>of</strong> <strong>the</strong> <strong>Navy</strong>,<br />

including pre-commissioning units commanded by lieutenant commanders (O-4) or<br />

above, but not including inactive duty training Naval Reserve units.<br />

Designation as a separate and detached command, in accordance with U.S. <strong>Navy</strong><br />

Regulation 0723 (1990), does not, by itself, convey authority to convene<br />

special courts-martial. Commanders or COs <strong>of</strong> units or activities that have<br />

been designated as separate and detached commands may request such authority<br />

in accordance with section 0121.<br />

(4) All directors, Marine Corps Districts.<br />

(5) All administrative <strong>of</strong>ficers, U.S. Naval Shipyards.<br />

(6) All inspector-instructors and site COs, Marine Corps Reserve<br />

organizations.<br />

(7) COs and OICs <strong>of</strong> organic combat service support organizations<br />

providing combat service support to Marine Expeditionary Brigades, Marine<br />

Expeditionary Units, or comparable Marine Air-Ground Task Forces.<br />

(8) COs <strong>of</strong> Marine Expeditionary Units and Marine Expeditionary Unit<br />

Service Support Groups.<br />

c. Summary courts-martial. Those <strong>of</strong>ficers who are empowered to convene<br />

general and special courts-martial may convene summary courts-martial. In<br />

addition, <strong>the</strong> Secretary <strong>of</strong> <strong>the</strong> <strong>Navy</strong>, acting under Article 24(a)(4), UCMJ, has<br />

empowered all commanders, COs, and OICs (if authorized) <strong>of</strong> inactive duty<br />

training Naval and Marine Corps Reserve units and activities <strong>of</strong> <strong>the</strong> <strong>Navy</strong> and<br />

Marine Corps, who are in a duty status, to convene summary courts-martial. A<br />
