g. Courts-martial involving classified information. See SECNAVINST<br />

5510.36 (series), M.R.E. 505, MCM, and R.C.M. 806, MCM, for procedures<br />

relating to trial <strong>of</strong> cases involving classified information.<br />

h. Reporting requirements by responsible command. Regardless <strong>of</strong> national<br />

security status and in addition to <strong>the</strong> 72-hour reporting requirement described<br />

above or o<strong>the</strong>r reporting requirements, in all cases where a possible violation<br />

<strong>of</strong> criminal law involves classified information, whe<strong>the</strong>r or not designated a<br />

national security case, <strong>the</strong> responsible command, convening authority, or staff<br />

judge advocate shall notify OJAG (Code 30) and Commandant <strong>of</strong> <strong>the</strong> Marine Corps<br />

(JAM):<br />

(1) when criminal prosecution is contemplated. However, OJAG (Code<br />

30) or JAM notification does not take precedence over, or substitute for, NCIS<br />

notification required by subsection 0126;<br />

(2) whenever a major development occurs in <strong>the</strong> case or investigation<br />

(e.g., designation as a national security case, apprehension, involvement <strong>of</strong><br />

o<strong>the</strong>r federal agencies); or<br />

(3) at least once every 30 days, whe<strong>the</strong>r or not <strong>the</strong>re has been a major<br />

development, unless <strong>the</strong> case is being reported by <strong>the</strong> NSCDA. Include CNO (N2)<br />

in <strong>the</strong> notification for all cases involving sensitive compartmented<br />

information or intelligence information (i.e., intelligence sources or<br />

methods, NOFORN material).<br />

i. Reporting requirements by NSCDA. Once informed <strong>of</strong> a potential<br />

national security case, <strong>the</strong> NSCDA shall report to CNO WASHINGTON DC/<br />

N09/DNS/N09N/N09N2/N09D and NAVY JAG WASHINGTON DC/30 on <strong>the</strong> status <strong>of</strong> <strong>the</strong><br />

case every 15 days via SITREP until it is determined that <strong>the</strong> case is not a<br />

national security case or until it is resolved by court conviction,<br />
